217 ESSEX STREET ' 2��-Fs�x S'� r � G 0 N O1 v i C O N d S Salem ® Redevelopment SRA Authority AL1 }; Salem Redevelopment Authority Decision December 9, 2015 217 Essex Street: Discussion and vote on proposed revisions to Verizon rooftop wireless antennae installation SRA Decision At its meeting on December 9, 2015, the SRA voted unanimously (3-0) to approve the proposed the installation of wireless antennas on the roof of 217 Essex Street, as recommended by the Design Review Board, and as shown in photo simulations and plans submitted to the SRA dated November 10, 2015. Approval is conditional upon the following: • The faux chimney shall be set back 4 inches from the parapet; • the balustrade shall be designed and constructed in such a way as to match the existing balustrade on the back of the building; and • that the language in the SRA decision from July 9, 2014 regarding installation of gas run-ups shall remain in force: • "...the proposed vertical gas run-up to be installed on the wall of the south facing elevation shall be painted to resemble the building's shade, and will be installed at or as close to the seam If of the two buildings as possible." Recommendation At its meeting on November 17, 2015 the DRB unanimously voted to recommend approval of the proposed rooftop wireless antennae installation subject to the following: • The faux chimney shall be set back 4-6 inches from the parapet, • the balustrade shall be designed and constructed in such a way as to match the existing balustrade on the back of the building, and • that the language in the decision from July 9, 2014 regarding installation of gas run-ups shall remain in force: • "...the proposed vertical gas run-up to be installed on the wall of the south facing elevation shall be painted to resemble the building's shade, and will be installed at or as close to the seam of the two buildings as possible." Proposal Last year, the DRB recommended approval of a wireless antenna installation atop the roof at 217 Essex Street. The installation would expose three to four antennas , I Salem ® Redevelopment Authority and they would be supported by steel braces, conditional upon the antennas being painted warm grey to match the steel braces, and that the braces were lowered as much as possible so as to be as inconspicuous as possible. The recommendation was subsequently approved by the SRA. The applicant is returning to the boards to revise its proposal. The applicant seeks to shelter the antennas in a 12 ft. high faux fiberglass chimney made to look like the same brick used on the building, to be installed at the southwest corner of the roof. Each side would be 5'10" in width. A white balustrade would be constructed at the roofline to screen mechanicals and other roof elements. It would meet the chimney's edge. Enclosed is a cover letter, plans, and photo simulations of the proposed project. Staff Comments The applicant was compelled to revise its project because the City's Historical Commission recommended the use of a faux chimney when this project was originally proposed. The DRB rejected the faux chimney that was proposed for the original project. The Massachusetts Historical Commission (MHC) is compelling the applicant to have a project that is approved by all local Boards. The project that is before you now is a result of conversations between a select group of DRB and Historical Commission members who agreed that the use of an appropriately sited and constructed faux chimney, with a balustrade, could be acceptable. The Historical Commission on Wednesday, November 4th approved of the project as it is now being presented to the SRA. This letter is being provided in advance of your December 9th meeting for final review of this project. In support of VzW's proposal, enclosed please find: • Six (6) 11" x 17"copies of our updated plans (revised as of November 10, 2015) • Six (6) copies of our updated photo simulations (revised as of November 11, 2015) Since the spring of 2014, VzW has been in communication with the SRA, as well as the Salem Historical Commission ("SHC"), the Design Review Board ("DRB"), and the Massachusetts Historical Commission ("MHC"), regarding the proposed rooftop antenna installation at 217 Essex Street. The parties have grappled over several different proposals, including the installation VzW's antennas within a faux chimney, as well as a"naked" installation with the antennas painted to match the existing elements of the rooftop. As of August 2015, MHC has suggested a compromise plan whereby VzW would construct a smaller faux chimney than called for in the original plans that were reviewed by the SRA in July 2014. Since then, VzW has been working with its engineering team to modify its site design to incorporate a less conspicuous chimney enclosure, resituated and repositioned to complement the historical features of the rooftop aesthetic. The enclosed plans and photo simulations reflect the most recent iteration of these evolving modifications as suggested by the SHC at its November 4th meeting, which have been approved by the DRB as of its November 17th meeting, and which now come before the SRA for final review and approval. Enhanced wireless communications can also be deemed to satisfy the Plan's goal of providing"new and expanded residential and non-residential opportunities, services, facilities and