Statement of Proposal
Banners
Turner's Seafoods requests permission to install four historic imagery
banners as shown in the requested three dimensional photo and
previously discussed at the last Design Review Board meeting. The
banners measure approximately 78 inches in height with a top
dimension of 30 inches and a bottom dimension of 20 inches to reflect
the cantor that exists with the existing flag poles. The bottom of the two
interior flags will be attached to two newly installed bottom flag poles
matching those that exist on the two outside pole configuration.
Although the exact imagery has yet to be selected it will match the style
shown in the photo and presented at last month's DR13 meeting. The two
inner most unused existing flag poles will be removed.
Changes to Previously Approved Signage
Turner's Seafood requests the following changes to approved fa�ade
signage at 43 Church Street:
1) Change blade sign color scheme from green, white, and brown to
more historic black and gold leaf
2) Reduce blade sign dimensions from 3'6" x 4' to 3'6" x 3'6".
3) Reduce pinned letters from 20" and 18" to 18" and 15".
4) Increase window graphic Turner's Seafood signs (6 in number)
from 2'6" x Vto 3' x 1'.
5) Add window graphic Turner's Seafood logo sign with "at LYCEUM
HALL" below. Overall size 14" x 18".
Square footage limit at 43 Church is length of the building x 1 which is
78.5. Overall square footage of proposed signage is approximately 75
square feet.

43 Church Street (Turner's Seafood): Discussion and vote on proposed excavation
and construction of exterior stairs and fenced border
SRA Decision
At its meeting on September 11, 2013, the SRA voted to unanimously approve
the August 28, 2013 DRB recommendation for a six foot landscaped strip
adjacent to the 43 Church building to be excavated and utilized as a staircase
leading to a new entrance/exit to the lower level of the building.
Further, this decision approves the recommendation of the DRB to approve a
black wrought-iron or similar fence and gate to be constructed around the
perimeter of the staircase, not to extend beyond the footprint of the brick portion
of the original 43 Church building.
This decision and all associated approvals is in reference to the plans submitted
to the SRA on the evening of September 11, 2013, entitled "Easement Plan
Parcel R-3 & P-6" dated 8.26.2013, as well as accompanying plans, drawings,
and elevations that were submitted at that time.
DRB Recommendation
At its meeting on August 28, 2013 the DRB voted to approve the proposed project to
excavate a staircase along an adjacent landscape bed at 43 Church Street (Turner's
Seafood) conditional upon the following:
0 That the proposed fence not extend beyond the original brick building

The applicant revised the proposal to reflect the condition noted above.

length of the landscape bed will be a new painted 4 ft. high wrought iron fence with
gate access to proposed stairs.

another light post). The clearance provided to enter the area in the rear remains the
same.

Turner's Seafood seeks permission to utilize the
six foot by twenty-eight foot landscaped space adjacent
to the original building located at 43 Church Street to
improve the functionality, safety, and aesthetics of its
building and operations. Two current challenges exist
with current conditions: 1) deliveries and 2) space for
additional mechanical equipment. All deliveries come
in through the rear door (also the handicap entrance),
down a corridor, which includes the men's bathroom
and a service station, and then through the kitchen into
the basement. Given the size and projected volume of
our business this delivery path poses many challenges
and safety concerns.
The proposed solution is to create an exterior
staircase that runs parallel to the building, which would
provide access to the basement and eliminate the need
to have deliveries come through the existing rear
entrance. The concrete staircase would measure S' 2"
by 17' 10" and be equipped with black metal handrails
per code. The staircase and the remaining area adjacent
to the original building (measuring 6' x 28') would be
enclosed by a four foot high wrought iron fence with
gates at either end and an additional cross section at the
far end of the staircase, There would be an 8 inch dirt
strip on the exterior side of the staircase for low
plantings along the bottom of the fence, which will
continue down the entire length of the fence. Within
the area being excavated there exists a light pole that
will be repositioned to remain in the same area and
provide the existing required light.
The second existing challenge is space for
mechanical equipment. Viewing 43 Church Street from
the rear offers a quick idea of how little space there
remains on the lower roof. In looking at the alley on the
opposite side of the building from the proposed
staircase you can see several mechanical platforms
cantilevered from the adjacent building above the alley.
Locating some of the new necessary mechanicals
behind landscaped screens in the remaining fenced in
area provides an almost invisible an unnoticeable and
unobtrusive solution.
Proposed Time Schedule
For Completing the Improvements
The projected opening for the restaurant is mid-
October. The work would optimally occur during the
end of September.

