Due to complaints received at this office, an inspection was done at
the above referenced property concerning an open stairwell.
Please be advised that you are in violation of the Massachusetts State
Building Code, Section 123 ( unsafe structures ) . This stairwell is open to the
public and is dangerous to life or limb. Please contact this office within
seven days from receipt of this letter.
Failure to do so shall constitute this office in filing a criminal complaint
in Salem District Court. Anyone who violates a provision of this code shall
be punishable by a fine of not more than $1,000.00 or by imprisonment for not
more than one year or both for each violation.

As discussed today, I am writing to you at the direction-of-W-.�
Donald Jeffrey regarding his property at 2 Lowell Street,,Sale
Unfortunately, Mr. Jeffrey is out of `the-country and, as I
explained, did not receive your original notice of a building
violation until May 21, 1991, the day before a criminal complaint
was issued. Although Mr. Jeffrey responded on May 21, stating his
willingness to correct whatever the violation might be, apparently
your actions crossed in the mail.
I am writing today to confirm what I told you on the telephone. I
will seek out a contractor to install the railing you requested.
I understand the contractor needs a building permit to do so, and
will make every effort to have the permit pulled and work
completed as expeditiously as possible. I will confirm the dates
to you in writing as soon as I can locate someone to perform the
work.
I understand you will, upon evidence of these good faith efforts,
request withdrawal of the criminal complaint which has been
scheduled for a hearing on June 13, 1991 at 11 a.m. . I would
appreciate your contacting me as soon as possible prior to that
date to confirm the complaint has been withdrawn since time does
not allow for notification to Mr. Jeffrey. If there are any
quesions, I may be reached during the day at ( 617 ) 561-1667 and
evenings/weekends at ( 617)242-2914.

This office represents an individual who was injured in a fall down
a stairwell at Two Lowell Street, Salem, MA at the corner of Fort
Avenue. The stairwell apparently leads down to a basement on the
Fort Avenue side of the house. We believe that an alleged
violation of the building code may exist. We are asking, on behalf
of our client , that your office view the premises to determine if a
violation exists, and kindly notify us. Thank you very much for

three (3) or more risers. Open sides of all stairs shall be
similarly protected by guards. However, handrails shall not be -
required on stairways with three (3) or more risers where the -
raised platform to which they lead is thirty (30) inches or less
above the floor or grade. .

101.4 Referenced Standards: Where differences occur between provisions of this
code and referenced standards, the provisions of this code shall apply.
SECTION 102.0 ORDINARY REPAIRS
102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, heating system or any
other equipment is specifically controlled by the provisions of this code or the
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction.'
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof, both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.
