RAGONE, LYNNFIELD, MA. , DEQ FILE NO. 64-11 This is to certify that at a public meeting on September 27, 1976, the Salem Conservation Commission voted to revoke the Order of Conditions granted under the Wetlands Protection Act to Joseph G. Ragone of Lynnfield, Massachusetts, to perform work on land adjacent to Swampscott Road, Salem. The application under the Wetlands Protection Act is identified by DEQE file no. 64-11 and the Order of Conditions is dated May 24, 1976. The action was taken because the work on the site is not in conformance with the Order of Conditions for the following reasons: (a) Equipment has not been removed from the pond and stream within the specified time period; (b) Filling of the marsh is not phased as directed to minimize siltation; y. '(c) The siltation dam has not been constructed; (d) Unacceptable material is being used as fill. This vote was taken following a letter, dated July 26, 1976, from the Com- mission to Mr. Ragone to advise him that if the Order of Conditions was not adhered to by August 31, 1976, the Commission would revoke it. That in accordance with Massachusetts General Law Chapter 131, a public hearing was' held and an Order of Conditions was issued on May . 24, 1976 which Order of Conditions is attached hereto and marked Aopendix.. "C" 7. That on or before July 26, 1976, the Defendant performed work affecting said fresh water wetland, creek and stream in violation of the said Order of Conditions in that filling was commenced with the construction of a dam and on the Northerly rather than the Southerly .:side of the fresh water wetland, creek and stream. r 8. ' That on July 26, 1976, the Plaintiff notified the Defendant of his violation of the terms of his Order of Conditions by Certified Mail, a copy of which Notice is attached hereto as Appendix r` V 9. That the Defendant after July 26, 1976 continued to perform work affecting said fresh water wetland, creek and stream in violation of the terms. of his Order of Conditions. $`{ w ' 10. That on October 8, 1976, the Plaintiff revoked said Order of �. Ragone Dear Mr. Feeherry: Mr. Ragone has undertaken to accomplish many of the conditions set by the Conservation Commission as prerequisites of a settlement. Since our last conversation in January, Mr. Ragone, his son and a contractor engaged by Mr. Ragone have spent countless hours cleaning the site and hauling rubble, trash and stored construction materials from the site. Mr. Ragone has informed me that all equipment and materials have been removed from the water and that much of the debris has been entirely removed from the site. He expects to complete all clean-up operations within a few weeks. To date, Mr. Ragone has incurred out of pocket expenses of approximately $3 , 100 in his efforts to comply with the Commission' s requests. This sum does not include his family' s time or the lost salvage value of the useable construction materials that he has disposed of in order to meet the Commission' s requests. He anticipates spending additional funds to complete the removal of trash and debris. There has been some additional dumping by unidentified third parties, but such dumping has not occurred with the frequency or severity of past dumping. Mr. Ragone anticipates barricading the entranceway to the property with large boulders or blocks once clean-up operations are completed. , This should prevent further dumping by third parties in that the only dumping in recent times has been done by people driving onto the property. There has been no dumping from the roadway onto the property, and it, therefore, does not appear that any barricades will be necessary other than along the entrance. In light of the expense of cleaning the property, Mr. Ragone is not in a position financially to seed the filled area. From Mr. Ragone' s observations, it is at least questionable whether seeding is necessary in any event. Despite heavy rains this winter and spring, there has been no erosion and no siltation of the filled areas. There is natural vegetation in the stream, and there appears to be siltation from upstream, but neither of these problems are the responsibility of Mr. Ragone. I would appreciate your thoughts on the need for seeding if, in fact, no erosion or siltation is taking place. Mr. Ragone has also requested that I extend an invitation to you and any other representatives of the Conservation Commission to view the property so that you can make your own assessment of his efforts. The channel design is understood to be in accordance with the revised calculation submitted at the public hearing on Monday, May 17, 1976, by Northeast Engineering and Survey Co. Inc. , Peabody, Ma. Additional 'conditions are as follows: 11(b) The riprap shall be of stone of shape and size and laid to reflect the value of Mannings n of 0.02 in the calculations. The riprap shall extend vertically 1 foot above the design water elevation due to the 100 year rainfall. 11(c) All channel slopes not constructed in bedrock shall be no greater than 12 horizontal to 1 vertical. All slppes above the riprap shall be covered with loam and seeded with grass from the top of the riprap to at least 3 feet from the top of the slope on the upper surface. 11(d) The temporary dams shall be adequately constructed to with- stand flood flows and shall be cleaned as required to prevent siltation downstream of the site. 11(e) The new channel shall be properly flared into the existing stream at the east end of the site. 11(f) All fill shall conform to condition 5 which requires that. all the material which has been dumped into the area from Swampscott Road shall be removed before commencing with further filling. 11(g) The proposed ditch from the pond on the south of the site to Forest River shall be cleaned by removing all materials dumped or stored on it. This ditch shall not be dredged or altered so as to drain or partially drain the pond. The length of the ditch in the proposed fill area shall have riprap and seeding as specified I! for the' m�.in channel. By a formal vote of the Commission, Brian French and I have been appointed to work with you to resolve this case. In general terms, the Commission is willing to settle this matter without further litigation. However, the Commission feels very strongly that such a settlement should be memorialized by an Agreement for Judgment which will incorporate at least the following terms : 1. Mr. Ragone must agree to neither fill nor otherwise alter the condition of his land without the approval of the Commission. 2. Mr. Ragone is prepared to enter into a formal agreement with the Conservation Commission that no further work will be conducted at the site without the prior approval of. the Commission. Mr. Ragone explained his plans. a. no culvert b. open up for bridge area, channel won't be straight but will follow the contours of the ledge. , � � c. bed of stream is n ostone ; 6 ft. uniform b�,t curving f��ollowing the contour. Channel is designed for the higher f1o�JA 12 cfs. Mr. French brought up the point of siltation in the stream, putting in a temporary dam,, one in the old and one in the new, sediment will be trapped and cleaned periodically. Mr. Ragone will lower the old stream so when the new one comes it will be proper level. The project will last from 2 to 5 years. He will level the hill at the same time and as far as the pond is concerned will not touch it but to clean it up. �.