amenities." With increased reliance on wireless technologies by both businesses and individuals, this project directly serves and benefits this objective by providing state-of-the-art enhanced wireless communications to the City of Salem. This installation supports economic development and enhances Salem's wireless connectivity thereby benefitting residents, business owners, tourists and public safety personnel. The physical attributes of the installation are also harmonious with the stated Plan goal to "preserve...historic architecture and resources." The difference concerns the details of a new Verizon Wireless communications facility proposed for the rooftop of the building at 217 Essex Street,and has contributed to a lengthy delay in Verizon's efforts to improve the coverage and capacity of its wireless network in downtown Salem. Following is a brief summary of the history that brings us to this point: PAST The Original Faux Chimney Plan In the spring of 2014,both the SRA and the SHC were presented with the same plan,dated May 16,2014, utilizing a faux chimney to contain four antennas,comprising two of the three sectors designed for this site. SHC thought that the faux chimney was out of proportion with the existing elements on the roof and it relayed that opinion to Verizon's regulatory consultants, EBL in a letter dated September 8,2014. SRA didn't like the faux chimney and, based on the recommendation of its Design Review Board,approved a plan with naked antennas.That approved plan was dated June 30,2014. SRA's approval is reflected in a letter dated July 11,2014,and it is on the basis of that approval and plan that a building permit was issued. The State Historic Preservation Process In 2014, EBI was handling the interactions with SRH and McLane Middleton was handling the process with SRA. While both interactions were happening at around the same time,there was no intersection between them and the conflict between the SRA and SHC did not become apparent until later in 2014,as Verizon was trying to complete the federal regulatory process involving review of the proposed plans by the Massachusetts Historical Commission ("MHC"). When the conflict became known, EBI and McLane Middleton together met with SHC. The property at 217 Essex Street is historically known as the Hoyt Block and is located within the Downtown Salem National Historic District. It is a Classical Revival, commercial building with many ornamental details including the roof balustrade,wooden cornice with modillions and dentils, and the stone-accented, round-arched window openings. In accordance with the Section 106 permitting process, the Commission has reviewed the submitted drawings and project information to determine whether the proposed telecommunications installation project will have an adverse effect on the structure and/or its surrounding historic properties. The Commission received and has reviewed revised drawings dated November 11, 2015. The Salem Redevelopment Authority and the SHC both previously commented on the project and proposed different opinions on how the antennae should be concealed. The revised design proposes two antennae to be instafled within a single 6'-6"x 6'-6" x 12' fiberglass chimney that will sit flush with the southwest comer of the roof. The third antennae will remain flush mounted and painted to match the penthouse. The fiberglass chininey shall be painted the color of natural red brick. It was ftirther recommended by the SHC that the revised chimney have a setback of 6". It is our understanding that the Design Review Board, at its meeting of November 17, 2015, recommended a setback between 4"-6" and that this is slated for final review and approval by the Salem Redevelopment Authority on December 9, 2015. Page 2 EBI Consulting We accept this revision and find that this compromise design will help mitigate any adverse effects on the structure and/or its surrounding historic properties. We require no further review, but respectfuHy request that a corrected drawing reflecting the 4"-6" setback be provided for the Commission's files. Thank you for your cooperation in this matter. EBI reported the SHC position to MHC as part of the MHC review process. We also brought the conflict to the attention of SRA,which reiterated its position to the MHC in a letter dated June 19,2015. Action Sujwested by MHC grappled with the conflicting positions of SRA and SHC and suggested a path forward in a letter dated August 12,2015. N4HC expressed concerns about the visibility of some rooftop bracing in the same manner as SRA. At the same time, MHC suggested utilizing potentially smaller faux enclosures along the lines suggested by SHC. Since the time of that August letter,Verizon has been working on a way to design the site utilizing a faux chimney or similar type stealth enclosure,but in a smaller dimension than originally proposed in an effort to thread this needle. A plan that can win approval of both SRA.and SHC will also pass muster with MH-C. PRESENT And this brings us to the present and where we could use your help. Verizon's design team has completed work on a re-design that we would like to present to both SHC and SRA in hopes that it will win approval from both boards. We have been in touch with Andrew Shapiro,the Economic Development Planner who provides staff support to the SRA and its Design Review