This office issued a letter on June 3, 1999 directing you to remove the unpermitted pool
located at 98 Margin Street.
A response from a Mr. Ed Skeffington, questioned whether the pool ordinance covered
this pool.
A review of the State Building Code indicated that a pool is defined as a structure over
24" deep intended for swimming.
State Building Code also states that a pool may not be located nearer than six feet from
the property line.
I have enclosed the State Code pertaining to these two points. State building code
supercedes any local codes. This opinion was reviewed and agreed to by Assistant City
Solicitor, John Keenan.
Based on this information, I am again directing you to remove the pool within thirty (30)
days upon receipt of this letter. Failure to do so will result in legal action being taken
against you in Salem District Court.

After a discussion with a relative living at 98 Margin Street, I reviewed Salem Zoning
Ordinance Section 7-10 concerning swimming pools. Your relative felt that the pool
ordinance did not apply because of surface area. The ordinance applies to all pools over
24 inches deep regardless of surface area. Therefore,the original order dated June 2,
1999 still applies.
However, because there was question of applicability, I will extend the order seven (7)
days.

Dear Mr. Quartarone,
In answer to complaints to the above referenced property, this office
posted said property today, Violation of Mass Building Code Sections 113 & 121 .
Anyone who shall Violate a provision of this code shall be punishable by a
fine of not more than One Thousand ($ 1 ,000.00) dollars or by imprisonment for
not more than one year, or both, for each violation.
Each day during which any portion of a Violation continues shall constitute
a separate offense. Also you may be in Violation of Salem Zoning Ordinance Section r'
VI Para A maximum height of fences. Violations of any of the provisions of this
ordinance shall constitute a misdemeanor. Any person who Violates this
Ordinance shall, upon conviction thereof, be fined not more than One Hundred
($ 100.00) per Violation, and in addition shall pay all cost and expenses
involved in the case.
Each day such Violation continues shall be considered a separate offense.
-` Contact this office within seven days (7) from receipt of this letter. To
r correct said Violation permit or special permits should be obtained from

DECISION ON THE PETITION OF IG OVANNA QBARTERONE FOR VARIANCE
AT 98 MARGIN STREET (R-3)
A hearing on this petition was held January 25, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Nutting, Strout and
Associate LaBrecque. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts.General Laws Chapter 40A.
Petitioner, owner of the property is requesting Variances to allow the existing
deck and fence to remain in this R-3 district.
The Variances which have been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plan of land, makes the following findings of fact:
1 . Fence and deck are needed for privacy;
2. Topography of the land makes in unfeasible to locate the deck on any
other part of the lot.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship
on the petitioner;
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted, 4-1 , to grant the variance to allow
the existing fence as requested. Mr. Hencal voted in opposition. The Board
of Appeal voted unanimously, 5-0, to grant the variance to allow the existing
deck as requested.
