provided in this application and presented at the public hearing, this Commission finds that

in the wetland regulations. Therefore, work on this project may not go forward unless and
until a new Notice of Intent is submitted which provides measures which are adequate to
protect the interests of the Act, and a final Order of Conditions is issued. A description of

3. This Order does not relieve the permittee or any other person of the necessity of complying
with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this
Order unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years,
but less than five years, from the date of issuance. If this Order is intended to be valid
for more than three years, the extension date and the special circumstances warranting
the extended time period are set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three
years each upon application to the issuing authority at least 30 days prior to the expiration
date of the Order.
6. If this Order constitutes an Amended Order of Conditions, this Amended Order of
Conditions does not extend the issuance date of the original Final Order of Conditions and
the Order will expire on 9/12/2017 unless extended in writing by the Department.
7. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash,
refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath,
paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the
foregoing.
S. This Order is not final until all administrative appeal periods from this Order have elapsed,
or if such an appeal has been taken, until all proceedings before the Department have been
completed.

9. No work shall be undertaken until the Order has become final and then has been recorded
in the Registry of Deeds or the Land Court for the district in which the land is located, within
the chain of title of the affected property. In the case of recorded land, the Final Order shall
also be noted in the Registry's Grantor Index under the name of the owner of the land upon
which the proposed work is to be done. In the case of the registered land, the Final Order
shall also be noted on the Land Court Certificate of Title of the owner of the land upon
which the proposed work is done. The recording information shall be submitted to the
Conservation Commission on the form at the end of this Order, which form must be
stamped by the Registry of Deeds, prior to the commencement of work.
10. A sign shall be displayed at the site not less then two square feet or more than three
square feet in size bearing the words,
"Massachusetts Department of Environmental Protection" [or, "MassDEP"]
"File Number 64-573 "
11. Where the Department of Environmental Protection is requested to issue a Superseding
Order, the Conservation Commission shall be a party to all agency proceedings and
hearings before MassDEP.
12. Upon completion of the work described herein, the applicant shall submit a Request for
Certificate of Compliance (WPA Form 8A)to the Conservation Commission.
13. The work shall conform to the plans and special conditions referenced in this order.
14. Any change to the plans identified in Condition#13 above shall require the applicant to
inquire of the Conservation Commission in writing whether the change is significant enough
to require the filing of a new Notice of Intent.
15. The Agent or members of the Conservation Commission and the Department of
Environmental Protection shall have the right to enter and inspect the area subject to this
Order at reasonable hours to evaluate compliance with the conditions stated in this Order,
and may require the submittal of any data deemed necessary by the Conservation
Commission or Department for that evaluation.
16. This Order of Conditions shall apply to any successor in interest or successor in control of
the property subject to this Order and to any contractor or other person performing work
conditioned by this Order.
17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated
Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be
marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall
be maintained until a Certificate of Compliance has been issued by the Conservation
Commission.

18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have
been fully stabilized with vegetation or other means. At no time shall sediments be
deposited in a wetland or water body. During construction, the applicant or his/her designee
shall inspect the erosion controls on a daily basis and shall remove accumulated sediments
as needed. The applicant shall immediately control any erosion problems that occur at the
site and shall also immediately notify the Conservation Commission, which reserves the
right to require additional erosion and/or damage prevention controls it may deem
necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.
NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS
19. The work associated with this Order(the "Project') (t)❑ is (2)® is not subject to the
Massachusetts Stormwater Standards. If the work is subject to the Stormwater
Standards, then the project is subject to the following conditions:
a) All work, including site preparation, land disturbance, construction and redevelopment,
shall be implemented in accordance with the construction period pollution prevention and
erosion and sedimentation control plan and, if applicable, the Stormwater Pollution
Prevention Plan required by the National Pollution Discharge Elimination System
Construction General Permit as required by Stormwater Condition 8. Construction period
erosion, sedimentation and pollution control measures and best management practices
(BMPs) shall remain in place until the site is fully stabilized.
b) No stormwater runoff may be discharged to the post-construction stormwater BMPs
unless and until a Registered Professional Engineer provides a Certification that:
i. all construction period BMPs have been removed or will be removed by a date certain
specified in the Certification. For any construction period BMPs intended to be converted
to post construction operation for stormwater attenuation, recharge, and/or treatment, the
conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that
the BMP has been properly cleaned or prepared for post construction operation, including
removal of all construction period sediment trapped in inlet and outlet control structures;
ii. as-built final construction BMP plans are included, signed and stamped by a Registered
Professional Engineer, certifying the site is fully stabilized;
iii. any illicit discharges to the stormwater management system have been removed, as per
the requirements of Stormwater Standard 10;
iv. all post-construction stormwater BMPs are installed in accordance with the plans
(including all planting plans)approved by the issuing authority, and have been inspected to
ensure that they are not damaged and that they are in proper working condition;
v. any vegetation associated with post-construction BMPs is suitably established to
withstand erosion.

