To Whom it may concern,
I am writing a letter of contest of a`non removal of snow and ice from a sidewalk'violation# 1977
that we received in the mail on February 3rd.We in fact DID remove the snow and ice from the sidewalk in front
of our house as well as a very large clearing around the fire hydrant that is in front of our house.You will see in
the pictures attached that my husband started snow blowing on 1/27/15 (images will appear twice,once with
time stamp and info and one clear shot for better viewing)The second photo is of our sidewalk that following
morning 1/28/15 on my way to work that I just happed to of taken to reassure him the sidewalk was clear as he
is very cognition of this.My husband,Edward Nolan takes pride in having our area in tip-top shape after EVERY
storm.The Firefighters were even driving by as I took the shot and smiled at the fact our hydrant was clear and
then some.They get the horrible task of clearing all others that people don't.After the Blizzard on 1/27/15 we got
a total of.8 inches of additional snow that was also removed and salted as our pictures show. Our sidewalk area
only improved as the days went on to the supposed violation date. (See accuweather.com screen shots attached as
well as the snow ordinance for the city of Salem at which we did comply with.)
This violation states we did not clear an area that we did. It also states they were unable to obtain a signature of
the offender yet we have home surveillance that proves otherwise&to boot,we where home at the said time.
They could of knocked at our door if they were really there inspecting and found a problem.If there truly was
an inspection done to our sidewalk we wouldn't of gotten a ticket. Note the time stamped camera footage picture
that not only shows no activity in the time frame the supposed inspection happened but also shows no attempt
to knock on our door. Could this ticket be for another house? This violation has to be a mistake. I am hoping
that it is and the numbering of the houses on Loring Ave had something to do with it. We are#465,across from
us is 490,our direct neighbor is 469.Our house is clearly marked by a number as well as our mailbox though.
494 Loring also got an incorrect ticket and reached out to us about it.We supplied them with video of them
shoveling after the blizzard and on 1/31 and their ticket was issued on Feb. 1 st also.We see that couple outside
shoveling every time there is snow. Mistakes happen but we would like this rectified and taken care of as soon as
possible please.
We contacted the Mayor and the town Councilor and were honestly very disappointed in the responses we got.
The Mayor said to send in the info even though we sent her the info and she agreed the snow was removed and
the Ward 7 Councilor told my husband to just pay it because we wouldn't win against the city and he gets thou-
sands of complaints and they don't win. That is unacceptable.To me,that sounds like an even bigger problem.
We cleared our sidewalk.
Have cleared that same sidewalk and hydrant for the past 7 years and have not ONCE not cleared it.
I look forward to a response to our contest.

esently,there is an ordinance requiring property owners to move snow from their bordering sidewalks within six hours ter the snow ceases to fall in the daytime and before 12:00 on if it ceases to fall in the nighttime. Violators are subject a $25 fine for 1 st offense, $75 for 2nd offense and $100r 3rd and subsequent offenses..
Is there a fine for shoveling snow onto the street?
Yes. Snowblowing, shoveling,orthrowing snow back onto
the street when clearing driveways or sidewalks is prohibited
by City Ordinance and violators are subject to a $75 fine for

VARIANCE AT�465 LORING AVE. (RT1 )
A hearing on this petition was held February 15, 1989 with the following Board
Members present: James Fleming, Messrs. , Bencal, Luzinski, Nutting and Strout.
Notice of the hearing was sent to abutters and others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a variance to allow construction
of an addition in rear of this property which is located in an R-1 district.
The Variance which has been requested can be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the
land, building or structure involed and which are not generally affecting
other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of of Appeal, after careful consideration of the evidence presented
and after viewing the plans, makes the following findings of fact:
1 . There was no opposition, Mr. Hayes spoke in favor;
2. The proposed addition will not encroach on any setbacks.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which effect the subject property but not
the district generally;
2. Literal enforcement of the provisions of the Ordinance would work a
substantial hardship on the petitioner;
3. The Variance requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the

fire safety be strictly adhered to;
4. Exterior finish of new construction conform to existing structure.
