In the meantime 3lhave e spoken with your chairperson, Joan Boudreau, and she suggested that I write you this letter. The history, as we understand it, is that at the time that the Tucker-Mathew;; building was redeveloped, Moses Alpers turned down the $100,000. grant from the Redevelopment Authority because he felt he did not want to sign a facade easement restricting his ownership. But, at the same time, the Redevelopment Authority would not allow exterior storm windows on the building" The contractor disallowed any responsibility for the windows which were installed because they were not properly protected from the elements. We now have a major problem wherein all the windows have to be replaced and installed correctly to withstand our New England weather. It is so bad that windows have actually fallen out of their casing onto the ground! This created a danger to the publier_as well as a liability to the condominium owners. In correcting the problem we honestly feel that installation of storm windows should be mandatory.. As per the memo cover sheet, we feel the proposal from Classic Construction is the best value even though it does not include the cost of storm windows. Perhaps with your assistance with the replacement of the windows the condominium owners could amortize the cost of this major project. Major air infiltration in most sashes. ( ossibly caused by shrinking or an error in original sizing 2. Broken vinyl spring balances and non- operational sashes. 3. Peeling and deterioration of sash exteriors. 4. Putty of false muttonsmissing or falling off. In answer to your question of possible repair, Ifeel that this would be an expensive temporary solution at best. the labor to remove, repair and re- install would be close to replacing the sashes in the proper fashion. Re-applied putty for false muttons would surely be a future problem. The method described in my proposal would serve the building for many years to come. The first quote is with Aluminum Clad Wood Double-Hung windows with true divided lites and acustom color. Using a clad window will greatly reduce future exterior maintenance. The second quote is an option using fixed windows over awnings with true lites and the same exterior cladding. Details of the true muntin and window profiles are shown on the shop drawing which is enclosed. As the windows in this quote are clad; you may be interested in knowing what they would cost if the windows were to have a primed wood exterior. Option #1 wood Double-Hungs: no change in the budget. Option #2 wood Fixed over awnings : $1 , 500 credit. An estimate for removing and replacing the windows would be $32 , 000 , not including interior painting. Olney Administrato CGO/ec Enclosures Salem Historical Commission Minutes of Meeting December 17, 1981 The Salem Historical Commission met for a special meeting on Thursday, December 17, 1981, 7:30 p.m., One Salem Green. Present were Messrs. Cook, Lahikainen, Wolfson, and Zaharis and Mrs. Wheaton. Also attending was Mr. Joseph Tarnowski. The meeting was called to order by Chairman Jacob - Wolfson. Local District Operation Mr. Joseph Tarnowski presented plans for a second-story porchat South Pine St. /at this special meeting as requested by the Commission at its meeting of December 2. He explained that the windows would be paired, double hung, 6 x 6 windows; trim on the addition would be the green of the rest of the building; and the walls would be shingled as the rest of the building. Members expressed concern about the relation of the roof of the addition to the handsome existing Second Empire style mansard roofline. Members felt that the possibility for a more sensitive treatment of these two lines should be carefully explored and questioned Mr. Tarnowski regarding the possibility of defea3ng final decision until January 6. Mr. Tarnowski agreed that. this would not be a problem for him. The clerk will copy plans for members to take with them to the site to study the options for recommendations on January 6. The Commission also considered preliminary plans for a sign at 21 Washington Square North, property of Richard Elliott, submitted by tenant, Paul Rabehenux. The flat sign to be applied to the side of the building with gold lettering on a black background was generally approved by the members but it was suggested that the scroll or colonialized shape would not be appropriate for a nineteenth century trade sign and that block letters, rather than a combination of block and script, should be used throughout. Mrs. Wheaton will relay these suggestions for Mr. Rabehenux's consideration, and a final application with specification as to exact location of the sign will be submitted at the meeting of January 6. National Register of Historic Places Gideon Tucker House/Father Matthe Building. In its final matter of business, the Commission reviewed plans for rehabilitation of the facade of the Gideon Tucker House/ Father Matthew Building at 129 Essex Street. This general review was occasioned due to the fact that the required three designees from the Commission had not been present at the meeting of the Design Review Board on December 9 when these plans were presented. Commission representation, which had been overlooked by the DR3, is requiredti similarly to the Heritage Plaza-West Agreement due to the expenditure of Small Cities Grant funding to identify and mitigate potential adverse impacts on National Register sites. In this case, the Salem Redevelopment Authority has offered to purchase a facade easement with Small Cities Grant funds. Christopher Olney, Salem Redevelopment Authority, noted in a letter to the Commission that the Commission will be notified to send its delegates to further DRB meetings on the site and sought only a general approval of the preliminary plans. Segal wad Enclosures AGREEMENT THIS AGREEMENT made this 28th day of April , 1982, between Moses Alpers Owner of land and buildings located at 129 Essex Street, Salem, Massachusetts (hereinafter referred to as "OWNER"), the CITY OF SALEM, a municipal corporation (hereinafter referred to as "CITY") acting by and through its Mayor, Jean A. Levesque, the Community Development Department acting by and through its Community Development Agent W. Gregory Senko, and the SALEM REDEVELOPMENT AUTHORITY, a public body, politic