September 10, 2015 at 7:00 P.M. for the purpose of transacting any and all business. Notice
of this meeting was posted on September 3, 2015 at 4:43 P.M. This meeting is being taped

Councillor O’Keefe was recorded as absent.
Council President Sargent presided.
Councillor Eppley moved to dispense with the reading of the record of the previous meeting.

#503 - HEARING ON PETITION OF VERIZON FOR CONDUITS ON FEDERAL STREET
A hearing was held on the Order of Verizon to install conduits on Federal Street.
Appearing in favor was Kelly-Ann Correia a Right of Way Specialist for UC/Synergetic and
representative for Verizon. She stated this was needed to provide services.
There was no one appearing in opposition.
Councillor Famico moved that the hearing be closed. It was so voted.

#504 - APPOINTMENT OF DR. JEREMY SCHILLER TO THE BOARD OF HEALTH
The Mayor’s appointment of Dr. Jeremy Schiller to serve as a member of the Salem Board
of Health with a term to expire on March 1, 2018 was held until the next meeting under the rules.
#505 - REAPPOINTMENT OF GREGORY ST. LOUIS TO THE CONSERVATION COMMISSION
The Mayor’s reappointment of Gregory St. Louis to the Salem Conservation Commission
with a term to expire on September 15, 2018 was confirmed by a roll call vote of 10 yeas, 0 nays, 1
absent. Councillors Turiel, Siegel, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and
Sargent were recorded as voting in the affirmative. Councillor O’Keefe was recorded as absent.
#506 - CONSTABLE
The Mayor’s appointment of Joseph Lamberti to serve as a Constable with the term to
expire on September 4, 2016, was received and placed on file.
#507 - CONSTABLE
The Mayor’s reappointment of John Massa to serve as a Constable with the term to expire
on August 8, 2018, was received and placed on file.
#508 - COMMUNICATIONS FROM THE MAYOR
The following Order recommended by the Mayor was adopted for first passage by a roll call
vote of 9 yeas, 1 nay, 1 absent and referred to the Committee on Administration and Finance co-
posted with the Committee of the Whole. CouncillorsTuriel, Siegel, Milo, McCarthy, Legault,
Gerard, Famico, Eppley and Sargent were recorded as voting in the affirmative. Councillor Furey
was recorded as opposed. Councillor O’Keefe was recorded as absent.
BOND ORDERED: That the sum of Two Million Two Hundred Fifty Thousand Dollars
($2,250,000.00) be and hereby is appropriated to pay the costs associated with the remediation of
the Salem Transfer Station property located at 12 Swampscott Road, Salem, MA 01970, including
demolition of the existing buildings and structures, capping of the onsite ash landfill, bring the site
into compliance with state and local requirements and for the payment of all costs incidental and
related thereto, and that to meet said appropriation the Treasurer, with the approval of the Mayor,
is authorized to borrow said sum under M.G.L. Chapter 44, Sections 7(3A) and 7(9), or pursuant to
any other enabling authority, and to issue bonds or notes of the City therefore.

That the Mayor and the Treasurer are each authorized to file an application to qualify under

#509 – APPROPRIATION TO “GOLF COURSE RENOVATIONS”
The following Order recommended by the Mayor was adopted under suspension of the
rules.
ORDERED: That the sum of Forty-five Thousand dollars ($45,000.00) is herby appropriated
from the “Receipts Reserved – Golf Course” account to the “Golf Course Renovations” account in
accordance with the recommendation of Her Honor the Mayor.
#510 – APPROPRIATION TO “RECEIPTS RESERVED – SALE OF VAULTS” & “DEPT. OF
PUBLIC SERVICES – EQUIPMENT”
The following Order recommended by the Mayor was adopted under suspension of the
rules.
ORDERED: That the sum of Thirty Thousand and Sixty-four Dollars and Eighty Cents
($30,064.80) is hereby appropriated from the Receipts Reserved funds listed below to the
“Department of Public Services – Equipment” account in accordance with the recommendation of
Her Honor the Mayor.
#511 – APPROPRIATION TO “CEMETERY – BURIAL”
The following Order recommended by the Mayor was adopted under suspension of the
rules.
ORDERED: That the sum of Twenty-Five Thousand dollars ($25,000.00) is hereby
appropriated from the “Receipts Reserved – Sale of Lots” account to “Cemetery - Burial” account in