c) The landowner is responsible for BMP maintenance until the issuing authority is notified
that another party has legally assumed responsibility for BMP maintenance. Prior to
requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible
party (defined in General Condition 18(e))shall execute and submit to the issuing authority
an Operation and Maintenance Compliance Statement("O&M Statement)for the
Stormwater BMPs identifying the party responsible for implementing the stormwater BMP
Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.)the O&M
Plan is complete and will be implemented upon receipt of the Certificate of Compliance,
and ii.)the future responsible parties shall be notified in writing of their ongoing legal
responsibility to operate and maintain the stormwater management BMPs and implement
the Stormwater Pollution Prevention Plan.
d) Post-construction pollution prevention and source control shall be implemented in
accordance with the long-term pollution prevention plan section of the approved
Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by
the National Pollution Discharge Elimination System Multi-Sector General Permit.
e) Unless and until another party accepts responsibility, the landowner, or owner of any
drainage easement, assumes responsibility for maintaining each BMP. To overcome this
presumption, the landowner of the property must submit to the issuing authority a legally
binding agreement of record, acceptable to the issuing authority, evidencing that another
entity has accepted responsibility for maintaining the BMP, and that the proposed
responsible party shall be treated as a permittee for purposes of implementing the
requirements of Conditions 18(f)through 18(k)with respect to that BMP. Any failure of the
proposed responsible party to implement the requirements of Conditions 18(f) through
18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate
of Compliance. In the case of stormwater BMPs that are serving more than one lot, the
legally binding agreement shall also identify the lots that will be serviced by the stormwater
BMPs. A plan and easement deed that grants the responsible party access to perform the
required operation and maintenance must be submitted along with the legally binding
agreement.
f) The responsible party shall operate and maintain all stormwater BMPs in accordance
.with the design plans, the O&M Plan, and the requirements of the Massachusetts
Stormwater Handbook.

g) The responsible party shall:
1. Maintain an operation and maintenance log for the last three(3) consecutive
calendar years of inspections, repairs, maintenance and/or replacement of the
stormwater management system or any part thereof, and disposal (for disposal the
log shall indicate the type of material and the disposal location);
2. Make the maintenance log available to MassDEP and the Conservation
Commission ("Commission") upon request; and
3. Allow members and agents of the MassDEP and the Commission to enter and
inspect the site to evaluate and ensure that the responsible party is in compliance
with the requirements for each BMP established in the O&M Plan approved by the
issuing authority.
h) All sediment or other contaminants removed from stormwater BMPs shall be disposed
of in accordance with all applicable federal, state, and local laws and regulations.
i) Illicit discharges to the stormwater management system as defined in 310 CMR 10.04
are prohibited.
j) The stormwater management system approved in the Order of Conditions shall not be
changed without the prior written approval of the issuing authority.
k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site
Design Credit(as defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1,
Low Impact Development Site Design Credits) shall not be altered without the prior written
approval of the issuing authority.
1) Access for maintenance, repair, and/or replacement of 13MPs shall not be withheld.
Any fencing constructed around stormwater BMPs shall include access gates and shall be
at least six inches above grade to allow for wildlife passage.

The applicant, the owner, any person aggrieved by this Order, any owner of land abutting
the land subject to this Order, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate MassDEP Regional
Office to issue a Superseding Order of Conditions. The request must be made by certified
mail or hand delivery to the Department, with the appropriate filing fee and a completed
Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR 10.03(7)
within ten business days from the date of issuance of this Order. A copy of the request shall

ADDITIONAL FINDINGS
Based on the Estimated Habitats of Rare Wildlife and Certified Vernal Pools Map (9/4/2014, online) from Natural
Heritage & Endangered Species Program (NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has
been determined that this project does not occur near any habitat of state-listed rare wildlife species nor contain any
vernal pools.
This order permits the remediation of contaminated soils per August 8, 2014 Notice of Intent, this Order of
Conditions,and approved plans.
GENERAL CONDITIONS
1. This Order of Conditions must be recorded in its entirety(including all 5 pages of Special Conditions)
at the Essex County Registry of Deeds or the Land Court for the district in which the land is located,
after the expiration of the 10-day appeal period and within 30 days of the issuance. A copy of the
recording information must be submitted to the Salem Conservation Commission before any
work approved in this Order commences.
2. Approval of this application does not constitute compliance with any law or regulation other than
M.G.L Chapter 131, Section 40, Wetlands Regulations 310 CMR 10.00 and the City of Salem Wetlands
Protection Ordinance, Salem Code Chapter 50.
3. All work shall be performed in accordance with this Order of Conditions and approved site plan(s). No
alteration of wetland resource areas or associated buffer zones, other than that approved in this Order,
shall occur on this property without prior approval from the Commission.
4. Prior to any work commencing on site,a DEP Sign showing DEP File#64-573 must be installed at the
entrance to the site and seen from the public way, but not placed on a living tree.
5. No work approved in this Order may commence until the ten(10)business day appeal period has lapsed
from the date of the issuance of this Order.
6. With respect to this Order,the Commission designates the Conservation Agent as its agent with powers
to act on its behalf in administering and enforcing this Order.
7. The Commission or its Agent,officers,or employees shall have the right to enter and inspect the property at
any time for compliance with the conditions of this Order,the Wetlands Protection Act MGL Chapter 131,
Section 40,the Wetlands Regulations 310 CMR 10.00, and shall have the right to require any data or
documentation that it deems necessary for that evaluation.
8. The term "Applicant'as used in this Order of Conditions shall refer to the owner,any successor in
interest or successor in control of the property referenced in the Notice of intent, supporting.documents

and this Order of Conditions. The Commission shall be notified in writing within 30 days of all
transfers of title of any portion of the property that takes place prior to issuance of the Certificate of
Compliance.
9. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and
approvals associated with this project. These permits may include but are not necessarily limited to the
following:
(1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816),U.S.Army
Corps of Engineers.
(2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority
of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00.
(3) Sewer Extension Permit from the DEP Division of Water Pollution Control under G.L. Ch. 21A ss7
and 314 CMR 7.00. Any Board of Health permit for septic system design for any portion of the
septic system within 100 feet of wetlands shall be submitted to the Commission prior to
construction initiation.
(4) Design Requirements for Construction in Floodplains under the State Building Code (780 CMR
744.).
10. If there are conflicting conditions within this Order,the stricter condition(s)shall rule.
11. All work shall be performed so as to ensure that there will be no sedimentation into wetlands and
surface waters during construction or after completion of the project.
12. The Commission or its Agent shall have the discretion to modify the erosion/siltation control methods
and boundary during construction if necessary.
13. The Commission reserves the right to impose additional conditions on portions of this project or this site
to mitigate any actual or potential impacts resulting from the work herein permitted.

