General Conditions Under Massachusetts Wetlands Protection Act (only applicable to approved projects) 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. General Conditions Under Massachusetts Wetlands Protection Act 10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A) to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 15. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 18. The work associated with this Order the "Project") is 1is not z subject to the Massachusetts Stormwater Standards. If the work is subject to the Stormwater Standards, then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. General Conditions Under Massachusetts Wetlands Protection Act (cont.) b) No stormwater runoff may discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation, including removal of all construction period sediment trapped in inlet and outlet control structures; ii. as-built final construction BMP plans are included, signed and stamped by a Registered Professional Engineer, certifying the site is fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per the requirements of Stormwater Standard 10; iv. all post-construction stormwater BMPs are installed in accordance with the plans (including all planting plans)approved by the issuing authority, and have been inspected to ensure that they are not damaged and that they are in proper working condition; v. any vegetation associated with post-construction BMPs is suitably established to withstand erosion. c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e))shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement)for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMPsOperation and Maintenance Plan ("O&M Plan") and certifying the following: i.)the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.)the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, and acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f)through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f) through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. A plan and easement deed that grants the responsible party access to perform the required operation and maintenance must be submitted along with the legally binding agreement. f) The responsible party shall operate and maintain all stormwater BMPs in accordance with the design plans, the O&M Plan, and the requirements of the Massachusetts Stormwater Handbook. wpaform5.doc• rev.5108 Page 6 of 11 Massachusetts Department of Environmental Protection Bureau of Resource Protection - Wetlands MassDEP File Number: ?; WPA Form 5 - Order of Conditions 64-485 Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 C. Allow members and agents of the MassDEP and the Commission to enter and inspect the site to evaluate and ensure that the responsible party is in compliance with the requirements for each BMP established in the O&M Plan approved by the issuing authority. h) All sediment or other contaminants removed from stormwater BMPs shall be disposed of in accordance with all applicable federal, state, and local laws and regulations. i) Illicit discharges to the stormwater management system as defined in 310 CMR 10.04 are prohibited. j) The stormwater management system approved in the Order of Conditions shall not be changed without the prior written approval of the issuing authority. k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site Design Credit(as defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1, Low Impact Development Site Design Credits)shall not be altered without the prior written approval of the issuing authority. 1) Access for maintenance, repair, and/or replacement of BMPs shall not be withheld. Appeals The applicant, the owner, any person aggrieved by this Order, any owner of land abuttingthe land subject 1 to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate MassDEP Regional Office to issue a Superseding Order of Conditions. The request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee and a completed Request of Departmental Action Fee Transmittal Form, as provided in 310 CMR 10.03(7) within ten business days from the date of issuance of this Order. A copy of the request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant, if he/she is not the appellant. Any appellants seeking to appeal the Department's Superseding Order associated with this appeal will be required to demonstrate prior participation in the review of this project. Previous participation in the permit proceeding means the submission of written information to the Conservation Commission prior to the close of the public hearing, requesting a Superseding Order or Determination, or providing written information to the Department prior to issuance of a Superseding Order or Determination. Based on the Estimated Habitats or Rare Wildlife and Certified Vernal Pools Map (June 1, 2003) from Natural Heritage & Endangered Species Program (NHESP) of the Massachusetts Division of Fisheries and Wildlife, it has been determined that this project does not occur near any habitat of state-listed rare wildlife species nor contains any vernal pools. This Order is issued under the Massachusetts Wetlands Protection Act,M.G.L. Chapter 131, Section 40 and the City of Salem Wetlands Protection Ordinance, Salem Code Chapter 34, Section 34-1 —34-13. 