DRB RECOMMENDATION: At their meeting on May 23, the DRB approved the alterations to the Fresh Taste of Asia outdoor cafe with the following conditions: • In order to permit adequate space on the diagonal Lappin Park walkway, the configuration of the cafe enclosure will match the attached site plan dated May 23, 2007 • The approval is exclusive of umbrellas and of candles on the tables. • The approval is for a maximum of 28 outside seats. PROPOSAL: The proposal includes replacing the outdoor cafe enclosure consisting of flowerpots, wood posts and a silver chain with black painted wood posts on black painted concrete bases and supporting a black chain. Among the elements not incompliance are the"trellis"treatment on the end of the area by Washington Street and wooden plant holders interspersed along the edge of the dining area. You are required to bring the outdoor dining are into compliance with your approved plans immediately. Failure to do so could result in the revocation of your outdoor cafe permit. If you wish to make changes to the outdoor dining area, you must receive SRA approval. Frandy Xu will provide the following information at this meeting: • Revised outdoor cafe site plan ■ Photographs of stanchions recently installed at 118 Washington Street ■ Photographs of seating recently installed at 118 Washington Street At the June 9, 2006 meeting the SRA approved the proposed Fresh Taste of Asia outdoor cafe with pending a final submission of the caf6 enclosure design. A final fence design was not approved. In the summer of 2006, wood posts mounted in flower pots were installed. In May of 2007 stanchions were installed that consist of wood posts mounted in a concrete base and painted black. The stanchions are connected by a black metal chain. For your reference, the site plan approved by the DRB in March 2006 is attached. Salem ® Redevelopment Authority SALEM REDEVELOPMENT AUTHORITY OUTDOOR CAFE PERMIT Preamble The Salem Redevelopment Authority encourages the development of outdoor cafes within the Heritage Plaza East and Heritage Plaza West Urban Renewal Districts to enhance the visitor and shopper experience in Salem and to assist in improving the economic viability of downtown businesses. This Permit process is designed to ensure that Salem's unique architectural and cultural features are protected as outdoor cafe's develop and to provide a consistent set of conditions for all outdoor cafe's. As such, the SRA shall allow outdoor cafe uses within the Urban Renewal District, subject to the following conditions: 1. All tables and chairs, as well as the surrounding area, must be maintained in a clean and safe manner. 2. Restaurants must provide to the SRA,proof of liability insurance which covers the outside seating areas. 3. Restaurants must receive approval for outdoor tables from the Salem Licensing Board and the Board of Health. 4. The design of all outdoor tables and chairs, and trash receptacles, must be reviewed by the Design Review Board and approved by the SRA. 5. Seating areas must be of a size large enough to accommodate safe, easy and uninterrupted pedestrian travel, as well as access to and from tables. Since the size of tables and seating areas may vary, the SRA reserves the right to determine whether or not adequate space exists for the creation of an outdoor cafe. 6. All tables and chairs must be safely secured in a vandal proof manner or must be brought inside every night. The storage or security system must be approved by the SRA. 7. All outdoor cafe permits will be issued to restaurants for a one-season trial period. During this time period restaurants will be closely monitored by all appropriate City departments and agencies to ensure that they comply with the provisions of this policy. Following completion of a satisfactory outdoor season, the SRA shall issue an outdoor cafe permit to the restaurant annually. 8. Outdoor cafe permits may be revoked by the SRA for non-compliance with the provisions of this policy, at any time. At this meeting, the applicant is requesting final approval of the outdoor cafe. He has received approval from the Licensing Board and Board of Health. In addition, the Design Review Board gave him a positive recommendation pending the submittal of a final design specification for the fence. At this point, he decided to use a chain rather than a fence and he is bringing the specification to the meeting. At the SRA meeting in March, the board requested that I investigate whether the Lappin Park deed prohibits this type of use. In my review of the deed, I did not see any thing that would prohibit this use. However last summer ownership found that the trees in Lapin Park blocked the cafe's Washington St. signage. With our landlords permission (RCG) we are proposing to add the Gulu-Gulu CaWs logo to a reflective window to the right of the Washington Street entrance. The logo is very basic yet eye catching — it consists of the cafe's mascot's face with the name of the company revolving around his head 4 times. This image was created for a T-shirt two years ago and was very popular. The Gulu-Gulu Cafe name is written in an Arial font. The logo will be recreated as a vinyl decal — it will be 6'10" long and 510" tall leaving