Dear Councillor Hayes :
First let me address your trying to reach me on July
29th and July 30th. I returned your call on July 29th and
left a message on your telephone answering machine ,
suggesting that you call on the 30th between 8 : 00 a.m. and
10 : 00 a.m. when I would be in the office . I also returned
your call on the 30th and left a message on your answering
machine once again. Let me remind you that you are the
one that did not want me to call you at your business
number but suggested I called your home after 5 : 00 p .m.
during a phone conversation, which I informed you that my
working hours ended at 4 : 00 p .m. and our business would
have to be conducted during my working hours, that I did
not want to be bothered at home, unless it was a case of
an emergency. Secondly, I answer all my telephone calls ,
my staff can vouch for that .
When you finally contacted me on July 31 , 1997 I
informed you of what the situation at 13 Locust Street was
as well as informed you that part of the fence located at
13 Locust Street was definitely located on City of Salem
paper street . To my knowledge there is no right of way at
Locust Street as I informed you earlier that there is an
extension of what we consider a paper street all the way
to mean low tide .
#1 . Please review the enclosed document recorded by the
City of Salem Assessor ' s office which describes the area
in question.
#2 . There is no right of way to my knowledge .
#3 . I will contact the Pliner ' s whom reside at 13 Locust
Street to remove the fence from the property it
encroaches .
#4 . As for having the land surveyed, I believe this could
be accomplished through the City of Salem Engineering
Department , but do not feel it is necessary.
#5 . My assessment of maintaining the trees and overgrowth
at this location would be a waste of tax payers money.
Also enclosed is a copy of a letter sent to 13 Locust
Street on July 11 , 1997 and if you kook closely, you will
acknowledge that you were copied on said letter.
I will send another letter to the Plinef-s telling
them to remove the fence and any other structure that is
situated on the paper street .
I am also contacting John Keenan for a legal opinion
on what legal rights are on a paper street concerning the
City of Salem and the abutters.
If this office can be of further assistance in this
or any other matter concerning the City, please do not
hesitate to call .

I tried to reach you at your :;ffice several times on July 29 and Jul
30, to discuss the new fence erected at the above address . You were not
in the office for several of my phone calls . I finally contacted you on
July 31, and you failed to provide me with any definitive knowledge
relative to the location of the fence and the right of way.
On July 31, I had to meet with several constituents in the Locust
Street area without any input from your office. As a result of that
meeting, I am requesting that you do the following:
1 . Provide me with a copy of a recorded instrument
showing the accurate layout of Locust Street,
including the exact locations of the right of
way.
2 . All documentation establishing the right of way.
3 . A land survey showing the exact amount of
encroachment by the Pliners ' fence on the
right of way.
4 . If it is established by survey that the Pliners '
fence is on public property, please outline,
with dates, how you will enforce the removal of
the fence.
5 . Your assessment of the need to thin or cut trees
on the right of way, and your schedule for
accomplishing same, if needed.
I will expect your response by August 11 , 1997 .

in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fol-
lowing conditions modify or differ from the plans,-specifications or other proposals submitted with the Notice
of Intent, the conditions shall control.
General Conditions
-1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee gr any other person of the necessity of complying with all
other applicable federal,state or local statutes,ordinances, by4aws or regulations.

4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply-
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in the Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
5. Any fill used in connection with this project shall be clean fill, containing no trash, refuse,rubbish or de
bris, including but not limited to lumber, bricks, plaster,wire, lath, paper, cardboard, pipe, tires,ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No.work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been flied, until all proceedings before the Department have been completed.

Dear Bob:
I met with Councilor Hayes last week to explain the situation on the above
captioned matter—essentially that Locust Street ended approximately 3-4 feet after
pavement, but still well before beginning of fence.
Councilor Hayes would still like to have the end of the street marked so that she
can explain the situation to the other complaining neighbors. Could you please mark the
end of the street and let me know when you do so that I may inform Councilor Hayes.
Some sort of identifiable stake or other apparatus will do. I have also returned the
engineer's map for your convenience.

Dear Inspector Tremblay:
Pursuant to your request and that of Ward Six Councilor Sally Hayes, I have
reviewed the above captioned matter regarding whether the fence is encroaching on city
property, specifically Locust Street. This is also in response to your correspondence of
July 11, 1997 to Mr. & Mrs. Pliner.
I have determined that the fence in question is not located on City owned property
as the land taken for the purpose of laying out Locust Street ends well before the fence in
question. Specifically, the Salem City Council, on November 14, 1963, took the
property necessary to lay out Locust Street—479.35 feet from Larch Avenue as shown on
the Plan of Edwin Brudzynski, Registered Engineer. Furthermore,Edward S. Pliner and
Pamela B. Burns, the present owners of 13 Locust Street, purchased all right, title and
interest to the land between the end of Locust Street (westerly bound) and the low tide
mark of the Danvers River (easterly bound). (See Southern Essex Registry of Deeds,
Book 13683, Page 15). I requested that Robert Gates, Senior Engineering Aide, to
review the situation. He informed me that the fence is not on the land taken for Locust
Street.
Although, there appears to be an issue regarding "reasonable use" of the
passageway to the Danvers River from the end of Locust Street, it does not concern City
property. Thus, it is inappropriate and unnecessary for me to render my opinion
regarding that concern. That issue is more appropriately addressed among the neighbors
and/or their respective legal representatives.

Dear Mr. Tremblay:
I tried to reach you at your zffice several times on July 29 and Jul
30, to discuss the new fence erected at the above address . You were not
in the office for several of my phone calls . I finally contacted you on
July 31, and you failed to provide me with any definitive knowledge
relative to the location of the fence and the right of way.
On July 31, I had to meet with several constituents in the Locust
Street area without any input from your office. As a result of that
meeting, I am requesting that you do the following:
1 . Provide me with a copy of a recorded instrument
showing the accurate layout of Locust Street,
including the exact locations of the right of
way.
2 . All documentation establishing the right of way.
3 . A land survey showing the exact amount of
encroachment by the Pliners ' fence on the
right of way.
4 . If it is established by survey that the Pliners '
fence is on public property, please outline,
with dates, how you will enforce the removal of
the fence.
5 . Your assessment of the need to thin or cut trees
on the right of way, and your schedule for
accomplishing same, if needed.
I will expect your response by August 11 , 1997 .