and corporate duly organized and existing pursuant to the provisions of Massachusetts General Laws, Chapter 121B, having its usual place of business in Salem (hereinafter referred to as "AUTHORITY"). WHEREAS, the OWNER is the record title Owner of fee simple title to real property situated at 129 Essex Street, Salem (see Essex South District Registry of Deeds, Book 6723 Page 366) on which there are situated structures of architectural significance; and WHEREAS, the CITY is the recipient of a Small Cities Grant under the Housing and Community Development Act of 1974 as amended, a portion of the funds of which have been designated for the building preservation of historic and/or architecturally significant building facades in the Central Business District; and WHEREAS, the CITY and the Authority have executed a Cooperation Agreement, dated March 7, 1979 in which the CITY delegates to the AUTHORITY, and the AUTHORITY agrees to undertake responsibilities with regard to the revitalization projects in the City's Central Business District; and WHEREAS, the AUTHORITY has prepared pursuant to the establishment of Urban Renewal Plans for the Urban Renewal Project Areas designated Heritage Plaza-East and Heritage Plaza-West which contain standards for exterior appearance to be imposed on all structures designated for historic and/or architectural preservation requiring, among other things, the acquisition and/or retention of facade easements over individual properties by the AUTHORITY as a stimulus to preservation activities. NOW, THEREFORE, in recognition of the foregoing and in consideration of the premises, mutual promises, obligations, covenants and restrictions hereinafter defined, the parties hereto agree as follows: - 1 - ARTICLE L• Design Review and Rehabilitation Program The OWNER shall furnish and install upon or in connection with the exterior of the structure all additions, improvements, alterations, repairs and services including all supervision, labor, materials, machinery, tools, equipment and services and in a good workmanlike manner perform and complete all work in accordance with construction drawings on file at the office of the Building Inspector and approved by the AUTHORITY. Final construction documents must be submitted to the AUTHORITY for its approval and approval must be given by the AUTHORITY prior to the commencement of the work. Any and all construction documents for additional/future facade improvements must be submitted to the AUTHORITY for its approval in a similar fashion. ARTICLE IL Deed of Easement Upon completion of the work by the OWNER, the OWNER, agrees to execute a Deed of Easement to the City of Salem and to the Salem Redevelopment Authority, jointly and severally, substantially in the form attached hereto as Exhibit "A" which instrument is to be recorded with said Registry of Deeds. ARTICLE IM Consideration In consideration of the grant of the Deed of Easement, the CITY agrees" 1. to pay the OWNER a sum not to exceed $60,000 but only upon completion of the work to the satisfaction and approval of the Authority; Z. As future phases of facade rehabilitation are undertaken to the remaining portion of the buildings at the site, the Authority may agree to pay the owner additional sums, to be paid only upon completion of these phases to the satisfaction and approval of the Authority. ARTICLE IV: Timetable for Construction The rehabilitation work shall commence on or before April 28. 1982 and shall be six months completed no later than gw=xxmtJdxfrom the date of commencement of work unless prevented by strike, accident, weather or other reasonable cause in which case the parties shall negotiate a time extension. ARTICLE V: Changes in Work Any changes in the scope of work described in Article I above shall be submitted by the OWNER to the AUTHORITY prior to the change being made by the OWNER. The AUTHORITY shall give written notice approving said changes and stating reciprocal changes in other aspects of this Agreement, including the amount of the grant or shall reject such changes and shall state the reasons for such rejection. _ 2 _ (C;r ARTICLE VL• Final Approval for Construction The AUTHORITY reserves the right to make inspection of the completed construction and to require remedial action by the OWNER when construction is not in compliance with the work described and referenced to in Article I of this Agreement. The AUTHORITY, as agent to the City, shall also have the right to require of the OWNER any records or documents as may be necessary to verify the final construction cost. ARTICLE VII: Noncompliance by the Owner In the event the OWNER does not faithfully meet his obligations under this Agreement, the AUTHORITY and the CITY shall have the right to reduce or abolish the CITY's contribution under Article II of this Agreement. ARTICLE VIII: Time and Manner of Payment The OWNER shall submit written notice of completion the AUTHORITY. The AUTHORITY shall within seven (7) days from the date of receipt of said Notice make its determination under Article V herein. The CITY upon the issuance of final approval by the AUTHORITY, shall reimburse the OWNER in accordance with the provisions of this Agreement within sixty (60) days of the receipt of said final approval. ARTICLE IX: Indemnification The OWNER shall assume all risk of and shall save harmless, defend and indemnify the AUTHORITY and the CITY against all acts, claims, demands, liabilities and damages which may in any manner be imposed on or incurred by the AUTHORITY or the CITY as a consequence of or arising out of the CITY's contribuition to the cost of the work caused to be done by the OWNER to achieve the rehabilitation of the exterior of said structure. ARTICLE X: Assignability The OWNER shall not transfer any interest in this Agreement without prior written consent of the AUTHORITY and the CITY. ARTICLE XL• Nondiscrimination The OWNERS shall not discriminate against any tenant or employee or applicant for tenancy or employment because of race, color, religion, sex, age, or national origin. - 3 - I t.. i d- ARTICLE XII: Amendment This instrument contains the entire and exclusive agreement between the parties and supersedes and terminates all prior or contemperaneous arrangements, understandings, and agreements, either oral or written.
