April 18. 1996. the Planning Board of the City of Salem held a public hearing tinder Section 7-18 Site Plan Review of the Salem Zoning Ordinance, at the request of Ronald and Raymond Falite with respect to their plan to rehabilitate the interior of an existing three story structure from forty (40) or more rooms for rent to a multi-family dwelling with eleven (11) new residential apartments at 10-14 Lynch Street. At a regularly scheduled meeting of the Planning Board held on April 18. 1996. the Board voted by a vote of nine (9) in favor, none (0) opposed. to approve the application as complying with the requirements of the Special Permit, subject to the following conditions: t. Conformance with Plan Work shall conform to plan entitled "Site Plan - Proposed 11 Unit Renovation, 14 Lynch Street," prepared by Miquelle. M.Z.O. Group. 2. Amendments Any amendments to the site plan or waiver of conditions contained within shall require the approval of the Planning Board. 3. Board of Appeal Decision All Board of Appeal requirements stated in a Decision time stamped by the City Clerk on April 2, 1996 shall be adhered to. c d. Board of Health The Board of Health conditions stated in a letter from Health Agent Joanne Scott dated April 12, 1996 shall be adhered to. �. Landscaping The Applicant shall work with the Planning Department's Landscape Architect to provide appropriate screening around the property and columnar street trees in front of the property. 6. Lightin a. A lighting plan shall be submitted to the Planning Department and approved in writing by the City Planner. b. All exterior lighting shall be installed and maintained in such a way so as not to reflect or cause glare on abutting or facing residential premises. 7. Maintenance a. The Applicant shall submit a plan for trash storage and removal to the Health Agent and the City Planner for their written approval prior to the issuance of Certificates of Fitness. b. Refuse removal, ground maintenance and snow removal shall be the responsibility of the Applicant, his successors or assigns. C. Winter snow in excess of the snow storage area on site shall be removed off site. 8. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or Holidays. Inside work of a quiet nature may be permitted at other times. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. i C. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board and in accordance with any and all rules. regulations and ordinances of the City of Salem. 9. Violations Violations of any conditions contained herein shall result in the revocation of this permit by the Planning Board. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, owner of the property request a Variance from parking for the property located at 10-14 Lynch Street (R-3) . The Variance which has been requested may be granted upon a finding of this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings, or structures in the same district. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful considerations the evidence presented at the hearing, makes the following findings of fact: 1. Petitioner seeks a variance to allow on-street parking for cars belonging to the future residents at 10-14 Lynch Street. 2. Petitioners pian to convert the building on this property to a multi- family unit for 12 families without changing the footprint of the existing structure, which was previously a rooming house is currently unoccupied. 3. Because the lot size is incompatible with a parking lot that could accommodate the required number of parking places, the building would be unusable as a multi-family dwelling if a parking variance were not granted. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substation hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to public good and without nullifying and substantially derogating from the intent of the district or purpose of the Ordinance. Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you may be entitled to hold back your rent payments.You can do this without being evicted if: A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in your rent. B. You did not cause the violations and they can be repaired while you continue to live in the building. C.
