The main cause of this has been the delay attendant upon receiving necessary permits for the same work from the Commonwealth of Massachusetts Division of Waterways and United States Army Corps of Engineers. All permits have now been obtained and work is in progress. Since the tanks are in a velocity zone in an area inundated by the 100 year flood, as defined by the Flood Hazard District in the Zoning Ordinance of the City of Salem, the tank vents shall be at an elevation greater than 21 ft., mlw. c. All proposed dredging shall be permitted with the restriction that dredging shall be done between October lst and May 31st. If dredged material used for fill on this site causes an odor it shall be covered by a 2 inch layer of sand. d. Construction materials or equipment shall not be disposed of in the harbor. e.i If the timber in contact with theharborwater is to be treated, the preservative shall be non-toxic to marine life. f. The lobstermen presently located at the site will be given one month's notice of any proposed dredging. Massachu,,vtts 01970 C ADDENDUM Salem Harbor has served many productive purposes including commercial net- gill fishing, trap-fishing, lobstering as well as sport-fishing, sailing, pleasure motor boating and boat tours. The Pickering Wharf property is adjacent to the South River Channel and is situated along the inner Salem Marine Basin, Northwesterly of the recently renovated Central Wharf portion of the U.S. National Park Service's Salem National Maritime Park. It is an area of low wave action and accordingly has acted as a shelter and tie-up for craft during storm conditions. Historically, the property has been used as a coal (storage) facility and most recently as an. oil (storage) depot. Over the years, water quality has worsened, due in large part to the interruption of the tidal flow into the South River and its underground culvert and the brackish state of the Old Mill Pond wetland. 1 The presence of the oil depot facility was to have an high impact on the area, including heavy (oil laden) situation into the water abutting the property and also deteriorating seawalls (both wood and stone) ; and adding to the .poor water quality. In fact, all of Salem's waters and flats are closed to the taking of shell-fish for human consumption except for one area, east of the light of Fort Pickering to the easterly extremity of Pickering Point in South Salem and even these shellfish areas are moderately contaminated.Z The immediate area for proposed renewal and dredging along the Pickering property supports little or no significant marine life, except for shellfish which die off after growing only moderately and tapeworms which thrive in muck and silt (as it exists now) . The dredging proposed is temporary and its impact has no ill effect on fisheries3 or their life cycle and even the above mentioned marine forms will return to the area s.fter dredging is completed. The dredging impact will be to remove years of build up siltation, returning the seawalls to their original height (top to bottom) , removing accumulated debris and rubbish and environmentally and visually improving the site. It must be stated that the seawalls themselves shall be either totally replaced, capped, strengthened, or rebuilt. All must be considered as definite improvement for the downtown Salem shoreline. It is clear from conversations with both the lobstermen and the developers of the Pickering property that all fishing and lobstering is done outside the proposed dredging area. The commercial fishermen have chosen not to seek alternatives available to them for relocation of their shoreline docking operations (loading and unloading) and are now docked, temporarily, -2- adjacent to the N14 bulkhead of Central Wharf by permit of the U.S. National Park Service.4 This permit is of short duration, erpiring 1231/78, non- renewable, is for the purpose of allowing the permittees time to find and secure, within the time duration of the permit, docking arrangements out- side the Salem Maritime National Historic Site. The current proposed use of the Pickering property (Heritage _Trust II) will significantly reduce the negative environmental impact of the area, and without ill effect according to its prior use. The visual and aethestic qual- ity will be greatly enhanced by the proposed commercial and residential usage. Gray, Sr. , and members Jane T. Lundregan, William Abbott, Arthur LaBrecque, and Donald Eames::present. Notices were duly mailed to abutters and others in accordance with Massachusetts General Laws, Chapter 808. Attorney Barry Plumkett represented the petitioner before the Board. . He stated that the complex will contain commercial, residential and a theatre, and the variances requested are as follows: 1. To co{istruct buildings A, K, and L. as shown on said plan, (combined Residential and non-Residential use) within 30 feet of abutting property lines..