The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. The work is a maintenance dredging project as provided for in the Act; or b. The time for completion has been extended to a specified date more than three years, but less than five years,from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. c. If the work is for a Test Project, this Order of Conditions shall be valid for no more than one year. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. An Order of Conditions for a Test Project may be extended for one additional year only upon written application by the applicant, subject to the provisions of 310 CMR 10.05(11)(f). 6. If this Order constitutes an Amended Order of Conditions, this Amended Order of Conditions does not extend the issuance date of the original Final Order of Conditions and the Order will expire on unless extended in writing by the Department. 7. Any fill used in connection with this project shall be clean fill. General Conditions Under Massachusetts Wetlands Protection Act 8. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 9. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" [or, "MassDEP"] "File Number 64-623 " 11. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A)to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition#13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. General Conditions Under Massachusetts Wetlands Protection Act (cont.) 17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 18. Alf sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. 19. The work associated with this Order(the"Project") (1) ® is subject to the Massachusetts Stormwater Standards (2) ❑ is NOT subject to the Massachusetts Stormwater Standards If the work is subject to the Stormwater Standards,then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs)shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation, including removal of all construction period sediment trapped in inlet and outlet control structures; ii. as-built final construction BMP plans are included, signed and stamped by a Registered Professional Engineer, certifying the site is fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per the requirements of Stormwater Standard 10; w &D m5 dm• rev.6/1612015 Page 7 of 12 Massachusetts Department of Environmental Protection Provided by MassDEP: Bureau of Resource Protection - Wetlands 64-623 WPA Form 5 — Order of Conditions MassDEPFile# Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 eDEP-Transaction# Salem cityrrom C. General Conditions Under Massachusetts Wetlands Protection Act (cont.) iv. all post-construction stormwater BMPs are installed in accordance with the plans (including all planting plans)approved by the issuing authority, and have been inspected to ensure that they are not damaged and that they are in proper working condition; v. any vegetation associated with post-construction BMPs is suitably established to withstand erosion. c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e))shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: L)the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.)the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f)through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. Maintain an operation and maintenance log for the last three(3) consecutive calendar years of inspections, repairs, maintenance and/or replacement of the stormwater management system or any part thereof, and disposal (for disposal the log shall indicate the type of material and the disposal location); 2. Make the maintenance log available to MassDEP and the Conservation Commission ("Commission") upon request; and 3. Allow members and agents of the MassDEP and the Commission to enter and inspect the site to evaluate and ensure that the responsible party is in compliance with the requirements for each BMP established in the O&M Plan approved by the issuing authority. h) All sediment or other contaminants removed from stormwater BMPs shall be disposed of in accordance with all applicable federal, state, and local laws and regulations. i) Illicit discharges to the stormwater management system as defined in 310 CMR 10.04 are prohibited. j) The stormwater management system approved in the Order of Conditions shall not be changed without the prior written approval of the issuing authority. k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site Design Credit(as defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1, Low Impact Development Site Design Credits)shall not be altered without the prior written approval of the issuing authority. 1) Access for maintenance, repair, and/or replacement of BMPs shall not be withheld. Any fencing constructed around stormwater BMPs shall include access gates and shall be at least six inches above grade to allow for wildlife passage. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. 21. There shall be adequate additional erosion and sediment controls stored onsite for emergency purposes. EROSION CONTROL 22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in any wetland resource area and/or buffer zones. The erosion control measures shown on the approval plan(s)and provisions in the Order will be the minimum standards for this project; the Commission or its Agent may require additional measures. 23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 25. The area of construction shall remain in a stable condition at the close of each construction day. 26. