DECISION ON THE PETITION OF CHRISTOS LIRXMNAKIS FOR FF1tE#
VARIANCES AT_8_LE_AVE; (R-1) cq,YY,0tERR:SAIEM.MASS.
A hearing on this petition was held on April 29, 1987 with the following Board
Members present: James Hacker, Chairman; Messrs., Bencal, Fleming, Luzinski,
and Strout. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with the Massachusetts General Laws Chapter 40A.
Petitioner request variances from density and setbacks to allow construction
of a single family dwelling and a garage on existing foundation in a R-1 zone.
The Variances which has been requested may be granted upon 3 finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from
the intent of the district the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing and
after viewing the plans, The Board of Appeal makes the following findings
of fact:
1. No opposition was voiced at the hearing.
2. Support of the plan was voiced by abutters and others;
3. A hardship exists that the foundation is dug and in place and has
been for many years prior to Zoning Ordinance.
On the basis of the above finds of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1. Special conditions exist which affect this lot which do not generally
affect the district;
2. Literal enforecement of the Ordinance would work a substantial
hardship upon the partitioner;
3. The Variances canbe granted without substantial detriment to the
public good and without substantially derogating from the intent
and purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted 4 - 1 (Mr. Bencal Opposed) to
grant the variance requested subject to the following conditions;
1. All conditions and concerns of the Salem Fire Dept. must be adhered to;
2. The 1'k ,story building to be used as garage and not as a dwelling unit.
3. Proper numbering be obtained frau City Assessors Office.
4. Structure to be built as per plans submitted;
5. A building permit be obtained prior to construction;
6. A Certificate of Occupancy must be obtained.
