Building Code were noted and need your immediate attention.

Points of Discussion:
1. Mr. Dave Harris, Building Inspector, City of Salem has requested.
Lindentree to furnish a written report of inspection of the
structural framing per Section 111. 0 of the Massachusetts State
Building Code. Upon examination, Lindentree offers the following:
A. The roof framing of the relocated structure and new connector
is unacceptable and in violation of the code. The general
contractor shall install (3) 2x12 beam above new 2x12 collar
ties spanning between (2) 4x4 wood posts centered below the new
ridge rafter & supported by the new glu-lam beams below. The
general contractor shall construct a2x4 kneewall on top of the
new (3) 2x12 beam, supporting the ridge rafter above. The
general contractor shall replace the existing wood post on the
first floor with a new glu-lam column and also install an
additional glu-lam column 6 ' -0" (+/-) to the east of said
column (this column shall sit on beam below) with new glu-lam
header spanning between the glu-lam columns, beneath the
existing beam above and concealing the existing metal connector
at the intersection of the existing built-up wood beam and glu-
lam beam above. Refer to Drawing A-4 , Building Section, for
additional information.
B. The new roof above Tony Lena 's restaurant has been modified and
strengthened as specified in Notes of Conference dated 6 May
1988 and is therefore acceptable to the architect.
C. The general contractor has furnished and installed the bent
strap hanger at the intersection of the new glu-lam beam
running north-south with the new existing beam running east-
west as specified in the Notes of Conference dated 19 April
1988. The general contractor shall install shims as required to
create bearing between bottom of existing beam and hanger.
2 . Lindentree has informed the general contractor that all finish
work shall cease until all of the following conditions are met:
A. Item lA is complete, inspected and approved by the architect.
B. Item 1C is complete, inspected and approved by the architect.
C. The architect has furnished a favorable written inspection
report of the structural framing to the building inspector.
D. The gas and building inspectors have signed-off on the building
permit job weather card.
3 . Door 201, as indicated on Drawing A-2, shall be a 1-1/2 hr. rated
B label 3 ' -0"x 6 ' -8"x 1-3/4" metal door and frame with door
closer.

1. It was decided that the General Contractor shall make the following
modifications to the new roof above Tony Lena' s restaurant:
A. Install 2x4 kneewall (spaced similar to roof rafters) at
approximately center span of new 2x12 roof rafters. Kneewall
shall span from existing Lena roof to underside of roof
rafters.
B. Align kneewall with existing beam in Tony Lena. Note that the
kneewall shall jog similar to existing beam.
C. Install (1) 4x4 wood post as required at southern portion
of existing beam in Tony Lena.
When these issues are resolved to the satisfaction of Lindentree,
the architects shall verify the structural integrity of the new roof
construction to the Salem Building Inspector.
2 . General Contractor shall install framing connections as outlined in
Notes of Conference 4-19-88. General Contractor shall notify
architect at completion of installation to arrange for inspection.
The architect shall forward his finding to the Salem Building
Inspector.
3 . General Contractor shall install exterior treated trim board as
indicated on Drawing A-3 , Elevations. The location of trim board
shall be verified with Back Bay Awning to correspond to the
Richdale, furnish and installed, awning dimensions. General
Contractor shall relocate exterior light fixtures in conflict with
awning.
4. All HVAC supply ducts conveying heated conditioned air shall be
fabricated and installed of non-combustible material as required in
Section 1009. 0, Construction of Metal Ducts and Vents, of the
Massachusetts State Building Code.
5. As stated on the Building Permit Job Weather Card, work shall not
proceed until the inspector has approved the various stages of
Construction. The General Contractor shall pursue the required
signatures.

3. 2 '-0o x 2 '-0'/ grade beam has been poured where Tony Lena &
new addition/connector abut.
4" New slab on grade has been poured at new addition/connector .
5. The 1/2" Wonderboard & Bituthene application at the exterior
perimeter foundation sill has been installed at east and
south elevations of the relocated structure. Note that this
construction detail , as indicated on Sketch HSK-2, requires
the application of Insulcrete finish on all exposed surfaces
of the Wonderboard.
6. The east elevation 1st floor door and windows have been
framed V -0" to the south , as previously agreed , to avoid
conflict with the existing beam"
7. The new second floor gable roof is framed including the 2x12
collar ties at upper 1 /3 of every pair of the roof rafters"
The ridge and eaves align with that of the existing roof .

new 10" concrete foundation. Mastic has been applied to

2. It was agreed to install 5 '-0" deep planting areas along
east and south elevations of the relocated building.
Sloped concrete entrance ramps shall be provided at
Entrance Doors 101A, 1016 & 102. Entrance ramps shall
have a maximum slope of of 1 : 12. The east elevation
planting area shall extendfrom the entrance ramp at Door
1016 to the 4 '-0" wide concrete walk and stairs at the
rear (north) elevation. The south elevation planting area
shall extend between the entrance ramps at Doors 101A &
102.
3. New 2x12 floor joists at 24" o. c. in Area A on ASK-1 have
been installed.
4. General Contractor- shall install 2x12 as indicated on ASK-

