As you know, the Salem Conservation Commission opened the required Request for Determination of Applicability Public Hearing on May 13, 1999. This public hearing has been continued to allow for additional information to be submitted. The Commission at its next meeting will decide whether or not a Notice of Intent will be required but has already agreed.that both school projects are able to be permitted. The High School component of this filing should, at the Commission's next meeting, get full approval and will not need additional wetland review. The Conservation Commission is looking at its jurisdiction over an existing drainage swale in the area of the new Federal Street School. This clarification is needed to determine if the project can be permitted immediately or have to be permitted through the Notice of Intent process. In either case this new school is being proposed on an environmentally appropriate site and is able to secure the required permits. Nevertheless, I do not believe it pprotectable;be- cause it is an isolated area subject to flooding that is too small to qualify as ILSF. That conclusion would have to be supported by engineeriag. calculations to be considered valid. Finally, t.here is another isolated area that appears to be too small for protection as ILSF. Criteria I normally use in making such determination included topography, hydrology, soil color and vegetation. The Carlton School, of course is �n.a residential area and-::s surrounc' d on three sides by roans, .parking lots. and homes Thus, wetland vegetation is absent. Accordi::.uly, I concluded that proc.e.c.ta>-le,wetland resources are absent. However, the North River is loc�,tea to the west and within 200 ' of the school. Thus, the Riverways Act may come into play unless Salem is one of those cities where the buffer zone is reduced. I could riot delineate the bank of the river because therF: are two 8 ' high chain link fences between the school and the rive-:. I would merely point out the presence of the river and leave it to your field crew to determine how to manage those two fence4 .when locating, the bank of the river. Criteria I used in making the determination incldued topography, hydrology, soil color and vegetation. I identified 6 areas that were either on the campus or just off it . The first area was delineated by flags 1-41WH. It is located at the western end of the site beyond the tennis courts. Near the tennis courts a RCP leads water into a. swamp that eventually drains frcros the swamp by a culvert near Highland Ave. Wetland indicate r. :species I, observed and use.i:in locating the liz: inclu' :a=red maple, pussy willow, deckled alder, buckthoz1l :alder and pe?-a�rbush. On the upland side of this line I found ::raghorn sumac, : lack cherry, black locuzzt; rultiflora rose and b-_a.cken. The mcs .--important wetland occurs at the south end of the rite in the vicinity of the undeveloped, fenced-in playing fields. I de- lineated this wetland with flags, A1-A44WH. Along the fenced-in fields, the wetlands begin at the ;toe of the slope. Wetland species I observed included red mr._ple, speckled alder, buckthorn alder, sheeplaurel, highbush blue'.:-y, maleberry, pepperbush, swamp azalea, sensitive fern and . :i.nnamon fern. On the upland side of the line I found red oak., white oak, black cherry, multiflcra rose and blackberry. At flag 11 I analyzed vegetative plots on each side of the line to determine percent dominance in the two communities. Those data, indicated on the DEP field data sheets, support the location of the line. I delineated two other wet areas by flags B1-B37 .and C1-C24 . In fact, the two are hydrologically connected to one another by a culvert under a path in the vicinityy of flags B13 and C1. Wetland B is better developed and included pussywillow, pepperbush, arrow-wood, purple loosestrife, highbush blueberry and maleberzy. The vegetation is not-.- as well dev-..doped and includes red in-ole: ..arrow-wood and buckthorn alder. In front of the school next to WiI:E= Sc is an elongated we-land consisting primarily of purple loosestrife, but it also includes elder, phragmites and cottonwood. It is a protectable resource because it is not isolated. Both a catchbasin and surface drainage lead water to a culvert that passes under Wilson St, connecting the area to a wetland N or Wilson St. I also quickly delineated the wetland N or Wilson St by £lags E1- E5. Near the tennis courts a RCP leads water into a. swamp that eventually drains fr>rms the swamp by a culvert near Highland Ave. Wetland indicat= species I observed and userl :in locating the includ red maple, pussy willow,-_s�, eckled alder, buckth.ora .aider and pen,.:�arbush. On the upland side of this line I found a-aghorn. sumac, : dark cherry, black locust; Multiflora rose and b-_a cken. The mcs.:--important wetland occurs at the south end of the -ite in the vicinity of the undeveloped, fenced-in playing fields. I de- lineated this wetland with flags Al-A44WH. Along the fenced-in fields, the wetlands begin at the ;toe of the slope. Wetland species I observed included red rwrle, speckled alder, buckthorn alder, siaeeplaurel, highbush bluebe-:_-y, maleberry, pepperbush, swamp azalea, sensitive fern and ,-Innamon fern. On the upland side of the line I found red oak, white oak, black cherry, multiflcra rose and blackberry, At flag 11 2 analyzed vegetative plots on each side of the line to determine percent dominance in the two communities. Those data, indicated on the DEP field data sheets, support the location of the line. I delineated two other wet areas_by flags Bi-B37 and Cl-C2,:, . Welch, PLS Welch Associates 353 West Center St West Bridgewater, MA 02379 Dear Ms Welch: On May 22, 1999 I returned