SRA Decision At its meeting on July 9, 2014, the SRA voted 5-0 to approve a June 25, 2014 DRB recommendation to approve revisions to the back seating area at 87 Washington Street (Opus) as presented in plans dated 7/1/14, conditional upon the following: • The front outdoor seating area and A-Frame sign must be reviewed and approved by the Design Review Board Update from July 23, 2014 DRB meeting: At its meeting on July 23, 2014 the DRB voted 5-0 to approve the proposed front outdoor seating area and A-Frame sign at 87 Washington Street (Opus), conditional upon the following: • The chain shown on the far left side of the plan must not exceed 5'8" Recommendation At its meeting on June 25, 2014 the DRB voted 5-0 to recommend approval of the proposed revisions to front and back outdoor seating areas at 87 Washington Street (Opus) on the condition that slimmer backless teak benches be used in the front. The DRB also voted to recommend an a-frame portable sign at this location conditional upon it being 6 sq/ft. or less and with a base that has legs, as opposed to the block base originally presented. Staff Comment The applicant has agreed to all of the conditions noted above and the revisions are reflected in the enclosed materials. Proposal for June 25 DRB Meeting The applicant proposes a new outdoor seating area plan — note that the applicant previously received approval to operate outdoor seating areas in the front and back of its location. The applicant proposes to no longer use the front as an outdoor seating area, but rather to have three teak benches placed along the front of the restaurant. The drawing on A1.2 shows this. e Salem ® Redevelopment Authority Whereas the original outdoor seating plan for the back of the restaurant had a 31 seat capacity, the new plan calls for seating for 38 people. Tables will be arranged differently than before and there will be a center lounge area with teak furniture. Drawing A1.1 shows this plan and A1.3 shows the furniture. More than adequate clearance along the sidewalk (6 ft.) is proposed. The applicant also proposes an A-Frame sign. Style and sample poster graphics have been provided with the materials. Complies? X - must have$1,000,000 liability insurance including naming the City and the SRA N/A - if a shared entrance, must share sign with other business(es) Staff Comment The proposed A-Frame sign is NOT compliant with the City's Sign Ordinance as it is larger than 6 sq/ft. That being the case, we cannot recommend approval of this particular sign. The applicant has been notified of this and is in the process of seeking an alternative to present to the Board. This Permit process is designed to ensure that Salem's unique architectural and cultural features are protected as outdoor cafes develop and to provide a consistent set of conditions for all outdoor cafes. All tables and chairs, as well as the surrounding area, must be maintained in a clean and safe manner. 2. Restaurants must provide to the SRA proof of liability insurance which covers the outside seating areas. 3. The design of all outdoor tables and chairs, and trash receptacles, must be reviewed by the Design Review Board and approved by the SRA. 5. Seating areas must be of a size large enough to accommodate safe, easy and uninterrupted pedestrian travel, as well as access to and from tables. Since the size of tables and seating areas may vary, the SRA reserves the right to determine whether or not adequate space exists for the creation of an outdoor cafe. 6. All tables and chairs must be safely secured in a vandal proof manner or must be brought inside every night. The storage or security system must be approved by the SRA. 7. All outdoor cafe permits will be issued to restaurants for a one-season trial period. During this time period restaurants will be closely monitored by all appropriate City departments and agencies to ensure that they comply with the provisions of this policy. Following completion of a satisfactory outdoor season, the SRA shall issue an outdoor cafe permit to the restaurant annually. 