facade improvements
Proposal for May 22 DRB Meeting
With regards to signage:
The applicant seeks to install a double-sided blade sign that contains the
"Turner's Seafood" lettering and logo. The sign will be 4'Y x 3'6", containing
colors PNT-EX.2 and PNT-EX.3, as shown on the accompanying "Specifications"
sheet, in "Minion Pro" font. The sign will allow for 1 Yof clearance above the
sidewalk.
A wall sign will be centered above the building's front entrance, spelling out
"Turner's Seafood" with individually pinned steel black (PNT-EX.1) letters (font
Minion Pro). The dimensions of the wall sign are 27' x 1'8".
Six identical window decals are proposed for the front-facing windows, which will
spelling out "Turner's Seafood" in white vinyl (VIN-1) and font Minion Pro. The
size of the lettering will be 2'6" x 1'.
With regards to other fagade work:
Six red and off-white striped awnings will be installed above each (six) front
window and will each allow 8' of clearance above the sidewalk. There is no text
proposed for the awnings.
Six planters, painted black, will be installed in front of each front window.
Six nautical or historic therned flags will be hung at existing flag poles.
Two existing lights — above and on either side of the front entrance —will be
rotated toward the proposed blade sign.
Staff Comment
The total square footage of the proposed signage (62.38 sq/ft) falls within the
allowance of 80 sqIft for this building. Also note that although the brick fagade on
the provided plans appear to be an altered shade of red from the existing brick,
the applicant is not proposing to alter the brick in any way.

43 Church Street (Turner's Seafood): Discussion and vote on proposed
signage and facade improvements
DRB Recommendation
At its meeting on May 22, 2013, the DRB recommended approval of the
proposed signage at 43 Church Street with the following condition:
The black pinned letters above the front door and centered along the
building's fagade should not encroach upon the second floor windows
The DRB recommended approval of all fagade improvements, except for the
flags, with the following condition:
Switching the proposed planters to window boxes and to have them
placed inside the recessessed areas of the first floor windows; they should
be 18" or less deep.
The DRB voted to continue the issue of the proposed flags and to have the
applicant resubmit a proposal with specific flag designs at a future DRB meeting.
Staff Comment for June 12 SRA Meeting
The applicant has revised the proposal to conform to the DRB conditions.
Proposal for May 22 DRB Meeting
With reciards to signage:
The applicant seeks to install a double-sided blade sign that contains the
"Turner's Seafood" lettering and logo. The sign will be 4'Y x 3'6", containing
colors PNT-EX.2 and PNT-EX.3, as shown on the accompanying "Specifications"
sheet, in "Minion Pro" font. The sign will allow for 10' of clearance above the
sidewalk.
A wall sign will be centered above the building's front entrance, spelling out
"Turner's Seafood" with individually pinned steel black (PNT-EX.1) letters (font
Minion Pro). The dimensions of the wall sign are 27' x 1'8".
Six identical window decals are proposed for the front-facing windows, which will
spelling out "Turner's Seafood" in white vinyl (VIN-1) and font Minion Pro. The
size of the lettering will be 2'6" x 1'.

With regards to other facade work:
Six red and off-white striped awnings will be installed above each (six) front
window and will each allow 8' of clearance above the sidewalk. There is no text
proposed for the awnings.
Six planters, painted black, will be installed in front of each front window.
Six nautical or historic therned flags will be hung at existing flag poles.
Two existing lights — above and on either side of the front entrance—will be
rotated toward the proposed blade sign.
Staff Comment from the May 22 DRB Meeting
The total square footage of the proposed signage (62.38 sq/ft) falls within the
allowance of 80 sq/ft for this building. Also note that although the brick fagade on
the provided plans appear to be an altered shade of red from the existing brick,
the applicant is not proposing to alter the brick in any way.

