Let me first state that our clients harbor neither ill will nor animosity towards Douglas and Jean Karam, owners of the Subject Property, and they are not opposed to the Karams previously stated plans for renovating the premises. I note that Ed and Joanne conveyed a small portion of their land to Mr. and Mrs. Karam so that the Karams could proceed with their plans to renovate the residence at 25 Winter Island Road. Nonetheless, our clients have a number of concerns relative to the actions recently undertaken upon the Subject Property and the impact those actions have had, and will have, upon the fragile environment in this area. Among these concerns is whether the actions to date have been undertaken with the appropriate oversight and guidance of all necessary authorities, including the Conservation Commission. Last month Ed Moriarty contacted me because he had serious concerns relative to Mr.and Mrs. Karam cutting down several trees that Ed believed were located on a right of way between his property and the Karams' property. I, in tum, spoke with Attorney Scott Grover who represents Mr. and Mrs. Karam. Attorney Grover indicated his clients had received permission from the Conservation Commission to clean up the area by removing various brush and"junk"trees. He further informed me that the area in between the two properties was a"paper street". I suggested to him that the cutting down RPR-28-2005 12:18 ORLRNDI 8 SWEENEY 617 376 0254 P.03iO4 Kevin Cornacchio,Chairman City of Salem Conservation Commission Page 2 April 29,2005 of five large maple trees, which Ed estimated were at least 50 years old,did not constitute cleaning up an area, and I also questioned his clients'authority to cut down trees on the area Attorney Grover maintains is city property. It was agreed by Attorney Grover and I that hereafter better communication would be exercised between our respective clients and the matter was dropped. We revisit this issue at the present time because it now appears this was not an isolated incident, but may be indicative of a pattern of conduct that the Commission should be mindful of in reviewing this matter. Next,we have the demolition of the residence upon the Subject Premises. This is the work that gave rise to the Conservation Commission's stop work order. We are mindful the Commission, through its agents, has conducted its own investigation and will not revisit facts concerning the same. However,we believe that the Commission should be aware that the Karams'application to the Zoning Board for which a Special Permit was granted indicated the work would involve the reconstruction and renovation of the existing structure. The application and plans submitted all reference the reconstruction, renovation of,and addition to,the existing structure. Please see North Shore Survey Corporation Plan submitted by the Karams to this Commission. Based upon the foregoing, there would appear to be a question, albeit, not for this Board,as to whether any Building Permit issued pursuant to the Special Permit is valid. What certainly is within the purview of this Commission, however,is the regulation of future actions upon the Subject Property. It is uncontroverted that the existing structure has been demolished, the work was accomplished with the use of heavy construction equipment, and the stockpiling of debris within the Buffer Zones for the Cove and the Salt Marsh. At this point, our clients respectfully submit that how we arrived at this juncture is not the issue for consideration. Certainly, it may have been a misunderstanding or lack of knowledge on the part of the Karams or their contractor. Again, however, this is not the critical issue that need be addressed by the Conservation Commission and other City Boards. Rather than review how these events transpired, our clients would prefer the focus be upon the appropriate response to those events. My clients respectfully submit the first line of inquiry should be a determination as to what,if any, damage has occurred to the Salt Marsh or the Cove as a result of the actions taken to date, taking into consideration the removal of trees, the demolition of the house, and the use of heavy equipment and stockpiling of debris upon the premises. In addition, nearly the entire house lies within the 100 foot Buffer Zone of the Salt Marsh as delineated on the North Shore Survey Corporation Plans submitted to the Conservation Commission. Thereafter, if then is a determination the Cove or the Salt Marsh have been affected the next question is a determination of what remedial action must be taken. Assuming the remedial action,if any, is accomplished, then we would suggest the Commission determine preventative or protective actions that must be undertaken by the RPR-28-2005 12:18 ORLRNDI 8 SWEENEY 617 376 0254 P.04iO4 Kevin Comacchio,Chairman City of Salem Conservation Commission Page 3 April 28,2005 Karams in connection with whatever construction the building commissioner determines will be allowed under the Special Permit previously granted. Again, our clients are not asking this Commission to act as a sanctioning body relative to the actions that have been taken to date, Rather they merely request that the Commission undertake actions it deems necessary to correct what has transpired, and set in place appropriate safeguards to insure future harm does not occur to either the Cove or the Salt Marsh. Thank you for your consideration of this matter. Very truly yours, Patrick J. Sweeney PJS:vb cc: Frank Taormina,Planner/Conservation Agent(Via Fax No. 978 740-0404) Edward J. REMARSS/MESSAGES: ry ' 0 CITY OF SALEM CONSERVATION COMMISSION April 15, 2005 Douglas and Jean Karam 91 Essex Street Salem, MA 01970 Re: Violation at 25 Winter Island Road Dear Mr. &Mrs. Karam: As you are aware, On December 30, 2004 you filed a Request for Determination of Applicability (RDA) with the Salem Conservation Commission for the addition of an existing deck and clearing of some site vegetation within the Buffer Zone of a Coastal Bank and within Land Subject