Special Conditions One Peabody Street 1. All work shall conform to the above-referenced plans and those final specifications which shall be filed with the Commission prior to construction. Any change made or intended to be made in the approved plans shall require the applicant to inquire of the Conservation Commission as to whether the change is substantial enough to require a new filing. If the Conservation Commission determines the changes to be substantial, the Commission can require the applicant to file a Notice of Intent. Z. Prior to commencement of excavation, a haybale barrier and an oil absorbant boom shall be placed downgradient of the area of work to prevent contamination of the adjacent resource area. Trench material shall be deposited on the upgradient side of the haybale barrier. Haybales shall be inspected daily and those showing signs of deterioration shall be replaced immediately. The haybale barrier shall remain in proper functioning condition until all disturbed areas have been stabilized. 3. Any additional erosion and sedimentation control measures deemed necessary by the Commission shall be instituted by the applicant. Any siltation caused onto any wetland or waterway areas shall be promptly reported to the Salem Conservation Commission and such areas restored to the satisfaction of the Commission. 4. During excavation all debris, fill and excavated material shall be stockpiled more than 100 feet away from the South River Canal and covered with 6 mil. polyethylene sheeting. 5. Servicing of equipment must be done outside the Buffer Zone to the resource area. Equipment must be maintained to prevent leakage or discharge of pollutants. Overnight storage of equipment must be 100 feet from the wetland boundary. 6. Use of rock salt (sodium chloride) or other toxic de-icing chemicals on paved areas is prohibited and any arrangement for snow removal shall so stipulate. 7. Members and agents of the Salem Conservation Commission shall have the right to enter and inspect the premises at all reasonable times to evaluate compliance with the conditions stated in the Order, and may require the submittal of any further and additional data deemed necessary by this Commission for that evaluation. 8. Upon completion of the project, the applicant shall submit with their request for a Certification of Compliance, and affidavit prepared by a professional engineer or land surveyor duly registered in the Commonwealth of Massachusetts, stating that the site has been developed in accordance with the requirements of this Order of Conditions and the referenced site plan. 9. Notice shall be given to this Commission no more than two (2) weeks nor less than two (2) days prior to the commencement of any construction activities. Dr. IIugh Mulligan of Gulf of thine Research Inc. was present at the meeting to discuss the drainage plans for the lot area at One Peabody Street. He noted that the Commission had placed a Condition that no parking temporary or otherwise should take place until the Commission reviews and approves a drainage plan. Dr. Plulligan stated that he had Scott Petrovich, a professional Engineer, look at the site and recommend a drainage plan. He stated that he recommended using leeching catch basins, which would be placed in six foot diameter basins and the water will run across the area disturbed and into the catch basin into the ground. The basins will contain bats that w311 catch oil and will be changed annually, and are designed to handle the one year storm. He also noted that the silt will be cleaned annually so that there is no danger of contaminating the wetland. John Vallis asked if they were recessed. Dr. Mulligan stated that the bat contains an absorbent material that attracts oil and would be replaced every year. He also noted that the life expectancy of the basins are indefinite if they are well maintained. Fred Harney asked if the property should be sold, if the conditions would go with it. Dr. Mulligan stated that they would be recorded at the Registry of Deeds and would have to be adhered to. Under an NPDES Permit Exclusion granted by the EPA Region I Office,pursuant to Title 40 of the Code of Federal Regulations, Part 122.3 (d), GMRC dewatered four underground No. 6 fuel oil storage tanks at the Site. The dewatering activities have since been completed, so that the underground storage tank removal activities may now proceed. The owner of the property,The George Peabody Cooperative Bank, has entered into a contractual agreement with Enpro Services, Inc. of Newburyport, MA for the removal of the underground storage tanks. The remaining liquids/sludges in the tanks will be cleaned and properly disposed of by the contractor. Any contaminated soil that is encountered during the excavation activities will be stockpiled on and covered with 6 mil polyethylene sheeting. Hay bales and/or an oil absorbant booms will be placed around any stockpiled material to prevent runoff. If dewatering of the excavation is necessary to GULF Or-MAINE RESEARCH CENTER INC. complete the tank removal,the contractor will either dispose of the water off-site, or treat the ground water and discharge the treated effluent into the South River Canal under the provisions set forth by local, state, and federal permitting procedures. Work at the Site is scheduled to begin Wednesday, November 28, 1990, and is expected to take approximately three weeks to complete the tank removal activities. Paving and additional sub-surface investigations will occur in the next six (6)months. File No.64-188. The proposed design will grade the area of disturbance (approx. 