15. Any proposed changes in the approved plan(s)or any deviation in construction from the approved
plan(s)shall require the applicant to file a Notice of Project Change with the Commission. The Notice
shall be accompanied by a written inquiry prior to their implementation in the field, as to whether the
change(s) is substantial enough to require filing a new Notice of Intent or a request to correct or amend
this Order of Conditions. A copy of such request shall at the same time be sent to the Department of
Environmental Protection.
16. In conjunction with the sale of this property or any portion thereof before a Certificate of Compliance has
been issued,the applicant or current landowner shall submit to the Commission a statement signed by the
buyer that he/she is aware of an outstanding Order of Conditions on the property and has received a copy of
the Order of Conditions.

PRIOR TO CONSTRUCTION
18. Prior to the commencement of any activity on this site other than activities listed above,there
must be a Pre-Construction Meeting on site between the project supervisor,the contractor responsible
for the work, and the Conservation Agent and/or a member of the Conservation Commission to ensure
that the requirements of the Order of Conditions are understood. The staked erosion control line shall be
adjusted, if necessary,during the pre-construction meeting. Please contact the Conservation Agent at
(978)619-5685 at least forty-eight(48) hours prior to construction to arrange for the Pre-
Construction Meeting.
19. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and
erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The
Commission and/or its Agent shall inspect and approve such installation at the pre-construction
meeting.
20. No clearing of vegetation, including trees,or disturbance of soil shall occur prior to the pre-construction
meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre-
construction meeting if absolutely necessary in order to place erosion control stakes where required.
21. There shall be adequate additional erosion and sediment controls stored onsite for emergency purposes.
EROSION CONTROL
22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction,
and shall be maintained during construction in any wetland resource area and/or buffer zones. The
erosion control measures shown on the approval plan(s)and provisions in the Order will be the minimum
standards for this project;the Commission or its Agent may require additional measures.
23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland
resource areas to prevent sediment from entering wetland resource areas.

24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or
replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed.
25. The area of construction shall remain in a stable condition at the close of each construction day.
26. Any de-watering of trenches or other excavation required during construction shall be conducted so as
to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered
through straw bale sediment traps, silt filter bags or other means approved by the Commission or its
Administrator.
27. Within thirty(30) days of completion of construction on any given portion of the project, all disturbed
areas in the completed portion of the site shall be permanently stabilized with rapidly growing
vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas.
28. If soils are to be disturbed for longer than two(2)months, a temporary cover of rye or other grass
should be established to prevent erosion and sedimentation. If the season is not appropriate for plant
growth, exposed surface shall be stabilized by other appropriate erosion control measures,firmly
anchored,to prevent soils from being washed by rain or flooding.
DURING CONSTRUCTION
29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all
times when work is in progress.
30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on
the approved plan(s).
31. All waste products,grubbed stumps,slash;construction materials,etc. shall be deposited at least 100 feet
from wetland resource areas and 200 feet from river.
32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage
system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be
immediately removed.
33. All exposed sub-soils shall be covered by a minimum of three(3)inches of quality screened loam topsoil
prior to seeding and final stabilization.
34. Immediately following drainage structure installation all inlets shall be protected by silt fence,strawbale
barriers and/or silt bags to filter silt from stormwater before it enters the drainage system.
35. There shall be no pumping of water from wetland resource areas.
36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other
components shall be fixed immediately.
37. During construction, all drainage structures shall be inspected regularly and cleaned as necessary.
38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance
of enforcement actions by the Conservation Commission including,but not limited to, civil administrative
penalties under M.G.L Chapter 21A, section 16.

39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to
the Conservation Commission to request a Certificate of Compliance (COC):
(1) A Completed Request for a Certificate of Compliance form (WPA Form 8A or other form if
required by the Conservation Commission at the time of request).
(2) A letter from a Registered Professional Engineer certifying compliance of the property with this
Order of Conditions.
(3) [Reserved]
40. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds
and a copy of the recording submitted to the Salem Conservation Commission.
41. If the completed work differs from that in the original plans and conditions,the report must specify how
the work differs; at which time the applicant shall first request a modification to the Order. Only upon
review and approval by the Commission,may the applicant request in writing a Certificate of
Compliance as described above.
42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been
stabilized with final vegetative cover and the Conservation Commission and/or its Agent has authorized
their removal.
ADDITIONAL CONDITIONS
43. Prior to the start of excavation, the applicant shall obtain the Conservation Agent's approval of the
design of a truck wash station,which is anticipated to be included in the project's NPDES
documentation or Release Abatement Measure(RAM)plan.

BASF, for the proposed remediation of chromium-impacted soils within a portion of the 100-foot Wetlands
Resource Area Buffer Zone adjacent to Mill Pond at the former Hamblet & Hayes facility located on
Colonial Drive.
! The remediation project is proposed in as an Activity Within the Buffer Zone as defined by 310 Code of
Massachusetts Regulations (CMR) 10.02(2)(b)(3) and will be performed as a Limited Project pursuant to
310 CMR 10.24(7)(c)(6) for the excavation and removal of chromium-impacted soil from within a portion
! of the 100-foot Buffer Zone of a Coastal Bank. The excavation area is entirely within a paved parking lot
bordering Mill Pond. No alterations will be made to the Coastal Bank itself. The remedial action is
authorized by the Massachusetts Contingency Plan (MCP) 310 CMR 40.0000 and will be conducted as a
Release Abatement Measure (RAM) pursuant to 310 CMR 40.0440 after a RAM Plan is filed with the
! Massachusetts Department of Environmental Protection (MassDEP). This NOI is being filed as part of
the requirements of the RAM Plan to obtain all necessary environmental permits.

