This office has been informed that you are refusing
to conform with the wishes of your abutting neighbor in
removing part of your fence that is located on his
property.
Your neighbor has had his land surveyed and it is
suggested that you remove what is located on his property,
or you have the option of having the land surveyed by your
independent surveyor to prove that the fence is located on
your property.
Please contact this office within fifteen ( 15 ) days
upon receipt of this letter to inform us as to your course
of action in this matter . Failure to do so could result
in legal action being taken against you.
Thank you in advance for your anticipated cooperation
in this matter.

neighbors claim that our fence is on his property.

Thank you very much flor, taking time to talk to me this mommg. In light of the fact that the weather
office is predicting heavy snow for Friday morning, it'was'gratifying to receive the assurances I
needed from our conversation, and will not have to come into your office.
As I mentioned to you, my husband and I were somewhat surprised to receive your letter as we are
currently having our attorney look into Mr. Colangelo's allegations. We are also engaging a surveyor
to completely map our property including the positioning of buildings and structures (which Mr.
Colangelo's survey did not show).
As you requested I keep you informed of our actions, the following is the scenario to this point. We
received a letter and picture of Mr. Colangelo's plot lines from his attorney who said we were
encroaching on his client's property. As we did not have any indication where our fence was on the
picture and the fence had been erected by the previous owners 10 - 15 years before we bought the
property, our lawyer asked his lawyer for clarification from Mr. Colangelo. She also pointed out that
the age of the fence brings a point of"adverse possession" into play, should our fence actually be on
Mr. Colangelo's property. Since Mr. Colangelo moved into his house and began badgering us
regarding the positioning of the fence, we have always disputed his allegation. (At one point we had
to call the police to prevent him from removing it without our permission.) To our knowledge, Mr.
Colangelo has had three surveys done on his land appearing not to be satisfied with the results. After
one survey my husband even noted that a rear line survey stake which was clearly visible from Maple
Avenue on one day,was not visible the next. After which Mr. Colangelo pressed his case.
My husband and I appreciate that you were able to assure us that your letter was in no way a case of
the City of Salem siding with Mr. Colangelo against us in this matter. When we have the results of
our survey I will contact your office if I need advise on how to proceed further. In the meantime, I
will refer Mr. Colangelo back to you if he attempts to insist your letter is an order from the city to
remove our fence.
