Commission's (MHQ requirements pertaining to painting the antennas to be installed on

Sprint's special permit was approved with the condition that the antennas be painted to

Dear Mr. Carr:
Staff of the Massachusetts Historical Commission have reviewed the additional information you submitted,received
August 16, 1999, concerning the proposed projects referenced above. The building at 217-221 Essex Street is listed
in the State and National Registers of Historic Places as part of the Downtown Salem National Register Historic
District and the Old Town Hall National Register Historic District. After a review of materials submitted,the MHC
has the following comments.
The MHC understands that the proposed project involves installation of two telecommunications antennae on an
existing chimney and penthouse. The MHC further understands that mechanical equipment will be housed in the
basement and that the skylight will be minimally modified at its sidewall to accommodate the coaxial cables. The
panel antennae will be six feet in height and will project above the roofline 1.5 feet higher than the existing speakers
do.
The MHC asks whether or not it is possible to paint the portion of the panel antennae which project above the line of
the penthouse and chimney a neutral,non-metalic gray. Where the panel antennae are flush against the penthouse
and chimney,the MHC requests whether or not they can be painted to match. ne MHC hopes that this alternative
is feasible, as it will help to reduce the visibility of the antennae.
The MHC looks forward to further consultation.

Dear Ken;
I conducted an Inspection at this Building yesterday with inspector Holloran of
the Salem Fire Department. Work has been done affecting "means of egress corridors"
We have no record of Building permits or inspections. This is a violation of the State
Building Code 780 CMR, Sections 118.1 through 118.4. Further, and of much more
serious a concern is that these changes have impacted the various tenant spaces by
removal of a required means of egress, State Building Code 780 C.M.R section 1010.2.
Per this section, you have created a"Hazardous Means of Egress" ( In any existing
building... in which the exits are deemed hazardous or dangerous to life and limb, the
Building Official shall declare such building dangerous and unsafe in accordance with
780 CMR 121.0.) Further, per 780 CMR 1004.2.2 "Any person served with any order
pursuant to 780 CMR 3400.5 shall have the remedy prescribed in 780 CMR 12 L"This is
a dangerous and hazardous situation that must be immediately remedied; such work must
be Permitted and Commence, by a Licensed and Insured Contractor within 24 hours from
the receipt of this letter. Any delay or further violation will cause this Department to
revoke the Occupancy Certificates for this Building, and Post this Structure as an "Unsafe
Structure"per 780 CMR, Section 121.2.
Further, I am Ordering that the following conditions be met. First, an Architect
must review the structure in the current configuration and check for Code Compliance,
inclusive of Architectural Access Board requirements. Any future changes must also be
reviewed in this manner. Second, Permits for all work including the Cell Tower
installation must be Permitted, performed by a Massachusetts Licensed Construction
Supervisor, and Inspected by this Office. Any concealed areas created by this work must
be removed to facilitate these inspections.

I received your voice mail and left a return message. I am passing through the area anyway on Thursday morning
so I will still swing by City Hall since it is now part of my itinerary for that day. I want to make sure I have the most
recent version of the Heritage West Urban Renewal Plan (including any Amendments and the date such
Amendments were properly approved). The one I have was given to me by someone in the Planning Department
in the spring of 2005 (almost two years ago) when I first started reviewing the Tompkins project.
Also, I understand other old wireless files might be archived or in storage at this point, but if you could at least
have the Sprint file for 217-225 Essex Street set aside and available then I can start with that one file. I am also
interested in Sprint's Planning Board file as well as their SRA file just for that particular site.
In the meantime, if you have already made other plans for Thursday morning, then please just have those two
Sprint files and a copy of the Heritage West Urban Renewal Plan, as amended, set aside for me to review. I do
not have to take up any of your time if you are busy.

