SRA Decision At its meeting on June 8, 2016 the SRA voted unanimously (5-0) to approve the proposed installation of signage (including a-frame sign) and lighting at 283R Derby Street (Notch Brewing) as recommended by the DRB. Recommendation At its regular meeting on May 25, 2016 the DRB voted unanimously to recommend approval of the proposed installation of signage (including a-frame sign) and lighting at 283R Derby Street (Notch Brewing). Staff Comments On May 18, 2016 the Zoning Board of Appeals (ZBA) voted to grant a variance to the applicant in order to consider 80 linear feet on the side of his building (acting as its storefront) as frontage. The ZBA approved a plan to allow for 103 square feet of signage to be placed on two elevations of the building as shown in the enclosed plans. The stamped decision is enclosed. Proposal Applicant proposes a series of six signs for his brewery/tap room. All signs will be painted white against the brick fagade. The applicant also proposes to place a wooden a-frame sign at the entrance to the driveway, in front of Waters and Brown, on Derby Street. Com lies? Portable Sign Requirements Y N ? X - must have $1,000,000 liability insurance including naming the City and the SRA X - if a shared entrance, must share sign with other business es Staff Comments The applicant is seeking a variance for relief of the amount of signage that he can install on his building. The Zoning Enforcement Officer had stipulated that the building's legal frontage is on Derby Street, and that Brother's Deli occupies the building's signage allowance. The applicant is seeking to have his storefront fagade facing (80 Linear feet) facing the parking lot (and Congress Street beyond) and the rear elevation facing the South River considered as frontage. The Department of Planning supports the notion of considering the parking lot side as frontage, given that the spirit of the Salem Sign Ordinance derives a calculation of signage that corresponds to storefront length. We do not necessarily agree that the South River should be considered frontage for the purposes of signage allowance. Assuming the ZBA grants relief to the applicant in the form of allowing the parking lot elevation to be considered frontage, the applicant will be allowed a total of 140 sf of building signage. The application as currently presented meets that standard, as well as Commercial Design Guidelines. The applicant is requesting that the sign be placed well beyond 10 ft of his entrance, which is ordinarily not allowed. That being said, the DRB/SRA has flexibility to allow for placement of the signage beyond 10 ft if it feels that extenuating circumstances make this necessary (or acceptable). In the petition date-stamped .April 26, 2016, the Petitioner requested a Variance of the provisions of Sec. 4-5.1 On- Prenuses Signs in Nonresidential Districts of the Salem Code of Ordinances to allow signage for chis business at the property. 2. Chris Loring,petitioner, presented the petition. 3. Notch Tap Room LLC is located at the rear of the building on 283 Derby Street. 4. The Building Commissioner ruled that the allowable signage at the property, based on the frontage of along Derby-Street,is completely occupied by Brothers Tavema. 5. The petitioner is requesting a Variance to install 103 square feet of signage on the building along the Congress Street and North River sides of the building, where the business is located at the rear of the building. 6. The petitioner testified that the hardship is that vendors will not be able to deliver goods without knowing where the business is located, wholesalers need to know where the location is to pick up finished goods and for consumers to know the location of the facility. 7. 'There is 79.9 linear feet along the fagadc where Notch Tap Room is located. 8. The requested relief,if granted, would allow signage for this business located at the rear, of the properh. 9. At the public hearing, one (1) member of the public spoke in favor and none in opposition to the petition. The Salem Buard of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, makes the following findings: 1 City of Salm[ Board of Appeals June 1.2016 Project:283 Rear Derby Street Page 2 of 2 Findings Sign Variance: I. Literal enforcement of the provisions of the Ordinance would create a substantial hardship to the apphcant as die Ordinance is not really applicable for a circumstance and vendors, wholesalers and consumers need to know the location of this facility. 3. The desired relief may not be granted without nullifying or substantially derogating from the intent of the district or purpose of the City of Salem Zoning Ordinance. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5) in favor (Peter A. Copelas (Vice-Chair),Jimmy Tsitsinos, Mike Duffy, Tom Watkins. Paul Viccica (alternate) and none (0) opposed, to approve the requested Variance to allow signage at the property subject to the following eight (8) standard terms, conditions and safeguards: Standard: 1. petitioner shall comply with all city and state statues, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. As you can see from the supplied documents, the sign will carry the Notch logo as well as the communication of our business uses and location (brewery, tap room, beer garden and a directional arrow). The Notch logo is not a specific font, but vintage letter press typography. The remaining fonts are Sentinel.The Notch maroon is Pantone color 7623. 1 would like to place the sign between 281 and 283 Derby Street in the area of the "Left Lane Must Turn Left" sign (detailed in the attached documents). This area is on the street side of the sidewalk and provides 7 feet of clearance for pedestrians. It is directly at the entry of our parking lot from the Derby Street, and 232 feet to our main entrance. Notch Tap Room has its own entrance, as does each business in the building. This decision requires the applicant to return to the Design Review Board and Salem Redevelopment Authority to seek approval for the outdoor seating area's umbrellas and fence, rooftop mechanical elements and screening, lighting, and signage. Recommendation On August 26, 2015 the DRB voted unanimously to recommend approval of the proposed fagade/building improvements (small project) and outdoor seating area at 283 Rear Derby Street (Notch Brewing), subject to the following conditions and considerations: 1.) The applicant must return for approval of a final signage proposal, umbrellas for the outdoor seating area, fencing, lighting, and rooftop mechanical elements. 2.) All other fagade treatments are approved, as well as tables and layout of outdoor seating area. Staff Comment for September 9, 2015 SRA Meeting As noted in the staff comment for the DRB meeting (below), the signage proposed to be above the roofline is not permitted by the City's Sign Ordinance; therefore it will require the granting of a variance by the Zoning Board of Appeals. Additionally, the applicant will have to seek relief from the ZBA for the amount of signage it would like to have because the Zoning Enforcement Officer has determined that Derby Street is the only representative frontage for this property (the amount of signage is proportional to the linear frontage of a property). This is why the applicant will go before the ZBA prior to returning to the DRB and SRA for final approval of signage. e Salem ® Redevelopment Authority Proposal Enclosed is a comprehensive proposal to renovate and adaptively reuse the building at the above noted address for the purposes of being a fully operational brewery with a tasting/tap room, and outdoor biergarten. Renovations will include: 1. A new window and door facing an outdoor seating area 2. A new storefront system 3. A total of four new windows along the front facing elevation (faces a parking area) along Congress Street 4. A new overhead door 5. Existing brick will be repaired/reconstructed and cost stone sills will be replaced where necessary The applicant proposes a 15 table, 90 max capacity outdoor seating area that will front the South River (1,822 sf in area). A photo of the proposed bench to be used in the area is enclosed. The applicant also proposes two options for signage; one totaling 188 sf and another totaling 178 sf. Staff Comment for August 26, 2015 DRB Meeting In regards to signage, the applicant is counting the South River elevation as frontage. For the purposes of calculating the maximum allowable square footage for signage, we do not consider the South River as frontage. Based on length of the building's frontage and the distance to the center of the street(s), the applicant may not have more than 121 sf of signage. Both proposed options for signage exceed this total. Finally, option A for signage shows a sign mounted above the roofline.