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through straw bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. Within thirty(30)days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer than two(2)months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. Project Summary • Existing Conditions The 0.41-acre Project site is located at 311 Derby Street in Salem's downtown waterfront area along the • channelized South River (see Figure 1, Locus Plan). The site contains entirely impervious surfaces, including: an existing single story, 19-foot high masonry building that formerly housed the Goodyear Tire and Rubber company and a paved parking area for 4 vehicles (see Figure 2, Site Aerial and Sheet 1 of 2, Site Plan Existing Conditions). The site is level and stormwater currently sheet flows from the site to the municipal storm drainage system in Derby Street or into the South River. • Project Description The Project includes renovating/re-purposing the existing building on the property to accommodate the restaurant uses and limited site improvements such as minor grading, pavement top coating/painting • and new fencing. Additionally,and in accordance with the Salem Harbor Plan, a new Harborwalk will be installed on the property along the South River. Provision of the Harborwalk will introduce public access to this site and this portion of the South River for the first time and will provide an existing missing link between the City-owned Harborwalk along the west and south sides of the River and the adjacent Harborwalk on the Speedway service station site. • The building footprint is approximately 7,400 square feet (sf) of which about half will house the Flatbread Pizza restaurant and the other half will house a Donut Shop and a Tap Room Bar. The area in front of the restaurant on the Derby Street side and in the rear of the building along the South River will include seasonal outdoor dining. A Harborwalk will also be constructed along the South River frontage. • A 69+/-sf cooler unit is being added to the rear of the building on top of an existing paved area and a dumpster area will be placed on the west side of the building.The site will be accessed from an existing curb cut on Derby Street and the existing 4 parking spaces located adjacent to either side of the site entrance will remain. • Minor grade changes (less than 6 inches) are required in the rear of the site to meet the existing elevation of the Harborwalk on the adjacent Speedway service station property to the east and the City of Salem's public Harborwalk/park area to the west. The grading will also direct stormwater from the rear of the site into two proposed catch basins connected to an existing outlet in the South River. The catch basins will be equipped with deep sumps to pretreat the stormwater prior to discharge. • Stormwater on the Harborwalk area will generally sheet flow into the South River.Stormwater along the Derby Street side of the property will continue to sheet flow to the storm drainage system in Derby Street. Wetland Resource Areas and Impacts • Wetland Resource Areas and Impacts The site is previously developed and entirely impervious. Previously altered state wetland resources areas on the site include Coastal Bank,Riverfront Area and Land Subject to Coastal Storm Flowage(100- year flood zone elevation 10 NAVD 88). The Coastal Bank resource area is the granite seawall located • below the concrete block cap(as shown on the Section View on Sheet 2 of 2)and the entire site is located within Riverfront Area and Land Subject to Coastal Storm Flowage resource areas. A 100-foot Buffer Zone extends from the top of the Coastal Bank inland across portions of the site (See Sheet 1 of 1 Site Plan Existing Conditions and Figure 3, FEMA Map). • The entire site is impervious, covered with the existing building and paving, and is a redevelopment project. There are no impacts to Coastal Bank and impacts to the Riverfront Area and Land Subject to Coastal Storm Flowage are temporary and associated with limited site improvements including minor grading, pavement top coating/painting, fencing and the installation of a Harborwalk along the South River. • Compliance with Performance Standards The Project will not result in any adverse impacts to state wetland resources areas and complies with the performance standards outlined in the state wetland regulations at 310 CMR 10.00 as described below. • The Coastal Bank resource is comprised of a granite seawall and no alterations to the seawall are proposed. The installation of the Harborwalk and limited site improvements adjacent to the Coastal Bank will not affect the storm damage protection or flood control function of the Coastal Bank resource area.The limited site improvements will temporarily impact the previously impacted Riverfront and Land Subject to Coastal • Storm Flowage resource areas. However, these temporary impacts will not affect the function of these resource areas.The RiverfrontArea is previously developed and the South River,which abuts the site, is a tidal waterbody that can accommodate any flood waters that may be generated from the site during extreme storm events. • Coastal Bonk Resource Area: The existing granite seawall constitutes a coastal bank pursuant to 310 CMR 10.30 of the state wetland regulations. The seawall is not a source of sediment for coastal beaches, coastal dunes or barrier beaches but is significant for storm damage protection and flood control serving as a vertical buffer to stormwater. The Project complies with the performance standards for coastal bank resource areas outlined in 310 CMR 10.30(6)through (8)as described below. • (6)Any project on such a coastal bank or within 100 feet landward of the top of such