2600 SF) into a broad swale channeling the stormwater runoff into a leaching catch basin designed to retain the one year storm. The one year storm is defined as the "first flush" and contains a large majority of pollutants which occur in urban runoff. WATER QUALITY ISSUES Urban runoff is composed of oil, grease, trace metals (such as lead) , and soluble pollutants (such as chlorides, BOD, nitrogen and phosphorus) . Oil, grease and some trace metals have a high affinity for sediments (particulates) . Much of the hydrocarbon load adsorbs to particles of sand and silt. Some trace metals (approximately 50%) are soluble. Chlorides (salts) can substantially be eliminated by simply not applying them. Nitrogen, BOD, and phosphorus components may be relatively insignificant from the paved area. The majority of pollutants are mobilized during the "first flush" events which are the frequent, low-intensity rainfall events which continually "wash" the watershed. These pollutants are also mobilized at the beginning of large rain storm events. Typically, water quality management practices are designed for this "first flush. " In this case, the volume of the "first flush" is equivalent to the runoff volume resulting from a one year 30 minute storm event. To address water quality issues, the proposed design retains the "first flush" , allowing the water collected to exfiltrate into a 2' wide gravel area and then into the surrounding soil . Absorbent bats will be hung into the leaching catch basin to absorb oils. To insure that the leaching basin performs as designed, annual maintenance is required to replace the absorbent bats and to remove silt and sediment which has built up on the bottom of the leaching basin. 14 English Street, Salem, Massachusetts 01970 508-741-1663 SUPPORTIVE CAI=LATIONS To address concerns about drainage and the water quality of the runoff generated from the disturbed site, we have proposed grading of the ground surface to channel stormwater into a leaching catch basin. The disturbed area is approximately 2600 SF where pavement was excavated to remove several underground storage containers. Presently this area exists as a dirt surface. Refer to attached Drainage Plan prepared by Patrowicz Land Development Engineering dated January 25, 1991. This area will receive asphalt pavement to match the existing pavement. The design includes the installation of a leaching catch basin in the northeasterly corner of the disturbed area. The leaching catch basin is sized to retain the one year ( 30 minute) storm event "first flush". This design storm event produces a rainfall amount of 0.75 inches per Technical Paper 40 (SCS) . The quantity of runoff generated by the design storm for the disturbed area is 162 cubic feet of water. The leaching catch basin has a' storage capacity of 167 cubic feet and therefore will retain the "first flush" . Note this volume calculation is conservative because it does not include the extra storage volume which is available through exfiltration into the surrounding soils. The leaching catch basin shall be a Chase Precast Corp. product # LP 6x3 which is a 6' diameter by 3' deep concrete basin or equal. The basin shall be installed with 2' crushed stone or gravel surrounding the sides as detailed on the drainage plan. Three absorbent bats (1811 long) will hang from the catch basin grate to absorb oils. ' Attachment R1 Report from Gulf of Maine Research Center, Inc. 27 February 1990 1 1 1 1 1 GULF OF MAINE RESEARCH CENTER INC. tENVIRONMENTAL CONSULTING SERVICES 204 LAFAYETTE STREET ' SALEM, MA 01970 (508) 745-6618 FAX (508) 741-8648 ' Salem Conservation Commission February 27, 1990 1 Salem Green ' Salem, MA 01970 Attention: John Vallis, Chairman RE: Proposed construction at #1 Peabody Street Salem, ' Massachusetts ' Dear Chairman Vallis: ' This letter, which constitutes an addition to the February 27, 1990 Notice of Intent under the Wetlands Protection Act (M.G.L. c.131 , s.40) for the above-referenced Site, is written to provide further information regarding proposed remedial activities ' associated with the removal of four 20,000 gallon subsurface fuel oil storage tanks and one 1 ,000 gallon subsurface gasoline storage tank from 1 Peabody Street, Salem, Massachusetts, hereafter referred to as the Site. ' Recently the applicant, George Peabody Cooperative Bank, of Peabody, MA acquired the Site through foreclosure and proposed to ' conduct site modifications required to reach compliance with the current provisions of Massachusetts General Law (MGL) Chapter 21E ' and all implementing regulations. In response to a request from Mr. Richard Carter, Vice President of the George Peabody Cooperative Bank, Gulf of Maine Research Center, Inc. (GMRC) has investigated 1 1 ' GULF OF MAINE RESEARCH CENTER INC. ' 2 this parcel of land for the presence of hazardous materials. In ' addition, Hugh F Mulligan PhD, Director of GMRC, addressed the Salem Conservation Commision on February 22, 1990 for approval to ' conduct a preliminary investigation at the Site. ' INTRODUCTION ' GMRC visited this Site on February 26, 1990. The purpose of this GMRC site inspection was to gather information