Board. Andrew is in conversation with his colleague, Natalie Lovett,the Community Development Planner,who provides staff support to the SHC. The two staffers are conferring with the chairs of their respective boards and trying to arrange a couple of dates in the next two weeks when a Verizon delegation could meet with both staffers and the chairs to review the proposed reconciliation plan and to chart a course for moving the plan through the formal review and approval process. Following the initial informal meeting, we expect that the proposed sequence will be Salem Historical Cormnission, followed by Design Review Board, followed by Salem Redevelopment Authority. We write to you now to request that you do what you can ft7om your respective positions to help this process move along as quickly and smoothly as possible. This information was submitted to the Commission as part of the Section 106 permitting process. The revised drawings demonstrate revisions requested by the Salem Design Review Board (DRB) as part of its review of the project, which is located within the City's Urban Renewal Area. The revised plans show the installation mounted to a raised steel frame on the southwest comer of the rooftop. The elements are painted warm gray. Two additional flush mount antennas are painted to match the brick. In its initial review, the Commission was concerned with the alteration of the roofline of this historic building, which is also located within the Downtown Salem National Historic District. As a result, the Commission requested that a less visible location for the telecommunications installation be found. Concurrently, the DRI3 commented on the project and requested that the antennae elements be exposed rather than concealed by a faux chimney structure. After reviewing the revised drawings for the steel frame structure, the Commission found the revisions to be less desirable than the original plans. While the antennae are not visible from Essex Street or Derby Square, the bracing is visible from the southern view along Washington Street, a main thoroughfare through the City. As designed, the steel framing is very obtrusive and distracts the eye from the historic buildings and skyline of the downtown. Of the two options presented to the Commission, the Commission unanimously voted in favor of the faux chimney to conceal the proposed antennae. There being an existing chimney on the building, the faux chimney will not Page 2 stand out as completely inappropriate to the structure and will suspend the diminishing effects of the accumulation of antennae on the building. SRA Decision At its meeting on October 12, 2016 the SRA voted unanimously (4-0) to approve the proposed installation of signage, new outdoor caf6 seating area / deck, new door and windows, and additional fagade improvements at 217 Essex Street (Brew on the Grid) as detailed in plans dated 9/15/16 and as recommended by the Design Review Board. Recommendation At its meeting on September 28, 2016 the Design Review Board voted unanimously (6- 0) to recommend approval of the proposed installation of signage, outdoor caf6/seating area/patio, new door and windows, and other fagade improvements as presented in plans dated 9/15/16. The approval is subject to the proposed blade sign on the Derby Square elevation being moved back from Essex Street to the other side of the window below it (so as to not black to the marble inset), and to limit the placement of logos on no more than three of five umbrellas in the outdoor seating area. Staff Comments for October 12, 2016 SRA Meeting The applicant originally proposed having a sign reface the existing time/temperature clock that is mounted on the fagade. The DRB expressed a preference to another scheme shown, whereby the clock fixture is removed from the fagade, and a blade sign is installed on the Essex Street fagade. The applicant agreed to this scheme and to the conditions noted in the recommendation. Proposal The applicant proposes to make a series of changes to the exterior(primarily Derby Square side) of the building. The restaurant owner is working with the City on acquiring an easement to utilize the Derby Square side of the building; proposing to remove the existing planting bed and replace it with a new outdoor seating area, which will rise 2'10" at its highest point from grade. The patio, which will be made of a concrete foundation, with brick face and brick pavers, will provide ADA accessible at-grade access where it will meet Essex Street. An existing bench will be moved and relocated next to a portion of the planting bed that will remain (closest to Old Town Hall). q Salem -11111M, Redevelopment Authority A new mahogany door with windows will be installed as a second means of egress for the building, which will exit to the proposed patio. Sidelights will be installed on both sides of the new door. The front entrance door will be refurbished. The patio area will be bordered by a proposed 3'6" high square black picket fence. Proposed furniture includes black steel chairs and 30N30" square top tables, as well as black umbrellas with the restaurant's logo. Three signs are proposed for the building: 1.) A sign to reface the existing time/temperature display, which calls for internal illumination of the white text with existing electrical infrastructure 2.) 