OUTDOOR CAFt PERMIT
Preamble
The Salem Redevelopment Authority encourages the development of outdoor caf6s within
the Heritage Plaza East and Heritage Plaza West Urban Renewal Districts to enhance the
visitor and shopper experience in Salem and to assist in improving the economic viability of
downtown businesses.
This Permit process is designed to ensute that Salem's unique architectural and cultural
features are protected as outdoor cafis develop and to provide a consistent set of conditions
for all outdoor cafis.As such, the SRA shall allow outdoor caf&uses within the Urban
Renewal District, subject to the following conditions:
1. All tables and chairs, as well as the surrounding area,must be maintained in a clean
and safe manner.
2. Restaurants must provide to the SRA proof of liability insurance which covers the
outside seating areas.
3, Restaurants rmi t receive approval for outdoor tables from the Salem Licensing
Board and the Board of Health.
4. The design of all outdoor tables and chairs,and trash receptacles, must be reviewed
by the Design Review Board and approved by the SRA.
5. Seating areas must be of a size large enough to accommodate safe,easy and
uninterrupted pedestrian travel,as well as access to and from tables. Since the size of
tables and seating areas may vary,the SRA reserves the right to detetmine whether or
not adequate space exists for the creation of an outdoor caf6.
6. All tables and chairs must be safely secured in a vandal proof manner or must be
brought inside every night.The storage or security system must be approved by the
SRA.
7. All outdoor cafk permits will be issued to restaurants for a one-season trial period.
During this time period restaurants will be closely monitored by all appropriate City
departments and agencies to ensure that they comply with the provisions of this
policy. Following completion of a satisfactory outdoor season, the SRA shall issue an
outdoor c2f6 permit to the restaurant annually.
8. Outdoor cafii permits may be revoked by the SPLA for non-compliance with the
Provisions of this policy, at any time.

SRA Decision
At its meeting on April 9, 2014, the SRA voted 3-0 to approve a March 26, 2014
DRB recommendation to approve a proposed outdoor seating plan / permit for 43
Church Street (Turner's Seafood), which includes 10 32" tables (black mesh top)
and 85 seats, with grey-toned umbrellas (no advertising), and four feet of
clearance between the chain that walls off the seating area and the green space
across the right-of-way.
DRB Recommendation
On March 26, 2014, the DRB voted unanimously to recommend approval of a
proposed outdoor caf& permit/ outdoor seating plan at 43 Church Street (Turner's
Seafood). This recommendation is in regards to a revised plan presented to the
Board on the above noted date, and includes a plan for 10 32" tables (black mesh
top) and 85 seats, gray toned umbrellas without advertising, and four feet of
clearance between the chain and right-of-way.
Proposal for March 26, 2014 DRB Meeting
Enclosed is a cover letter explaining the applicant's request, the applicant's Common
Victualler License that notes coverage of the venue's outdoor patio, a certificate of
liability insurance, catalogue cuts for the tables and chairs, and a plan.
The proposed outdoor seating area will be in the back of the restaurant, facing Salem
Green, and will accommodate 38 people with ten 30"x3O" black mesh top tables and
34 black wicker chairs. The area will be chained off with stanchions. The proposed
space between the chain and the shrubs for pedestrian access is 3'.
Staff Comment
The Building Department has commented on the plan and will require access of a
minimum of 4' for the public sidewalk. This should be made a condition of any
approval.
The applicant had mentioned possibly using umbrellas. I will request that the
applicant bring a representation of the proposed umbrellas to the meeting.

Dear board members:
Turner's Seafood - Salem Inc. request the approval for the
previously approved outdoor dining at its restaurant located at 43
Church Street. Outdoor dining in Salem has become an extremely
popular venue and in order to remain competitive during the warmer
months, Turner's Seafood needs to offer its customers this unique
dining experience.
The location of the outdoor seating is located at the rear of the building
in a courtyard type setting predominantly surrounded by the location's
bordering buildings. Per the enclosed plan there are ten tables, thirty-
four chairs, and two benches giving overall seating plan of
approximately 38 people. Service for the outdoor dining will come out
of the restaurant's rear door, which also acts as the building's handicap
entrance. All tables and chairs will be stored and chained each night
immediately adjacent to the restaurant between the two existing trees.

Preamble
The Salem Redevelopment Authority encourages the development of outdoor caf6s within
die Heritage Plaza East and Heritage Plaza West Urban Renewal Districts to enhance the
visitor-and shopper experience in Salem and to assist in improving the economic-,iability of
downtown businesses.
This Permit process is designed to ensure that Salem�s unique architectural and cultural
features are protected as outdoor caf6s develop and to provide a consistent set of conditions
for an outdoor caf6s. As such, the SRA shall allow outdoor CaR uses within the Urban
Renewal District, subject to the following conditions:
I. All tables and chairs,as well as the surrounding area, must be maintained in 2 clean
and safe manner.
2. Restaurants must provide to the SRA proof of liability insurance which covers the
outside seating areas.
3. Restaurants must receive approval for outdoor tables from the Salem Licensing
Boatdand the Board of Health.
4. The design of all outdoor tables and chairs,and trash receptacles, must be reviewed
by the Design Review Board and approved by the SRA,
5. Seating areas must be of a size large enough to accommodate s-Afe, easy and
uninterrupted pedestrian travel, as well as access to and from tables. Since the size of
tables and searing areas may vary, the SPLA reserves the right to determine whether or
not adequate space exists for the creation of an outdoor caf4i.
6. All tables and chairs must be safely secured in a vandal proof manner or must be
brought inside every night. The storage or security system must be approved by the
SKA_
7. All outdoor ca&permits will be issued to testaurants for a one-season trial penod-