1. This Order permits the construction of a 2,200 square foot, one story, wood frame building, associated utility work (water, electric, gas, sewer), and removal of portable/trailer structures. This project is located within land subject to coastal storm flowage and the 100 foot buffer zone extending from the shoreline. Adjacent resource areas include Land Under the Ocean, Coastal Bank, and Coastal Beach and no alteration or work will occur within these resource areas. The project will not alter the grades within the site area. The stormwater report included with the Notice of Intent dated November 25, 2008, outlines the plan to handle site stormwater, the construction period pollution prevention plan, erosion and sediment control plan, and the long term operation and maintenance plan. Per DEP's comments: "MassDEP questions whether applicant has met Standard 7 of the Stormwater regulations-to the maximum extent practicable. Redevelopment calls for improving existing conditions for water quality-how does this project meet the standard?" and email correspondence between the applicant's representative and the Conservation Agent on January 27 and 28 2009 (See attached),the applicant also agreed to install a new deep sump catch basin with a hooded outlet. The new catch basin will be installed approximately 8 feet south of and will connect to the existing drain manhole located near the center of the site. Additionally, the applicant agreed to remove the grate structure on the existing drain manhole and replace it with a solid cover to ensure that stone water runoff from the site will be collected in the new catch basin rather than the drain manhole. GENERAL CONDITIONS 2. This Order of Conditions must be recorded in its entirety (all 6 pages) at the Essex County Registry of Deeds or the Land Court for the district in which the land is located, after the expiration of the 10-day appeal period and within 30 days of the issuance. A copy of the recording information must be submitted to the Salem Conservation Commission before any work approved in this Order commences. 3. The Commission or its Agent,officers,or employees shall have the right to enter and inspect the property at any time for compliance with the conditions of this Order, the Wetlands Protection Act MGL Chapter 131, Section 40, the Wetlands Regulations 310 CMR 10.00,and shall have the right to require any data or documentation that it deems necessary for that evaluation. 9. The term "Applicant'as used in this Order of Conditions shall refer to the owner,any successor in interest or successor in control of the property referenced in the Notice of intent, supporting documents and this Order of Conditions. The Commission shall be notified in writing within 30 days of all transfers of title of any portion of the property that takes place prior to issuance of the Certificate of Compliance. 10. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and approvals associated with this project. These permits may include but are not necessarily limited to the following: (1) Section 404 of the Federal Water Pollution Control Act(P.L. 92-500, 86 stat. 816), U.S. Army Corps of Engineers. (2) Water Quality Certification in accordance with the Federal Water Pollution Control under authority of sec. 27(5)of Chapter 21 of the Massachusetts General Laws as codified in 314 CMR 9.00. PRIOR TO CONSTRUCTION 18. Prior to the commencement of any activity on this site other than activities listed above,there shall be a Pre-Construction Meeting between the project supervisor, the contractor responsible for the work, and a member of the Conservation Commission or its Administrator to ensure that the requirements of the Order of Conditions are understood. The staked erosion control line shall be adjusted, if necessary, during the pre-construction meeting. Please contact the Conservation Commission Agent at (978) 745-9595 ext 311 at least forty-eight(48) hours prior to any activity to arrange for the pre-construction meeting. 19. Prior to the pre-construction meeting and commencement of any activity on this site, sedimentation and erosion control barriers shall be installed as shown on the approval plan(s)and detail drawings. The Commission and/or its Administrator shall inspect and approve such installation at the pre-construction meeting. 20. No clearing of vegetation, including trees, or disturbance of soil shall occur prior to the pre-construction meeting. Minimal disturbance of shrubs and herbaceous plants shall be allowed prior to the pre- construction meeting if absolutely necessary in order to place erosion control stakes where required. Attachment to Order of Conditions # 64-485 Page 4,of 6 21. There shall be twenty (20)hay bales and wooden stakes under cover on the site to be used only for emergency erosion control. EROSION CONTROL 22. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specifications provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project; the Commission may require additional measures. 23. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 24. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 25. The area of construction shall remain in a stable condition at the close of each construction day. 26. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 27. Within thirty (30) days of completion of construction on any given portion of the project,all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer that two(2) months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 29. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). 31. All waste products,grubbed stumps,slash; construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 32. Cement trucks shall not be washed out in any wetland resource or buffer zone area,nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed. 33. All exposed sub-soils shall be covered by a minimum of three(3) inches of quality screened loam topsoil prior to seeding and final stabilization. 