#512 – APPROPRIATION TO BE EXENDED FOR REMOVAL OF TREE STUMPS CITY WIDE
The following Order recommended by the Mayor was adopted under suspension of the
rules.
ORDERED: That the sum of Twenty-Five Thousand dollars ($25,000.00) is hereby
appropriated from the “Capital Outlay – Renovation & Repair” account to be expended for removal
of tree stumps city-wide by the Department of Public Services in accordance with the
recommendation of Her Honor the Mayor.
#513 – APPROPRIATION TO “WITCH HOUSE – CONTRACTED SERVICES”
The following Order recommended by the Mayor was adopted under suspension of the
rules.
ORDERED: That the sum of Fourteen Thousand Seven Hundred Dollars ($14,700.00) is
hereby appropriated from the “Receipts Reserved – Witch House” account to the “Witch House –
Contracted Services” account in accordance with the recommendation of Her Honor the Mayor.
#514 – ACCEPT DONATION FROM THE FRIENDS OF THE COUNCIL ON AGING
The following Order recommended by the Mayor was adopted.
ORDERED: Accept the donation from the Friends of the Council on Aging in the amount of
One Thousand Five Hundred Dollars ($1,500.00) to replace the refrigerator in the dinning room at
the Council on Aging. These funds will be deposited into the Council on Aging Donation Fund in
accordance with the recommendation of Her Honor the Mayor.
#515 – ESTABLISH A PARKING FEE AT THE GARAGES FOR OCTOBER
The following Order recommended by the Mayor was adopted.
ORDERED: Effective Saturday, October 3, 2015 and each Saturday and Sunday thereafter,
until Sunday, November 1, 2015, the daily rate for parking in the South Harbor Parking Garage, the
Museum Place Parking Garage and the Church Street Parking Lot, excluding the East lot adjacent
to St. Peter Street, shall be twenty dollars ($20.00).
Be it further Ordered that any Salem resident who presents valid identification at the Church
Street Parking Lot shall not be subject to the $20.00 fee.

#516 – LEASE AGREEMENT WITH WICKED HOWL ENTERPRISES, INC.

ORDERED: The Mayor is hereby authorized to execute, on behalf of the City of Salem, a lease
agreement with Wicked Howl Enterprises, Inc. d/b/a Lobster Shanty Unit #3 at Artist Row for a term
beginning January 16, 2016 ending January 15, 202, with option to renew the lease for up to five
one-year periods. (Lease Agreement can be viewed in the City Clerks Office during normal
business hours.)
#517 – MAYOR TO ESTABLISH 37 OFF STREET PARKING SPACES ADJACENT TO BRIDGE
STREET
The following Order recommended by the Mayor, was referred to the Committee on
Ordinances, Licenses and Legal Affairs.
ORDERED: The Mayor is hereby authorized to establish and construct 37 spaces of off
street parking adjacent to Bridge Street at 50 St. Peter Street.
#518 - COMMUNICATIONS FROM THE MAYOR
The following Order recommended by the Mayor, was referred to the Committee on
Ordinances, Licenses and Legal Affairs.
ORDERED: The City of Salem herby designates the position of Outside Expert Appraiser
George E. Sansoucy, PE, LLC as a Special Municipal Employee, as defined in Mass. General Law
Chapter 268A.

