SRA Decision At its meeting on June 11, 2014, the SRA voted to approve a May 28,2014 DRB recommendation to approve the proposed folding door windows, outdoor seating area tables, chairs, heaters, fence, and building lights, pending a review to be conducted by Building Department personnel. Pole lights were to be reviewed in further detail at a future meeting. At its meeting on July 9, 2014, the SRA voted to approve the pole lights and the Board was informed that the fence and light installations were compliant with City ordinances. The entire project is approved. DRB Recommendation At its meeting on May 28, 2014, the DRB voted 6-0 to recommend approval of the proposed new windows/sliding doors, wall and post lighting fixtures, gas heaters, chairs, and fence at 155 Washington Street (Adriatic Restaurant and Bar), conditional upon the following with regards to exposed junction boxes and conduits for the new proposed wall lighting: • The current junction boxes will be reduced to a small connector and allow for a "T" connection to be made to connect the lower hanging light fixture —there will not be two junction boxes. • Conduits will be painted to match the wall. Staff Comment The applicant clarified during his presentation to the DRB, that new proposed lighting on the building would replace existing lighting fixtures. Additionally, the applicant will mobile heaters, moveable pole lights, a spotlight over the restaurant's primary sign, and new black chairs. DATE: July 3,2014 At the last SRA meeting on June 11, 2014, the Board voted to approve the applicant's proposal for an outdoor seating area pursuant to the condition that the Building Department review and approve of the implementation of the project. Furthermore, the Board stipulated that the proposed pole lights not be approved until more information was received. Attached for your review are the pole lights in question. There are four that are aligned evenly along the new fence. I have consulted with the Building Department and it is comfortable with how the fence and lights have been installed. The fence allows for more than six feet of clearance to the curb and slightly less than that to the one parking meter that is situated along that particular sidewalk. All fixtures have been drilled into the sidewalk. The applicant has expressed that the planters that were present before this project had remained in place (although they were not drilled into the sidewalk). However, the expense to install such an awning is more than the applicant can afford at this time. Thus, as an interim solution, the applicant is proposing to utilize these umbrellas. Staff Comment for DRB Meeting There are issues with several establishments having umbrellas that weren't reviewed. The fact is umbrellas only last a year or two and then need to be replaced. Some establishments have changed colors from what was in the originally approve plan, some have umbrellas with sponsors. Some SRA decisions are clear on restrictions; others are not. I will not be at the July 27 meeting but would like to take up formal guidelines for outdoor umbrellas at the August or September meeting. Some City staff (and community members) have talked about outdoor areas they've been to where there are trademarked umbrellas and found them to work well. Staff suggestion on this proposal is that there be a recommendation to approve it for this season only given the understanding that the intent is to install a permanent awning. This Permit process is designed to ensure that Salem's unique architectural and cultural features are protected as outdoor cafes develop and to provide a consistent set of conditions for all outdoor cafes. As such, the SRA shall allow outdoor cafe uses within the Urban Renewal District,subject to the following conditions: 1. All tables and chairs, as well as the surrounding area,must be maintained in a clean and safe manner. 2. Restaurants must provide to the SRA proof of liability insurance which covers the outside seating areas, 3. Restaurants must receive approval for outdoor tables from the Salem Licensing Board and the Board of Health. 4. The design of all outdoor tables and chairs,and trash receptacles,must be reviewed by the Design Review Board and approved by the SRA. 5. Seating areas must be of a size large enough to accommodate safe,easy and uninterrupted pedestrian travel,as well as access to and from tables. Since the size of tables and seating areas may vary,the SRA reserves the right to determine whether or not adequate space exists for the creation of an outdoor cafe. G. All tables and chairs must be safely secured in a vandal proof manner or must be brought inside every night.The storage or security system must be approved by the SRA. 7. All outdoor cafe permits will be issued to restaurants for a one-season trial period. During this time period restaurants will be closely monitored by all appropriate City I departments and agencies to ensure that they comply with the provisions of this policy.Following completion of a satisfactory outdoor season, the SRA shall issue an outdoor cafe permit to the restaurant annually. 8.
