RE: Violation of Building Codes on 9 March St. Court
Dear Mr. McIntosh;
As a taxpayer, I am concerned about the infringement
and violations of the law concerning permits by which the city of
Salem seems to be operating.
Mark Petite has encroached the law by illegally doing
work to his property on March Street Court. As an example, an
addition of a shed dormer and a back porch deck have been built;
a wood-burning stove and a spiral staircase have been installed;
and, boat docks were built with a retaining cement wall . These
items have all been done, to the best of my knowledge, without
building permits.
The most blatant violation of codes is the stone wall
that was built on the shoreline and was backfilled with roof shingles
and covered with soil . I feel this has a potential as an underground
fire hazard and remains as a dangerous situation for surrounding
shoreline neighbors .
As one of these neighbors , I am very concerned about
this situation and the lack of consideration for the law and others.
Is it possible for this condition to be rectified so that others are
not subjected to the dangers involved?

RE: 9 March Street Court
1. Conformance with Plan
Work shall conform to plan entitled "Single Family Residence for Mark & Martha Petit",
dated August 28, 1988.
2. Conservation Commission
Work shall comply with all requirements of the Salem Conservation Commission Order of
Conditions #64-172.
3. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a.No work shall commence before 7:00 a.m. on weekdays and 8:00 a.m. on Saturdays. No
work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or
holidays. Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours
prior to commencement of construction.
7. Violations
Violations of any conditions shall result in revocation of this permit by the Planning Board.
This Special Permit shall not take effect until a copy of the decision bearing
certification of the City Clerk that twenty days have elapsed and no appeal has been filed
or that if such appeal has been filed and it has been dismissed or denied, is recorded in the
Essex County Registry of Deeds and is indexed in the grantor index under the name of the
owner of record or is recorded and noted on the owner's certificate of title. The fee for
recording or registering shall be paid by owner or applicant.
I hereby certify that a copy of this decision and plans are on file with the City Clerk
and a copy is on file with the Planning Board.

PLANNING BOARD
Will give a public hearing under Section P, Wetlands and Flood Hazard
Districts of the Salem Zoning Ordinance, at the request of Mark Petit and
Jeff Morris. The purpose of the hearing is to discuss a plan for the
construction of two (2) single family homes located in a Flood Hazard
District at 9 March Street Court. The hearing will. be held on Thursday,
October 20, 1988, at 7:00 p.m. , One Salem Green, second floor conference
room.
