Dear Property Owner
This letter is to notify you that the previously cited retaining wall at your property
continues to be unsafe and has partially collapsed and is in imminent danger of total
collapse.
This Department has declared the retaining wall separating your property from
4 Atlantic Street an unsafe structure as defined by the State Building Code 780 CMR
Section 121.
Under Section 121.3 of the State Building Code you are required to begin to make this
structure safe within 24 hours of receipt of this notice.
Failure to address this situation will result in further action by the City of Salem, which
could include this department causing the removal of this unsafe structure, under the
provisions of 780CMR Section 121, followed by an attachment of liens to the appropriate
properties to cause repayment of any incurred expenses.

Dear Sirs;
The recent collapse of the retaining wall between these two properties has been brought to the
attention of this department. Upon inspection of this situation I found a large piece of this structure has
fallen, and most of this structure is in further danger of collapse. According to 780 CMR Section 103 it is
the responsibility of the owner of a structure to maintain the same in good repair. Further, according to 780
CMR Section 121, it is the responsibility of the owner of a structure that has been determined to be unsafe
to take immediate action to make said structure safe.
It is the determination of this office that this is an unsafe structure,and that due to the location,
adjacent to the public sidewalk,has the potential to be a danger to public safety. You are therefore ordered
to make this structure safe,and to begin this work immediately. Within the next 24 hours temporary braces
to prevent further collapse, and some form of barrier and caution tape needs to be installed,so as to protect
and alert the general public from this danger. The actual repair/replacement of this structure will require
proper engineering and permitting, and this should be commenced within the next thirty days.
Failure to address this situation could result in further action by the City of Salem,which could
include this department causing the removal of this unsafe structure,under the provisions of 780CMR
Section 121, followed by an attachment of liens to the appropriate properties to cause repayment of any
incurred expenses.