- The ines..The petitioner stated that a study had been done and plans drawn up according to the study to make the best use of the land, commercially and astheticly. The land is abutted on one side by the water. The petitioner further stated that the side line and set back requirements from the street and property lines as required by the Salem Zoning Ordinance . would restrict'-; develop able portion of the land and would thus render the buildings inconsistent with the surrounding structures and the architectural character. The Board voted unanimously to grant the variances as requested; . The Board found that the property was unique because of its size and location. The Board found that a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship. The Board further found that it could grant the relief requested without any detriment to the public good, and with- out derogating from the intent and purpose of the Zoning By-Law. It was found that the granting of the variances would be to the benefit of the City of Salem. GRANTED. Attorney Plunkett, representing the developers, explained that his clients wish to reconstruct the seawall, build slips and dredge at their property at 197 Derby St. Attorney Plunkett added that the necessary permits from the Army Corps of Engineers and the Div:.sion of Waterways are pending. Philip Briggs of Add Inc. explained that Heritage Trust wishes to re- build the seawall from where it is now to the property owned by the Federal Government. Dredging will be done on the edge of the pier and will consist of approximately 500 cubic yards of silt. The developer, wish to dredge the silt to 12 feet below mean low water. Brad Northrup questioned the construction of the floating dock. Mr. Briggs explained that they would be wood piles with styrofoam floats with. wood ramps to the dock. Brad Northrup also inquired whether the developers will have gasoline on the site . Mr. Briggs stated there would be underground fuel storage. He added that it has not been decided at this time what fuel storage capacity would be, but he gave an approximate estimate of 5000 gallons. Paul Sdillis questioned the proposed anchorage of these tanks. Klr. Collins stated that they would be fiberglass tanks, steel banded and anchored in slab concrete . The Court finds further that the defendants in this action have no possessory rights in the area in issue either as tenants, by adverse use or otherwise." Attorney Stephens replied That this decision was being appealed. Attorney Stephens next questioned the date of the hearing, as it falls on a Jewish Holiday. Joe Antonelli showed the Commissioners pictures he had taken of the debris on the property. Paul Willis remarked that at least part of the fill placed` on the property came from the sewerage project. Joe is to check with Hewitt Construction Co. as to ,Then they are going to comply with the Cease and Desist. In addition Joe informed the Commission that he has written a letter to Colin Cameron advising him of the potential health hazard resulting from the dumping on the lot on Clark St. Joe is to follow up the letter to Por. Cameron with a phone call. Ma.,101u 1 11S-1139 , 0 ADDENDUM Salem- Harbor has served many productive- purposes including commercial net gill fishing, trap-fishing, lobstering as well. ps sport-fishing, sailing, pleasure motor boating and boat tours: The Pickering Wharf property is adjacent to the South River Channel- and is situated along the inner Salem Marine Basin, Northwesterly of the recently renovated Central, Wharf portion of the U.S. National Park Service's Salem National Maritime Park. It is an area of low wave action and accordingly . has acted as a shelter and tie-up, for craft during storm conditions. Historically, the property has been used as 'a coal (storage) facility and most recently as an oil (storage) depot. Over thy= years, water quality has worsened, due in. large part to the interruption of' the tidal flow into the South River and its underground culvert: and the-brackish-state of the. Old Mill,- Pond wetland.l The presence of the oil depot facility was to have an high impact on the area, including heavy (oil ;laden) situation into. the.water abutting the property and also deteriorating seawalls (both wood and stone) ; and adding to the poor water quality. In fact, all of Salem's waters and . flats are closed to the taking of shell-fish for human consumption except for one area, east of the light of Fort Pickering to the easterly extremity of Pickering Point in South Salem and even-these shellfish areas are moderately contaminated.2 The immediate area for -proposed= renewal and dredging along the. Pickering ,.,property supports little or no significant marine life, except for shellfish :which die off after growing only moderately and tapeworm's which . thrive. in ; muck and silt (as it exists now) . The dredging.:proposed is temporary and -its . impact has no ill effect on fisheries3 or their life cycle and even the above mentioned marine forms will return to the area after dredging is completed.. The dredging impact will be to remove years of build up siltation, returning the seawalls to their original height (top to bottom) , . -removing accumulated debris and rubbish and environmentally and visually - improving the site. It must be Stated that theeseawalls,'themselves shall 'be either totally replaced, capped, strengthened, or rebuilt. All must be considered as definite improvement for the, downtown Salem shoreline. It is clear from conversations with both the lobstermen and the developers of the Pickering property that all fishing and lobstering is done outside the proposed dredging area. The commercial fishermen have chosen not to seek alternatives available to them for relocation of their shoreline docking operations (loading and unloading) and are now