34. Immediately following drainage structure installation all inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 35. There shall be no pumping of water from wetland resource areas. Attachment to Order of Conditions N 64-485 Page 5of 6 36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including, but not limited to, civil administrative penalties under M.G.L Chapter 21A, section 16. AFTER CONSTRUCTION 39. Upon completion of construction and final soil stabilization, the applicant shall submit the following to the Conservation Commission to request a Certificate of Compliance (COC): (1) A Completed Request for a Certificate of Compliance form(WPA Form 8A or other form if required by the Conservation Commission at the time of request). (2) A letter from a Registered Professional Engineer certifying compliance of the property with this Order of Conditions. (3) An"As-Built" plan signed and stamped by a Registered Professional Engineer or Land Surveyor showing post-construction conditions within all areas under the jurisdiction of the Massachusetts Wetlands Protection Act. This plan shall include at a minimum: (a) All wetland resource area boundaries with associated buffer zones and regulatory setback areas taken from the plan(s)approved in this Order of Conditions; (b) Locations and elevations of all stormwater management conveyances, structures and best management designs,including foundation drains,constructed under this Order within any wetland resource area or buffer zone; (c) Distances from any structures constructed under this Order to wetland resource areas- . "structures"include,but are not limited to,all buildings, septic system components,wells, utility lines,fences,retaining walls,and roads/driveways; (d) A line delineating the limit of work-"work"includes any filling,excavating and/or disturbance of soils or vegetation approved under this Order; 40. When issued, the Certificate of Compliance must be recorded at the Essex County Registry of Deeds and a copy of the recording submitted to the Salem Conservation Commission. 41. If the completed work differs from that in the original plans and conditions, the report must specify how the work differs; at which time the applicant shall first request a modification to the Order. Only upon review and approval by the Commission, may the applicant request in writing a Certificate of Compliance as described above. 42. Erosion control devices shall remain in place and properly functioning until all exposed soils have been stabilized with final vegetative cover and the Conservation Commission and/or its Administrator has authorized their removal. Additional hay bales may be placed during Phase 3 as noted below. Work will be scheduled to avoid storm events. Phase 2 Excavation and Installation of Foundation The first phase involves excavation of approximately 33 cubic yards of material from a 36 x 60 foot area to a depth of 3 to 18 inches to accommodate a 6 to 7 inch thick concrete slab foundation with 11/2 foot deep band beams along the perimeter and the center of the slab. Once the excavation is complete,the perimeter will be insulated with 4 inches of poly carbonate insulation. A layer of crushed stone will then be installed in the excavation and covered with a layer of filter fabric and a plastic vapor barrier. The reinforcing rods and steel tensioning cables will then be placed in a grid and the concrete poured into the area from a concrete truck. When the concrete has cured to about 75%of its strength,the tensioning cables will be tightened(post tensioned)using a hydraulic jack to 25,000 PSI.The cable ends will then be anchored and the concrete allowed to cure completely. The material excavated for the slab will be re-used to re-grade the foundation area and to create a 6 foot wide by 3 inch high slope along the perimeter of the slab. The remaining approximately 3 cubic yards will be spread evenly around the immediate area. See Section and Plan View on Page 2. Phase 3 Utility Installation The proposed building will be serviced by new electrical,gas,sewer and water utilities. The utilities will be installed in trenches. The trenches will be excavated to a depth of 3 to 4 feet and a width of 1Y2 to 2 feet. The excavated material will be stored along the landside of the trench and used for backfill. Crushed stone will be placed in the trench and the utilities will then be installed and the trench backfilled with the excavated material. The electrical cable will be placed on a bed of sand. It is expected that the utility trenches will be excavated and backfilled to previous grade within the same day. In the event that the trenches must remain open overnight,a row of haybales will be installed on the seaward side of the trenches and remain in place until the trench is backfilled. Phase 4 Building Construction The modular units will be shipped in 3 to 4 boxes on a trailer that is trucked to the site via Blaney Street. An existing fence located between the Blaney Street property and the marina property will be temporarily removed to allow truck/trailer access to the marina site. Once on the marina site,a crane will be used to lift the modular units from the trailer for placement on the foundation as shown on the 1 aerial image and photographs on Pages 3 and 4. The trucks/trailers would then vacate the premises. Once the