Pleased be advised that this office represents Solarteere-e-
em, Child Growing Center, Inc. owner of the above referenced
property. Your letter of September 11, 1990 has been
referred to me for response.
The subject property is a two family residence. Each of the
residents of the two apartments are lessees under a written
lease. They therefore are not "lodgers" or "boarders" under
the law of the Commonwealth. The Supreme Judicial Court has
ruled that the distinguishing feature of a lodger is his
lack of interest (either a leasehold or fee ownership inter-
est) in the property he occupies. You may rest assured that
the lessees will allow no lodgers or occupants other than
the named lessees to stay at the premises.
Legal issues aside, Patricia Jennings Welch, the director of
the school that owns the property, recognizes the importance
of maintaining good relations in the neighborhood. She has
spoken with the tenants and has received assurances that the
property will not be the source of disruption or imposition
to the neighbors.

of a lodging house at the above referenced property, which is in a Residential
two-family district.
It appears that you may be in violation of the City of Salem Zoning Ordin-
ance, Section V (Permitted uses in an R-2 district) . It also appears there may
be a violation of the Massachusetts General Laws, Sub Section 22 (Lodging houses) .

On 10/ 11/90, inspections were conducted at 143 Loring Avenue, Apartments 111 and 112.
These inspections were conducted by Pablo Valdez, Code Enforcement Inspector of the
Salem Health Department, in accordance with Chapter II, Article XIII of the Salem
Code of Ordinances of 1973, Section 2-334, "Certificate of Fitness" and Chapter II
of the State Sanitary Code, 105 CMR 410.000, "Minimum Standards of Fitness for Human
Habitation."
Apartment 111 consisted of a kitchen,living room, bathroom and three (3) bedrooms.
Apartment 112 (second floor) consisted of two levels (floors) . On the first level
there is a kitchen, living room, bedroom and bathroom.
On the second level (third floor) there are two (2) bedrooms only.
Inspector Valdez has stated that both apartments in this two-family dwelling are
in order and Certificates of Fitness can be issued by the Health Department.

Greenhouse Schoot, at 145 Loring Avenue, who ha-6 vented out the heeond
btoor and attic o6 the attached buitding to at teast Give ( 5 ) eottege
boys. (She woutdn 't tett my husband how many, but admitted to at
teast Give. ) 1 have telephoned hex every day since they moved in,
and she neven once answered my phone catts. I speak to hen 066ice
Manager and Leave messages daity.
We have Lived on Loring Avenue since we were married in May o6 1968 .
In twenty-two years, the only serious eomptaint we had was when a home
diagonatty across Brom us was going to be sotd as a Veterinary Ctinie.
I in6o4med att neighbors within a one btock area, had Jack Nutting,
and my cousin, Joe Centorino .speak at a meeting at aur home, and the
potential owners withdrew theca o66e4. Now, a Samity resides these.
Other smatter things were: getting used to the t4a66ie, the
occasionat automobile accident, ort Loud kids watking by yetting,
tacking on playing music earty in the morning.
Needtess to hay, we neven reatized how tueky we had been. Since
Tuesday, September 4 , however, we have onty been abte get three to
Sour hours o6 .steep a night.
We ane concerned that the property vatues witt go down ( even 6u4ther
in today 's economy ) i6 peopte aren 't abte to sett on Hent thein homey
with an "Animat House" in the vicinity, and thein tack o6 concern and
abitity to act tike "adutts" .
We own a unit down at Pickering Whar6 , and have had it vacant up to
ive months, because we woutd not cent it to two adutt 6emate / mates
roommates but hetd out Son singte peopte ort married couptes because we
vatue the privacy and quiet that peopte are entitted to when having to
Live in etose proximity to others. Ms. Weteh, however, seems to have
no regard Son those o6 us who Live in hes business 's neighborhood.
Our concerns tie in these questions:
1 . How many unretated peopte ane attowed to Live in one dwetting?
2 . What is the age that one is considered an "adutt" to .sign a
tease?
3 . Since there ane cottege boys Living in the attic, shoutdn 't there
be a Sine escape of a second exit in case o6 6ire?
4. What can be done?