8. Outdoor caf6 permits may be revoked by the SRA for non-comphance with the
provisions of this policy,at any time.

Proposal for March 26, 2014 DRB Meeting
Enclosed is a cover letter explaining the applicant's request, the applicant's Common
Victualler License that notes coverage of the venue's outdoor patio, a certificate of
liability insurance, catalogue cuts for the tables and chairs, and a plan.
The proposed outdoor seating area will be in the back of the restaurant, facing Salem
Green, and will accommodate 38 people with ten 30"x3O" black mesh top tables and
34 black wicker chairs. The area will be chained off with stanchions. The proposed
space between the chain and the shrubs for pedestrian access is 3'.
Staff Comment
The Building Department has commented on the plan and will require access of a
minimum of 4' for the public sidewalk. This should be made a condition of any
approval.
The applicant had mentioned possibly using umbrellas. I will request that the
applicant bring a representation of the proposed umbrellas to the meeting.

Dear board members:
Turner's Seafood - Salem Inc. request the approval for the
previously approved outdoor dining at its restaurant located at 43
Church Street. Outdoor dining in Salem has become an extremely
popular venue and in order to remain competitive during the warmer
months, Turner's Seafood needs to offer its customers this unique
dining experience.
The location of the outdoor seating is located at the rear of the building
in a courtyard type setting predominantly surrounded by the location's
bordering buildings. Per the enclosed plan there are ten tables, thirty-
four chairs, and two benches giving overall seating plan of
approximately 38 people. Service for the outdoor dining will come out
of the restaurant's rear door, which also acts as the building's handicap
entrance. All tables and chairs will be stored and chained each night
immediately adjacent to the restaurant between the two existing trees.

DRB Recommendation
At their meeting on May 26, 2010, the DR13 voted to recommend approval of the
proposed outdoor dining area at 43 Church Street with the following conditions:
- The applicant shall be allowed to include two additional tables; and
- The lighting shall be reviewed and approved prior to the SRA meeting.
Staff Comment
The applicant has revised the proposal to conform to the DRB conditions.

The outdoor dining area is proposed behind the restaurant and would be defined

To the Members of the SRA,
We are applying for a permit for an outdoor caf6 directly behind the Lyceum. As there are many
dining establishments in Salem now providing outdoor seating, we feel that we should provide
the same and that it is critical to our financial well-being to do so. Many of our customers have
asked us to provide this as well. Our intention is to have four 36"tables with 4 seats each plus
two 6 ft benches with two coffee-height tables and one or two chairs. We will have umbrellas,
and some partial fences on wheels that can be removed at night. The tables and chairs would be
stored against our building at night and chained. It is our intention to do some planters and other
small landscaping to enhance the area. Also we will be adding some outdoor lighting to our
building. We hope our plan and intention will be acceptable to the SRA and feel it will be an
aesthetic improvement.

Deborah, I do not see a problem with the plan you have laid out (narrative and sketch) providing this is the final plan and all
furnishings remain moveable in the event of an emergency. The fire department will inspect the changes with you after this

Good afternoon Chief Cody,
Thank you for your phone call, and I will try to give you as much detail as possible regarding our plan
for the outdoor seating area.
The seating area is directly behind the restaurant, beginning with a partial fencing on wheels parallel
to the end of the handicapped ramp (but not coming over as far as the ramp itself) and extending
towards the Goldberg bldg block about 44 feet, ending at another fence on wheels parallel to the tree
just before the hydrant (in other words the hydrant is outside the proposed seating area). There would
be 4 tables with 4 chairs and 4 umbrellas (all moveable and with the chairs stackable) plus two
benches each approx 6 ft long plus two low tables in front of the benches plus a seat or two (so
additional seating for about 6 to 8 people). Alternatively there may be one more dining height table
with chairs instead of the benches, but at this point I believe we will go with the two benches. We
would like to use this area from approx. April 1 until October 30, weather permitting. All of the furniture
would be moved to against the building at night and chained, so the fire lane would be left open after
closing.