docked, temporarily, adjacent to the NW bulkhead of Central Wharf by permit_of the U:S .haCionaY ' Park Service:4 This perr_itis of 'short duration, erpiring 12j3I/78, non renewable, is for the purpose of allowing. the permittees time to find and secure, within the time duration of the peimit, docking arrangements out- side the Salem Maritima 1:at1onal Historic Site. The current proposed use of the Pickeringproperty. (Neritage Trust II) will significantly reduce the negative environmental impact of the area, and without ill effect according to its prior use. Our structural engineer has designed a new beam that will by-pass this pile (see attached sheet D66) . It is very important that the pile be cut off flush with the top of the seawall (elevation 11 .0) and not be used to carry any load, and that very close attention be paid to the proper installation of the new beam and additionalsteel . December 17, 1974 1.0 PURPOSE The purpose of the proposed investigation is to obtain prelimi- nary information about foundation conditions at the Pickering Oil Co. site. This information is needed for evaluating the feasibility of various foundation types and making estimates of foundation costs for various development schemes. If the decision is made to go ahead with development of the site, the subsurface data developed during this investigation will partially fulfil the requirements for final design of foundations, but will have to be supplemented by additional detailed boring data and foundation analysis for specific structures. _2.0 INFORMATION TO BE OBTAINED - 2.1 Available Information To the best of our knowledge, no borings have been made on the site previously. We have made a reconnaissance of the site and have summarized our observations in a letter report dated November 7, 1974 to Skid- more Owings & Merrill. In general, we observed that damage due to large settlements was obvious in several buildings, an oil tank, sections of the concrete spill-retention wall around the tank farm, and sections of the harbor-side bulkhead. These settlements un- doubtedly are the result of unfavorable foundation soils whose physical characteristics and geometry can only be determined by borings. f -2- 2.2 - 2.2 Proposed Boring Program We estimate that five (5) split-spoon borings, drilled to - bedrock, glacial till, or other good bearing material, would suffice to provide the general subsurface data needed for planning purposes. Since no high buildings (20 stories or more) are being con- sidered for this site, there will be no large concentrated loads which would require knowledge of the physical properties of the bedrock. Hence, no rock coring is required. No undisturbed sampling is proposed for this investigation. The split-spoon (disturbed) samples should be adequate for planning studies. For final design, some undisturbed sampling combined with detailed laboratory testing and foundation analysis may be economi- cally justified depending on the details of the foundation loading and the subsurface profile revealed at the site of a specific struc- ture by the split-spoon borings made for that structure as part of the final design. For estimating the cost of the proposed borings we have as- sumed that the average depth of each boring will be 60 feet. Be- cause there are no boring data available for the site, the assump- tion is only an educated guess. In order not to underestimate the cost we have estimated this depth on the high side of what might be expected, but there is the possibility that the foundation condi- tions might be even worse than our conservative guess and that the borings could go deeper than 60 feet. 2.3 Proposed Laboratory Testing Program The laboratory testing program would consist of measuring in- dex properties of the soil-samples: For the types of soil that are most likely to be encountered, those properties would include only. water-contents_-and.Atterberg Limits. More sophisticated laboratory tests, such as consolidation and strength tests, would be much more expensive and would require tak- ing undisturbed samples in the borings (which would be much more expensive than the split-spoon samples) . Such tests are not needed for the feasibility study, although they may -be.neede-d for final design of specific structures. -" " -3- 3.0 SCOPE OF WORk: Geotechnical Engineers Inc. would perform the following work: i 1. Select the layout of the borings. 2. Inspect the boring operations. 3. Perform laboratory tests as needed to classify '^ the soil samples. 4. Perform engineering studies to evaluate the technical feasibility of various foundation types. S. Evaluate the construction problems inherent in the foundation conditions at the site. i 6. Submit a report covering the results of the 4 study. i A surveyor should be engaged to lay out the five (5) pro- posed borings. This could be done by surveyors who work for the t City of Salem, or the work could be sub-contracted by Geotechnical Engineers Inc. , or by Skidmore Owings & Merrill. A boring contractor must be engaged to do the borings, either by Geotechnical Engineers Inc. or by Skidmore Owings &Merrill. The proposed boring program consists of five (5) split-spoon sample borings to bedrock or glacial till, with no rock coring. 4.0 FEE SCHEDULE Fees for our services will be based on the time worked on the project in accordance with the enclosed "Standard Conditions For Engagement." 