A boxwood hedge is proposed along three sides of the dining area and a series of planters is proposed for the fourth side along the sidewalk in front of the restaurant. Staff Comment The proposal would result in the removal of three trees—two crab apples and one red oak. The City Tree Warden is holding a public hearing regarding the proposed tree removal on July 8, 2009 at 6:00 pm. This conflicts with the SRA meeting; however, the applicant's architect will be available for the SRA meeting. Past SRA/DRB Actions The SRA reviewed the proposal on May 13, 2009, and granted conceptual approval. The DRB reviewed the proposal on May 27, 2009, and recommended approval with the following conditions: - The width of the boxwood planting bed shall be increased by at least 24" along the New Derby Street and Washington Street sides of the patio; - The "northern" entrance for Passage to India shall be widened; - The concrete finish shall be designed to distinguish the patio from the sidewalk area; and .'.rl Salem Redevelopment Authority - Two DRB members shall review and recommend approval of the revised proposal prior to the SRA meeting, or the application will be continued to the next DRB meeting. On July 22, 2009, the Salem Redevelopment Authority(SRA) voted to approve the outdoor dining area. The SRA believes the outdoor dining area will be an attractive amenity that will activate the streetscape and enhance downtown's vibrancy. Joey Arcari, Tavem's owner, has demonstrated himself to be an experienced and successful restaurant operator. We are confident in his ability to successfully operate the outdoor dining area. In the unlikely event that issues arise, Mr. Arcari understands that the SRA permit for the outdoor dining area will be revoked. There has been much discussion of:his proposal and for the Licensing Board's benefit, I am writing to provide a summary of the review and approval process to date. It is interesting to note that the idea of an outdoor patio at this location can be traced back to the Salem Planning Board's review of the developer RCG's site plan application in December 2007 and January 2008. During the review, a Planning Board member suggested the open space on the comer could be used in a better way such as an outdoor caf6. As a condition of the site plan review approval, RCG agreed to assist the City in developing a new design for the green space. RCG prepared a conceptual plan for the entire green space; however, at the time, there was no tenant for the development's commercial space, and the City did not have funding to advance the plan. After Tavern in the Square had decided to lease the ground Floor of the development, Mr. Arcari submitted an application for an outdoor caf6 permit to the SRA. The initial design incorporated the entire green space and included a 9' planting bed between the sidewalk and the patio area. All of the trees were preserved in this plan. The SRA reviewed the initial proposal on May 13, 2009, and granted conceptual approval. The SRA then referred the applicant to the Design Review Board (DRB) for further review of the design. v The DRB reviewed the design at its May 27 and June 24, 2009 meetings. While the initial design preserved all of the trees, there was concern that the construction would damage the root systems of some of them. In addition to concerns about the root systems, DRB members expressed concern about how the patio space would work from an urban design perspective when it wasn't being utilized because it was separated from the sidewalk by the 9' planting bed. As a result of these and other considerations, the applicant modified the design and reduced the size of the patio area—limiting it to the area currently proposed. The revised proposal required the elimination of three trees—two crab apples and one red oak. Noting that the Tree Warden has jurisdiction over the removal of any trees, the DRB recommended approval of the revised design to the SRA on June 24, 2009. The SRA considered final approval on July 8, 2009. The SRA decided to delay any action until a special meeting on July 22 in order to provide time for the Tree Warden's decision to be made and to provide additional time for City Councillors to comment. On July 20, 2009, the Tree Warden issued a decision allowing the trees to be removed at the applicant's expense. (One of the crab apples was found to present a hazard because of its poor condition and needed to be removed regardless.) The Tree Warden required the applicant to plant seven new red maple trees downtown. At the special SRA meeting on July 22, 2009, the applicant presented a revised plan that included stanchions. The stanchions were included to address concerns expressed by a City Councillor about pedestrian flow possibly conflicting with table service. The stanchions would be used when the patio is open for table service. During those hours, pedestrian flow would follow the sidewalk to the corner—where the granite circle is. As discussed during the SRA meeting, it is at that comer where the crosswalks