a six inch border around the decal. The company plans to use similar signage as is used at the current Gulu-Gulu Cafe in Lynn, MA. The signage was created by MassArt student Nick Schillaci and was based on the Gulu-Gulu Cafe logo. The letters were carved in the French Art Nouveau style. The gold color is called February Gold (Wal-Mart# 94213) and the black is a basic latex acrylic enamel with a satin finish. The second sign would be attached over the sidewalk along Essex St. As with the Lynn sign, it would be wrapped in a metal frame and bolted into the brick to the left o=the doorway. The front of the building is 38' in length. The entranceway to the left is for the 2nd floor apartments while the doorway to the right is for the Gulu-Gulu Cafe. The bottom of the signage would start at 8' off the ground and would be attached to the left of the doorway. We plan to install two simple black adjustable swivel Flood Lights to spotlight the sign. The lights are 5 3/4" in diameter and would be installed on the white railing directly above the sign and positioned downward. Gulu-Gulu Cafe Letter of Intent Outdoor Cafe Permit March 1, 2007 To Whom It May Concern: I am writing to ask permission to set up outdoor seating at Gulu-Gulu Cafd's newest location at 118 Washington St, Salem MA. The location of the cafe is directly attached to Lappin Park(where the"Bewitched" statue is located) on the corner of Washington St. and Essex St. The proposed furniture (see below) includes a 28" round folding table and two 15"W x 13"D x 33"H folding chairs. We propose having six tables with two chairs per table. The sidewalk area is 39 feet in length. The walkway is approximately 10 feet deep leaving sufficient room for pedestrian traffic. The folding chairs and tables would be brought inside in the evenings. They would be stored in the basement area when not in use. Approval from the licensing board and the Board of Health will be sought before opening in June 2007. Liability insurance will be purchased to cover the entire seating area. Both our neighbors have and will have outdoor seating. Taste of Asia has had outdoor seating since they opened and it is very popular with the tourists and the regulars. Gulu Gulu Cafd will have outdoor seating when they open. I think outdoor seating for the restaurants at 118 Washington benefits everybody. I propose 4 tables to the left of the front door and 5 to the right. Our contractor has done a great drawing to show you how it would look and the exact measurements. We will secure them every night by stacking the chairs and locking them to the gates which have been set up around the tables. The tables will be all put in the same area and locked as well to the same gate. The gate around the tables will be secured to the ground and loops will be at the bottom of the poles. That is where the tables and chairs will be locked down to. We will have tables and chairs which correspond exactly to the same look the other two establishments will have. This will give the park a nice, neat and professional look. We will not serve alcohol without food to any patrons and have a close watch on our outdoor space. Handicap Ramp Proposed project to move current handicap ramp from inside of premises to outside. Currently,handicap entrance is through a common hallway from which patrons can enter the individual establishments [see attachment 41. Outdoor ramp would allow for easier, safer and direct access to the establishment. Because of the slope of sidewalk, the proposed ramp would be leveled; i.e. it would not have to be constructed at an angle/slope. This allows not only for an easier construction but also assures that the ramp would be visually coherent and not obstructive. Please see attachment 3 for ramp plan/drawings. 2. Sign and awning Proposed project consists of a sign and a wooden awning. The awning would be similar to that at Cafe Polonia's Boston location [see attachment 6] but would only protract 2 feet from the building as opposed to 3 feet at the Boston location. The awning would be wood construction with shingles. The sign would be 3 x 8 feet and would be similar to the one at the current location. The three lights above the sign would remain in tact as to preserve the constancy and visual esthetics of all 4 restaurants in the building facing the park. 3. Outdoor seating Proposed project is to place seating for 12 patrons in an outdoor patio area as shown on attachment 8. Currently, all 3 restaurants in the building offer patio dining facing the park. Cafe Polonia's outdoor patio would enhance the city's image as a dining destination. The park /square would look reminiscent of outdoor cafe culture found in European cities such as Paris or Rome. Currently, all 3 establishments with outdoor patios use similar furnishings. The proposed patio would also be furnished with similar style furnishings as shown on attachments 10 and 11. The only difference would be that the furniture, while very similar in shape and design would be wicker instead of aluminum to allow for added seating comfort. Today,vibrant Polish American communities can be found in Salem as well as neighboring towns. 5. The business will create an estimated 8— 12 full and part time positions.