8. Outdoor cafe permits may be revoked by the SRA for non-compliance with the provisions of this policy, at any time. Signed and sealed this // '` day of -)''IV 2010 13. r S ern Redevelop petitioner h L , eSalem D p Redevelopment p �0 ® Authority �C Design Review Board Final Review August 28, 2013 87 Washington Street (Opus Restaurant): Continuation of discussion of proposed outdoor cafe (front seating area only) DRB Final Review—August 28, 2013 At their meeting on August 28, 2013, the DRB voted to approve and affirm the August 14, 2013 SRA decision to approve front outdoor seating at 87 Washington Street; Opus Restaurant— as presented on the plan entitled "Proposed Site Plan A-2.1." The applicant was informed that they would not be able to commence FRONT outdoor seating and service until an alteration of premises is first approved by the Salem Licensing Board, and then by the ABCC. Proposal The applicant is in the process of reproducing final plans for their proposed front outdoor seating area, so they will be provided to you at the meeting. Per the recommendation of the DRB from the July 24, 2013 meeting, the applicant has revised the plan to eliminate one table (far right when facing the building) and replace it with a heater. The clearance within the chained area for waitstaff and patrons will be 3'8". The clearance on the sidewalk will be no less than 4' at any point. The tables will be 30" cafe rounds, mesh top, with black powder coat finish. Staff Comment As noted in the below decision, the SRA approved the rear seating plan as recommended by the DRB at the July 24, 2013 meeting. The SRA also voted to approve the front seating area that is being proposed to you today, conditional upon your final approval and/or added conditions. SRA Decision —August 14, 2013 At their meeting on August 14, 2013, the SRA voted to approve the July 24, 2013 DRB recommendation for a REAR outdoor seating plan and cafe permit at 87 Washington Street. The SRA then voted to approve the applicant's proposed FRONT outdoor seating plan and cafe permit on the condition that the DRB approves the plan presented at the August 14, 2013 SRA meeting. w eSalem ® Redevelopment Authority DRB Recommendation from July 24, 2013 At their meeting on July 24, 2013, the DRB voted to recommend approval of the proposed BACK outdoor seating area without further comment. The DRB voted to continue the issue of the FRONT seating area due to concerns about not having adequate clearance for pedestrians and not providing what they considered to be a comfortable amount of room within the seating area. Staff Comment from August 14, 2013 SRA Meeting The applicant verbally presented a proposal at the July 24 DRB meeting to extend the wood enclosure for recycling and waste bins, further to where the "blue line" on the plan appears in front of it (the enclosure is located at the lower right-hand corner of the back seating area). The DRB approved this proposal; however, this change is not reflected on the revised plan. The applicant revised the plan for the front seating area to respond to the concerns and critique from the DRB. If it is satisfied with this plan, the SRA may vote to approve it on the condition that the DRB perform one final review. Please note that the clearances denoted on the revised plan meet accessibility requirements, for clear passage. The DRB voted to continue the issue of the FRONT seating area due to concerns about not having adequate clearance for pedestrians and not providing what they considered to be a comfortable amount of room within the seating area. Staff Comment The applicant verbally presented a proposal at the July 24 DRB meeting to extend the wood enclosure for recycling and waste bins, further to where the "blue line" on the plan appears in front of it (the enclosure is located at the lower right-hand corner of the back seating area). The DRB approved this proposal; however, this change is not reflected on the revised plan. The applicant revised the plan for the front seating area to respond to the concerns and critique from the DRB. If it is satisfied with this plan, the SRA may vote to approve it on the condition that the DRB perform one final review. This Permit process is designed to ensure that Salem's unique architectural and cultural features are protected as outdoor cafes develop and to provide a consistent set of conditions for all outdoor cafes. The existing metal bulkhead doors will be removed and replaced with a metal platform over the existing bulkhead footprint. The platform will allow for make-up air vents to be installed in the sidewalls to supply the basement with fresh, tempered air (currently under SRA review). 5. Install blue LED string lights (Christmas lights) in the alley, as per the drawings, at roughly 12'-6" above grade to provide a safe and welcome walkway to Salem Green. The lights shall be installed on a dimmer to control the brightness. A surface mounted junction box and conduit shall be installed as per drawings. The junction box and conduit shall be painted to blend with the brick(currently under SRA review). 6. Install an outdoor Variant Refrigerant Flow heat pump system on the roof to supply the ductless A/C units in the basement(currently under SRA review).