are located. At the July 22 meeting, members of the public raised concerns about parking in the area. As you know, parking is a concern for many downtown. From parking garages being full during snow emergencies to meter feeding, people have strong feelings about parking. In order to improve the current parking system and plan for future development, the City and the SRA are conducting a comprehensive parking study of downtown. It is important to note that City ordinances do not require commercial businesses downtown to provide parking because of the supply of on-street and off street parking downtown (more than 2,200 publicly owned spaces and 1,300 privately owned spaces). As is true with all outdoor cafe permits within the Urban Renewal Areas, the SRA will not issue the permit until the Licensing Board gives its approval, the Health Department confirms that there are no outstanding issues, and the applicant provides a certificate of liability insurance that indicates the outdoor seating area is included in the coverage. 2 The SRA believes the outdoor patio area will be a fine addition to downtown, and I encourage you to approve Tavem in the Square's application. During the hours of operation, the restaurant will have exclusive use of the sidewalk area immediately contiguous to the outdoor dining area and the building. DIRECTOR PUBLIC SERVICES PUBLIC SHADE TREE REMOVAL HEARING DECISION OF THE TREE WARDEN On July 8, 2009, a hearing in accordance with Chapter 87 of Massachusetts General Law was held for the purpose of discussing the removal of three trees, one 8" caliper Crab Apple (multiple cavities presenting sever hazard to pedestrians; included in the hearing, but not required; must be removed), a 5"caliper Crab Apple and a 7"caliper Red Oak, adjacent to the Tavern on the Square Restaurant on the comer of Washington and New Derby Streets. Richard Rennard,Tree Warden and Ron Malionek, General Forman of Public Services conducted the hearing. Tavern on the Square representatives requested removal of the trees to make way for out door seating and presented a drawing showing the proposed seating area. The proponent-business owner stated that the trees,primarily due to root loss,would not survive due to the nature of the excavation proposed. The proposed seating area,they stated,would enhance the now dark and under-maintained corner, eliminate vagrancy in the area and provide an economic boost to the downtown. The City's Design Review Board (DRB),including landscape architect Michael Blier, concurred with this perspective and commentary at the hearing was provided by DRB member architect Paul Durand in support of the proposed outdoor seating plan. Local resident John Hayes and City Councilor Steven Pinto spoke against the removal of the trees due to the loss of open space. As Tree Warden,I take seriously my responsibility to preserve and protect the City's public shade trees, but at the same time I must balance the practical and economic development needs of our community,with the goal of striking a positive balance that supports both view points. Therefore, in the event that the proponent moves forward with the proposed plan to construct the outdoor seating, the one decayed tree and two live trees shall be removed at his expense and seven(7)new 2.5-3"caliper Columnar Red Maple trees must be planted by the proponent at locations marked by the Tree Warden. The replacement trees must be planted between September 1 and October 15, 2009. These trees shall be planted at the proponent's expense at locations adjacent or in close proximity to the location where said trees were removed. The design intent is to create a patio, which acts as sidewalk cafe for the "Tavern in the Square' restaurant. We are proposing extending the existing sidewalk grade into the town owned green space adjacent to New Derby Street creating a patio level with the existing sidewalk. The patio will be bordered by a T-0" planting bed (with larger areas at the New Derby Street side) the boxwood hedge will delineate the patio on three sides with the side adjacent to the restaurant to be demised by a row of movable planters.The paving material is proposed to be exposed aggregate concrete,which will further define the patio area from the public sidewalk. The patio drainage will be handled with new catch basins located at each corner piped into a new dry well system. The existing grade dictates that at the corner of the site the grade needs to be manage by a small retaining curb, which is assumed to be pre-cast concrete. The patio furniture is seen as cast aluminum with canvas awnings and hard piped gas heaters to extended the patio season into early Fall. Please feel free to call me with any questions or comments. SRA Minutes April 12, 2000 Page 4 of 6 Simsbury Develonment—Project& Elevation Annrovals Attorney Jacob Segal and Al Crepeau project architect, appeared before the SRA seeking approvals for this assisted living project and its elevations. Attorney Segal addressed the Board asking for their approval to demolish