1.0 BACKGROUND AND INTRODUCTION
1.1 Regulatory Environment
This Notice of Intent (NOI) is filed under the Wetlands Protection Act(WPA) Massachusetts General Laws
(M.G.L.) Chapter 131 §40 and its implementing regulations 310 Code of Massachusetts Regulations
r (CMR) 10.00 Wetlands Protection and in accordance with the Salem Wetland Protection and
Conservation Bylaw as published in Salem Code Chapter 34.
The proposed remediation meets the criteria for an Activity Within the Buffer Zone as defined by 310
CMR 10.02(2)(b)(3) as it is an "activity other than minor activities... undertaken within 100 feet of an area
subject to protection under M.G.L. c.131 §40...which will alter any Area Subject to Protection...and
requires a Notice of Intenf'. The proposed remediation will be conducted as a Limited Project pursuant to
310 CMR 10.24(7)(c)(6) as it is a"remediation of a release of oil and/or hazardous material in accordance
rwith the provisions of 310 CMR 40.0000'.
1.2 Introduction
r BASF submits this NOI requesting an Order on Conditions authorizing the removal of chromium-impacted
soils, a portion of which are within the 100-foot Buffer Zone of a wetland resource area at the former
' Hamblet & Hayes (H&H) Facility located on 20 Colonial Drive in Salem, MA (Figure 1). The Property is
currently owned and operated by Univar USA(Univar). The excavation area is located in a paved parking
lot that abuts Mill Pond.
rThe remedial effort is proposed under the Massachusetts Contingency Plan or MCP (310 CMR 40.0000)
as a Release Abatement Measure (RAM). The proposed remediation will eliminate an area of chromium-
impacted soil located partially within the 100-foot Buffer Zone of Mill Pond and mitigate risk associated
with potential exposure to chromium-impacted soil and groundwater. This NOI contains a description of
the 100-foot Buffer Zone of Mill Pond and the proposed remedial program.
The Licensed Site Professional of Record (LSP) for this project is Frank W. Lilley (LSP #4183) of Golder
Associates Inc. (Golder).
1.3 History of Site Use
rThe former H&H facility (Site) is located on 20 Colonial Road in Salem, Massachusetts (Figure 1). The
Site has been in use for industrial manufacturing operations for over 70 years. The Site was initially
' developed in the early 1900s as a cement manufacturing facility and was subsequently utilized by Bursaw
Oil Corporation (Bursaw) for the storage and distribution of petroleum products. Bursaw reportedly had
several aboveground storage tanks (ASTs) in operation at the facility. H&H began operations at the Site
rin the 1950s and jointly used the Site with Bursaw until the 1970s; Bursaw, utilized the laboratory and

storage buildings on the southern portion of the Site, while H&H utilized the manufacturing building and
the northern portion of the Site.
Historically, H&H operated the facility for the manufacturing of basic chromium sulfate and aluminum
sulfate (alum) for the tanning industry. Additional H&H operations included transfer, storage and
repackaging of petroleum chemicals and solvents and, for a short time, the production of phenolic-based ,
fungicides. The Ciba-Geigy Corporation (Ciba, now BASF) acquired H&H via a stock purchase in 1978
and the H&H stock was subsequently acquired by Van Waters & Rogers, Inc. (VW&R) in September
1989. ,
Environmental conditions at the Site, including previous soil and groundwater remediation, current site
use, and extent of soil,sediment, and groundwater impacts, are documented in Section 2.1 and in the '
following reports:

The release abatement measure planned for the summer of 2014 is described in this NOI. A Draft RAM
Plan has been prepared and it will be finalized and filed with the MassDEP after issuance of the NOI. The
Draft RAM Plan is being not being finalized to in case mitigation measures required by the City of Salem
Conservation Commission, as the issuing authority, require modification of the RAM Plan as well as other ,
logistical details.

2.0 OBJECTIVES
The proposed remedial program has two primary objectives:
' ■ Eliminate an area of chromium-impacted soil and thereby mitigate the potential risks to
human health and the environment.
■ Reduce or eliminate a potential source of continuing chromium impacts to groundwater.
' The following sections discuss these two objectives in greater detail.
2.1 Mitigation of Human Health and Environmental Risks and Source Removal
The demolition of the former Production Building (see Figure 2) by Univar in 2011 resulted in a change in
MCP Disposal Site conditions whereby soils that were,determined to be "Isolated" in the previous Method
3 Risk Characterization performed in association with the Class C-2 RAO (March, 2009) are now
classified as 'Potentially Accessible' under the MCP. BASF conducted an additional subsurface
investigation in May 2012 to evaluate conditions beneath the former Production Building and surrounding
areas. Investigation findings are summarized in the Post Class C-2 RAO Operations & Monitoring (O&M)
Report (BASF, May 21, 2013) on file with the MassDEP Northeast Region.
The 2013 O&M Report identified an area of chromium-impacted soil at concentrations exceeding Upper
MCP Concentration Limits (UCLs) beneath the former Production Building. Based on the evaluation
' conducted by the LSP, this discrete area of elevated chromium in soil is considered a potential source of
oil and/or hazardous materials (OHM) as defined by the MCP. Because this soil is a potential source, it is
' targeted for removal and off-Site disposal. Based on an understanding of historical site use and response
actions completed to date,the LSP believes this will be the last remedial measure required for this Site.
' The intent of the proposed remedial program is to achieve a condition of "No Significant Risk", as defined
by the MCP; to human and ecological receptors with respect to the chromium-impacted soil located within
the 100-ft Buffer Zone of the uplands portion of Mill Pond. The areas of proposed remediation to achieve
' this level of "No Significant Risk" with respect to chromium-impacted soils in the Mill Pond uplands are
depicted on Figure 2.