building is erected,the utility connections will be made and the interior will be fitted out. This work will not require the cutting of any trees and will be completed in a day(estimate work day from 7.30 am to 4:00 pm). There will be a traffic detail on Derby Street while the truck/trailer is moving to the site. The temporary fence would be re-installed after the trucks/trailers leave the site. We are submitting this letter to you within the required 30 days,hoping you will be able to address problems we have with the proposed plan. Our home at 43 Turner Street directly abuts the Marina, on the lot identified as "Robert A. &Diane L. Guethlen." We are very concerned to see that the Portable Shed and Portable Building, which are behind our yard and those of our neighbors, are slated to remain on their present, respective sites. These buildings pose serious health and property risks. We want them moved away from our homes as part of the building replacement design. When people work on their boats in these buildings,they use paints and other solvents that produce noxious fumes and VOCs in a residential neighborhood. When we walk out our back door many days from April through November, we have to jump back in. It feels like someone has stuck a sock in our throats and/or the odor is so bad that we cannot be in the yard at all. These activities and the chemicals stored in these areas also pose a severe fire risk to our home and those in the general,historic Derby Street neighborhood. A frightening example happened last year when the very fire that destroyed the properties to be rebuilt in this plan broke out. It required a number of phone calls to the Salem Fire Department before help arrived at the Marina. As we loaded up our cars with "valuables," including our pet dog and cat,the flames rose higher and ever closer to our 1730's antique Georgian Colonial. We knew our home, which was restored to period with a wood roof and clapboards, would go up in minutes if sparks blew in our direction. The same was true for all the other wooden buildings on the street, including the historic landmark, The House of Seven Gables. When we heard a month ago that a plan for rebuilding was being designed, Linda personally visited the manager of Hawthorne Cove Marina to voice our concerns and request the buildings be moved away from our backyards. The Marina manager said it wasn't too late to consider that option and that he would communicate the issues to Russ Vickers, the owner, of Hawthorne Cove Marina, when he returned from vacation. He even suggested that there was land on the opposite side, away from any homes,that may be a good alternate site. This petition for a marina building replacement at Hawthorne Cove Marina should address the emissions of noxious fumes and VOCs coming from the marina and minimize fire risks in this residential historic neighborhood. I was under the impression more footage was deemed necessary in new constructions being planned for coastline properties? We feel strongly that this proposed construction needs to be located further away from the waters edge? The height of the building as described to me by the owner of the marina was approximately 20 feet in height, should the building be scheduled to be built on a different parcel of land on the property from the original plans we feel that if the height mars the view to abutters this needs to be considered before a permit is granted. Traffic is always a major concern in our immediate area, proposing this large building complex will most likely limit parking of mariners and this is a major concern for us.All summer long from May to October the guests use the parking area at the ferry site, once the ferry site moves into operation how much valuable parking space will be lost to the mariners using the marina with this new construction and where will ample parking be provided for the mariners? Will it be possible for the modular buildings proposed come into the marina site by water delivery rather than come on a large truck to place the building parts on this property? Our streets are very narrow and having large products being delivered to this site at the marina may cause a problem for residents in the immediate area of the marina? Introduction Hawthorne Cove Marina, Inc. desires to construct a new 2,200 square foot (sf), one-story wood frame 1 marina support building and remove several existing portable/trailer structures from its existing facility on White Street in Salem, MA. Also included is related utility work (water, electric, gas, sewer) to serve 1 the new building including a sewer pump station and outlet pipe to the nearby City sewer system in TurnerStreet. The new building will replace a building lost to fire in 2007. 1 B. Site Description and Use The Project site is the existing Hawthorne Cove Marina property bounded by Derby Street to the north, 1 White Street to the east, Turner Street to the west, and Salem Harbor to the south containing approximately 1.83 acres. Approximately 0.34 acres (15,000 sf) of the site is constructed on filled ' tidelands under Chapter 91 License No. 250. The entire site consists of a gravel surface. The existing stormwater drainage system is limited to one catch basin connected to a 24 inch storm drain line that runs 1 through the site. The site topography is virtually flat,and for most rain events,stormwater infiltrates the gravel surface into the underlying soils. 