the Salem Evening News building (the smaller SEN building will remain)to develop an assisted living facility with a retail component on the ground level. He continued that this is one of the last approvals in a long series of approvals needed for development. A request to release the fagade easement on this building is scheduled to be heard at the April 26`s City Council meeting. The Planning Board has also given its approval for this project through its Site Plan Review process. At this time, Mr. Al Crepeau reviewed the elevations of the new structure with the Board. He pointed out that recommendations made at previous DRB meetings have been incorporated into these elevations, including a building marker at the corner tower and bringing in the roof portion of the tower so that this portion of the building looks higher. He also stated that he researched the recommendation to use soldier courses around the window openings, however he felt that this is not typical in a federal period building. He continued that the balcony design and material have been redrawn, along with the upper story, soffit lighting has been added to the upper story and a signage and lighting system for the first level has been changed to reflect the DRB's recommendations. Mr. Crepeau explained that he had studied the odd bay window configuration suggested by the DRB and after several drafts, he determined that the current window system should remain. Mr. Crepeau submitted a lease provision that will be part of the lease agreements regarding balcony usage to ensure exterior uniformity. At this time, Ms. Dubinsky pointed out that the landscaping details on Front Street have not been approved, and configurations could be altered if changes are implemented around the Marketplace area, as per a condition in the Planning Board Decision to redesign the Marketplace to try to add more parking in the area. In addition, Ms. Dubinsky noted that all materials, finishes, colors, and hardware specifications must be submitted to the DRB for final approval. Ms. Vinson commented that the balconies being proposed for this building are not typical in a federal style building. Mr. Baldini made a motion to allow for the demolition of the Salem Evening News building for the Simsbury assisted living project with its retail component on the ground level. He further motioned that the elevation plans shown this evening be approved with the understanding that the landscaping and building details be reviewed and approved by the Design Review Board. The underground engineering affects the placement of the structure, which is slated to have an underground parking garage serving a minimum of 40 cars. 3. Because the site is at the center of the downtown business district, it must meet the standards for review set by the Salem Redevelopment Authority (SRA). Residential developments are favored uses in the downtown under the City of Salem 's Master Plan because of the revitalizing effect they have on downtown biusinesses. 4. Although the Zoning Ordinance is silent as to whether the proposed use is a permitted use in the B-5 district, the enumerated uses in the district are analogous ones. Both nursing homes and multi-family dwelling are allowed uses, and the proposed assisted living facility is not dissimilar in its function to those, although it is not entirely the same as either one. 5. Vann Ness Development presented architectural renderings and a verbal summary of the main features of the planned building by the architect who was responsible for the plan. Mike Abend of Abend Associates presented the results of a traffic study reflecting few additional trips to the site resulting from the proposal, The estimated number of employees and visitors to the center each shift was charter, and estimates for the number of cars expected to be parking in the facility's garage were presented. 6. The specific variances requested, in addition to the use variance, were as follows: (a) Side yard setback of no feet (o'); (b) maximum lot coverage greater than 50%; (c) minimum lot area per dwelling unit less than 500s.f. and (d) on site parking of no less than 40 vehicles, to be located in an undergound level of the proposed structure. Petitioner proposes to acquire and demolish the building at 133-189 Washington Street in order to erect a new 6 story edifice to house assisted living for elderly residents. 2. Petitioner's proposed building will contain 80 units on upper floors, an underground parking garage with spaces for 39 vehicles, and approximately 15,000 square feet of retail space on the ground level . A circular drive will provide access to the complex from Front Street. 