3.0 EXISTING CONDITIONS '
The Site consists of approximately 4.36 acres developed for industrial/commercial use and contains Land
Under Water, Salt Marsh, Coastal Beach, and Coastal Bank associated with Mill Pond, a Class SB '
Surface Water body. Current operations at the Site are limited to bulk storage, blending, repackaging and
distribution of various chemicals and are confined to the south side of the Site. Bulk materials are
delivered to the Site via tanker truck and rail car and are transferred in designated transfer areas within t
the Site to on-site storage tanks, located in a warehouse building adjacent to the rail road spur.
Repackaged products are transported from the Site via bulk tankers and trailers. The Site includes a
large parking lot that borders Mill Pond. This parking lot previously included the former Production
Building which was demolished by Univar. The parking lot is separated from Mill Pond and an area of
Salt Marsh by a fence. The facility maintains a Storm Water Control Plan. ,
The Site is bordered to the north and northwest by a New England Power (NEP) easement, to the '
northeast by Mill Pond, to the east by the Massachusetts Bay Transit Authority (MBTA) Castle Hill Rail
Yard, to the south by a lot and building owned by the Exeter International Realty Trust, and to the west by
various other commercial tenants. Access to and egress from the Site is provided by Colonial Road, east
of the intersection of Colonial Road and Jefferson Avenue, and is restricted by chain link fencing. There
are three gates into the facility:the main gate located adjacent to the main office Building A; the rear gate '
located adjacent to Building K; and a gate located where a rail road spur enters the Site from the rail road
yard southeast of the Site.
3.1 Site Contamination
Soil sampling conducted in May 2012 and reported in the May 2013 Post Class C-2 RAO O&M Report
identified two areas of chromium-impacted soil (Figure 2) and recommended these areas for remediation.
These two areas are as follows:
■ Area #1: Consists of trivalent chromium (Cr°1) and hexavalent chromium (Crv')-impacted
soils and comprises approximately 7,500 square feet (ft) located adjacent to the south-
southwestern bank of Mill Pond. Chromium impacts in Area #1 generally extend to a
depth of 13 to 15 feet below ground surface (bgs). '
■ Area #2: Consists of Crv'-impacted soils and comprises approximately 1'g00 ft2 located
adjacent to and west of the rail road spur. Chromium impacts in Area #2 generally
extend to a depth of approximately 5 feet bgs. '
A portion of highly contaminated soil from these areas will be removed from the Site and disposed of at a
licensed disposal facility. Lightly impacted and unimpacted soils will be returned to the excavation in
accordance with the soil management provisions'of the RAM Plan. Up to 1,400 cubic yards may be '
excavated and disposed of off-Site.

i ' 3.2 Wetland Resource Area
The Site includes Mill Pond, a Class SB Surface Water tidal pond, surrounded by a salt marsh consisting
predominantly of Phragmites austra/is. The Site contains the coastal resource areas: Coastal Beach, Salt
Marsh, and Coastal Bank. The 100-foot Buffer Zone extends landward from the limit of the Coastal Bank
(Figure 2). Resource area features illustrated on Figure 2 were digitized from Drawing Number C-1
entitled "Resource Area Delineation" included in the July 20, 2004 Chapter 91 Dredging Permit
Application filed with the MassDEP Northeast Regional Office by Vanasse Hangen Brustlin, Inc. (VHB)
(Appendix A). Drawing Number C-1, which delineates the boundaries of the wetland resource areas, has
also been filed with the Salem Conservation Commission as part of an Order on Conditions issued to
Ciba Specialty Chemicals in approximately 2002 or 2003. This Order on Conditions was closed by Ciba
' in the spring of 2010. A separate Order on Conditions was issued to Univar in July 2010 for demolition of
Production Building (DEP# 64-499). Based on information provided by the Salem Conservation
Commission to Golder (March 1014), the Order on Conditions filed by Univar in July 2010 relied on
Drawing C-1 to delineate the boundaries of the wetland resource areas.
' Mill Pond is influenced by both tidal fluctuations and surface water/runoff discharges from Jefferson
Avenue and the surrounding properties. Historically, Mill Pond received discharge from the Site via
facility drains, storm water runoff control structures, and surface sheet flow. Mill Ponds drains to the north
and northeast through a subsurface conduit. The conduit lies beneath the railroad yard adjacent to and
northeast of the Site, and it now represents the channel of the South River. The discharge elevation of
' the conduit exiting the Mill Pond is elevated relative to the South River channel structure; therefore,
sediment is trapped in Mill Pond as was intended by the culvert design. The majority of the South River
flow is channeled into subsurface storm drains, and filled land above the channel has subsequently been
' developed. The subsurface conduit (i.e., the former South River) discharges into Salem Harbor near the
intersection of Derby Street and Lafayette Street and the Congress Street Bridge. The discharge to
' Salem Harbor is controlled by tide gates, operated by the City of Salem, which dampens inlet and outlet
flow to Salem Harbor.
According to the most recent Federal Emergency Management Agency (FEMA) Flood Insurance Rate
Map for Essex County, Massachusetts Panel 25009CO419F (Appendix B, Figure B-1), the Site does not
contain Land Subject to Coastal Storm Flowage.
' The limits of the wetland resource area shown on Figure 2 were delineated by VHB staff in November
2001 in support of the Notice of Intent application to obtain Order on Conditions #64-354. The wetland
resource area boundaries were confirmed in a Determination of Applicability issued by the City of Salem
Conservation Commission on April 11, 2002.