#519 – ORDINANCE AMEDING CHAP. 36 SOLID WASTE MANAGEMENT
The following Ordinance recommended by the Mayor, was adopted for first passage
and referred to the Committee on Ordinances, Licenses and Legal Affairs co-posted with
Committee of the Whole.
In the year two thousand and fifteen
An Ordinance to amend and Ordinance relative to solid waste management
Be it ordained by the City Council of the City of Salem, as follows:
Section 1. Chapter 36 is hereby amended as follows:
1) Section 36-4 Pickup of Large Items is hereby amended by deleting the first paragraph in its
entirety and replacing it with the following:
“Bulk items such as mattresses and furniture shall be collected by appointment by the City’s
solid waste collection contractor. E-Waste, including computers and televisions, and
appliances may be recycled at quarterly collection events scheduled by the City Engineer.
The City may charge a fee for the disposal of certain items.
2) Section 36-5 Residential Curbside Solid Waste and Recycling Collection is hereby amended
by deleting the first paragraph in its entirety and replacing it with the following:
“The City shall provide weekly municipal curbside solid waste and bi-weekly recycling
collection to all owner-occupied residential units and non-owner occupied rental units
serviced by the municipal collection contract at the time this section is adopted.”
3) Section 36-6 Collection Fee for Certain Residents is hereby amended by adding the
following to end of the first sentence in Section 36-6 (f):
“ if evidence of ownership and an affidavit is filed with the City Engineer within 45 days of
purchase of property or change in deed.”
4) Section 36-8 Collection Fee for Certain Commercial Establishments is hereby amended by
adding the phrase “per commercial unit” at the end of the first sentence of this section.
Section 2. This Ordinance shall take effect as provided by City Charter.

#520 – LAND TAKEN FOR HIGHWAY PURPOSES

absent. A motion for immediate reconsideration in the hopes it would not prevail was denied.
ORDERED: Whereas, in the opinion of the Mayor and City Council of the City of Salem, the
public convenience and necessity of the inhabitants of the City require that certain parcels of land
be taken for highway purposes from the owners of record of land abutting Canal Street in said City
of Salem, Massachusetts as the same are more particularly described in “Exhibit A”, and whereas
it is the intention of the Mayor and City Council to take said land by right of eminent domain, it is
therefore Ordered:
That the City of Salem does herby take Parcels of Land for Highway purposes identified on
“Exhibit A” attached hereto, and as shown on plans attached hereto in “Exhibit B”, to be recorded
herewith and made a part of this taking, and a copy to be filed in the office of the Engineering
Department, Salem, Massachusetts.

#524 – REQUEST TO HOLD AN EXECUTIVE SESSION
A request from Mayor to meet with the City Council in Executive Session relative to litigation
by Northside Carting regarding the Transfer Station. Conducting this discussion in an open
meeting may have a detrimental effect on the litigation position of the City
Councillor Siegel moved to hold an Executive Session by roll call vote.
The City Council voted to hold an executive session by a roll call vote of 10 yeas, 0 nays, 1
absent. Councillors Turiel, Siegel, Milo, McCarthy, Legault, Gerard, Furey, Famico, Eppley and
Sargent were recorded as voting in the affirmative. Councillor O’Keefe was recorded as absent.
Following the Executive Session, the City Council voted to reconvene in open session and
continue the regular meeting.
#525 – PRESENTATION BY MAYOR TO SALEM LITTLE LEAGUE
A request of Mayor to do a presentation of City Seals for the Salem Little League
Williamsport All-Star Team, was received and placed on file.

Councillor Milo introduced the following Order, which was adopted.
ORDERED: That the City Council meet with National Grid to discuss a plan to repair 92
natural gas leaks in the City of Salem and that the matter is referred to the Committee on Public
Health, Safety and Environment co-posted with Committee of the Whole. Invite Mayor or her
representative and a representative from National Grid, Fire Chief or his designee, Police Chief,
City Engineer, City Electrician, State Representative Tucker and Senator Lovely.