5.0 ESTIMATE OF FEES 5.1 Engineering The engineering fee cannot be accurately determined in ad- vance. REPLY TO ATTENTION OF: - NEDOD-R-23-77-603 PUBLIC NOTICE 17 November 1977 - i Heritage Trust II, Essex Street, Salem, Massachusetts has requested a permit under Section 10 of the River and Harbor Act of 1899 and Section 404 of the Federal Water Pollution Control Act Amendments of 1972 to: Construct and maintain an approximately 60 berth marina at Pickering Wharf in Salem Harbor at Salem, Massachusetts as shown on the attached plans. The work includes the following. a. Approximately 1,145 linear feet of 6 foot wide pile supported floating dock around the perimeter of Pickering Wharf as shown on the plans. b. The installation of 10 finger floats, 6' x 18' each, along the southwest corner of the wharf. c. The installation of 8 finger floats on the east side of the wharf as shown on the plans. d. The installation of 3 gangplanks and floats for access to the floating dock. e. The construction of a pile and timber pier, 12' x 34' , with 3 floats around it at the northeast end of the wharf. f. Repair and replace the existing bulkheads around the wharf and place approximately 395 linear feet of riprap at the base of the steel sheet piling as shown on sheet 7. g. Dredge to a depth of 1 foot below mean low water as needed around the existing wharf. Approximately 800 c.y. of material will be dredged and placed in low spots on Pickering Wharf. This project is part of a combined residential, shopping center and marina to be constructed on Pickering Wharf. A plan showing the entire proposal is also attached to this notice. In order to properly evaluate the proposal, we are seeking public comment. Anyone wishing to comment is encouraged to do so. Comments should be submitted to us in writing by 19 December 1977. The applicant is required to obtain all necessary local and State authorizations including a water quality certificate from the State agency concerned with water quality control in accordance with Section 401 of the Federal Water Pollution Control Act Amendments of 1972. In- inial use of this information will be to convert Salem to the regular program of flood insurance by the Federal Insurance Administration. Further use of the informa- tion will be made by local and regional planners in their efforts to promote sound land use and flood plain development. 1. 2 Coordination Contacts and meetings with city officials , agencies , and residents yielded a variety of information regarding land use and planning data, past flood history, and estimates of current and future community development patterns. At a meeting held on November 26 , 1974 , be- tween town officials and representatives of Anderson- Nichols , decisions were made pertaining to study limits and methods; data was also gathered pertinent to flood- prone areas. On June 4 , 1975, representatives of the Federal Insurance Administration and Anderson-Nichols gave a presentation to Salem City officials and resi- dents to familiarize them with both the Flood Insurance Program, and the nature and requirements of the study to be performed. At the final coordination meeting held February 24 , 1976 , representatives of the Federal In- surance Administration and Anderson-Nichols again gave this presentation and also considered all questions from those in attendance. It was decided by the City Engineer that detention ponds (perched swamps) in upland wetlands should not be de- lineated, as the base flooding would be less than 1 foot. 1. 3 Authorization and Financing This Flood Insurance Study was conducted by Anderson- Nichols & Company, Inc. , at the request of the Federal Insurance Administration, U. S. Department of Housing and Urban Development. The source of authority for the study is the National Flood Insurance Act of 1968 , as amended. Authority and financing are contained in Con- tract No. H-3715 . 2. 0 AREA STUDIED 2 . 1 Scope of Study Y This Flood Insurance Study covers the incorporated area of the City of Salem. The area of study is shown on the Vicinity Map (Figure 1) . The detailed study is restricted to areas affected by tidal, flooding or the surge that accompanies severe storms, including the tidal flooding of the North, South, and Forest Rivers. In the detailed study, the effects of velocity are also considered. Thompson' s Meadow, a swampy area on the upstream section of Forest River, was evaluated by approximate methods . Existing development and proposed urbanization expected to occur within the next 5 years were also considered. 2. 2 Community Description The City of Salem, located 11 miles northeast of Boston, in southeastern Essex County, Massachusetts , is a sub- urban community of approximately 8 square miles . The city is bordered on the north by the Danvers River and Beverly Harbor, on the south by the Cities of Swampscott and Lynn, on the east by Beverly and Salem Harbors and the City of Marblehead, and on the west by the Town of Peabody. The area was incorporated as a town in 1630 , and the name of Salem (from the Hebrew work for "peace" ) was adopted. Salem is an important industrial center, with manufacturing as the predominant economic pursuit. Physiographically, Salem is located in the Glaciated Appalachians . The dominant bedrocks , probably Carboni- ferous in age, are clastics such as sandstone, shale, and conglomerate, metamorphosed to varying degrees , and originally deposited in sedimentary basins . Within Salem, the coastal lowland supports dense urban development and has been subjected to fill type modi- fications . The shoreline , 18 . 