The following section describes the resource area and the 100-foot Buffer Zone for the Coastal Bank
resource area at the Site.
3.2.1 Coastal Bank ,
The Wetlands Protection Act 310 CMR 10.30(2) define a coastal bank as "...the seaward face or side of
any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, '
land subject to tidal action, or other wetland'. This definition is further clarified in MassDEP Wetlands
Program Policy 92-1: Coastal Banks, which states "coastal banks can be inferred to be associated with
lowlands subject to tidal action or land subject to coastal storm flowage'. Rule B of this Policy further ,
states: "For a coastal bank with a slope greater than or equal to 4:1 the top of the bank is the point above
the 100-year flood elevation where the slope becomes less than 4:1". '
The entire Site, including Mill Pond, is above the 100-year floodplain (Appendix B, Figure B-1). Therefore
the limit of the coastal bank is the point where the slope becomes less than 4:1. The limit of the Mill Pond ,
Coastal Bank wetlands resource area as approved by the City of Salem Conservation Commission in the
May 13, 2002 Determination of Applicability is depicted on Figure 2.
3.2.2 100-Foot Buffer Zone
The majority of the 100-foot Buffer Zone to the Coastal Bank in the remediation area contains asphalt and
concrete paved surfaces and a one-story wood-frame shed. The excavation area is entirely within the
parking lot and is not expect to go beyond the fence bordering Mill Pond.

4.0 REMEDIAL PROGRAM
The proposed remedial program includes the excavation and removal/disposal of chromium-impacted
soils from two areas within the 100-foot Buffer Zone to the Coastal Bank totaling approximately 9,400 ft".
' Based on the existing soil data, the site's operational history, and the proximity of the rail road tracks
which preclude excavation, the estimated excavation volume is 1,400 cubic yards (yd'). A post
' excavation sampling plan will be implemented to verify this characterization, and additional soil will be
removed, as necessary, based on these data.
The remedial program will include the installation of Site perimeter controls, erosion and sedimentation
controls, excavation soil stockpiling, excavation dewatering, saturated soil stockpile decanting, and
' control and disposal of non-hazardous materials at the Site. Excavated soil will be temporarily stored on
Site for testing before being transported off-Site for disposal. Remedial activities will not impact or alter
the existing Coastal Bank.
The following section describes the anticipated construction sequence for implementation of the proposed
remedial program.
4.1 Construction Sequence
The following sections describe the anticipated components necessary to implement the proposed
remedial program.
4.1.1 Health and Safety
' The existing Site-specific Health and Safety Plan (HASP) will be updated to include remedy-specific
activities and hazards. Subcontractors will be required to provide HASPs pertaining to their contracted
tasks and associated hazards. Throughout remedy implementation, health and safety activities will be
conducted to address potential site worker and community exposure to contaminated media, including
' inhalation of fugitive dust and particulates. The HASP will include provisions for the construction of high-
visibility fencing delineating the exclusion zone, posting signs and blocking access to unauthorized
1 personnel, the application of dust control measures (as appropriate), the use of safe work practices with
regards to heavy equipment and open excavations, and personal protective equipment.
' 4.1.2 Preliminary Site Work
Preliminary Site work will include the organization of remedial program logistics with Univar personnel to
minimize construction activity impacts on Univar daily operations. Preliminary Site work will also include
Ithe installation of initial erosion controls (i.e., hay bales and silt fence barriers) along the Coastal Bank
boundary along the length of the existing Site perimeter security fence in the area impacted by the
proposed remedial program.

4.1.3 Mobilization '
Contractor equipment and materials including excavators, dewatering equipment, frac tank, construction
fencing, and soil stockpile containment materials will be mobilized to the Site and staged in designated
areas. ,
4.1.4 Site Preparation '
Site preparation will include the cutting and removal of asphalt and concrete surface cover from the
excavation areas. Initial surface cover removal will be performed for a limited portion of the proposed
excavation areas and additional surface cover removal will proceed as excavation activities progress.
Sequential surface cover removal as the excavation progresses will limit the pervious surface area within
the construction area exposed to precipitation infiltration and subject to dust control. Soil stockpile ,
containment areas will be assembled, construction fencing delineating the exclusion zone will be erected
and excavation dewatering equipment will be prepared.
4.1.5 Erosion and Sedimentation Control
Erosion and sedimentation controls, initiated during preliminary site work, will be an ongoing activity at the
Site for the duration of the remedial program. Erosion controls consisting of hay bales and silt fence
barriers will be utilized along the perimeter of the Coastal Bank and around each soil stockpile. Erosion
and sedimentation controls are discussed further in Section 7.1.
4.1.6 Excavation
Chromium-impacted soils will be excavated utilizing standard earthmoving equipment to a maximum ,
depth of approximately 15 feet bgs in Area#1 and a maximum depth of approximately 5 feet bgs in Area
#2. Excavated soils will be temporarily staged on-Site in erosion and sedimentation control containment
berms and segregated into three stockpiles based on the results of a visual screening process. Following
excavation stockpile volumes reaching maximum storage limits or completion of the proposed
excavations, whichever is first, stockpiled soils will be characterized and loaded into transport trucks and '
transferred to a disposal facility licensed to receive such material.
4.1.7 Dewatering ,
Excavation activities to an anticipated depth of 15 feet bgs in Area#1 will require excavation dewatering
and saturated soils removed from Area #1 will require decanting prior to their transport off-Site.
Excavation dewatering fluids will be pumped directly into a fractionation (frac) tank for settling and
treatment prior to effluent discharge in accordance with the MCP and National Pollutant Discharge '
Elimination System (NPDES) Permitting Program requirements. Excavation dewatering and stockpile
decanting activities are detailed further in Section 7.2.

