2. Work shall conform to plan entitled, "Leggs Hill Pond Outlet Control
Structure," dated May 9, 1986, prepared by Thomas Rouleau, P. E. ,
Engineering Assistant, and detail plan entitled, "Precast Cement
Concrete Catch Basin."
3. Prior to commencement ori orat-r-}; ion, an erosion and sedimentation
control barrier in accordance with "Erosion and Sedimentation Control
Guidelines," Publication #13, 529-39-1000-2-84-C.R. , dated August, 1983,
shall be installed upstream of the proposed control structure and
downstream of the proposed structure.
a. Staked haybales shall be placed in a configuration which will
adequately contain any sedimentation resulting from the dike removal.
b. Such hay bales may be removed after the water has sufficiently -
cleared to indicate no further sedimentation will take place.
4. The Town of Marblehead Water Department shall be notified
seventy-two (72) hours prior to commencement of construction.
5. Prior to backfilling around the control structure, the Commission or
its designated shall be notified to confirm the rim elevation is set at
27.3.
6. The. City of Salem shall be responsible for ensuring that the
structure is cleaned and maintained at least twice yearly. The Town of
Marblehead shall be notified at least seventy-two (72) hours in advance
of such maintenance operations.
7. Following installation, the proposed slope shall be vegetated to
ensure stability.

1 . Except as modified by this Order of Conditions, all work shall
conform to plans submitted with the Notice of Intent, dated 1/85. Any
changes made or intended to be made in the plans shall require the
applicant to inquire of the Commission in writing whether the change
requires a new filing. A site plan noting changes required by this
Order of Conditions shall be submitted to the Conservation Commission
prior to the commencement of site work._
2. Prior to the commencement of site work, a written erosion control
and sedimentation barrier program shall be established, submitted to the
Conservation Commission and approved by theConservationCommission.
The erosion control and sedimentation barriers shall be established in
accordance with "Erosion and Sedimentation Control Guidelines",
Publication #13 ,529-39-1000-2-84 C.R. , dated august, 1983. The erosion
control and sedimentation barrier program shall address, but not be
limited to, the type of barrier (s) , placement, maintenance, frequency
Of replacement, stabilization and revegetation.
3. No site work sha.11 commence until the approved barriers have been
installed, inspected and approved by the Conservation Commission or its
designated representative.
4. Security of the property (site) shall be the responsibility of the
applicant. Prior to any further site work, a barrier shall be erected
at the site entrance and controlled by a locked gate to insure there is
no unauthorized dumping of unacceptable materials.
5. Site work resulting in the removal of material or the disturbance of
underlying strata shall be prohibited below elevation 40.
6. Prior to the commencement of site work, all unacceptable fill
material on the site shall be removed from the site and disposed of in a
manner approved by the Conservation Commission.
7 . All disturbed banks within the 100' buffer zone with pervious
underlying stratas. shall be stabilized in accordance with the "Erosion
and Sedimentation Control Guidelines", Publication
#13 ,529-39-1000-2-84—C.R,. , dated August, 1983, at a slope not to exceed
1' :i . Revegetation of said areas shall be attempted during each growing
season. Any area which does not revegetate over 75% of its surface
within two growing seasons shall be replanted with indigenous species.
A revegetation plan for such purposes shall be presented to and approved
by the Conservation Commission prior to its implementation.
8. The Conservation Commission or its designated agent shall be
notified immediately of any unacceptable fill found during the site
preparation. If the Conservation Commission or DEQE determines the
unacceptable material to be non—hazardous, it will be removed from the
site and disposed of in a manner approved by the Conservation
Commission. Fill material which is determined to be hazardous by the
Conservation Commission or DEQE shall be removed to an approved facility
and copies of delivery slips shall be supplied to the Conservation
Commission. Until such unacceptable hazardous material is removed from
the site, no additional site work may be performed.

9. Upon written advance notification, Conservation Commission members
and/or its agent shall have the right to enter and inspect the site to
evaluate compliance with these conditions and to require the applicant
to submit any data deemed necessary. by the Commission for that
evaluation.

FIRE DEPARTMENT CERTIFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with the provision of Section 113.5 of the Massachusetts
State Building Code, and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief, the applicant for a building permit
shall obtain the Certificate of Approval (see reverse side) and stamped -_-
plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit may be J w
issued. The Massachusetts State Building Code requires compliance z 3
approval of the Salem Fire Department, with reference to provisions of E: m w
Articles 4 and 12 of the Building Code, the Salem Fire Code, Massachusettsa z
General Laws, and 527 Code of Massachusetts Regulations. =) N

The applicant shall submit this application with three (3) sets of plans, zo � ':
drawn in sufficient clarity, to obtain stamped approval of the Salem Fire E- �_
Department. This applies for all new construction, substantial p W w
alterations, change of use and/or occupancy, and any other approvals as uai a =
required by the Massachusetts General Laws, and the Salem Fire Code. ¢ z
Exception: Plans will not be required for structural work when the
proposed work to be performed under the building permit will
not, in the opinion of the Building Inspector, require a
plan to show the nature and character of the work to be
performed.
Notice: Plans are normally required for fire suppression systems,
fire alarm systems, tank installations, and Fire Code
requirements.
Under the provisions of Article 22 of the Massachusetts State Building
Code, certain proposed projects may not require submission of plans or
complete compliance with new construction requirements. In these
cases, provisions of Article 22, Appendix T, and Tables applicable
shall apply. This section shall not, however, supersede the
provisions outlined in the Salem Fire Prevention Regulations, Chapter
148, MGL, or 527 Code of Massachusetts Regulations. All permits for
fire code use and/or occupancy shall apply for the entire structure;
fire alarm and/or smoke detector installation shall apply to the
entire structure based upon current requirements as per Laws and/or
Codes, but the existing structure may comply with regulations
applicable for existing structures.
Notice: Sub-contractors may also be required to file individual
applications for a Fire Department Certificate of Approval
for the area of their work. Such sub-contractors shall file
an Application to Install with the Fire prevention Bureau
prior to commencing any work for those areas applicable.

The Salem City Council recently passed the attached ordinance which

units or 10,000 square feet of commercial space hire specific.

The purpose of the ordinance is to ensure that Salem and Salem Area
residents receive the maximum benefits from the growing construction
ecomcny of the City of Salem.
A preconstruction conference will be scheduled by the Planning
Department to discuss and explain the developer' s requirements as
outlined in the City of Salem Ordinance. The following information
shall be furnished by the developer to ensure compliance with this
ordinance:
Upon issuance of a Building Permit, the developer shall submit to the
Solea Planning Department the following requested information:
a. scope of construction;
b. construction time schedule;
c. projected number of employees and man-hours;
d. types of trades to be hired; and
e. names, addresses, and principals of contractors and
sub-contractors being hired.
Upon initiation of construction, all developers shall submit weekly
workforce reports listing the following:
a. names of employees;
b. residential address of each employee;
c. craft of each employee;
d. job category of each employee;
e. hours worked of each employee;
f. hourly wage of each employee; and
g. company which each employee is employed by.