to Salem High School to review my wetland line along Wilson St _ On an earlier visit I delineated a wetland along the street by a series of numbered, initialed, pink flags (Dl-D24WH) . The early delineation was done primarily on the basis of the distribution of purple loosestrife and smartweed from the 1998 growing season. These species ordinarily prefer a very moist habitat. On this occasion I looked at soils and plants that were not present during the month of March_ Along the street there is a drainage swale_ At the eastern end of the Swale between my old flag D23 and D24 I found nonhydric soils having a hue, value/chroma of 10YR 5/6. Within the swale there is a catch basin between flags D21 and D22. At this point the purple loosestrife thins out and the soils become 10YR 4/4 . Thus, the stand of purple loosestrife is isolated on its east and west ends by nonhdric, upland soils_ It is very difficult to ignore the purple loosestrife and smartweed_ Accordingly I reflagged a smaller area of wetlands by numbered, initialed, green flags (K1-K9) . Down gradient and east of the catchbasin the loosestrife disappears. I believe that most of the water is picked up by the catchbasin so that it is not wet enough to support the purple loosestrife_ Still. farther east, the swale develops more wetland vegetation including phragmites. This wetland resource is delineated by the previous pink flagging. In short, the wetland I previously delineated in March is, by my present interpretation, separated into two wetlands, being interrupted by upland soils and vegetation. I am not at all impressed with a narrow swale (15 ' x 701 ) domi- nated by purple loosestrife. It probably exists because the catch basin grating is overgrown with vegetation. Were it to be kept open, water might drain through the Swale quickly enough that the purple loosestrife could not continue to exist. Criteria I used in making the determination included topography, hydrology, soil color and vegetation. Renmants of wetlands exist towards the south end of the site. I flagged two areas in the SW corner that are actually off the school property. On the sketch provided me, both areas were indi- cated as ponds. At this time, I don' t think either one is a pond. The first was delineated by flags 1-5 . It is a depression, lacking water which is populated by boxelders. In my opinion, it is far too small to be protectable as Isolated Land Subject to Flooding. Its surface area is probably less than 500 S.F. A second area indicated as a pond is at the SW corner and off the property. It is a low area where water collects. Draining the area is a small ditch about 1' wide by 6" deep. I delineated the side closest to the school with flags 6-9. I went no further be- cause it exists on private property. At one time I believe the wetlands stretched all the way across the southern end of the site. Over time the area has been civilized and tamed so that at the present time much of the area is covered by lawn for playing fields. For much of the spring, I suspect, the playing fields are too wet to use. All of the water from the playing fields eventually made its way to the wetland I delineated by flags 6-9. It still drains there, but otherwise lacks the characteristics of a wetland. I therefore did not de- lineate the grassed area of the playing fields. A third area I flagged W 10-21) occurs at the rear of the backstop. wetland vegetation in the form of red maple, boxelder, f pussy willow, purple loosestrife, phragmites and tussock sedge occur here. Nevertheless, I do not believe it is protectable be- cause it is an isolated area subject to flooding that is too small to qualify as IISF. That conclusion would have to be supported by engineering calculations to be considered valid. Finally, there is another isolated area that appears to be too small for protection as ILSF. It occurs along the SE property line next to a fenced-in tennis court not located on school property. Moreover, unless the city of Salem has a more restrictive bylaw than 310Ctv2, I do not believe there are any legal vernal pools present either. To be protectable as a vernal pool according to 310CMR, the pool would have to be located within a protectable resource area. The two areas I delineated were isolated areas, not connoted by a stream to other wetland resources. Certainly the isolated area opposite the school entrance is too small to be protectable as Isolated Land Subject to Flooding. That is; it cannot hold the minimum volume of a quarter acre feet of water. Since it does not qualify as ILSF, it is not a protectable resource and cannot contain a protectable vernal pool. The other area you suggested is also located within my flags. I do not know how large this area is, but I suspect that it, too, is not large enough to qualify as IISF and the same argument would apply. Hypothetically, suppose it is a vernal pool. The buffer zone of a vernal pool does not extend outside the limits of the resource within which it is found. Moreover, ILS$ does not have a buffer zone. The second BVW is located in the rear of the property behind the backstop of the south ball field. The third BVW is between the ball field and the existing play area on the south side of the existing building. Carlton School The project consists of the construction of a new elementary school at the location of the existing Carlton Elementary School. The existing school will be demolished in order to make room the new school building. There is one resource area that is affected by the construction of the new school. The existing school lies within the 200-foot Riverfront Area for the North River, and some of the proposed construction will also lie within the 200-foot Riverfront Area.