necessary for ' the preparation of a Notice of Intent under the Massachusetts Wetlands Protection Act (M.G.L. Chapter 131 , Section 40) and t Regulations (310 CMR 10.00), as well as the City of Salem Wetlands Bylaw. All Wetland Resource Areas described herein are defined according to the Massachusetts Wetlands Protection Act (M.G.L. ' Chapter 131 , Section 40) and Regulations (310 CMR 10.00), as well as the City of Salem Wetlands Bylaw. ' The Site occupies an area of 43,007 square feet and is ' depicted as lot number 434 on Salem Assesor's Map 34 (Figure 2). The majority of the Site is occupied by a three-story building with ' associated paved areas. A chain-link fence marks the western, southern and eastern property bounds, while a granite sea wall along the South River marks the northern property boundry. Site ' topography is nearly level and the property is situated within an elevation of 10-20 feet NGVD. ' SITE HISTORY AND ASSESSMENT Based on a visual assesment of the site, research with state ' and local officials, and results from subsurface testing, evidence indicates that the Site contains oil contamination, probably relating to its history of heavy industrial use. Several reports of a 'sheen' t ' GULF OF MAINE RESEARCH CENTER INC. ' 3 have been noted on the South River adjacent to at the area where the ' property abutts the South River. ' Historic evidence and recent research indicate that four 20,000 gallon underground steel fuel oil storage tanks and one 1 ,000 ' gallon underground gasoline storage tank are buried on Site. It is likely that several of these underground storage tanks date from the early part of the twentieth century. The property was originally filled prior to the turn of the ' century, and may have been used by shipping companies as transfer space for industrial purposes. After the year 1910, the Site was occupied by the Essex County Electric Power Plant, and it's support building. Since the removal of the boiler house associated with the ' plant in 1965, the property has been used by various small businesses, including metal-working shops and a circuit manufacturer. Fuel oil has been stored at the Site since at least 1913, and ' evidence exists that other hazardous materials such as cutting oils, solvents, and transformer oils have been used there on a regular ' basis. Inspection of the soil samples from subsurface materials show that oily soils are present underground in the eastern portion of the Site. The lack of volatile organic compounds in groundwater ' samples taken at the Site indicate that the groundwater contamination is from heavier molecular weight fuel oils. In ' addition, low levels of PCBs were also found in one soil sample collected from the Site. The source of the PCBs has not yet been determined. ' PROPOSED ACTIVITIES AND MITIGATION 1 1 GULF OF MAINE RESEARCH CENTER INC. ' 4 The proposed project will involve the drainage, excavation, ' and removal of four 20,000 gallon steel underground fuel oil storage tanks and one 1 ,000 gallon gasoline storage tank within the 100' ' buffer zone of a Coastal Bank. ' The tanks have all been determined to be full of water.ln order to determine the most efficient means by which to dispose of the tank contents, it will first be necessary to analyze the tank contents to determine the concentration of contamination. tThere are three means of handling the contaminated water: 1 ) It can be disposed of at an off-site facility. 2) The contents of the tank can be treated prior to discharge into the sewer system 3) The contents of the tanks can be treated prior to discharge into the ' South River. In the event that options 2 or 3 are chosen, all permits required by state, local, and federal agencies will be obtained prior to treating the tank contents. In order to remove the fuel storage tanks, the area directly ' above and around the perimiter of the tanks must be excavated and contaminated soil must be temporarily stockpiled. Thus, t construction activties will take place approximately 50 feet from the granite seawall of South River (coastal bank). ' All contaminated soil will be stockpiled on and covered with 6 mil polypropylene sheeting to prevent potential erosion, siltation, ' and contamination of the resource area. The stockpiled soil will also be surrounded by an oil-containment boom and hay bales will be tplaced down-gradient to prevent any leachate from impacting the coastal waterway. After excavation, both the fuel oil and gasoline storage ' tank(s) will be removed from the site and disposed of accordingly. The excavation pit will be filled with clean soil and graded all contaminated soil will be handled in accordance with The 1 ' GULF OF MAINE RESEARCH CENTER INC. Massachusetts Contingency Plan ( 310 CMR 40.00 ) and Policy WSC ' 89-001 . ' All work done at the site will conducted so as to prevent any further impact to the coastal resource area and it is anticipated that the removal of oil-contaminated fill as a potential source of contamination will improve the area as a coastal resource. The Center evaluates ocean outfalls and impacts to other water uses, defines wetland boundaries, defines compensation for wetland utilization, evaluates feasibility of dredging and disposal of dredge spoils, and prepares Environmental Impact Statements, ' Environmental Impact Reports and applications for environmental Permits and approvals.