5 miles in length, is characterized by tidal-flat inlets , stretches of salt marsh and rough rock. The land rises gradually inland, and then rises sharply, becoming what is known as the "Salem Highlands" , its pock-marked plateau created by the more recent glacial action. These patterns produce a normal an- nual precipitation of 41. 28 inches , fairly well distrib- uted throughout the year. Temperatures rarely exceed 96°F in the summer or dip below -19°F in the winter months. Average temperatures are 70 . 3°F in July and 30 . 7°F in January. 2 . 3 Principal Flood Problems Because of its exposed location, Salem is vulnerable to high tide levels resulting from the effect of north- eastern-induced storm surges coupled with normal astro- nomical tide ranges . Damages to structures in the flood plains has occurred during a storm such as that of March 1830 (Reference 2) , and rncently in February 1972 and December 1974 , with their respective tide levels , at the Boston tide gage , being 9 . 1 feet and 7. 6 feet mean sea level. 2 . 4 Flood Protection Measures Presently in place along the shoreline are numerous em- bankments and seawalls designed for the primary purpose of erosion protection. These barriers do provide some protection against wave action associated with the more frequent events (10 and 50 year) . They may not be suf- ficient to significantly preclude flooding of property by the 100- and 500-year tidal events . Flood control projects for the North and South Rivers' were not designed to protect against tidal inflows of the magnitudes attained by the 100- and 500-year floods . Actually, the design criteria for these projects are based more on the 10- and 50-year figures for precipi- tation runoff with little consideration given to storm- tide effects. It must also be noted that the heights of existing or planned tide gates within the city are insufficient to prevent tidal inflow during the 100-year event. While it is acknowledged that some inland flooding does occur in conjunction with severe events , it is signifi- cant to note that recent construction such as that on Jefferson Avenue can be expected to alleviate this situ- ation during future flood events . It must be accepted, however, that the city storm-drainage system will not be able to operate effectively during times of heavy preci- pitation which is in concert with a high astronomical 4 tide and the storm-related ocean surge; unless suffi- ciently pumped, storm water cannot be discharged to an elevation below the existing tide level . 3. 0 ENGINEERING METHODS For flooding sources studied in detail in the community, standard hydrologic and hydraulic study methods were used to determine the flood hazard data required for this study. Floods having recurrence intervals of 10- , 50- , 100- , and 500- years have been selected as having special significance for flood plain management and for flood insurance premium rates . - The analyses reported here reflect current conditions in the watersheds of the streams . 3. 1 Hydrologic and Hydraulic Analyses As no continuous record of tidal-flood data for the im- mediate Salem coastline exist, long-term records from the Boston tide gage, representative of the Salem area, were used. The gage is located approximately 10 miles southeast of Salem, and is subject to the same north- eastern inducted surges encountered in Salem. Tidal ele- vations have been recorded at this gage since 1921. From 1851 to 1921, high tides were recorded at either Common- wealth Pier or the Navy Yard, and from 1723 to 1851 , were estimated from historical accounts . Values of the 10- , 50-, 100-, and 500-year tide elevations were obtained from a log-normal distribution of maximum tide levels (Figure 2) after adjustment for the observed gradual rise in sea level of 0. 05 foot per decade prior to 1910 and 0 . 1 foot per decade thereafter (Reference 3) . The elevations used for this study are all measured from mean sea level. Locations of elevation reference marks given in Exhibit 1 are shown on the Flood Insurance Rate Map (Figure 2) . 4 . 0 FLOOD PLAIN MANAGEMENT APPLICATIONS A prime purpose of the National Flood Insurance Program is to encourage state and local governments to adopt sound flood plain management programs. Each Flood Insurance Study, there- fore, includes a flood boundary map designed to assist commu- nities in developing sound flood plain management measures . 4. 1 Flood Boundaries In order to provide a national standard without regional discrimination, the 100-year flood has been adopted by the Federal Insurance Administration as the base flood for purposes of flood plain management measures . For tidal-flood areas , the boundaries of the 100-year and the 500-year flood have been delineated, using topo- graphic maps (Reference 4) , enlarged to a scale of 1 inch = 12 , 000 feet with a contour interval of 10 feet. Although flood boundaries are normally shown on a flood boundary map, in this study; maps showing flood insurance zones have been used to indicate the flood boundaries . On this map, the 100-year flood boundary coincides with the boundary of the areas of special flood hazards (Zones A3 and V3) and the 500-year flood boundary coincides with the boundary of areas of moderate flood hazards (Zone B) . In cases where the areas of special flood hazards (Zones A3 and V3) are not bordered by areas of moderate flood hazards (Zone B) , the 100-year and 500-year flood bound- aries coincide. 