shall be required..

The above referenced property has come to the attention of this department for the following
reason(s):
A report has been made to this office that there is an illegal fourth apartment unit in this
permitted three(3) -unit building. You were advised of the buildings 3-unit status back in
January of 2015(see attached),for this reason an inspection must be conducted by our
inspection team to assure compliance with the code and city ordinance
Under the provisions of 780 CMR, Section 104.6.,the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter
to schedule this required inspection. If this property has rental units, these tenants must be notified
in advance of this inspection, so that access to these spaces may also be accomplished.
This inspection shall be conducted on June 10, 2015 at 1:15 p.m.; failure to respond to this
notification will be construed as non-compliance, and as such an Administrative Search Warrant
will be sought, so as to allow the lawful inspection of this property.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. RR-nt�9(Massachusetts General laws.Chapter 239•section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold batik your rent payments.You can do this without being evicted if:
A- You can prove that your dwelling unit or common areas contain code violations which arc serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C You are prepared to pay any pottion of the rentiiito court if a judge orders you to pay it(For this,it is best to put the
rent money aside in a safe placc.)
2. Repair and Dedoct(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your tent .
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,-
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have tbedr
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rcpt in any
year to make the repairs.
.3. Rer_aliai=-Ret Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239, ..

5. Breach of Warranty of Habi ability:You may beenuded to sue your landlord to have all or some of your rent resumed if your..
dwelling unit does not meet minimum standards of habitability.

violation of the consumer protection act and regulations,for which you may sue an owner.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if.
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this,it is best to put the
rent money aside in a safe place.)
2. Ren it and ret(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,