to Coastal Storm Flowage. On January 13, 2005 the Salem Conservation Commission issued a Negative Determination for the proposed work within the buffer zone with the understanding (as shown on the approved plans dated 11/23/04) that minimal work would be performed within the buffer zone and therefore would not require the filing of a Notice of Intent (NOI). On April 13, 2005 it was brought to my attention that a considerable amount of site work was being performed at 25 Winter Island Road, potentially within the buffer zone. Following a site inspection, I observed a backhoe and a considerable amount of soil and boulders stockpiled within the buffer zone with no erosion control measures in place. In addition, to the above-referenced resource area on site, it was also determined that Salt Marsh also exists on site. The Salt Marsh also has a one hundred foot buffer zone, and the stockpiled material is located approximately 25 feet away. The work that is currently being performed has significantly altered the buffer zone and could potentially harm the coastal resource areas. At this time, the Salem Conservation Commission is directing you to stop all work, stabilize you site (by removing all stockpiled material and machinery from the buffer zone and return the buffer zone to its original grade), and file a Notice of Intent including all required submittal documents with the Salem Conservation Commission as soon as possible. 120 WASHINGTON STREET, SALEM, MASSACHUSETTS 01970 • TEL: 978.745.9595 FAX: 978.740.0404 ♦ WWW.SALEM.COM Should you have any question regarding this matter, please feel free to call me directly at (978) 745-9595 extension 311. Karam and Jean Olsson Dear Tom: As follow-up to our recent conversation relating to the Board of Appeal's approval of the application for zoning relief at 25 Winter Island Road, I am writing to clarify our understanding that the approval allows the Karams to perform the following: 1. Reconstruct the house on the original footprint of the existing house, along with expanding the existing third half story to a full third floor which will not exceed the overall zoning ridge height requirement of 35 feet. 2. Provide front set backs that are: a. Front stairs: 5'0" b. Window bay: 6'0" The above dimensions are as shown on the plans that were submitted with the original application and approved by the Board. Thank you for your understanding and assistance with these clarifications. Very t y yours, AV. TELEPHONE: 978-745-9595 MAYOR FAX: 978-740-9846 DECISION ON THE PETITION OF DOUGLAS & JEAN OLSSON KARAM REQUESTING A SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 25 WINTER ISLAND ROAD R-1 A hearing on this petition was held on December 15, 2004 with the following Board Members present: Nina Cohen, Chairman, Richard Dionne Bonnie Belair, Nicholas Halides and Steven Pinto. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner requests a Special Permit to allow reconstruction and expansion of existing nonconforming structure for the property located at 25 Winter Island Road located in an R-1 zone. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is section 5-3 (2) (8), which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension of expansion, of nonconforming lots, land, structures, and uses, provided however, that such change, extension, enlargement of expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. A. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or stuctures in the same district. B. Literal enforcement of the provisions of the Zoning Ordinance would involve Substantial hardship, financial or otherwise, to the petitioner. C. Desirable relief may be granted without substantial detriment to the public good and Without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. The Board of Appeal, after careful consideration of the evidence presented, and after viewing the plans, makes the following findings of fact DECISION ON THE PETITION OF DOUGLAS &JEAN OLSSON KARAM REQUESTING A SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 25 WINTER ISLAND ROAD R-1 page two 1. The Petitioner's Douglas &Jean Olsson Karam own a nonconforming house and adjacent lot at 25 Winter Island Road. They wish to reconstruct the house for use as their family residence. 2. According to elevations and plans drawn by Peter Pickman Architects, their planned reconstruction will vary the terms of the Ordinance by expanding the side to within 7 feet of the lot line, and the front of the house to within 6 feet of the front lot line. 3. The planned reconstruction will not expand will not expand the overall height of the house, which is 32 feet, but by creating dormers will extend the roof to create a third floor where previously the house had 21rz . 4. The plans have been explained to the neighbors, all of whom support the Karam's plan. One neighbor, Jane Dionne attended the meeting in order to voice her support for the Karams. They also had the support of Joseph O'Keefe, Ward 7 City Councillor and Lucy Corchardo, Ward 1 City Councillor. 5. There was no opposition to the petition. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows; 1. Literal enforcement of the provisions of the ordinance would involve substantial hardship on the petitioner. 2. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the ordinance. 3. The Special Permit granted can be granted in harmony with the neighborhood and will promote the public health, safety, convenience and welfare of the City's inhabitants. 4. Special conditions exist which especially affect the subject property, but not the district in general. On the basis of the above findings of fact, the Zoning Board of Appeal voted 5 favor and 0 in opposition to grant the Special Permit requested, subject to the following conditions; 1. Petitioner shall comply with all city and state statues, codes ordinances and Cl) regulations. p T> 3 i DECISION OF THE PETITION OF DOUGLAS AND JEAN OLSSON KARAM REQUESTING A SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 25 WINTER ISLAND ROAD R-1 page two 2.
