OF EMPLOYMENT AND TRAINING ( PETITIONERS ) COPLEY INVESTMENTS ( OWNERS ) FOR A VARIANCE FROM THE SIGN ORDINANCE TO ALLOW ONE SIGN AT THE CORNER OR WASHINGTON & CHURCH STS . AND ANOTHER SIGN AT THE CORNER OF ONE SALEM GREEN & CHURCH ST . ( B-5 ) A hearing on this petition was held May 16, 1990 with the following Board Members present: Richard A. Bencal, Chairman; Joseph Correnti, Edward Luzinski, Richard Febonio and Mary Jane Stirwolt. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40r Petitioner is requesting a Variance from the City of Salem Sign Ordinance to allow two off premise, post mounted signs to be located, one at the corner of Washington and Church Sts. , the second at the corner of One Salem Green. Signs will be located in a B-5 district. The Variance which has been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings and structures in the same district. b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented and after viewing the plans, makes the following findings of fact: 1 . There was no opposition presented. 2. Supportive letters were submtted from Mayor Harrington, Joan Gormalley, the Director of the Chamber of Commerce, as well as a petition in favor signed by local merchants. On the basis of the above findings of fact, and on the evidence_ presented at the hearing, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property but not the district in general. 2. We feel it would be easier for all parties involved , if signs were to be placed at key locations outside the One Salem Green complex in both English and Spanish to direct people to the Department of Employment and Training .