coastal bank shall have no adverse effects on the stability of the coastal bank. The Project does not propose any alteration of the coastal bank resource area and the activities proposed adjacent to the coastal bank will not create any adverse impacts on the stability of the coastal • bank. i> agc 12 • • Salem Flatbread Notice of Intent Filing • (7)Bulkheads,revetments,seawalls, groins or other coastal engineering structures may be permitted on such a coastal bank except when such bank is significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, coastal dunes, and barrier beaches. No alterations to the existing coastal bank are proposed. (8)Notwithstanding the provisions of 310 CMR 10.30(3) through(7), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37. According to the most recent Estimated Habitat Map of State-Listed Rare Wetland Wildlife published by the Massachusetts Natural Heritage and Endangered Species Program,the Project is not located in any specified habitat site of rare vertebrate or invertebrate species. Land Subject to Coastal Storm Flowage: The entire Project site is located in Land Subject to Coastal Storm Flowage which is defined in the state wetland regulations at 310 CMR 10.04 as "land subject to • any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record,whichever is greater." The site is entirely located in the FEMA flood Zone AE which has an elevation of 10 NAVD88 (See Figure 3, FEMA Map). The state wetlands regulations do not include any performance standards for Land Subject to Coastal Storm Flowage. Nevertheless,the Project will not create any adverse impacts to this resource area and the South • River is a tidal waterbody that can accommodate any flood waters that may be generated from the site as resulting from storm events. Riverfront Area: The entire Project site is located in the Riverfront Area as it adjacent to the South River • which flows into Salem Harbor. The wetland regulations at 310 CMR 10.58(3)presume that riverfront areas are significant to the protection of private or public water supplies,groundwater, land containing shellfish, wildlife habitat and fisheries and that they provide flood control and prevent storm damage and pollution. Because the site is entirely developed, entirely impervious, located adjacent to the tidal South River in a highly urbanized section of Salem's downtown waterfront area, these functions are not provided by the Project site. The site is not located near any public or private water supply, is and will remain entirely • impervious, does not contain any vegetation or other natural features that provide wildlife habitat, nor does the site function in a manner that protects land containing shellfish or fisheries, and the adjacent South River is a tidal waterbody that can accommodate any flood waters that may be generated from the site during storm events. • Alternatives The Project is proposing the re-use of the existing building with no expansion in the building footprint and minimal site improvements. There are no practical and substantially equivalent economic alternatives to the Proposed Project as defined in 310 CMR 10.58(4)(c)(1)and the Project does not result • in any adverse impacts to state wetland resource areas. Reducing the size of the Project would require demolition of a portion of the existing building and would create more temporary impacts to state 1' agc 13 • • Salem Flatbread Notice of Intent Filing wetland resource areas than the proposed Project. As discussed in the previous paragraphs,the Project meets the performance standards for other resource areas on the site. • The site is very small (0.41 acres) and presents little opportunity for alternative site build outs. The site is bounded by Derby Street to the north, an existing public walkway to the west,the South River to the south and the Speedway service station to the east (see Figure 2, Site Aerial). The site contains an existing single story structure that the Project Proponent is in the process of renovating/re-purposing to restaurant uses within the existing structure. There are more intensive alternatives that the Proponent could pursue such as adding a second story to the existing building which would nearly double the size of the structure; building an addition to the structure to increase the building footprint;or demolishing the building and constructing a new structure that maximize the building footprint. The Proponent investigated other properties in the vicinity but did not identify any feasible locations for the proposed restaurant uses. 3. Construction Methods and Schedule • The building renovations will be completed over the next few months. The Harborwalk, including minor site grading and drainage and construction activities,will be installed in the spring/early summer of 2017. The Project compliance with these standards is described below and indicated in the attached Stormwater Checklist. Proiect Summary • The Project includes renovating/repurposing the existing building on the property to accommodate the restaurant uses and limited site improvements such as minor grading, pavement top coating/painting and new fencing. Additionally, and in accordance with the Salem Harbor Plan, a new Harborwalk will be installed on the property along the South River. , • As noted in the Project Description, the entire site is currently and will remain impervious. Stormwater currently sheet flows from the front of the site to the storm drainage system in Derby Street and from the rear of the site to the South River. Stormwater along the Derby Street side of the property will