5. The existing longitudinal beam and column encased in GWP
supporting 'the second floor have been exposed. General
Contractor shall hang new Giu-lam beams from existing
longitudinal (4) 2x12 beam with i ' diameter steel pipe
and 1/4 steel plate hung from top of existing beam. All
steel connectors must be enclosed by the wood beams, a
minimum of 1 " on all sides to ensure the 1 hour rating of
the heavy timber.
6. General Contractor shall provide a continous -CY1 x 2 '-0"
concrete grade beam along the side (west) elevation which
abuts the existing Tony Lena Restaurant.

must be provided in the northwest corner of the
basement.
6" All floor surfaces, scheduled to receive quarry tile
finish as indicated on Construction Documents, shall be
finished with Armstrong Medintech Resiliant Flooring

Dear Santos :
Mr . Joseph Manzi telephoned and identified . himself as the General
Contractor for the referenced project . Several issues must be resolved
before construction can commence:
1 . The building permit has been issued under the construction
supervision license of Douglas F. Trees . Since Lindentree is not
the contractor , any reference to our company or any of our staff as
same , must be eliminated from the building permit and . transferred
into the appropriate contractor ' s name before construction starts .
2 . The construction documents were prepared for the sole purpose of
obtaining a building permit , which was eventually achieved through
an exhaustive effort . The drawings are not , nor were they ever
intended to be full "Working Drawings . " Lindentree is required
under Section 127 , Construction Control, of the Massachusetts State
Building Code (copy enclosed) , to supervise the construction of any
project bearing our stamp . The Architect of record is further
required to make regular visits to the construction site to
determine that , generally, the work is proceeding in accordance
with the documents as approved for the building permit and all
minimum provisions of the State Building Code. We must also report
our observations on a bi-weekly basis to the local building
official , as identified in the enclosed City of Salem Control
Construction Form. Therefore it must be reiterated that even though
certain details may not be explicitly shown on the drawings the
construction must fully conform to all code provisions and
allowances for such must be a part of your contract work. For
example, the relocated building ' s first floor elevation is the same
as finish grade (sidewalk elevation) for handicapped access and per
Richdale' s requirements . Section 874. 0 of the Massachusetts State
Building Code does not allow untreated wood to be in contact with
the ground or untreated wood joists to be exposed to ground located
within the periphery of the building over crawl spaces or

unexcavated areas . An acceptable construction method for this
particular situation as well as several others must be resolved so
that the building will comply with the State Building Code. It is
Lindentree ' s responsibility through construction supervision to
ensure that this project is executed in accordance with the approved
drawings and , where the drawings may be not fully explicit , with the
minimum standards established by the Massachusetts State Building
Code. Our construction supervision will be provided at an hourly
rate- of $65 . 00.
3. The General Contractor , as identified on the approved building
permit , is required to execute all work in accordance with the
approved construction documents and • all local, state , and federal
statutes and regulations. Any situation that arises in the field
which may cause a deviation from the construction documents must be
reviewed by the architect prior to being implemented by the
contractor.
If the drawings prepared by Lindentree for the purpose of obtaining
a building permit are to be used as construction documents ,
Lindentree is prepared to provide a complete and professional
service to satisfy your needs and expectations . (Note: The
opportunity exists for the general contractor , due to the nature of
the construction documents , to provide a product less than the City
of Salem' s standards require. We wish to assure you that through
our construction supervision this scenario will not be
allowed to transpire. )
The construction of this project will demand our attention and
require us to communicate with the general contractor , Richdale ,
and yourself on a continuous basis . . We must all work together so
that the end result will be something we may all be satisfied with .
Please furnish me with a copy of the necessary transfer of the
building permit , identifying the appropriate general contractor;
until then construction cannot begin.

SECTION 127.0CONSTRUCTION CONTROL
127.1 Responsibilities: The provisions of this section define
the construction controls required for all structures needing
registered professional architectural or engineering services,
and delineate the responsibilities of such professional services
together with those services that are the responsibility of the
contractor during construction.
Exceptions:
1. Any building containing less than thirty-five thousand
(35,000) cubic feet of enclosed space;
\ 2. Any single or two-family house or any accessory building
J thereto;
3. Any building used for farm purposes; and
4. Retaining walls less than ten (10) feet in height at all
points along the wall as measured from the base of the
footing to the top of the wall.
127.2 Professional architecture or engineering services.
127.2.1 Design: All plans, computations and specifications in-
volving new construction, alterations, repairs, expansions or
additions shall be prepared by or under the direct supervision
of a registered professional architect or engineer and bear his
signature and seal; said signature and seal shall signify that
the. plans, computations and specifications meet the applicable
provisions of this code, all acceptable engineering practices and
all applicable laws and ordinances.
127.2.2 Architect/engineer inspectional responsibility: The reg-
istered professional architect or engineer shall be responsible
for the following:
1. Review of shop drawings, samples and other submittals of
j the contractor as required by the construction contract
documents as submitted for building permit, and approval
for conformance to the design concept.
2. Review and approval of the quality control procedures for
all code-required controlled materials.
3. Special architectural or engineering professional inspection
of critical construction components requiring controlled
materials or construction specified in the accepted engi-
neering practice standards listed in Appendix B.