1 The site currently contains a small 1-story building used as an office, a 2-story building with office/laundry/bathroom facilities and several small sheds used for operations and maintenance tools 1 and supplies. Also on the site are several temporary portable/trailer structures providing additional workshop and maintenance space to replace the space lost when the five destroyed the marina support 1 building in 2007. 1 The site is utilized as a marina with the backland used for vehicle parking during the boating season and storage of boats during the off-season. A boat lift system is utilized to move boats to and from the water. There is a boat wash area located just landward of the boat lift. Boat servicing, painting, and hull 1 maintenance occurs in portions of the marina. Proposed Project Work The proposed Project includes the following elements as depicted on Sheet 2 of 2 of the Notice of Intent Plans: • Construction of a new 2,200 sf 1-story wood frame building. This new building will be utilized as office space and marina support space including restroom facilities. The foundation will be a post tensioned concrete slab at grade. Excavation will be approximately four feet of depth at the edges of the slab. ' • Installation of utilities to serve the new building. Water and electricity will be obtained from on-site connections to existing buildings. Gas will connect to existing services in Turner Street. Hawthorne Cove Marina is in the process of ' proceeding with securing other local permits for this work. ' • Installation of a sewage pump station and outlet piping. A new packaged sewer pump station will be installed on site with outlet piping to the City sewer ' at an existing manhole in Turner Street. This new sewer pump station and connection to the public system will handle the sanitary waste from the new building and adjacent existing building to replace an existing inadequate on-site septic system. Hawthorne Cove Marina is in ' the process of proceeding with securing other local permits for this work. ' • Removal of existing temporary trailer structures. Existing portable trailer structures providing office, workshop, and storage facilities will be ' removed from the site once the new building is constructed. D. Resource Areas Resource areas within the Project site are limited to Land Subject to Coastal Storm Flowage. There is also a 100 foot Buffer Zone that extends inland from the existing shoreline. Land Under Ocean, Coastal Bank ' and Coastal Beach are adjacent resource areas to the site, and no alteration or work activity will occur within these resource areas. Resource areas and Buffer Zone are depicted on the Sheets 1 and 2 of the ' Notice of Intent Plans. ' Hawthorne Cove Marina Notice of Intent Project Description • Page 2 of 3 ' Land Subject to Coastal Storm Flowage (LSCSF) means land subject to any inundation caused by coastal ' storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater. This resource area is significant to flood control and storm damage prevention. ' There are no specific performance standards for this resource area. Land Subject to Coastal Storm Flowage extends over 1.5 acres (83%) of the site. All proposed work ' activities described above will take place within the LSCSF resource area. The new building to be constructed will be a slightly smaller footprint than the building lost in the January 2007 fire (2,160 sf. vs. ' 2,876 sf)and portable structures on the site will be removed. No changes to the grades within the site are proposed. The Project will not create any adverse impacts to this resource area nor will it reduce the ' capacity of the site to buffer waves or provide flood protection. ' Buffer Zone-All of the proposed work occurs within the 100 foot Buffer Zone. ' The Stormwater Management Standards ' The redevelopment checklist reviews compliance with each of the Stormwater Management Standards in order. Standard 1: (Untreated discharges) No new stormwater conveyances (e.g., outfalls) may discharge untreated stormwater directly to or cause erosion in wetlands or waters of the Commonwealth. ' The Project does not include any new stormwater conveyances. Stormwater runoff is limited to ' runoff from the building roof which is comprised of asphalt shingles. Runoff from this type of roof requires no pretreatment per stormwater regulations. (It should be noted that the proposed building replaces a somewhat larger building that was lost to fire in 2007.) ' Standard 2: (Peak rate control and flood prevention) Stormwater management systems must be designed so that post-development peak discharge rates do not exceed pre- development peak discharge rates. This Standard may be waived for land subject to coastal storm flowage. The proposed Project is located within Land Subject to Coastal Storm Flowage and stormwater discharges to tidal waters and therefore this standard is waived. ' Hawthorne Cove Marina Notice of Intent Redevelopment Checklist • Page 2 of 8 i ' ' Standard 3: (Recharge to Ground water) Loss of annual recharge to ground water shall be eliminated or minimized through the use of infiltration measures, including environmentally sensitive site design, low impact development techniques, best management practices, ' and good operation and maintenance. At a minimum, the annual recharge from the post-development site shall approximate the annual recharge from the pre-development conditions based on soil type. This Standard is met when the stormwater management system is designed to infiltrate the required recharge volume as determined in accordance with the Massachusetts Stormwater Handbook. The proposed