As the result of an inspection of the premesis, structure, open land area,
or vehicle owned, occupied, or otherwise under your control , the fol-
lowing recommendations are made and shall serve as a notice of a violation
of the laws, ordinances , or regulations pertaining to the prevention of
fire and the protection of life and property.
On August 7, 1992, I spoke to Mr. Dumas relative to the major problem which existed at
120 Washington St. , namely, the enormous accumulation of rubbish, and discarded build-
ing materials throughout the entire building. At that time I imforned Mr. Dumas via
his car phone to clean up the entire building, and submit plans by a licensed sprinkler
company to sprinkler the entire building. I have not heard or seen anyone since that
conversation.
On the evening of September 8, 1992 after attending a meeting at One Salem Green, I
decided to walk over and view the area around the park at Essex and Washington Sts.
Upon arrival I noted that I was able to enter the building at the end of the unsecured
fence on the Essex St. side. I entered freely without any locks, or warning signs
telling me to stay out.
The "fire load", that is; the maximum heat that would be released if all the combusti-
bles in a given fire area burned, in this structure is at its maximum due to the open-
ings in the building thereby causing maximum, draft and the spread of fire a major hazard
and concern for all the people in the building and also an extreme exposure threat to
all other buildings in the area.
Due to the severity of the hazard I have ordered all work to cease, the Phoenix School
closed, and notified all tenants of the conditions and made it clear'.that their per-
sonal safety is in jeopardy if they remain in the building. The conditions/hazards in
this structure are a direct violation of M.G.L. Chap. 148, S.S, and the Salem Fire Code
Articles 1,3,6, and 35. Copies of these laws are enclosed.

The marshal or the head of a fire department to whom he may
delegate authority, shall make an inspection every three months of
institutions as defined by the state building code, licensed by and under `the supervision of the department of public health, or licensed by the
department of public welfare, and shall make a report of such inspection
to each such department on forms submitted to the marshal by such
department for this purpose. Said marshal or such head of a fire
department shall also make an inspection every three months of the
premises specified in innholder's licenses issued under chapter one
hundred and forty.
SECTION 5. Entry Upon Premises and Removal of Combustible
Materials Regulated; Penalty.
The marshal, the head of the fire department or any person to whom
the marshal or the head of the fire department may delegate his authority
in writing may, and upon complaint of a person having an interest in any
building or premises or property adjacent thereto, shall, at any reasonable
hour, enter into buildings and upon premises, which term for the purposes

broken boxes or barrels or any other refuse or useable materials that is or
may become dangerous as a fire menace or as an obstacle to easy ingress
into or egress from such buildings or premises, they shall, in writing, order

such order shall be served upon the owner, occupant or his authorized
agent by a member of the fire or police department. If said order is not
complied with within twenty-four hours, the person making such order, or
any person designated by him, may enter into such building or upon such
premises and remove such refuse or any useable materials or. abate such
conditions at the expense of such owner or occupant. Any expense so
incurred by or on behalf of the commonwealth or of any city or town,
shall be a lien upon such building or premises, effective upon the filing in
the proper registry of deeds of a claim thereof signed by such person and
setting forth the amount for which the lien is claimed; and the lien shall.

No person shall use or allow to be used, sell or offer for sale any
unvented liquid fired space heater. Whoever violates the provisions of

I have enclosed a chart which is based on asking rents for a triple net lease
over a 5 year period. I have projected utilities based on the costs of my
office which is almost three sides glass and on the electric and gas we use
on an area of 1,050 square feet. The common area fee is also projected
from costs of similar buildings in the area. I have increased the utilities
by 2% per year and the C.A.M. by 5% per year.
The parking is now being quoted at$600.00 per year, per space. The parking
can be figured into the lease, for example 12 spaces at $600.00 = $9,000.00
per year to be added to the base rent.
This exercise is to be used as a guideline to decide between your present
costs and the projected cost at Peabody Block.
You will note that this does not preclude negotiations by you with Lawlor.

1 A. Proposal
1 Hicks Management Group proposes to lease to the City of Salem 27,000 square
feet at 118-128 Washington Street, Salem, Massachusetts, (including hallways)
1 for$12.60 per square foot on a triple net basis.
B. Lease description
1 I. Location: Located at 118-128 Washington Street between Essex Street and Barton
Square.
1 2. Size: 27,000 total square feet: 10,000 SF 2nd Floor, 10,000 SF 3rd Floor, and 7,000 SF
4th Floor(see Floor Plan, Appendix 1).
1 3. Rent: $12.60/SF NNN (tenant pays proportionate share of operating costs). 2 5 0

a) Parking: 43 to 73 Parking Spaces to rear depending on which parking plan
1 is adapted (see Parking Plan Alternatives, Appendix 2).
b) Conference Room: Flexible, modernized conference room with 18-foot
1 ceilings, suitable for public hearings, lectures and conferences, located on
the fourth floor.
1 c) Accessibility: Located in center of city business district and accessible to all
key locations.
1 5. Terms: 25 year lease witeriodic escalations.
1 6. Fit-out: HMG will bring the property to fit-out stage upon purchase of the property
(see List of Renovations to be Performed Prior to Fit-out, Appendix 4). Reasonable
fit-out to be performed by HMG per City of Salem's needs upon City's execution of
' lease.
7. Options:
' a) Rooftop Executive Office/Conference Room: A fifth-floor may be added
with glass enclosed offices, conference room and terrace with ocean view.
1 b) Storage: The basement of the existing Essex St. building may be salvaged
to be used for the City's storage needs.