4.1.8 Post-Excavation Sampling
Soils that exhibit visual indications of chromium impacts (i.e., yellow or green staining) will be excavated
to the extent practical. Verification soil samples will be collected from excavation sidewalls and bases
' and submitted for analysis of Cr... and Crvi to confirm chromium-impacted soils have been removed to
support a condition of"No Significant Risk".
' 4.1.9 Resource Area Restoration
Based on the existing soil data, implementation of this remedial program will not alter or impact Mill Pond
Coastal Bank areas. Areas within the 100-foot Buffer Zone to the Mill Pond Coastal Bank impacted by
the remedial program will be restored in accordance with the procedures described in Section 7.4.
I4.1.10 Demobilization
Once resource area restoration is complete, the contractor will demobilize all personnel, equipment, and
material from the Site. Each piece of equipment and non-disposable material will be decontaminated in
accordance with the MCP. No materials will be disposed of within the wetland resource areas or the 100-
foot Buffer Zone.

5.0 IMPACTS TO WETLAND RESOURCE AREAS
The proposed remedial program is designed to improve the quality of on-Site soil and downgradient
groundwater, including potential groundwater discharge to Mill Pond, by removing a source of chromium
impacts in Site soil. As a result, this remedial program will have a beneficial impact on the wetland ,
resource areas.
Based on the existing soil data, the proposed remediation will not result in the alteration of or impact to '
any Mill Pond wetland resource area including the Coastal Beach, Salt Marsh, or Coastal Bank.
However, remedial activities will have a temporary impact on the Coastal Bank 100-foot Buffer Zone. ,
Anticipated impacts to the 100-foot Buffer Zone to the Coastal Bank are discussed in the following
section.
5.1 Coastal Bank
The proposed remedial program will include the excavation of approximately 1,400 yd' of chromium-
impacted soils from within the 100-foot Buffer Zone of the Coastal Bank. However, excavation activities
will not alter the existing Coastal Bank. Remedial activities conducted within the 100-foot Buffer Zone will '
result in an improvement of subsurface conditions and thus result in an increase in the quality of
groundwater that discharges to Mill Pond. Upon completion of remedial activities, Site conditions will be
restored to conditions equivalent to those present prior to implementing the remedial program. The '
percentage of impervious surface cover will not be increased.

6.0 COMPLIANCE WITH PERFORMANCE STANDARDS
As described in the previous section, the proposed remedial program includes activities within the 100-
foot Buffer Zone to the Coastal Bank. This remedial program is proposed as an Activity within the Buffer
' Zone under the provisions of 310 CMR 10.02(2)(b)(3) and will be conducted as a Limited Project pursuant
to 310 CMR 10.24(7)(c)(6). The following sections describe how this remedial program complies with the
1 regulatory criteria for response actions permitted as Activities within the Buffer Zone and the performance
standards for work in Buffer Zone.
' 6.1 Activities Within The Buffer Zone
Activities permitted under 310 CMR 10.02(2)(b)(3) are subject to preconstruction review by the issuing
' authority through the filing of a NOI and authorize the issuing authority to issue an Order on Conditions
and impose such conditions to meet the performance standards for work in Buffer Zone.
As described in the following section, the proposed remedial program generally complies with the
performance standards for work conducted in a 100-foot Buffer Zone to a Coastal Bank. Remedial
activities will not alter or adversely impact the Coastal Bank and Buffer Zone conditions will be restored
following remediation.
' 6.2 Resource Area Performance Standards
This section describes the performance standards for Coastal Banks and discusses how this proposed
remedial program is in compliance.
' 6.2.1 Coastal Bank
' As identified in 310 CMR 10.30, there are two sets of performance standards for Coastal Banks, each
applying to the appropriate functional class. The two functional classes of Coastal Banks are those that
are significant to storm damage prevention or flood control due to the coastal bank's contribution of
' sediment to a coastal beach, dune, or barrier beach [310 CMR 10.30(3) through (5)] and those that are
significant to storm damage prevention and flood control because they act as vertical barriers to storm
waters[310 CMR 10.30(6) and (7)].
Based on the Site location (i.e., approximately 3,000 feet west of Salem Harbor), the Coastal Bank of Mill
Pond functions as a vertical buffer to storm waters, not as a sediment source and therefore the
performance standards of 310 CMR 10.30(3) through (5) are not applicable. Since the proposed work is
entirely in Buffer Zone to the Coastal Bank, this remedial program has been designed to meet the
following applicable 310 CMR 10.30 performance standards:
' 310 CMR 10.30(6) Any project on such coastal bank or within 100 feet landward of the top of such
bank shall have no adverse effects on the stability of the coastal bank.

6.3 Limited Project 1
Limited Projects are categories of activities conducted within an existing regulated wetlands resource
area which can proceed at the discretion of the issuing authority without fully meeting the applicable 1
resource area performance standards. The types of projects covered as Limited Projects are, by nature,
activities which are important to the protection of public health, safety and/or the environment, such as
remediation projects in accordance with the MCP.
In accordance with provisions at 310 CMR 10.24(7)(c)(6), this remediation project will be conducted as a
Limited Project. '

