Dear Ms. Burek:
Thank you for responding to my phone call regarding the unit you own at 15 Lynde
Street in Salem. This office sent a violation letter back on October 12, 2001 to unit#32
at 15 Lynde Street. We received no reply.
Basically, the condo unit has been torn apart without any building permits being issued.
The unit has been like this since 2001. The removal of flooring and wall plaster presents
a serious risk of the spread of fire throughout a building of this design.
Violations are the following Massachusetts State Building Code
780 CMR, Section 110 - Building Permit Required
110.7 —Construction Documents
113.2 —Compliance with Building Code
Additionally, permits are required for plumbing, electrical and fire departments.
You are directed to secure the necessary permits and to begin repair within 30 days upon
receipt of this notice. If you feel you are aggrieved by this order, your appeal is to the
Board of Building Regulations and Standards in Boston.
Additionally, under Section 115.2 of the State Building Code, you are required to arrange
an inspection of the unit as soon as possible. If you have any questions, please contact me

I was asked to look at the ceiling in Apartment 22-D. The tenant lifted the drop-ceiling
tile and I was able to look up into the bathroom of the apartment above.
Massachusetts State Building Code 780 CMR, Section 713.2 requires horizontal
separation at all floor levels.
You are directed within 10 days upon receipt of this notice, to install the proper fire rated
sheetrock to the ceiling.
Additionally, the unit above 32-D also has been remodeling the bathroom without any
building permits.
Please contact this office when the repairs to unit 22-D are complete for a reinspection.

Please be advised, this department was notified of multiple problems on the rear decks of
the above mentioned property.
While I was inspecting the rear decks, I took a look at the side decks also.
The following is a list of problems that need to be addressed within 30 days upon receipt
of this letter.
1. Railing on 1"to 2°d and 2°d to 3rd warped and no longer secured.
2. Railing on 1St stairway was never put on.
3. 4d' floor newel post very loose.
4. All the board on the stairway needs to be refastened.
The stairway to deck connections need to be improved on all three porches (left side most
urgent).
Ballisters at various locations needs to be checked and some replaced.
Gas grills are not allowed by the Salem Fire Department on any exit staircase (Salem fire
code regulates#2 under Chapter MGL 148 Section 5)

The current exemption of "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, provided that the owner
acts as supervisor. (State Building Code Section 109.1 .1
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one to six family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official ,
on a form acceptable to the Building Official , that he/she shall be responsible
for all such work performed under the building permit. Section 109.1 .1
The undersigned "homeowner" assumes responsibility for compliance with the State
Building code and other applicable codes, by-laws, rules and regulations.
The undersigned "homeowner" certifies that he/she understands the City of Salem
Building Department minimum inspection procedures and requirements and that
he/she willcomply with said procedures and requirements.

NOTE: Three family dwellings 35,000 cubic feet, or larger, will be required
to comply with State Building Code Section 127.0, Construction Control .
HOME OWNER' S EXEMPTION
The Code states that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109.1 .1 - Licensing of Construction Supervisors) ; provided that is
a Home Owner engages a person(s) for hire to do such work, that such Home
Owner shall act as supervisor."
Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix Q, Rules and Regulations
for Licensing Construction Supervisors , Section 2.15) . This lack of aware-
ness often results in serious problems , particularly when the Home Owner
hires unlicensed persons. In this case your Board cannot proceed against
the unlicensed person as it would with licensed Supervisor. The Home Owner
acting as supervisor is ultimately responsible.
To ensure that the Home Owner is fully aware of his/her responsibilities,
many communities require, as part of the permit application, that the Home
Owner certify that he/she understands the responsibilities of a supervisor.
On the last page of this issue is a form currently used by several towns.
You may care to amend and adopt such a form/certification for use in your
community.

Let me first thank you for the replacement of the
stairs on the right hand side of the building. This set
of stairs was a major concern to this department .
Per our conversation on the job site, it is important
that a structural engineer evaluate the remaining two
staircases, one in the rear of the building and the other
on the left hand side of the building to determine there
safety. It is not felt by this department that they are
in as severe a condition as the one that were replaced but
may need some reshoring. I would appreciate a report from
a structural engineer as soon as possible .

Dear Ms. Perez:
The purpose of this letter is to provide notice that certain premises owned by you,or
under your control have been used for the illegal keeping, sale, or manufacturing of controlled
substances, as defined in Massachusetts General Laws, Chapter 94C, Section 1.
Specifically,the premises located at 15 Lynde Street Apt. 6, Salem, MA 01970 were used
for such purposes. See the enclosed police report for the specific dates and times.
Massachusetts General Laws Chapter 139 Section 20 provides in pertinent part,
"Whoever knowingly lets the premises owned by him, or under his control, for the purposes
of....the illegal keeping, sale, or manufacture of controlled substances,as defined in section one
of chapter ninety-four C, or knowingly permits such premises,while under his control,to be used
for such purposes,or after due notice from any such use omits to take reasonable measures to
eject therefrom the persons occupying the same as soon as it can be lawfully done, shall be
punished by a fine of not less than one hundred nor more that one thousand dollars or by
imprisonment for not less than three months,nor more than one year, or both."
The Salem Police Department will be enforcing the provisions of M.G.L. ch. 139, sect.
20 (copy attached),to prevent drug trafficking in residential neighborhoods and to promote a
safer environment for families living in rental housing.
