Once again, this Department has received and confirmed a complaint that you are again
operating a scrap metal and junk business from your property and it appears on the Public way
adjacent to your property. Once again, you are in violation of City of Salem Zoning Ordinance
section 3 ,(allowed uses) and City of Sale ordinance 38-7-obstructions in the Public Way. Again,
you are directed to cease operating the junk business and to remove any and all materials from
the Public Way. Failure to address this matter within ten days will result in additional tickets and
further enforcement actions.

Dear Mr.Manon,
The Building Department has been made aware that an unregistered vehicle is stored
on your property at the address cited above. This is a violation of City Ordinance.
Sec. 24-21. -Keeping of unregistered, abandoned or discarded motor vehicles, trailers or boats.
(a)No person shall park, store, keep, or leave or allow that there be parked, stored, kept, or left any unregistered
motor vehicle, trailer or boat of any kind within the city for a period of more than 15 days.If such vehicle, trailer
or boat which has been abandoned or discarded, and the vehicle, trailer or boat has been posted and recorded as
being on the property for at least 15 days, the owner of the vehicle, trailer or boat or the owner of the property
shall be ordered in writing by the authority having jurisdiction, namely the building,police and fire departments,
to immediately remove such vehicle, trailer or boat from the property, unless any one of the following conditions
has been fulfilled:
(])Such vehicle, trailer or boat is registered in the commonwealth or in any other state and also has
displayed thereon a valid windshield inspection sticker, so called, as required by M G.L.A. c. 90, § 7A for
vehicles, and M G.L.A. c. 90B for boats or by the laws of the state registration.
(2)Such vehicle, trailer or boat is contained in an enclosed building or otherwise out of the view of the
public or of abutters.
(3)A license has been granted under M G.L.A. c. 140 in connection with the motor vehicle business or
junk business.

(b)Any person wishing to park, store, keep, or leave one such vehicle, trailer, or boat in excess of 15 days must
first apply for and obtain written approval from the chief ofpolice and fire chief or their authorized designees.
Such approval shall not exceed one calendar year(365 days); however, upon reapplication, the chief of police
or the fire chief or his authorized designee may reissue such approval for an additional calendar year.
(c)Any person aggrieved by a denial of the chief of police or the fire chief for approval to store such a vehicle,
trailer or boat in excess of 15 days or any person wishing to store two or more such vehicles, trailers or boats for
any length of time may seek approval from the city council by filing a written request in the office of the city clerk.
If the city council renders a denial to the request, it shall order the authority having jurisdiction,police,fire or
building department, to have the vehicle, trailer, boat removed from the property.
(d)Any person violating this section shall be punished by a fine of$50.00. Each day the violation continues after a
conviction shall constitute a separate offense.
(Code 1973, § 16-24; Ord. of 9-22-11(1))
You are required to legally register the vehicle—or to have it removed from the property- by May
15, 2015. Alternatively, you make seek relief through one of the remedies described in the
ordinance above.
Failure to resolve the issues cited above will be construed as non-compliance and may
result in the issue of municipal tickets and fines as well as further enforcement
actions.

The current exemption of "homeowners" was extended to include owner-occupied
dwellings of six units or less and to allow such homeowners to engage an in-
dividual for hire who does not possess a license, provided that the owner
acts as supervisor. (State Building Code Section 109.1 .1
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to re-
side, on which there is, or is intended to be, a one to six family dwelling,
attached or detached structures accessory to such use and/or farm structures.
A person who constructs more than one home in a two-year period shall not be
considered a homeowner. Such "homeowner" shall submit to the Building Official ,
on a form acceptable to the Building Official , that he/she shall be res onsible
for all such work performed under the building permit. Section 100M
The undersigned "homeowner" assumes responsibility for compliance with the State
Building code and other applicable codes, by-laws, rules and regulations.
The undersigned "homeowner" certifies that he/she understands the City of Salem
Building Department minimum inspection procedures and requirements and that
he/she willcomply with said procedures and requirements.

HOME OWNER'S EXEMPTION
The Code states that: "Any Home Owner performing work for which a building
permit is required shall be exempt from the provisions of this section
(Section 109.1 .1 - Licensing of Construction Supervisors) ; provided that is
a Home Owner engages a person(s) for hire to do such work, that such Home
Owner shall act as supervisor."
Many Home Owners who use this exemption are unaware that they are assuming
the responsibilities of a supervisor (see Appendix Q, Rules and Regulations
for Licensing Construction Supervisors, Section 2.15) . This lack of aware-
ness often results in serious problems, particularly when the Home Owner
hires unlicensed persons. In this case your Board cannot proceed against
the unlicensed person as it would with licensed Supervisor. The Home Owner
acting as supervisor is ultimately responsible.
To ensure that the Home Owner is fully aware of his/her responsibilities,
many communities require, as part of the permit application, that the Home
Owner certify that he/she understands the responsibilities of a supervisor.
On the last page of this issue is a form currently used by several towns.
You may care to amend and adopt such a form/certification for use in your
community.

In compliance with the provision of Section 113.5 of the Massachusetts
State Building Code, and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief, the applicant for a building permit

Exception: Plans will not be required for structural work when the
proposed work to be performed under the building permit will
not, in the opinion of the Building Inspector, require a
plan to show the nature and character of the work to be
performed.
Notice: Plans are normally required for fire suppression systems,
fire alarm systems, tank installations, and Fire Code
requirements.
Under the provisions of Article 22 of the Massachusetts State Building
Code, certain proposed projects may not require submission of plans or
complete compliance with new construction requirements. In these
cases, provisions of Article 22, Appendix T, and Tables applicable
shall apply. This section shall not, however, supersede the
provisions outlined in the Salem Fire Prevention Regulations, Chapter
148, MGL, or 527 Code of Massachusetts Regulations. All permits for
fire code use and/or occupancy shall apply for the entire structure;
fire alarm and/or smoke detector installation shall apply to the
entire structure based upon current requirements as per Laws and/or
Codes, but the existing structure may comply with regulations
applicable for existing structures.
Notice: Sub-contractors may also be required to file individual
applications for a Fire Department Certificate of Approval
for the area of their work. Such sub-contractors shall file
an Application to Install with the Fire prevention Bureau
prior to commencing any work for those areas applicable.
