RE: "The Enclave" !127 Marlborough Road
On Thursday, May 18, 1995, the Planning Board of the City of Salem opened a public hearing
regarding the application of the R.J. Kelley Company under Section 7-14, Cluster Residential
Development Special Permit, Section 7-16, Wetlands and Flood Hazard District Special Permit
and a Definitive Subdivision Plan for the development of 8.26 acres to allow the construction of
16 single family homes, a roadway and associated utilities to service the homes at 127
Marlborough Road.
The public hearing was closed on July 20, 1995. At a regularly scheduled meeting of the
Planning Board held on July 20, 1995, the Board voted by a vote of seven (7) in favor, none
opposed, to approve the application as complying with the requirements of the requested
permits, subject to the following conditions:
1. Conformance With Plan
Work shall conform with set of plans entitled, "Definitive Subdivision- The Enclave
Salem, MA", sheets 1-5, prepared by Eastern Land Survey Assoc., Inc., dated February
21, 1995, revised July 28, 1995.
2. Amendments
Any amendments to the plans or waiver of conditions contained within shall require the
approval of the Planning Board.
3. Conservation CorrLmission
All work shall comply with Order of Conditions #64-233 issued by the Salem
Conservation Commission.
4. Utilities
Utility installation shall be reviewed and approved by the City Engineer prior to the
issuance of a Building Permit.
5. Lighting
The Applicant, his successors or assigns shall coordinate with Massachusetts Electric and
the City Engineer on the installation of street lighting within the Subdivision. The street
lighting shall be the responsibility of the applicant, his successors or assigns, until such
time as the City accepts the street.
6. Underground Utilities
All site utilities shall be installed underground.
7. Traffic
a. Applicant, his successors or assigns, shall agree to widen Marlborough Road at
the entrance and exit area to Terri-Way in a fashion suitable to the City Planner.
Such widening shall occur for a minimum of 80 feet in length.
b. Applicant, his successors or assigns, shall provide the City, at no cost, an area of
land approximately 12 feet wide along the entire property frontage to allow for the
future widening of Marlborough Road. This area of land is not to be utilized until
said area of land is determined by the City to be necessary to accommodate future
roadway improvements. The responsibility for any future roadway expansion
shall not be borne by the Applicant, his successors or assigns. Such area shall be
shown on the plan, and maintained in perpetuity as a No-Build Zone.
8. Landscaping
a. Trees shall be a minimum of 3 1/2" caliper planted 30 feet on center on each side
of Terri Way and Fumari Way. The trees shall be planted in accordance with the
recommendations of the Salem Planning Department.
b. A four foot sidewalk, a three foot planting strip and pre-cast cement concrete curb
shall be constructed around Terri Way and Furnari Way, including each cul-de-
sac.
C. A five foot sidewalk,three foot planting strip and vertical granite curbing shall be
installed along the entire Marlborough Road property frontage and extending
approximately 400 additional feet to the end of the Fumari property at 125
Marlborough Road. Such sidewalk shall be constructed from the applicant's,his
successors or assigns', property line into the road layout. Length of new
sidewalks shall be indicated on the approved plan.
d. Maintenance of landscape vegetation shall be the responsibility of the developer,
his successors or assigns. in accordance with the City of Salem Subdivision
Regulation Right-of-Way Improvements Policy.
e. After all project landscaping is completed, and prior to the issuance of a
Certificate of Occupancy, the applicant, his successors or assigns. shall be
required to add further landscaping if such is required by the City Planner.
f Planting circles shall be included in the approximate center of each cul-de-sac
with final design details to be approved by the City Planner and the Fire
Department.
9. Sewer Connection
The applicant, his successors or assigns, shall connect the residential dwelling at 7 Home
Street to the City of Salem or City of Peabody sewer system. Such connection shall be
completed prior to the issuance of the first Certificate of Occupancy for the new
development. The connection shall either be at the front of the property, into a manhole
on Home Street or if not possible, the connection shall be through the rear of the property
at 7 Home Street directly into the new sewer line.
10. Securi
The applicant, his successors or assigns, shall file a bond, tri-party agreement or
covenant with the Planning Board prior to release of the plan to ensure completion of
improvements required under the City of Salem Subdivision Regulations, and as required
by this approval. Such security is subject to the review and approval of the City Solicitor.
11. Clerk of the Works
A Clerk of the Works shall be provided by the City, at the applicant, his successors or
assigns expense, as is deemed necessary by the City Planner.
12. Board of Health
All Board of Health requirements shall be strictly adhered to.
13. Fire Department
All work shall comply with the requirements of the Salem Fire Department.
14. Water Test
The water system shall be tested by the City of Salem Clerk of the Works for pressure
and bacteria prior to the issuance of a Certificate of Occupancy.
15. Construction Hours
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work
shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or
holidays. Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of
construction on abutters. Advance notice shall be provided to all abutters in
writing at least 72 hours prior to commencement of construction of the project.
C. Drilling and blasting shall be limited to Monday-Friday between 8:00 a.m.-5:00
p.m. There shall be no drilling or blasting on Saturdays, Sundays, or holidays.
Blasting shall be undertaken in accordance with all local and state regulations.
d. All construction vehicles shall be cleaned prior to leaving the site so that they do
not leave dirt and/or debris on surrounding roadways as they leave the site.
e. A street sweeper shall be employed during construction as deemed necessary by
the City Planner.
f. All construction shall be performed in accordance with the Rules and Regulations
of the Planning Board, and in accordance with any and all rules, regulations and
ordinances of the City of Salem.
16. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be
submitted to the Planning Department and Engineering Department prior to the issuance
of the final Certificate of Occupancy.
17. Violations
Violations of any condition shall result in revocation of this permit by the Planning
Board, unless the violation of such condition is waived by a majority vote of the Planning
Board.
I hereby certify that a copy of this decision and plans have been filed with the City Clerk
and copies are on file with the Planning Board. The Special Permit shall not take effect until a
copy of this decision bearing the certification of the City Clerk that twenty (20) days have
elapsed and no appeal has been filed or that if such appeal has been filed, and it has been
dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the
name of the owner of record is recorded on the owner's Certificate of Title. The fee for recording
or registering shall be paid by the owner or applicant, his successors or assigns.
