at the owner's risk only upon notice to the Department and to the Conservation Commission.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office(see htto://www.mass.oov/eea/agencies/massdep/about/contacts/)to issue a
Superseding Determination of Applicability. The request must be made by certified mail or hand delivery
to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for
Departmental Action Fee Transmittal Form)as provided in 310 CMR 10.03(7)within ten business days
from the date of issuance of this Determination. A copy of the request shall at the same time be sent by
certified mail or hand delivery to the Conservation Commission and to the applicant if he/she is not the

Section 3-.O—Rear Deck Replacement
3.1 General / Demolition
Remove the rear deck and staircase in their entirety. This shall include but may
not be limited to the masonry stoop (first step) below the staircase, the stair
treads, stringers, railings, support posts, lally columns, floor joists, decking, etc.
The masonry footings shall be replaced, however, the existing footings may be
abandoned in-place.
The existing deck is curved. The new deck shall be square. Rebuild the deck
according to the same general dimensions as the existing (approximately 36 x 10
feet).
This section specifies the minimum requirements. The contractor shall supply
and install all required materials for a complete and professional installation.
All work shall beperformed in compliance with the Massachusetts Building Coda
and be subject to the approval of the Salem ISD.
3.2 New Deck and Stairs
Supply, install, and construct a new deck and staircase according to the following
minimum requirements. The dimensions of the new deck shall be approximately
36 x 10 feet. All materials shall be pressure-treated pine except the decking,
stair treads, and stair risers. The decking shall be Fiberon Paramount Decking.
A. Footings: Excavate below the frost line (at least 48 inches below grade).
Form and pour new concrete footings using 12 inch diameter sonar tubes.
The depth and spacing of the footings shall comply with the
Massachusetts Building Code. The existing footings shall not be reused.
B. Concrete Stoop: Remove and properly dispose of the existing concrete
stoop (first step). Excavate, form and pour a new concrete stoop to act as
a step and support for the new staircase. The concrete mixture shall
comply with ASTM specifications. The tread and riser sizes shall comply
with the Massachusetts Building Code.
C. Ledger Board: Supply and install a new pressure-treated ledger board.
Properly attach the new deck to the building in the same manner as the
existing. Supply and install flashing to prevent water from penetrating the
area behind the ledger board.
D. Support Posts: Supply and install new 6 x 6 inch pressure-treated
support posts mechanically fastened to the new concrete footings. Posts
with smaller dimensions shall not be accepted.
E. Girders and Joists: Supply and install 4 x 8 inch girders and 2 x 8 inch
joists 16 inches on center. Fiberon decking allows joists to be spaced 16
inches on center for"perpendicular to joist application". Substitute
decking may require 12 inch on center spacing. The contractor shall be
responsible for the proper installation of the joists.

F. Decking: Supply and install 5/4 x 6 inch square edge Fiberon Paramount
Decking. The owner shall choose the color (standard color— not special
order). The decking shall be properly spaced and pitched for rainwater
run-off.
G. Staircase: Supply and install new stairs using 2 x 12 inch stringers and
Fiberon Paramount Decking that matches the deck. Supply and install
risers using preprimed pine or PVC trim. Pine risers shall be primed and
painted using Benjamin Moore or approved equal products. The color
shall be white.
H. Staircase Handrail and Deck Railings: Supply and install new
handrails/railings consisting of 2 x 4 inch top and bottom rails and 1'/2 inch
square balusters spaced four inches on center. All new railings shall be
42 inches in height. Supply and install 4 x 4 inch newel posts as
necessary to support the handrail/railings. Also, supply and install a round
handrail at the staircase.
I. Miscellaneous Repairs: Patch all areas with pine or PVC trim as
necessary to achieve a complete and professional installation. Repair the
wood siding after the deck and stairs are installed. All damaged siding
shall be replaced with new materials that match the existing. Install new
materials to fill all holes, voids and missing sections. All areas with gaps
greater than Y2 inch between the new and old work shall be repaired.