continue to sheet flow to the storm drainage system in Derby Street. In the rear of the property, two catch basins will be installed to collect and direct stormwater drainage to an • existing 8-inch outlet that discharges to the South River. The catch basins will be equipped with deep sumps and hoods to pre-treat the stormwater prior to discharge which is an improvement over existing conditions. Compliance with Stormwater Standards r Standard 1: No New Untreated Discharges The Project does not propose any new untreated discharges. The existing site is impervious and will remain impervious. There is an existing drainage outlet that extends from the site into the South River. Two new catch basins equipped with deep sumps to pre-treat stormwater will be installed to 40 collect stormwater drainage in the rear of the property. The catch basins will be connected to the existing outlet in the South River. Standard 2: Peak Rate Attenuation A waiver from Standard 2 is requested because the project is located in land subject to coastal storm • flowage and stormwater discharge is to a wetland subject to coastal flooding.The South River,which abuts the site, is a tidal waterbody that can accommodate any flood waters that may be generated from the site during extreme storm events. • Stormwater Report 1 • • Salem Flatbread Notice of Intent Filing Standard 3: Recharge The Project does not propose stormwater recharge. The site is small and entirely impervious and • with the exception of the two catch basins equipped with deep sumps,there is no space to install stormwater BMP's and it is not practical to recharge stormwater. Standard 4:Water Quality A Long-Term Pollution Prevention Plan is included in Exhibit 1. Standard 5: Land Uses With Higher Potential Pollutant Loads(LUHPPLs) The Project does not constitute a Land Use with Higher Potential Pollutant Loads. Standard 6:Critical Areas The Project is not located near nor does the stormwater discharge near or to a critical area. Standard 7: Redevelopments and Other Projects Subject to the Standards only to the maximum extent practicable The Project is subject to the Stormwater Management Standards only to the maximum extent practicable as it constitutes a Redevelopment Project. Stormwater Standards 1,8, 9 and 10 are met and Stormwater Standards 1 through 3 are met to greatest extent practical as described herein. The Project does improve existing conditions by installing two new catch basins equipped with deep sumps and hoods to pretreat stormwater drainage from the rear of the property prior to discharge to an existing 8-inch drain that outlets into the South River. • Standard 8: Construction Period Pollution Prevention and Erosion and Sedimentation Control A Construction Period Pollution Prevention and Erosion and Sedimentation Control Plan is included in Exhibit 1. The Project is less than one acre in size and is not subject to a NPDES Construction General Permit. Standard 9: Operation and Maintenance Plan The Post Construction Operation and Maintenance Plan is included in the Exhibit 1. Long Term Pollution Prevention Plan (Standards 4 and 30) The following shall be implemented as part of the Long-Term Pollution Prevention Plan: * a. Good housekeeping practices such as picking up trash and other measures mandated in the Operation and Maintenance Plan. b. After construction,there shall be no storage of equipment or materials on-site. c. Vehicles are not to be washed on-site. • d. The catch basins will be inspected quarterly to insure that they are functioning properly and are not silted-up. Silt and debris will be removed and properly disposed-of off-site. e.- No chemicals shall be stored on-site. The project site will be under constant 24/7 security surveillance,therefore there is no need to have a spill prevention plan. • f. There will also be no storage of any fertilizers, pesticides and/or herbicides. g. Provisions for solid waste management will be handled by day-to-day restaurant operations. h. Snow plowing will be handled by day-to-day during the winter season. Sand use is expected along with pavement/walkway sweeping. Storage of road salts and/or sand are not anticipated. i. In the unlikely event of a spill,the stormwater system will be lined with a temporary • impermeable lining at the discharge point so that clean-up can be employed to remove any spillage from the site and properly disposed. Construction Period Pollution Prevention & Erosion/Sedimentation Control Plan (Standard 8) a. Erosion/Sedimentation Control Measures The Project site is virtually flat;therefore, siltation/erosion is not expected. Nevertheless, during construction of the Harborwalk and installation of the catch basins and drain lines, a silt boom shall be placed along the perimeter of the seawall along the Project site and • the proposed catch basins will be protected with hay bale barriers and/or silt sack until construction is complete. b. Prior to construction: Prior to the Harborwalk pre-construction meeting with the Salem Conservation Commission,the site contractor will be responsible for installing the erosion control measures described above. c. Construction sequence: The construction of site work associated with the installation of catch basins and the Harborwalk will commence after all permits are in hand and a pre- construction conference with the Salem Conservation Commission (and/or it's agent) has been completed. Following the preconstruction site visit,the erosion/sedimentation controls will be installed and construction will proceed. d. Maintenance of erosion controls:the site contractor will be