SUBJECT: March Street/Rice Street
Several weeks ago William Haight and I responded to an odor complaint
instituted by Frances Grace, on Rice Street. We determined that no sewer
problem existed, but discovered that buildings owned by Moses Alpers, P.O. Box
428, Salem, MA, at #20 March Street, are in a collasped state and we witnessed
rats in the area. These buildings are definite fire and health hazards, in
my opinion. Will you review and advise me of your actions.

1. An application for variance was filed with the Board by Robert -Tnhncnn

requested variances from the following Sections of the 1982 Rules and
Regulations of the Board:

2. The application was heard by the Board as an incoming case on Monday,

3. After reviewing all materials submitted to the Board, the Board VOTED
as follows:
GRANT a variance to Section 21.1, on condition that the slope of the curb cut
be 1:9 (11%) slope for 121 .
Any person aggrieved by the above decision may request an adjudicatory
hearing before the Board within thirty (30) days of receipt of this
decision by filing the attached request for adjudicatory hearing form.
If after thirty (30) days., a request for an adjudicatory hearing is not
received, the above decision becomes a final decision and the appeal
process is through Superior Court.

PLEASE NOTE: The Board may , in -its discretion , either hold a
hearing on your- application for variance or issue a preliminary
decision without a hearing. . Preliminary decisions become final
30 days after issuance unless any person requests an adjudicatory
hearing. You should, therefore, include all relevant information
with your application. At minimum, the plans should include a
site plan , details, and plans showing an attempt at solutions to
the problem(s) . Also, when existing site conditions make
compliance impracticable in your opinion , PHOTOGRAPHS of existing
conditions are extremely helpful to the Board.