10' x 13" pin mounted letters lit by proposed goose neck lighting fixtures (x3) above the front entrance; and 3.) A 2'6" x 2'6" black metal blade sign with white text mounted to brick on the Derby Square elevation and lit with a black finished LED fixed arm fixture. Staff Comments Any approval of the patio area will be conditional upon the applicants successful acquisition of an easement for the area. The pin mounted sign and blade sign mounted on the Derby Street elevation are compliant with the City's sign ordinance and design guidelines. The reface of the clock does not appear to be in compliance with the City's sign ordinance, as it is positioned above the sills of the second floor windows (no- allowed per ordinance). Additionally, signs are not permitted to project more than five feet from the building; this structure (if acting as a sign) may violate that standard set forth by the ordinance. Lastly, internally illuminated signs are discouraged in the urban -enewal area. At this time we are recommending denial of this sign. The subject property at 217- 221 Essex Street,historically known as the Hoyt Block,is located within the Downtown Salem Historic District and is listed in the National and State Registers of Historic Places. The revised proposed Verizon project consisting of the installation of four tall exposed antennas with vertical and diagonal bracing at the southwest comer of the subject property rooftop,two antennas to the penthouse,and other associated equipment is described in the informational packet that was submitted to this office,received July 13, 2015. At this time,the MHC is concerned that the heigbt,location, and diagonal bracing of the antennas proposed for the southwest comer of the subject property will be visually obtrusive from at least one major thoroughfare within Salem and will alter the character of the building. The MHC requests that the project proponent explore the feasibility of locating the antennas proposed for the southwest comer of the subject property rooftop to another location on the rooftop or to enclose to antennas within a stealth chimney enclosure. Relocating a portion of these four antennas and placing the remaining antennas within stealth flue pipes and/or a smaller stealth chimney may also provide an effective alternative that would preserve more of the historic architectural characteristics of the rooftop. Additionally, the DRB requested that VzW change the location of the 3" gas run up to coincide with a"searn" between the two buildings, and also requested that VzW paint the pipe to match the brick building faqade. VzW has agreed to make the changes requested by the DRB and believes the installation strikes a balance between enhanced comm uni cations and protecting the building's architectural integrity. Furthermore, VzW is a tenant on the premises. When its leasehold term terminates, VzW will remove its antennas and equipment. The proposed project includes the installation of six (6) antennas on the rooftop, all installed in accordance with directives from the Design Review Board to minimize their visual impact. The proposed improvements will close a coverage gap currently existing in VzW's network and allow it to meet its obligations under the Telecommunications Act of 1996 and to provide service to the its customers in and around the City. Timeline: The proposed installation will begin as soon as the required approvals are in place and the building inspector has issued a building permit. Installations of this type typically are completed within 45-90 days. Overview of Proposed Rooftop Wireless Telecommunications Equipment Requiring SRA/DRB Approval: Of the six (6) antennas VzW proposes to install on the rooftop, 4 of these antennas, the beta and gamma sectors, will be mounted on posts in the southwest corder of the rooftop and painted a"warm gray." VzW also proposes to install an additional 2 antennas, the alpha sector, on the wall of an existing penthouse. Those antennas will be painted in color and texture to match the color of the penthouse to which they are attached. In addition, VzW intends to install additional equipment on the rooftop to support the antennas, with little to no visual impact. The rooftop at 217 Essex Street already hosts wireless telecommunications equipment; VzW's equipment will be installed in a manner that will not interfere with the existing carrier on the rooftop. Specifications for the Proposed Equipment: Antennas The proposed installation includes a total of six (6) antennas. Four (4) of the antennas will be mounted on posts and painted to minimize visual impact from the street. The two (2) alpha sector antenna arrays will be affixed to the existing rooftop penthouse, will be painted in a color and texture similar to match that of the structure to which they are attached. As a result, there should be little to no visual impact. 3"Gas Pipelin e VzW also proposes to install a 3" steel pipe that will ran up the fa�ade of the building. The pipe will be installed on the seam between two building on Essex Street, and will be painted to match the brick fagade of the two buildings to minimize visual impact. Additional Equipment Any additional equipment installed by VzW, including cables, cable trays, condenser units and generators will either have no visual impact, or will blend in the with the equipment already existing on the rooftop. 2