responsible for maintaining each control described in this plan. During construction,the on-site contractor will inspect • all sediment and erosion control structures weekly and after each major rainfall event. Records of inspections will be prepared and maintained on-site by the site contractor. Silt shall be removed from behind the barriers if greater than two (2) inches deep,or as needed. Damaged or deteriorated erosion control devices will be repaired immediately after identification. Sediment that is collected in structures or behind barriers shall be properly disposed of off-site. Spoil piles (if any result from construction)shall be covered with tarps and surrounded by staked hay bales. Introduction Important.When A Stormwater Report must be submitted with the Notice of Intent permit application to document filling out forms compliance with the Stormwater Management Standards. The following checklist is NOT a substitute for on the computer, the Stormwater Report which should provide more substantive and detailed information but is offered use only the tab . Plans are required to show existing and proposed conditions, identify all wetland resource areas, NRCS soil types, critical areas, Land Uses with Higher Potential Pollutant Loads (LUHPPL), and any areas on the site where infiltration rate is greater than 2.4 inches per hour. The Plans shall identify the drainage areas for both existing and proposed conditions at a scale that enables verification of supporting calculations. • As noted in the Checklist, the Stormwater Management Report shall document compliance with each of the Stormwater Management Standards as provided in the Massachusetts Stormwater Handbook. The soils evaluation and calculations shall be done using the methodologies set forth in Volume 3 of the Massachusetts Stormwater Handbook. To ensure that the Stormwater Report is complete, applicants are required to fill in the Stormwater Report Checklist by checking the box to indicate that the specified information has been included in the Stormwater Report. If any of the information specified in the checklist has not been submitted, the applicant must provide an explanation. The completed Stormwater Report Checklist and Certification must be submitted with the Stormwater Report. • The Stormwater Report may also include the Illicit Discharge Compliance Statement required by Standard 10. If not included in the Stormwater Report,the Illicit Discharge Compliance Statement must be submitted poor to the discharge of stormwater runoff to the post-construction best management practices. 2 For some complex projects,it may not be possible to include the Construction Period Erosion and Sedimentation Control Plan in • the Stormwater Report. Stormwater Checklist and Certification The following checklist is intended to serve as a guide for applicants as to the elements that ordinarily need to be addressed in a complete Stormwater Report.The checklist is also intended to provide conservation commissions and other reviewing authorities with a summary of the components necessary • for a comprehensive Stormwater Report that addresses the ten Stormwater Standards. Note: Because stormwater requirements vary from project to project, it is possible that a complete Stormwater Report may not include information on some of the subjects specified in the Checklist. If it is determined that a specific item does not apply to the project under review, please note that the item is not applicable(N.A.)and provide the reasons for that determination. • A complete checklist must include the Certification set forth below signed by the Registered Professional Engineer who prepared the Stormwater Report. This documentation may be in the form of the propriety BMP checklist found in Volume 2, Chapter 4 of the Massachusetts Stormwater Handbook and submitting copies of the TARP Report, STEP Report, and/or other third party studies verifying performance of the proprietary BMPs. ❑ A TMDL exists that indicates a need to reduce pollutants other than TSS and documentation showing that the BMPs selected are consistent with the TMDL is provided. • Standard 5: Land Uses With Higher Potential Pollutant Loads (LUHPPLs) ❑ The NPDES Multi-Sector General Permit covers the land use and the Stormwater Pollution Prevention Plan (SWPPP) has been included with the Stormwater Report. ❑ The NPDES Multi-Sector General Permit covers the land use and the SWPPP will be submitted prior to the discharge of stormwater to the post-construction stormwater BMPs. • ❑ The NPDES Multi-Sector General Permit does not cover the land use. ❑ LUHPPLs are located at the site and industry specific source control and pollution prevention measures have been proposed to reduce or eliminate the exposure of LUHPPLs to rain, snow, snow melt and runoff, and been included in the long term Pollution Prevention Plan. ❑ All exposure has been eliminated. • ❑ All exposure has not been eliminated and all BMPs selected are on MassDEP LUHPPL list. ❑ The LUHPPL has the potential to generate runoff with moderate to higher concentrations of oil and grease(e.g. all parking lots with >1000 vehicle trips per day) and the treatment train includes an oil • grit separator, a filtering bioretention area, a sand filter or equivalent. The redevelopment checklist found in Volume 2 Chapter 3 of the Massachusetts Stormwater Handbook may be used to document that the proposed stormwater management system (a) complies with Standards 2, 3 and the pretreatment and structural BMP requirements of Standards 4-6 to the maximum extent practicable and (b) improves existing conditions.