SRA Decision
At their meeting on April 9, 2008, the SRA voted to approve the March 26, 2008
DRB recommendation for the proposed signage and exterior lighting at 275-281
Essex Street with the elimination of the fourth bullet point condition regarding the
exterior lighting.
DRB Recommendation
At their meeting on March 26, 2008, the DRB voted to recommend approval of
the proposed signage and exterior lighting at 275-281 Essex Street with the
following conditions:
• The red band shall extend the length of the Crombie Street side of the
store (if possible);
• The green verticals shall be removed;
• The lettering on the Essex Street side shall move toward the corner; and
• The lighting shall be the design presented and not what was installed by
the developer.
Proposal
The base proposal includes two sign boards on the Essex Street fagade and a
vinyl logo and lettering on the Crombie Street fagade. The colors are corporate
colors. Add alternates include the extension of the sign board on Crombie and
lighting.
Base proposal
The revised proposed sign board is 3/4" PVC board with two-color wood grain
digital print, and dimensional sign letters and logo. The sign boards are 20'-7" by
V-1" and 20'-3" by V-1" for a total of 26.18 square feet. The vinyl sign is 2'-6" by
2'-0" for a total of 5 square feet and is less than 20 percent of the window area.
Add/Alternates
Add/alternates to the project are extending the sign board on the Crombie Street
fagade an additional 22'-7" and lighting.
The proposal complies with signage square footage requirements.

As part of the review and approval of the redevelopment of the CIF Tompkins
building, the SRA required that the uses in the three first floor commercial units
be retail and/or restaurant. The developer is requesting approval of a real estate
office that will also display art in the Crombie Street space. The attached letter
describes the proposal.
The Cromble Street space was formerly leased to Body Empowered Wellness, a
fitness studio for women, and has been vacant since that business closed. The
corner space is currently leased to Get in Shape for Women, a different fitness
studio, and had formerly been leased to Cabin Fever, a home furnishing store.
The third commercial space, which fronts on Essex Street, has been envisioned
as a restaurant space although any retail use would be allowed. There has been
interest by restaurants for that space; however, it is my understanding the
challenge to making it feasible has been securing a liquor license.
Given the fact that the proposal is not exclusively an office use and includes an
accessory art gallery, and that the Crombie space is small and not on a
prominent shopping street, staff recommends the SRA waive the use
requirement for this specific proposal in this specific unit. Staff further
recommends that the retail and/or restaurant use requirement remain in place for
all three commercial units. Any non-retail or non-restaurant use proposed for any
of the three commercial spaces would need to be reviewed and approved by the
SRA.

I just wanted to let you know the plans we have for the use of the space
we plan to lease from you at 281 Essex Street.
We run our office a little different than most other real estate offices. We
feel that, as a business, we are connected to the community that surround us,
including the residents and other businesses. One of the ways we do this is to
provide a space for local artists to display their work. The art is hung so that it
can be seen from the street, and we invite the public in to view it during business
hours. We install specialized lighting and mounting systems to display the
artwork property. Though it wasn't possible in our former office because of space
constraints, we will be holding a reception to introduce new artists (approximately
every 2 months), inviting local residents & business people.
The ground floor of the unit will be left open, with the reception area and
artwork display at the front of the office. The back of the office will be use for our
agents' desks. The lower level will be used for my office, a conference room,
storage and utility room.
I have been involved in the revitalization of Salem's downtown ever since I
started working in this community in 2000. 1 have been on the board of Salem
Main Streets pretty much since its inception, so I know and believe in the concept
that to keep a downtown vibrant, then ground floor space should be retail,
restaurants or its equivalent. We fit that description. We are open 7 days a week,
with most days having hours from 9am to 6pm.

The next nulestone for this project is Final Design Approval by the SRA. I am enclosing
information on Final Design submission requirements and a listing of upcoming meeting
dates for the SRA.
The Final Design Plans should incorporate the conditions set forth in the SRA Decision and
discussed further at the SRA and DRB meetings attended by you and your client. In
addition, ,is we talked about at the SRA meeting, the DRB has requested that you rectify die

SPLA DECISION:
At their meeting on March 14, 2007, the SKA voted to approve the DRB
recommendation with the condition that scale of the storefronts be looked at more
closely in the Final Design Plans.
DRB RECOMMENDATION:
At their meeting on February 28, 2007, the DRB recommended approval of the
Schematic Design Plans with the following conditions to be included in the Final
Design Plans:
1. Storefronts should be restored or opened up;
2. Bricks should be reused on the Crombic Street facade,where possible, and
the reconstruction of the brick must match the existing building exactly;
3. ffistorical preservation specification for repointing, must be included;
4. Entry point for the retail unit(s) and egress for the residential units should be
