Based upon the findings of the inspection detailed below, the Board of Health
and Building Department determine that the following violation(s) exist at your
property cited above:
There is a severe overgrowth of weeds and grass, as well as, old fencing and
chairs littering the property. There is also miscellaneous trash and debris on the
property.
You are ordered to correct the violations listed above within 7 days of
receipt of this letter.
Failure to comply within 7 days may result in a criminal complaint sought
against you in Salem District Court, or after 7 days the City may correct the
violations and impose a lien on your property to recover the costs of such
action.
This inspection was conducted in accordance with Massachusetts General Law,
Chapter 111, Sections 127A and 127 B and 105 CMR 410.602(A), of Chapter ll,
State Sanitary Code, Minimum Standards of Fitness for Human Habitation, and
Section 12-56 et seq. of the Code of Ordinances, City of Salem, Massachusetts

at the above cited property. This inspection was conducted by David
Greenbaum, Sanitarian, for the Board of Health and Tom St. Pierre for the
Building Department on September 28, 2005.
You have the right to request a hearing before the City Council. A request for a
hearing must be received in writing in the Office of the City Clerk and the Director
of Public Property within 7 days of receipt of this Order. At the hearing, you will
be given the opportunity to present evidence as to why this Order should be
modified or withdrawn. You may be represented by an attorney. You have the
right to inspect and obtain copies of all relevant inspection or investigation
reports, orders, and other documentary information in the possession of the
Board of Health and Office of Public Property, and that any adverse party has the
right to be present at the hearing.

Exception: This sub-section does not apply to new buildings or structures.
114.2 Report to assessors: The building official shall give to the assessors of the
municipality written notice of the granting by him of permits for the construction of
any buildings or structures, or for the removal or demolition, or for any substantial
alteration or addition thereto. Such notice shall be given within seven (7) days after
the granting of each permit, and shall state the name of the person to whom the
permit was granted and the location of the building or structure to be constructed,
reconstructed, altered, demolished or removed.
114.3 Expiration of permit: Any permit issued shall be deemed abandoned and
invalid unless the work authorized by it shall have been commenced within six (6)
months after its issuance; however, for cause, one or more extensions of time, for
periods not exceeding six (6) months each, may be granted in writing by the building
commissioner or inspector of buildings. Work under such a permit in the opinion
of the building commissioner or inspector of buildings, must proceed in good faith
continuously to completion so far as is reasonably practicable under the
circumstances.
For purposes of this section, any permit issued shall not be considered invalid
if such abandonment or suspension of work is due to a court order prohibiting such
work as authorized by such permit; provided,however, in the opinion of the building
commissioner or inspector of buildings, the person so prohibited by such court order,
adequately defends such action before the court.
114.4 Previous approvals: Nothing in this code or the rules and regulations
pursuant thereto shall affect any building permit lawfully issued, or any building or
structure lawfully begun in conformance with such permit, before the effective date
of this code or any amendments thereto.
114.5 Signature to permit: The building commissioner or inspector of buildings
shall attach his signature to every permit, or he may authorize a subordinate to affix
such signature thereto.
114.6 Approved pians: if approved by him, the building commissioner or
inspector of buildings or his authorized subordinate shall stamp and endorse in
writing the plans submitted in accordance with Section 113.5; one (1) set of such
stamped and endorsed plans shall be retained; the other set of plans shall be kept
at the building site, open to the inspection of the building commissioner, inspector
of buildings, or his authorized subordinate, at all reasonable times.
114.7 Revocation of permits: The building commissioner or inspector of buildings
may revoke a permit or approval issued under the provisions of this code only in

Petition o€MARYANN KOCUR requesting a Special Permit to extend a nonconforming
two-family home with the addition of third-floor dormers on the property located on 7
MARCH STREET CT (R2 Zoning District).
A public hearing on the above Petition was opened on October 17, 2012 pursuant to 1\'fass General
Lain Ch. 40A, 11. The hearing was closed on October 17, 2012 with the following Zoning Board.
of Appeals members present: Rebecca Curran (Chair), Bonnie Belair,Junme Tsitsinos,and Richard
Dionne.
Petitioner seeks a Special Permit pursuant to Section 3.3.5 of the Cine of Salem Zoning Ordinances.
Statements of fact: .
1. In a petition date-stamped Septernber 24, 2012, petitioner requested a Special Pertn,it to
construct a third-story dormer on the propem, located at 7 \-larch Street Court.
2. At the hearing, the owner and petitioner, Mariann IKocur, presented the petition.
3. At the hearing, no member of the public spoke in favor of or against the project.
The Board of Appeals, after careful consideration of the evidence presented at the public hearing,
and after thorough review of the plans and petition submitted, makes the following findings:
t. Desirable relief may be granted without detriment to the public good and without nullifying
or substantially derogating from the intent or purpose of the zoning ordinance,since the
proposal is in keeping with the neighborhood and the relief requested is minimal. I he Board
finds that the project will have no adverse effect on the neighborhood or the city that would
outweigh its bene ficial impacts.
2. 16 permitting such change, the Board of,Appeals requires certain appropriate conditions and
safeguards as noted below.

On the basis of the above findings of fact and all evidence presented at the public hearing including,
but not knuted in, the Plant:, Documents and testimou , the Zoning Board of_Appeals voted four
(4) in favor (Curran, Dionne, 'f and Belair) and none (0) opposed, to grant the: requested
Special Permit. A Special Permit under Section 33.5 is granted to allow for the proposed addition
as shown on the submitted plans.
The Board of Appeals voted to grant petitioner's request for a Special Permit suN,cct to the
following terms, conditions, and safeguards:
I. Petitioner"shall comply With all cit} and state statutes, ordinances, codes and regulations.
2. All construction shall be done as pet the plans said dimensions submitted to and approved
by the Building Cotrmiissioner.
3. AD requirements of the Salern Fire Department relative to smoke and fir safety shall be
stricdt. adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner is to obtain approval from any Cats Board or Commission having jurisdiction
including, but not lirn ted to, the Planning Board.
