B. Order of Delineation (cont.)
This Order of Resource Area Delineation determines the boundaries of those resource areas noted above
and is binding as to all decisions rendered pursuant to the Massachusetts Wetlands Protection Act
(M.G.L. c.131, §40) and its regulations(310 CMR 10.00) regarding such boundaries. This Order does
not, however, determine the boundaries of any resource area or Buffer Zone to any resource area not
specifically noted above, regardless of whether such boundaries are contained on the plans attached to
this Order or to the Abbreviated Notice of Resource.Area Delineation.
This Order must be:signed by a majority of the Conservation Commission. The Order must be sent by
certified mail (return receipt requested) or hand delivered to the applicant. A copy also must be mailed or
hand delivered at the same time to the appropriate DEP Regional Office (see Appendix A)

C. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office(see Appendix A)to issue a Superseding Order
of Resource Area Delineation. The request must be made by certified mail or hand delivery to the
Department, with the appropriate filing fee and a completed Appendix E: Request for Departmental Action
Fee Transmittal Form, as provided in 310 CMR 10.03(7)within ten businessdays from the date of
issuance of this Order. A copy of the request shall at the same time be sent by certified mail or hand
delivery to the Conservation Commission and to the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40) and is inconsistent with the wetlands regulations(310 CMR 10.00).
To the extent that the Order is based on a municipal bylaw or ordinance, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department of Environmental Protection has no appellate
jurisdiction.

The following is a summary of wetland investigations conducted on a parcel east of Circle Hill
Road in Salem,Massachusetts. The purpose of these investigations was to determine the wdent
and location of wetland resources subject to jurisdiction under the Massachusetts Wetlands
Protection Act(MGL Ch. 131 S.40)and the City of Salem Wetlands Ordinance within and
immediately adjacent to the project site.
1.0 Methods
Wetland investigations were conducted on Septernber'20,2000 and January 31,2001.
Documentation of the wetland delineation using vegetation and soil sampling at established
transect locations was conducted on March 27,2001. The limits of jurisdictional wetland
resources were delineated with numbered sequences of flags in accordance with the
procedures established within the Massachusetts Wetlands Protection Act Regulations(3 10
CMR 10.00)and the Department of Environmental Protection—Delineating Bordering
Vegetated Wetland handbook(1995). Vegetation,soils and hydrologic indicators were used
to establish the wetland boundary. Enclosed,please find DEP Bordering Vegetated Wetland
Delineation Field Data Forms supporting the wetland delineation at four locations.
2.0 Site Overview
The project site presently contains several rocky knolls separated by drainage channels
containing intermittent streams with-a narrow fringe of wetland vegetation. The largest area
of wetland is along the eastern property boundary. Much of the site is in an ea fly
successional stage,with dense,sapling and shrub-sized grey birch(Betula pWrdifoha)and
trembling aspen(Populus tremuloides). Wetlands typically contain late meadow/early shrub
swamp species, including meadowsweet(Spiraea latifolia)willow(Sala sp.),and goldenrod
(Solidago sp.).

3.0 Wetland Resources
Areas identified by wetland flags Al-A38,B1-B74,and.DI-D63 have all been determined to
qualify as bordering vegetated wetland(BV W)under 310 CMR 10.00. The C-series wetland
located off site to the west appears to be an isolated basin,not connected to another wetland
or waterway,and is therefore not jurisdictional as a BV W. This wetland may qualify as an
Isolated Land Subject to Flooding, in addition to being under federal jurisdiction through
Section 401 and 404 of the Clean Water Act.
Within the areas of BV W are intermittently flowing streams that discharge toward the eastern
portion of the site,then off-site to the south. None of these streams is indicated on the US
Geologic Survey topographic quadrangle covering the site. Therefore,they are presumed not
to contain Riverfront Area pursuant to 310 CMR 10.58. They do,however,contain inland
bank subject to jurisdiction under 310 CMR 10.54.
Areas within 100 feet of areas identified as BV W are subject to jurisdiction by the Salem
Conservation Commission as administrators of the Wetlands Protection Act and the Salem
Wetlands Ordinance.
3.0 Other Resources
The site is not located within the estimated habitat of rare wetlands wildlife,as determined by
reference to the Massachusetts Division of Fisheries and Wildlife Natural Heritage Atlas
(2000-2001 edition),nor is it located within an Area of Critical Environmental Concern
(ACEC)as mapped by the Massachusetts Department of Environmental Management.

Dear Councillors:
Enclosed please find petitions from the residents of Parlee Street,Paul Avenue,
Cauldron Court,Malone Drive, Circle Hill Road, Ugo Road, Malm Avenue, Barcelona
Avenue, and Crowdis Street, that we would like to have placed on your next City
Counci I agenda. The citizens of these streets are against the development of the land
near Dell Street,Parlee Street, and Circle Hill Road, which has already been sold to a
developer but is also presently being looked at by the Conservation Commission.
The reasons we are against the development of this land are as follows:
1) Most of the land are wetlands.
2) There is not much open space left in Salem and we would like to keep this
land for open space.
3) We are also concerned where the connection road or access road to the
development will be. If the access road originates from Highland Avenue to
Mooney Road or another street off of Highland Avenue then our streets will
be like raceways which will be very dangerous to the residents and especially
the children .

Please do what you can to preserve our wetlands, keep some open space in the
City of Salem, and protect the citizens in our area.

RE: Review of wetland delineation at property off Durkin Road
Dear Mr. Cefalo and Conservation Commission Members:
At your request, I have reviewed the wetland delineation at the above referenced
property. My field studies were conducted on May 23, 2001. 1 reviewed all wetland
systems shown on plans entitled "Resource Area Plan located in Salem, MA,"prepared
by Eastern Land Survey Associates, Inc. dated April 24, 2001.
I conducted my review of the delineation using criteria established under Federal, State
and local regulations. I was able to see nearly all the flags depicted on the plan, however,
some were either missing, or I could not find them owing to the thick cover on the site.
With the few exceptions noted below, I believe the flags in the field depict a reasonable
and professional interpretation of jurisdictional wetland resource areas on and adjacent to
this site. My opinion of the wetland boundary differs in,some locations and the
Conservation Commission may wish to incorporate the following into their determination
of the wetland resource boundaries:
• Move flag C3 six feet northerly, eliminate flag C5 and connect C4 to C6.
Add an intermediate flag midway between D3 and D4, eight feet upslope.
• Move D1 six feet northerly.
• Add anew flag 27 feet northwest of D63; connect to D63 and the relocated DI.
• Move D45 five feet westerly.
• Move D42 eight feet northerly along the line of D42/D43.
• Add an intermediate flag midway between D60 and D61, ten feet upslope of the line.
• Eliminate D34 through 37; connect D33 to D38.
• Add an intermediate flag between D24 and D25, five feet upslope.
• Move B35 ten feet easterly.