3. Variances are required due to the lack of mandated lot area per dwelling unit, lot coverage in excess of 50% absence of side yard requirements and lack of adequate off street parking. Use variances would allow combined housing and retail use of site that had previously been dedicated to commercial use as an editorial and distribution office for a daily newspaper. A parking variance is needed because the number of residential units greatly exceeds the available parking on the site. 4 . In support of the proposed variances, petitioner states that its plan offers to create housing for elderly residents in a central location that includes services and amenities appropriate to their needs. Existing buildings which were built before the Zoning Ordinance was enacted, also exceed lot coverage and side yard requirements . 5 . Parking requirements were based on a projected number of workers and visitors on site during peak time periods of the day. These estimated numbers were derived from conditions at other assisted living centers managed by the Simsbury group in Beverly and in West Springfield, Ma. It is projected that the residents of the assisted living home will not own or operate vehicles themselves. 6. In opposition to the proposal , Marlow Tuttle, of Larchmont Street argued that the proposed building was far too massive for the site in downtown Salem. The increased density would be detrimental to the existing residential neighborhood. The increased demand created by an 80 unit mixed use building would exacerbate the need for offstreet parking in an area where parking needs exceed availability. 7. Also speaking in opposition to the proposal were Meg Twohey of the Federal Street Neighborhood Association and Carlos Buretta of the Heritage Plaza Condominium Association, who observed that the parking provisions seemed inadequate for the need created by the complex, and that the height and scale of the proposed building were excessive for this site. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. George Atkins Ronan, Segal, and Harrington 59 Federal Street Salem, MA 01970 RE: Assisted Living Center/Retail Space, 155-189 Washington Street Site Plan Review Special Permit On Thursday October 7, 1999, the Planning Board of the City of Salem opened a Public Hearing regarding the application of Van Ness Development Corporation under Site Plan Review for the demolition of the building located on the site, excluding approximately 9,000 square feet and the construction of a six story retail and assisted living mixed use building. The plan consists of approximately 12,000 square feet of retail space on the fast floor and 73,000 square feet (80 units) of assisted living on the remaining five floors. In addition,the plan shows the parking for 39 vehicles under the building. The Public Hearing was continued to October 21, 1999,November 18, 1999, and December 2, 1999, and closed on December 2, 1999. At a regularly scheduled meeting of the Planning Board held on December 2, 1999,the Board voted by a vote of eight(8) in favor, one (1) opposed,to approve the application as complying with the requirements of Site Plan Review, subject to the following conditions: 1. Conformance with the Plan Work shall conform with the plan entitled, "Site Development Plan for Salem Assisted Living Facility, 155-189 Washington Street, Salem, MA",prepared by MHF Design Consultants, Inc., dated August 5, 1999. In addition,the elevations titled"Landmark at Salem" and dated December 23, 1999. 2. Amendments Any amendments to the site plan shall be reviewed by the City Planner and if deemed Assisted Living Center/Retail Space December 28, 1999-2 necessary by the City Planner, shall be brought to the Planning Board. Any waiver of conditions contained within shall require the approval of the Planning Board. 3. Landscaping a. All landscaping shall be done in accordance with the approved set of plans. b. Trees shall be a minimum of 3 ''/s" caliper. c. Maintenance of landscape vegetation shall be the responsibility of the developer, his successors or assigns. d. After such landscaping is completed, the developer will add further landscaping if such is requested by the Planning Board or the City Planner. 4. Signage a. Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 5. Lighting a. No light shall cast a glare onto adjacent parcels or adjacent rights of way. c. A final lighting plan shall be submitted to the City Planner for review and approval prior to the issuance of a building permit. d. After installation, lighting shall be reviewed by the City Planner, prior to the issuance of a Certificate of Occupancy. 6. Construction Practices All construction shall be carried out in accordance with the following conditions: a. Work shall not be conducted between the hours of 5:00 PM and 8:00 AM the following day on weekdays or at any time on Sundays or Holidays. b. All reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior to commencement of construction of the project. c. Drilling and blasting shall be limited to Monday-Friday between 8:00 AM until 5:00 PM. There shall be no drilling or blasting on Saturdays, Sundays, or holidays. Blasting shall be undertaken in accordance with all local and state regulations. d. All construction vehicles shall be cleaned prior to leaving the site so that they do not leave dirt and/or debris on surrounding roadways as they leave the site. e. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules,regulations and ordinances of the Assisted Living Center/Retail Space December 28, 1999-3 City of Salem. f. All construction vehicles left overnight at the site, must be located completely on the site. g. Street sweeping shall be conducted on surrounding roadways as deemed necessary by the City Planner. 7. Clerk of the Works A Clerk of the Works shall be provided by the City, at the applicant, his successors or assigns' expense, as is deemed necessary by the City Planner. 8. Board of Health All Board of Health requirements as specified in the attached decision dated September 22, 1999, shall be strictly adhered to. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. 10. Building Inspector All work shall comply with the requirements of the Salem Building Inspector. 11. Utilities a. Utility installation shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of a Building Permit. 12. Marketplace Design a. The applicant,his successors, or assigns shall design,engineer, and provide construction specifications for the redesign of the Marketplace. All of this work shall be provided at the total cost of the applicant,his successors or assigns. b. Final redesign plans for the Marketplace shall be approved by the City Planner and the Market and Tourism Commission. The plans for redesign of the Marketplace shall commence within six(6)months of the Assisted Living Center/Retail space's final approval of all required Boards and Commissions. c. The design, engineering, and construction specifications shall be completed within twelve (12) months of the final approval of all necessary Boards, Commissions, and the City Planner for the redesign of the Marketplace. Once the engineering and construction specifications have been completed by the applicant and approved by the City Planner,the applicant's involvement in the re-design of the Marketplace ceases. 13. Salem Redevelopment Authority Approval Following Salem Redevelopment Authority and their Design Review Board approval of the Assisted Living Center/Retail Space December 28, 1999 -4 project, the applicant shall present the final plans approved by the Salem Redevelopment Authority to the Planning Board in a public hearing at their next regularly scheduled meeting. At that time the Board will determine whether the revisions made to the plan require an amendment to the approved site plan. 14. Deliveries No deliveries shall be made to both the retail space, the assisted living center, and the office space during the hours of 7:00 AM to 9:00 AM and 4:00 PM to 6:00 PM. 15. Parking Retail space occupants shall be required to provide its employees with monthly or annual passes to a public parking garage located in the City of Salem. 16. Ingress and Egress Twelve (12)months from the date of the issuance of a Certificate of Occupancy, the entrance and exit patterns shall be reviewed by the City Planner. If it is determined by the City Planner that the entrance and exit patterns are not safe,the applicant, his successors or assigns will be required to provide additional information to the City Planner to correct the problem. Final design of the entrance and exit shall be approved by the City Planner. 17. Change In Use Any change in use from an assisted living center to any other use must be brought before the Planning Board for Site Plan Review Special Permit approval. 18. Maintenance a. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer,his successors or assigns. b. Winter snow in excess of snow storage areas on the site shall be removed off site. c. Maintenance of all landscaping shall be the responsibility of the applicant,his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two-(2)year period. 19. As-built Plans As-built plans, stamped by a Registered Professional Engineer, shall be submitted to the Planning Department and Engineering Department prior to the issuance of the final Certificate of Occupancy. 20. Violations Violations of any condition shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. DRB Recommendation At their meeting on November 19, 2008, the DRB voted to recommend approval of the proposed exterior fagade, signage and lighting at 155-189 Washington Street with the conditions that the proposal be modified to: - Return to the whole brown base scheme as originally proposed; - Use horizontal trim on all of the pilasters; - Locate the blade signs as in the elevations; - Make the blade signs about 6 inches shorter (less wide); - Extend the awnings up to fill the sign band as in the Central Square photos; - Move the gooseneck lighting to the top band, and have fewer lights than shown in the Central Square photos; - Move the Tavern sign slightly down so the silver band aligns with the top of the canopy, and the top of the 'T' marks the middle of the top brown band; - Use brushed aluminum for the horizontal line in the sign (below "Tavern"); - Use the wall sconces originally proposed; - Not include "Salem" in the sign; and - Use urns as shown in the photos and which will be planted year-round.