The registered professional architect or engineer shalt per- 1
form the necessary professional services and be present on the
construction site on a regular and periodic basis to determine
j that, generally, the work is proceeding in accordance with the
documents approved for the building permit.
127.2.3 Reporting: The registered professional architect or
engineer shall submit periodically, in a form acceptable to the
building official, a progress report together with pertinent com-
ments. At the completion of the construction, the registered
professional architect or engineer shall submit to the building
official a report as to the satisfactory completion and the readi-
ness of the project for occupancy (excepting any items not en-
dangering such occupancy and listing pertinent deviations from
the approved building permit documents).
127.3 Construction contractor services: The actual construc-
tion of the work shall be the responsibility of the general con-
tractor as identified on the approved building permit and shall
involve the following:
1. Execution of all work in accordance with the approved con-
struction documents.
2. Execution and control of all methods of construction in a
safe and satisfactory manner in accordance with all appli-
cable local, state, and federal statutes and regulations.
3. Upon completion of the construction, he shall certify to
the best of his knowledge and belief that such has been
done in substantial accord with items 1 and 2 above and
with all pertinent deviations specifically noted.
127.4 Special professional services: When applications for un-
usual designs or magnitude of construction are filed, or where
code reference standards and/or Appendix B require special
architectural or engineering inspections, the building official
may require full-time project representation by the registered
professional architect or engineer in addition to that provided
in Section 127.2.2. The project representative shall keep daily
records and submit reports as may be required by the building
official. Upon completion of the work, the registered profes-
sional architect or engineer shall file a final report as required
under Section 127.2.3.
127.4.1 Building permit requirement: This special professional
service requirement shall be determined prior to the issuance of
the building permit and shall be a requisite for the permit
issuance. Refusal by the applicant to provide such service as
required by the building official shall result in the denial of the
permit. However, the applicant may file an appeal as provided
' in Section 125.0.

127.4.2 Fee and costs: All fees and costs related to the per-
formance of special professional services shall be borne by the
applicant.
127.5 Building official responsibility: Nothing contained in
this section shall have the effect of waiving or limiting the
building official's authority to enforce this code with respect to
/ examination of the contract documents, including plans, compu-
tations and specifications, and field inspections (see Section
108.0).
SECTION 128.0 CONSTRUCTION MATERIALS SAFETY BOARD
128.1 Membership: There shall be a board under the control
of the Commission called the Construction Materials Safety
Board, hereafter in Section 128.0 called the Board which shall
consist of nine (9) members, one (1) of whom shall be a member
of the Commission who shall be ex officio and a voting member
of the Board and eight (8) members to be appointed by the
chairman of the Commission: one of whom shall be a registered
professional engineer who is a structural engineer; one of whom
shall be a registered architect; one of whom shall be a repre-
sentative of a commercial testing laboratory; one of whom shall
be a representative of a public testing laboratory; two of whom
shall be representatives from the construction industry; one of
whom shall be a member of a university faculty engaged in re-
search and teaching in structural materials; and one of whom
} shall be a member of a university faculty engaged in research
and teaching in the area of theoretical and applied mechanics.
128.2 Duties: The Board will review applications for registra-
tion or licensing of individuals, laboratories or firms responsible
for the inspection, control and testing of construction materials,
and review applications and pertinent data relevant to all mater-
ials, devices, products and methods of construction not in-
cluded in this code; and report to the Commission their recom-
mendations. The Board will collect information and review cases
where disciplinary action against an existing license, whether
an individual, laboratory or firm, has been proposed; and make
recommendations to the Commission. The Commission will issue
applications, receive payment for the review of such appli-
cations and approvals, registration and licensing fees, and
maintain records for the efficient dispatch of the duties of the AI
Board.
128.3 Testing and evaluation groups: The Commission shall
establish and maintain testing and evaluation groups who will
have the responsibility of administering and directing, under
the supervision of the Commission, the testing and controls for
evaluating individual applicants, laboratories and firms wishing
to become registered or licensed.

regarding development inspection fees.
Any developer who constructs, reconstructs or
rehabilitates six (6) or more residential units or 10, 000
square feet or more of commercial space shall pay to the
Building Department a fee for building, plumbing and gas
inspections. The fees will be charged at the rate of
Twenty and 00/100 ($20. 00) dollars per hour and will be
due within thirty (30) days of receipt of the invoice. No
Certificate of Occupancy will be issued by this Department
until all outstanding inspection fees have been paid.
The above fees are to be paid in addition to
all other fees required under the Building Permit fee