Project will result in no loss of annual recharge to groundwater. Ground water levels at the site are controlled by tide levels in the harbor. ' Standard 4: (80%TSS Removal) Stormwater management systems must be designed to remove 80% of the average annual post-construction load of Total Suspended Solids (TSS). This standard is met when: ' a. Suitable practices for source control and pollution prevention are identified in a long-term pollution ' prevention plan and thereafter are implemented and maintained, b. Stormwater BMPs are sized to capture the required water quality volume determined in accordance with the Massachusetts Stormwater Handbook,and ' c. Pretreatment is provided in accordance with the Massachusetts Stormwater Handbook. The Project proposes no changes to existing, or the addition of new stormwater systems or ' conveyances. Full compliance with the long-term pollution plan requirement far new developments and redevelopments. • Has the proponent developed a long-term pollution plan that fully meets the requirements of Standard 4? ' Since the Project activities will disturb less than one acre,a Long Term Pollution Prevention Plan is not required. ' • Does the pollution prevention plan include the following source control measures? - Street sweeping - Proper management of snow, salt, sand and other deicing chemicals - Proper management of fertilizers, herbicides and pesticides ' - Stabilization of existing eroding surfaces The Project site is primarily a flat gravel surface with no application for these elements. If through source control and/or pollution prevention, all ' land uses with higher potential pollutant loads cannot be completely protected from exposure to rain, snow, snow melt and stormwater runoff, the proponent shall use the specific stormwater BMPs determined by the Department to be suitable for such use as provided in the Massachusetts Stormwater Handbook. Stormwater discharges from ' land uses with higher potential pollutant loads shall also comply with the requirements of the Massachusetts Clean Waters Act, M.G.L. c. 21, §§26-53, and the regulations promulgated thereunder at 314 CMR 3.00, 314 CMR 4.00 and 314 CMR 5.00. ' The proposed replacement marina building work does not generate any uses with Higher Potential Pollutant Loads(HPPL). These include those areas ' used for hull cleaning,maintenance and painting. Hull cleaning is performed in a designated area just inboard of the boat lift. Currently,boat wash is contained within this area and infiltrates through a crushed stone and filter system before it infiltrates into the ground. ' Due to the nature of the site and space limitations, hull maintenance and painting is performed throughout the marina yard at random isolated locations (where the boat is stored or can be temporarily placed). Runoff protection is provided at the individual specific location and time of the activity by use of tarps and plastic sheets placed on the ground to collect debris and materials generated by the hull maintenance and/or painting work. When the work is completed, the tarps are removed and collected materials are properly disposed of. No hull maintenance and painting work is performed during rain events. Materials, tools, and equipment used for these activities are stored in enclosed sheds when not in use. CONSTRUCTION ACTIVITIES ' The proposed marina building construction Project will involve the following construction activities: ' 1. Construction of a new 1 story wood frame building with office space,meeting room and restroom facilities. 2. Installation of utility services to the building,including sewer pump station. 3. Removal of portable/trailer structures from the site. D. CONSTRUCTION PERIOD POLLUTION PREVENTION PLAN AND EROSION&SEDIMENT ' CONTROLPLAN The Project's construction specifications and plans will require the implementation of pollution I ' prevention, erosion and sediment control measures by the contractor to prevent and minimize potential impacts to adjacent wetland resource areas. These measures will include at a minimum the items listed below. Additional measures will be implemented should usual site or weather conditions require them. • Contractor's Superintendent shall retain a copy of this document in their possession on site at all times (24/7). They shall endorse a copy of the certification page and submit it to the Design Engineer,the Building Department Official,and the City Engineer for their records.A ' copy of all Periodic inspection reports prepared by the Superintendent shall be kept on site and made available upon request by the town or owner's agents. ' • All construction work shall be laid out and controlled by survey and shall follow the approved Site Plan. ' • Stake limit of work and install Hay Bale/Siltation Fence Barrier. Maintain a reserve capacity ' of hay bales in a stockpile prepared to be used for replacing any damaged hay bales during ' Hawthome Cove Marina Notice of Intent Stormwater Report • Page 2 of 7 ' construction or to add to areas that require additional protection. • Schedule and conduct a pre-construction meeting on-site with the Engineer and the Owner. ' • Contractor's Superintendent shall prepare and submit to the owner and the design engineer a plan showing locations of the construction site facilities for the following: ' o Construction Trailer/Site Office o Temporary Equipment&Machinery Storage Areas or Facilities ' o Temporary Sanitary Waste Disposal Facilities o Construction Solid Waste Disposal Container Area o Management Plan