Enclosed please find a 'Request for Determination of
Applicability' concerning vegetation management by AMTRAK along
its Right-of-Way. This request is for approval of additions to
the wetland delineation along the City of Salem section of track
which lies between Jefferson Avenue and March Street (see
enclosed Track Chart) . This delineation was performed by Sanford
Ecological Services, Inc. (SES) on August 30, 1991 in accordance
with the Massachusetts Right-of-Way Management Regulations (33
CMR 11. 00) (hereafter referred to as the Regulations) .
Included in this submittal is a USGS map section depicting the
location of the track within the region and a track chart which
indicates the existing, approved delineation of Sensitive Areas,
as well as the newly delineated Sensitive Areas (which are the
basis of this Request) . As set forth in the Regulations, these
areas include wetland resources. The present delineation
consists of 10-foot "No-Spray" zones and 100-foot "One-year
Limited Spray" zones. The newly delineated areas would be
10-foot "No-Spray" zones and 100-foot "One-year Limited Spray"
zones.
We recommend that the Salem Board of Health send notices to all
owners of private wells within 100 ' of the R.O.W. requiring well
owners to place signs identifying well locations.
If the Commission would like to inspect the City of Salem
delineation prior to scheduling a hearing, or if there are any
questions regarding this submittal, please contact me at our
Southborough office.

Enclosed please find a 'Request for Determination of
Applicability' concerning vegetation management by AMTRAK along
its Right-of-Way. This request is for approval of additions to
the wetland delineation along the City of Salem section of track
which lies between Jefferson Avenue and March Street (see
enclosed Track Chart) . This delineation was performed by Sanford
Ecological Services, Inc. (SES) on August 30, 1991 in accordance
with the Massachusetts Right-of-Way Management Regulations (33
CMR 11. 00) (hereafter referred to as the Regulations) .
Included in this submittal is a USGS map section depicting the
location of the track within the region and a track chart which
indicates the existing, approved delineation of Sensitive Areas,
as well as the newly delineated Sensitive Areas (which are the
basis of this Request) . As set forth in the Regulations, these
areas include wetland resources. The present delineation
consists of 10-foot "No-Spray" zones and 100-foot "One-year
Limited Spray" zones. The newly delineated areas would be
10-foot "No-Spray" zones and 100-foot "One-year Limited Spray"
zones.
We recommend that the Salem Board of Health send notices to all
owners of private wells within 100 ' of the R.O.W. requiring well
owners to place signs identifying well locations.
If the Commission would like to inspect the City of Salem
delineation prior to scheduling a hearing, or if there are any
questions regarding this submittal, please contact me at our

Dear Commission Members:
Enclosed please find a draft copy of the 1992 Yearly Operational
Plan, which has been prepared for the AMTRAK National Railroad
Passenger Corporation's Commuter Rail Lines in Massachusetts. Also
enclosed is a copy of the public notice which appeared in the
Environmental Monitor dated April 22, 1992 which describes the
procedure set forth by the Massachusetts Department of Food and
Agriculture for the public review of this document.
This Yearly Operational Plan was drafted in compliance with the
Rights of Way Management Regulations (333 CMR 11.00) . Department
approval of a Yearly Operational Plan, in conjunction with the
approved 5-year Vegetation Management Plan, is required before the
railroad can perform any vegetational management practices which
include the selective use of herbicides. The enclosed Yearly
Operational Plan identifies areas in your municipality 'where
herbicide spraying has been restricted due to the proximity of
certain "Sensitive Areas" , as defined in the . Rights of Way
Management Regulations.
This document is being provided to the Conservation Commission,
Board of Health, and head of government in each municipality for
review.
Please feel free to call me with any questions pertaining to this
Yearly Operational Plan or the public review procedure set forth by

Please be advised that the AMTRAK National Railroad Passenger
Corporation proposes its Summer vegetation management program of
its Commuter Rail System right-of-way to occur between 18 July and
31 July 1993 . This vegetation management program will be conducted
in accordance with the terms of the approved "Yearly Operational
Plan -- 1993 Calendar Year: AMTRAK National Railroad Passenger
Corporation, Commuter Rail System" , under the Massachusetts Rights
of Way Management Regulations ( 333 CMR 11 . 00 et seq. ) . The
herbicide application program is scheduled to be completed within
ten (10) days of the specified spray period.
Your municipality is being notified of the date of the Summer
vegetation management program in accordance with the notification
procedures specified in Section 11 . 07 of the Rights of Way
Management Regulations. In compliance with these Regulations, this