5. 0 INSURANCE APPLICATION In order to establish actuarial insurance rates, the Federal Insurance Administration has developed a process to transform the data from the engineering study into flood insurance cri- teria. This process includes the determination of reaches, Flood Hazard Factors , and flood insurance zone designations for the tidal areas of the city. 5. 1 Reach Determinations Reaches are defined as flood-prone areas having the same relative flood hazard, based on the average weighted difference in water-surface elevations between the 10- and 100-year floods . This difference does not have a variation greater than that indicated in the following table for more than 20 percent of the reach. Average Difference Between 10- and 100-year Floods Variation Less than 2 feet 0. 5 foot One reach meeting the above criterion was required for the flooding sources of Salem. This one reach was for the Atlantic Ocean. 5. 2 Flood Hazard Factors The Flood Hazard Factor (FHF) is the Federal Insurance Administration device used to correlate flood informa- tion with insurance rate tables . Correlations between 7 property damage from floods and their• FHF are used to set actuarial insurance premium rate tables based on FHFs from 005 to 200 . The FHF for a reach is the average weighted difference between the 10- and 100-year flood water-surface eleva- tions expressed to the nearest one half foot, and shown as a three-digit code. For example , if the difference between water-surface elevations of the 10-year and 100- year floods is 0. 7 foot, the FHF is 005 ; if the differ- ence is 1. 4 feet the FHF is 015 ; if the difference is 5. 0 feet, the FHF is 050 . Base flood elevation lines show the locations of the expected whole-foot water-surface ele- vations of the base (100-year) flood. This map is de- veloped in accordance with the latest flood insurance map preparation guidelines published by the Federal In- surance Administration. 6. 0 OTHER STUDIES While there have been past studies defining specific flcod problems for certain areas of Salem (References 5 and 6) , these studies have been concerned with precipitation runoff. Normal tide levels were considered, but tidal flood analysis was not done. The Flood Insurance Study for Swampscott has been completed and the results of this study are in general agreement with those for Salem. Engineering analysis of the subsoil conditions show that conventional underground utilities can be installed because of a stable soils condition. The existing utilities have been installed in this manner and have functioned satisfactorily over a period of years . E. The proposed buildings will be erected on piles mechani- cally fastened to a structural concrete slab first floor system in compliance with the Massachusetts State Building Code. The amendment stipulates that in these Districts, no structure or building shall be constructed or substantially improved, or earth filled or excavated, without a Special Permit from the Planning Board. In granting a Permit, the Board must find that a number of conditions have been met. These conditions insure that construction elevations and methods will minimize or eliminate flood damage. In short, if a developer wants to do something in the areas covered by the proposed ordinance that are not allowed by right, he must apply to the Planning Board for a Special Permit. The Board then must review the application in regard to specific criteria and approve the application if it complies, and disapprove it if it does not. Part of this review is a request for comments by the Building Inspector, City Engineer, Board of Health, and Conservation Commission. The ordi- nance stipulates that comments must be received within 35 days. Follow- ing that comment period, the Planning Board will hold a public hearing on the application; notice of the hearing will be sent to you. I am enclosing a copy of the amendment as adopted for your information. The Board of Appeals shall establish a hearing on the petition under the provisions of Chapter 40A of the Massachusetts General Laws and in accordance with the Board' s administrative rules , Section IX, Paragraph C. and shall notify the Planning Board, City Engineer, Board of Health, Conservation Commission and Historical Commission of said hearing. The Board of Appeals shall notify the applicant in writing of its decision on the petition. In the event a variance is granted, the Board shall document in its decision the nature of the variance from the provisions of the Wetlands and Flood Hazard Districts as well as the grounds for its granting. A variance from the Flood Hazard District shall include the following statement : "The construction of a structure below the base flood level increases risks to life and property and will result in increased premium rates for flood insurance up to amounts as high as $25 for $100 of insurance coverage. *" The Board of Appeals shall, as a condition of the variance, require that a copy of the variance be recorded by the applicant at the Registry of Deeds. 8.