for Construction Materials&Supplies ' o Temporary Soil and Excess Materials Stockpiling Areas o Non-Stormwater Discharge Control Devices • Work will be scheduled to avoid storm events. • Equipment, materials, debris, or any other item shall not be left within the work area that may be affected by rising water. Work areas shall be left in a condition so that the rising ' water shall not cause any damage to on going work or adjacent areas. Dust Control: The need for dust control is not anticipated. The proposed building has a small ' footprint and the Project will not require regrading of the site. In the case that dust control is needed, standard dust control measure will be implemented as required. Care will be taken to not create ' runoff from excessive use of water to control dust. Non-Stormwater Discharges: During construction, activities that could encounter groundwater are ' not expected. If groundwater is encountered, the construction dewatering and all non-stormwater discharges will be directed into a storm drain inlet equipped with a silt-sack (or equivalent) inlet ' protection or a sediment basin. Equipment Storage: All machinery, tools, and building materials will be stored in protected open ' areas of the site. The operator will select and maintain a suitable and secure area of the site for storage. ' Solid Waste Disposal: The disposal of excess building materials and other construction site wastes will be managed carefully. All waste materials will be collected and stored in securely covered ' receptacles. Construction wastes that may be encountered on site include the following: ' 1)Packaging materials(including wood,paper,plastic,etc.) Hawthorne Cove Marina Notice of Intent Stormwater Report • Page 3 of 7 2)Scrap or surplus building materials (scrap wood,metals,rubber,plastic,and concrete) ' 3)Adhesives,paint/stain,sealers,cleaning fluids and solvents Temporary Sanitary Waste Disposal: There will be sanitary waste from workers during construction ' activities that will be confined to temporary facilities. Domestic waste haulers licensed by the State of Massachusetts will be contracted to regularly remove the sanitary waste and to maintain the facilities ' in good working order. Maintenance and Inspection Procedures:The following inspection and maintenance practices will be ' used to maintain the erosion/sediment and pollution controls measures: • All control measures will be inspected at least once every seven day period. 1 • All control measures will be maintained in good working order. If an inspection indicates ' that repair or maintenance work is required,then it will be initiated within 24 hours. Spill Prevention:The typical construction materials required for building projects are expected to be ' present onsite during construction and will include the following: ' • concrete • petroleum products • wood ' • sealers • paints ' Materials Management Practices: The following are the material management practices that will be used to reduce the risk of spills or other accidental exposure of materials and substances to stormwater runoff. 1. The following good housekeeping practices will be followed onsite during the construction project: • An effort will be made to store only sufficient amounts of products necessary to complete the ' work. • All materials will be stored onsite in a neat,orderly manner in their original containers and,if possible,under a roof or other enclosure. ' • Manufacturers' recommendations for proper use and disposal will be followed. • The Site Superintendent will inspect daily to ensure proper use and disposal of materials. Hazardous Products: The following practices will be used to reduce the risks associated with hazardous materials: ' • Products will be kept in their original containers,unless they are not re-sealable. • Original labels and material safety data will be retained for important product information. • Surplus products that must be disposed of will be discarded according to the manufacturer's ' or agency recommended methods of disposal. 3. Product Specific Practices: The following product specific practices will be followed onsite: ' • Petroleum Products: All onsite vehicles will be monitored for leaks and receive regular preventive maintenance to reduce leakage. Petroleum products will stored in tightly sealed containers, which are clearly labeled. Any asphalt based substances used onsite ' will be applied according to manufactures'recommendation. • Paints/Sealants: All containers will be tightly sealed and stored when not required for use. Excess paint will not be discharged to the stormwater system, but will be disposed of properly according to manufacturers' instructions or state and local regulations. ' mill Control Practices: In addition to good housekeeping and material management practices discussed ' in the previous section, the following practices as required by the construction activities will be followed for spill prevention and cleanup: • Manufacturers' recommended methods for spill cleanup will be clearly posted and site personnel will be made aware of the procedures and the location of the information and ' cleanup supplies. • Materials and equipment necessary for spill cleanup will be kept in the material storage area ' onsite. Equipment and materials will include, but not limited to, brooms, dustpans, mops, rags, gloves, goggles, kitty litter, sand, sawdust, and plastic or metal trash containers specifically for this purpose. • All spills will be cleaned up immediately after discovery.
