The ensuing communication shall serve as our follow-up to our telephone call regarding the
unpermitted work at 75 Loring Avenue. Complaints were received by our Department the
aforementioned property and 'upon inspection the property was found to be in violation of the
Massachusetts State Building Code.

I- Un permitted electrical and construction work. (Section 105.0 of 780 CMR Massachusetts
State Building Code) —!Building Permit Application Form,Permit Fee, Debris Disposal
Affidavit, Worker's Compensation Affidavit and Stamped Drawings from a Registered
Massachusetts Architect(with review from Salem Prevention prior to submittal to the
Building Department) arerequired to be submitted during the filing.
2- Provide a signed and notarized affidavit from a Registered Massachusetts Architect stating the
work completed is in compliance with the Massachusetts State Building Code. With standing this
letter de-construction of the partition wall shall be required to review code compliance.
3- Electrical permit shall be applied for by a licensed Massachusetts Electrician, with
disclosure to such department that work has been previously completed.
Until such time that all requirements of this letter and any and all further requirements are

DECISION-ON-THE-PETITION OF JOHN TOY FOR A VARAINCE AT
[75 LORING AVE. (R�2) FIL90
A hearing on this petition was held February 17, 1988 with the lfo�o ingbBoa'rd���
Members present: James Hacker, Chairman; Messrs. , Fleming, Strout and Associate
Member Dore. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property,is requesting a Variance from use and parking
to allow premises to be used for classes on Tai Chi Chaun. Property is located
in an R-2 district.
The Variance which has been requested may be granted upon a finding of the Board
that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Apeai, after careful consideration of the evidence presented at the
hearing, makes the following findings of fact:
1 . Although located in an 5-2 district, the property is adjacent to an
industrial facility and across from several commercial establishments;
2. ehic_es entering and exiting from the property could exacerbate
existing traffic problems and endanger criidren in the area;
3. Traffic & parking problems would be minimized by limited class size;
4. Ward Councillor Mark Blair spoke in opposition to the petition citing
potential traffic problems. There was no other opposition;
5. On person spoke in favor of the petition.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the Ordinance would work a substantial
hardship on the petitioner;

v. The relief requested can be granted Without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, to grant the relief
requested, subject to the following terms and conditions:
1 . Petitioner will use the first floor only for one on one teaching;
2. The Fire Department's requirements for mixed use ( residential/commercial)
fire alarm systems must be met;
3. A traffic warning sign must be placed at the driveway exit;
4 . Hours of operation are 9:00 a.m.-9:00 p.m. , Monday through Saturday;
5. At least four parking spaces constructed in accordance with the
Salem Zoning Ordinance must be maintained.

Dear Bill:
Residents of Ward Seven have brought to my attention a two-family
home with a large business sign attached to it. The property is
located at 75 Loring Avenue.
To my knowledge, there is no permit for this sign, and it is
not allowable under the City of Salem' s current ordinance. I would
appreciate your department taking the necessary steps in having this
sign removed.

Dear Mr. Evangelista:
Due to a complaint received by this department, I inspected the exterior of your above
mentioned property.
The fence is falling over onto your neighbors property. Also the rear steps need to be
repaired or replaced.
State Building Code 780 CMR Section 120 requires the owner of a property to maintain
all systems in proper working order.
Therefore, you are directed to secure a building permit for the rear stairs and to repair or
replace the fence within 30 days upon receipt of this letter.
Failure to comply will result in municipal code tickets being written and a complaint
being filed in Salem District Court.