7.0 MITIGATION
This remedial project is proposed to remove a source of continuing chromium impacts to soil and
' groundwater in the uplands area of Mill Pond, a source present as a result of over 70 years of industrial
manufacturing activity at the Site and located hydraulically upgradient of the wetlands resource area. No
loss of or direct impact to a wetland resource area will result from the proposed remedial program.
iMitigation measures proposed include the use of short term construction-related controls designed to
avoid potential impacts to wetland resource areas where practicable and minimize unavoidable impacts.
' Long term mitigation measures include the removal of up to 1,400 yd' of chromium-impacted soil from the
subsurface within the 100-foot Buffer Zone to Coastal Bank upgradient of the wetland resource area.
The following sections discuss short term mitigation measures in greater detail.
I 7.1 Erosion and Sedimentation Control
The proposed remedial program will include comprehensive erosion and sedimentation control plans
designed to isolate construction activities from wetland resource areas outside the,work area, avoid
unnecessary impacts and minimize unavoidable impacts.
The proposed remedial program consists of the temporary disturbance of approximately 7,500 ft' of land
' within the 100-foot Buffer Zone to Coastal Bank and is below the one acre threshold requiring an NPDES
Notice of Intent for discharge of stormwater from construction activities.
Proposed erosion and sedimentation controls, depicted on Figure 3, include the following:
1 ■ Stabilized construction entrance: Vehicular access to and egress from the construction
area will be provided through a single point of access. This access point will include
facilities to wash truck tires prior to departure and a crushed stone pad to facilitate
drainage.
' ■ Coastal Bank Barrier: During preliminary Site work, the contractor will install a hay bale
and silt fence barrier wall along the Site perimeter security fence beginning 25 linear feet
south of the southern extent of Staging Area #1 and extending 25 linear feet past the
northwestern extent of Staging Area#2 (Figure 3).
■ Temporary Discharge: (see also Sections 7.2 and 7.3) Collected surface water runoff,
excavation dewatering and soil stockpile decant water will be collected and transferred to
the frac tank located in Staging Area #2. Effluent will be treated and discharged directly
to Mill Pond north of Staging Area#1 through a"dirt bag"filter,crushed stone, and staked
hay bales and silt fence. These devices, coupled with the monitoring and control of
volume of dewatering effluent discharged from the Site, will allow strict control of
I discharge velocities and avoid unnecessary impacts to wetland resource areas.
■ Soil Stockpile Controls: Soil stockpile containment berms, located in Staging Area #2
(Figure 3), will be constructed utilizing hay bales and silt fence barriers completely
surrounding the stockpiles and will include the emplacement of 60-millimeter
' polyethylene (poly) sheeting as a base liner. The poly sheeting will be extended over and
across the surrounding soil stockpile hay bale containment structures and draped over

each soil stockpile and secured at the end of each work day to minimize fugitive dust
escape and precipitation infiltration.
7.2 Excavation Dewatering and Stockpile Decanting
Excavation activities to an anticipated depth of 15 feet bgs in Excavation Area #1 will require excavation '
dewatering and saturated soils removed from below the water table will require decanting prior to
transport off-Site. Excavation dewatering fluids will be pumped directly into a three-chambered frac tank
for settling and treatment prior to effluent discharge in accordance with the MCP and NPDES Permit
requirements. Soil stockpile decant water will be collected in sump areas constructed within each of the '
soil stockpile containment berms and pumped into the frac tank. After suspended solids settlement
dewatering fluids will be treated by filtration, flocculation, and/or chromium reduction utilizing bag filters
and liquid-activated carbon prior to effluent discharge. Effluent will be tested for compliance with the MCP '
and the NPDES discharge permits.
7.3 Stormwater Management '
Stormwater runoff at the Site during remedial program activities will be controlled in accordance with the
standards of the NPDES administered by the United States Environmental Protection Agency (USEPA).
Stormwater that falls within the remedial area will be collected as part of the dewatering and decanting
operations and treated prior to discharge in accordance with the applicable NPDES regulations.
Stormwater runoff from the remainder of the Site will be directed away from the remedial program area to '
minimize the volume of stormwater requiring treatment. Dewatering effluent will be collected, conveyed to
the frac tank for testing and treatment (if necessary) prior to discharge.
This remedial program does not include any redevelopment or new development, the emplacement of
any new impervious surface areas, or any new permanent stormwater discharge not currently in '
existence. The temporary water discharge will be located outside of all wetland resource areas and will
be controlled by filter bags, hay bales, and silt fence barriers. ,
7.4 Resource Area Restoration
Following completion of the remedial program, resource areas affected by construction activities will be
restored to conditions equivalent to those existing prior to implementing construction activities. The
proposed restoration is designed to remove any temporary structures installed during construction
activities, restore existing grades, and replace surface cover. Erosion control mitigation measures will
remain in place throughout the restoration activities. The following section describes those activities
necessary to restore the 100-foot Buffer Zone to the Coastal Bank. ,

' 7.4.1 Coastal Bank
During the proposed remediation, approximately 7,500 ft' of Buffer Zone to the Coastal Bank will be
impacted by construction activities. No construction activities will impact or alter the existing Coastal
Bank and the Coastal Bank will be protected from erosion or additional sedimentation by the installation of
hay bales and silt fence barriers. Following remediation, hay bales and silt fence barriers will be
removed, original grade in the Buffer Zone will be restored, and surface cover will be restored to its pre-
excavation conditions (parking lot). No new impervious surfaces area will be created during restoration
activities.

8.0 SUMMARY AND CONCLUSIONS ,
BASF proposes to excavate chromium-impacted soils present in the subsurface within and near the 100-
foot Buffer Zone of the Coastal Bank of Mill Pond located at the former Hamblet & Hayes facility on
Colonial Drive in Salem, MA. The remedial program includes temporary impacts to the Buffer Zone to the '
Coastal Bank but will not alter or impact the Coastal Bank, Salt Marsh, or Coastal Beach areas of Mill
Pond. No temporary or permanent loss of wetland is proposed and all disturbed areas within the Buffer '
Zone will be restored to current conditions upon completion of construction activities. Abutter notifications
are included as Appendix C.
The proposed remedial program complies with the performance standards for Activities Within The Buffer
Zone as described under 310 CMR 10.30(2)(b)(3) and will be performed as a Limited Project pursuant to '
provisions at 310 CMR 10.24(7)(c)(6).
The applicant respectfully requests the City of Salem Conservation Commission, as the issuing authority, '
find that the proposed program will remediate and restore conditions on Site, and therefore issue an
Order on Conditions for the remedial program described herein.

The project will benefit Mill Pond by removing a source of chromium in soil that is impacting the quality of
groundwater that discharges to Mill Pond.
Information and plans for the project may be reviewed between 8:00 am and 4:00 pm at the Conservation
Department, Salem City Hall Annex. A public hearing will be held at the Salem Conservation
