An application for a building permit to build a shed was applied
for June 4, 1971 along with an addition to the house. A permit
was issued September 8, 1971 , a copy of applicantion for permit— is
attached.
As for needing a variance for side set backs, shed was built on side
line in 1972 and is allowed under Mass General Laws, Chapter 40 A
Sect. 7. Six year statue of limitation on building permits.

DECISION ON PETITION FOR SPECIAL PERMIT TO INSTALL SWIMMING POOL.
A hearing was held on this appeal on May 16, 1973, pursuant to notices
mailed postpaid to the petitioner, Board Members, abutters , abutters to
abutters , and others , and advertisements were duly published in the Salem
Evening News, advising of this Public Hearing.
Board Members present were William F. Abbott , Donald Koleman, Arthur
Labrecque , and Associate Member Warren Baughn who was authorized to repres-
ent an absent member for this meeting.
Petitioner appeared and explained the case the same as in the original
appeal on file .
No one appeared in opposition.
The Board Members have the facts presented to the meeting, together with
a plot plan showing location of proposed pool, and are of the opinion
that a Special Permit for which application is made , is in harmony with
the purpose and intent of the Ordinance , and should be granted.
By unanimous vote , the Board has therefore voted to grant a Special Permit
to install and maintain said pool as requested, subject to the following
CONDITIONS•
l. - Bona fide effort made to minimize noise and lights in order to
avoid disturbing privacy of neighbors .
2. Use of the pool shall cease at 10:00 P.M.
3. Pool shall be constructed and maintained in accordance with the
General Laws of the Commonwealth of Massachusetts , and the rules
and regulations of the City Building, Health, Electrical , Police
Departments, and Zoning Ordinance , applicable to swimming pools .
4. A fence at least four feet high shall be installed and surround
the perimeter of the pool itself; fence shall be constructed of
pickets , or stockade , or chain link type material; rail fences
shall not be permitted; the fence shall have a locking device and
a closing device so as to keep the gate shut at all times; a min-
imum of one ladder, stair, ledge , or standup area , not over three
feet below water surface shall be provided for each seventy-five
feet of perimeter; fence shall have only one opening, three feet
maximum width.

5. Pool shall be constructed of materials that will provide a structurally
sound and tight tank with impervious surfaces that are easily cleaned
6. No swimming pool or appurtenances thereto shall be installed or altered
until a building permit has been obtained from the Building Inspector, ;:''_

The Inspector of Buildings 'refused to issue a permit to construct a two
story addition to an existing dwelling at 42 March Street as such would '
be in violation of the density ,requirements of the City Zoning Ordinance ..
Petitioner appealed to the oard. of Appeals to vary the terms of the Ord-in
ance to permit erecting the proposed addition, and a hearing was held on
this appeal on July 28 , 19'71 , pursuant to notices mailed postpaid to the`
Petitioner, abutters , Board embers , and others , and advertisements pub-
lished in the Salem Evening yews advising of this public hearing.
All Board members were present at this hearing.
No one appeared in opposition.
Petitioner appeal was presented to the Members , the same as in the original
petition on file ; his family requires more space to provide comfortable
and convenient living accommodations ; the dwelling which is small, was
purchased in 1968 with the thought in mind that an addition would be con
structed as the need arose; petitioner ' s sister and her daughter have moved .
in with his family and additional space is urgently needed; this addition
would provide a dining room on the first floor and another bedroom on the
second floor; a variance is required as the lot is undersize for the 'dis-
trict and the required distance to the side and rear boundary are imppssi
ble to observe as the existing dwelling is 3. 7 ' from the side and 28 .6 '
from the rear property line ; the proposed addition would be 10 ' closer to` '
the rear boundary, and the Ordinance requires thirty feet .
The Board found that to grant this variance would relieve a serious hard-
ship to the petitioner and enable him to provide adequate living : quarters;
for his entire family, and further found that to grant the variance as
requested would not derogate from the intent and purpose of the Ordinancz' .
and would not be detrimental to the public good as existing dwellings in
this area were erected prior to the adoption of the present Zoning Ordin-
ance and are located on lots of similar size and in closerlproximity to
boundarylines than is now allowed, and for these reasons, voted unani-
mously to grant this appeal as requested.
