General Conditions 1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas- ures,shall be deemed cause to revoke or modify this Order. 2. This Ordsr does not grant any property rights or any exclusive privileges;it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply. (a) the work is a maintenance dredging project as provided for in the Act;or (b) the time for completion has been extended to a specified date more than three years, but Tess than five years,from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. - 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. B. Any fill used in connection with this project shall be clean fill, conta ring no Dash, refuse,rubbish or de bris, including but not limited to lumber, bricks, piaster,wire,lath, paper, cardboard, pipe,tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until ail proceedings before the Department have been completed: ! 8. February 24, 1983 PROPOSED POND RECLAMATION " At : Tedesco Pond - Vinnan Square - Salem, Mass. Developer: Maine Post & Beam Company, Inc. , York Harbor, Maine Pond Engineer: Sea P.lanatation, Inc. , Salem, Mass. Description of Wetland: * 3.1 acre kettlehole pond located entirely within a 7.5 acre parcel of land owned by Pond View Realty Trust, adjacent to Stop & Shop at Vinnan Square. r, * The land was previously used as a gravel borrow pit. * It is currently vacant. * It is a holding pond for drainage run off from Vinnan Square area. * Flow is controlled by 2- 60" State installed culverts at opposite ends of 2 the Pond. * Surrounding land is from 8-15 feet above water level at pond. Proposed Oil `and Sediment Retention Basin: * We plan to construct an oil and sediment retention area in the vicinity of the influent culvert. This would resemble, a small footbridge in design. Oil surface scum trapped behind the bridge would be periodically manually removed. Sediment and silt could be pumped out by a septic tank pump truck. Bio-Mass Filter. Bar: * The existing sediment bar to the northeast of the influent culvert would remain and be encouraged by some grooming and planting to act as a natural filter to decrease turbidity, remove nutrients and improve wild- life habitat. Storm Drainage; . * We plan to construct two leaching fields fed by four catch basins to channel excessive drainage from the roadway into the subsoil to allow natural filtration of water into pond. Each basin will have an oil trap and sediment collection sump. * Drainage from influent culverts near the Stop & Shop end will be channeled into the oil and sediment retention basin. -z- / Jogging Track: * We plan to construct a V-6' wide footpath around the perimeter of the pond. Biological; * We plan to remove all existing rubbish and refuse from the pond. * We plan to introduce Fundulus Diaphanus (top minnow) to control mosquito larvae.
