Dear Mr. Munroe:
Please be advised it has been brought to my attention
that the above entitled building is about to be sold and
there is a question whether or not the intended use of the
building by the prospective purchasers is a permissible
continuation of an existing nonconforming use.
The property in question is located at 128 Margin Street
and consists of a one-story brick building which currently
houses a photo printing and development business in one-half
of the building and until very recently the remainder of
the building housed a trophy fabricator. Prior to it' s most
recent use, the building housed a truck storage and repair
business and also a bookbinding and printing business . The
prospective purchaser intends to operate a prostheses business.
Customers would be fitted for artificial limbs and the like
which would be fabricated on the premises . The building is
located in a two-family residential zone, but was constructed
well before adoption of the existing zoning ordinance.
Massachusetts General Laws c40A §6 provides that a zoning
ordinance does not apply to existing buildings or structures
or to the existing use of any building or structure. In other
words, §6 protects nonconforming uses and nonconforming
structures against the applicability of subsequently adopted
zoning ordinances and amendments to the same. However, this
section goes on to state that when there is a substantial
change or substantial extension of a nonconforming use, the
nonconformity looses it' s protection and is subject to the
zoning ordinance.

The courts have frequently been called upon to decide
whether a proposed use of property is a continuation of a
nonconforming use. In Powers v Building Inspector of Barnstable
363 Mass 648 (1973 ) the Supreme Judicial Court set out a
test for determining whether a proposed use of property fits
within the exemption granted to nonconforming uses . These
tests are:
1. Whether the proposed use reflects nature
and use prevailing when zoning ordinance
took effect;
2 . Whether there is a difference in the quality
and character, as well as the degree to the
proposed use ;
3 . Whether the proposed use is different in
kind in its effect on the neighborhood.
In my opinion, using the three-pronged test above, the
proposed use of the building fits within the exemption granted
nonconforming uses and it would be a permissible continuation
of a nonconforming use. The building has been used in an
industrial/commercial manner which is greater than the use
now contemplated. In addition, the quality and character
of the proposed use is less than the other previous uses.
Lastly, the proposed use would not be different in kind from
previous uses in it' s effect on the surrounding neighborhood.
