The Applicant is working with National Grid to install a flood light on the utility pole adjacent to the parking area to provide lighting for the lot. • A chain-link fence was constructed at the top of the slope leading down to the vegetated wetland area between 15' to 25' from the edge of the parking area. • The two(2)"NO SNOW STORAGE" signs were mounted on the chain link fence. • The configuration of the drainage system is different than as shown on the approved design plan. The proposed catch basin was replaced with an oil separator that directly ties into the original catchbasin. The current drainage system configuration provides the same amount of treatment to the stormwater runoff prior to the discharge to the wetlands as the original design. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. the work is a maintenance dredging project as provided for in the Act; or b. the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse, rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing. 7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 8. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to this Conservation Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior to the commencement of work. 9. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" [or, "MA DEP"] "File Number 64-314 10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before DEP. 11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance (WPA Form 8A)to the Conservation Commission. 12. The work shall conform to the plans and special conditions referenced in this order. 13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 14. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission,which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. This form shall be returned to the Commission within 21 days of recording accordance and prior to commencement of any activities subject to the Order of Conditions. 5. It is the responsibility of the applicant to procure all other applicable federal, state and local permits and approvals associated with this project. Prior to the commencement of any activity on this site,the applicant or current landowner shall submit to the Commission in writing a construction schedule/sequence of work to complete this project. 18. Prior to any work on site,the proposed limits of work shall be clearly marked with stakes or flags and shall be confirmed by the Commission or its Administrator. Such markers shall be checked and replaced as necessary and shall be maintained until all construction is complete. Workers shall be informed that no use of machinery, storage of machinery or materials,stockpiling of soil or construction activity is to occur beyond this line at anytime. 19. Prior to commencement of construction on site,the limits of wetland resource areas closest to construction activity shall be flagged with surveyor's tape and shall remain in place during construction. The limits of areas to be impacted and the limits of work in the replication area(s)shall be clearly flagged. 20. There shall be_20 hay bales and wooden staked stored under cover on the site to be used only for emergency erosion control. EROSION CONTROL 21. Appropriate erosion control devices shall be in place prior to the beginning of any phases of construction,and shall be maintained during construction in the wetland areas and buffer zones. The erosion control specification provided in the Notice of Intent and the erosion control provision in the Order will be the minimum standards for this project;additional measures may be required by the Commission. 22. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas. 23. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 24. The areas of construction shall remain in a stable condition at the close of each construction day. r 25. Any de-watering of trenches or other excavations required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharges from de-watering activities shall be filtered through haybale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 26. Within thirty days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 27. If soils are to be disturbed for longer than two months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth,exposed surfaces shall be stabilized by other appropriate erosion control measures,firmly anchored,to prevent soils from being washed by rain or flooding. DURING CONSTRUCTION 28. A copy of the Order of Conditions,construction plans,and copies of the documents and reports cited in Condition# 11,shall be on the site upon commencement and during any site work for contractors to view and adhere to. 29. Erosion and sedimentation control devices shall be inspected after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. 30. Only clean fill, free of masonry, stumps,asphalt,and any other kind of waste material shall be used on the site. 31. All waste products,grubbed stumps,slash; construction materials,etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from rivers. 32. All filling or removal of waste material from the site shall be done in accordance with the regulations of the City of Salem Health Department. 33. Cement trucks shall not be washed out in any wetland resource or buffer zone area. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be removed by hand. 34. No fuel,oil,or other pollutants shall be stored in any resource area or the buffer zone thereto,unless specified in this Order of Conditions. 35. There shall be no pumping of water from wetland resource areas. 36. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 37. Immediately following drainage structure installation,all inlets shall be protected by silt fence,hayblae barriers and/or silt bags to filter silt from stonnwater before it enters the drainage system. 38. The project shall not cause an increase in run-off onto adjacent properties,either during construction or when completed. 39. The applicant is hereby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L. Chapter 21A,section 16. POST CONSTRUCTION 40. All disturbed areas, slopes and proposed landscape areas shall be loamed and seeded or stabilized through the use of erosion control blankets or other approved means. All disturbed areas will be graded,loamed, and seeded prior to November 1 of each year,if possible. No disturbed areas or stockpiled material will be left unprotected or without erosion controls during the winter. I i ` 41. Upon completion of construction,the applicant or current landowner shall submit the following to the Commission to request a Certificate of Compliance: (1) A letter requesting a Certificate including the following information: a. Name and address of current landowner; b. Name and address of the individual/trust or other entity to whom the Certificate is to be issued: c. Street address and lot number for the project; and d. DEP file number (2) A letter from a Registered Professional Engineering or Land Surveyor certifying compliance of the property with this Order of Conditions (3) An"As-Built"plan signed and stamped by a Registered Professional Engineer showing post-construction conditions and: a. As-built elevations of all drainage ways constructed within 100 feet of any wetland resource area; b. As-built elevations and grades of all filled or altered wetland resource areas,buffer zones and replicated areas;and c. Distances to all structures within 100 feet of any wetland resource area. 42. When issued,the Certificate of Compliance must be recorded at the Essex County Registry of Deeds. 43. If the completed work differs from that in the original plans and conditions,the report must specify how the work differs;at which time the applicant shall first request a modification to the Order. Only upon review and approval by the Commission,may the applicant request in writing a Certificate of Compliance as described above. 44. Erosion control devices shall remain in place and properly functioning until all exposed soils have been stabilized with final vegetative cover and the Commission and/or its Administrator has authorized their removal. 45. Two tests were performed in the area of the proposed parking lot. Results were as follows: Test 1 0-44" Gravelly loam fill, 10 yr 3/2, broken pavement from 26" —32", many fragments of iron, wire, aluminum cans, brick and concrete. No water table evident. Test 2 0-60" Gravelly loam fill, 10 yr 3/2, concrete chunks at 40", iron and brick at 32", wire pieces at 12", no observed or estimated water table. These tests did not show any original topsoil or subsoil. The material is clearly the result of filling. The conventional approach to designations of soil is provided through Keys to.Soil Taxonomy by the USDA. These soil designations are intended primarily for natural processes, and to soils that have undergone pedogenic processes. Though we can classify buried soils, in this case we are concerned with the fill placed over soil. There is no "typical" classification of this material, as the properties vary with the material. In this case, the fill material is a sandy or gravelly loam. It is dark brown in color(10yr 3/2) suggesting that some amount of organic material is present throughout the fill. It is interspersed with a great deal of debris, including iron, aluminum, wood, clay, concrete, and glass. It is clearly a mineral soil, not organic. In"Engineering and Soil Mechanics" by Tuma and Abdel-Hady 1973, Topsoil is referred to as"a mixture of sand, silt and/or clay with some organic matter called humus." Under this definition, I would have to agree that our site does not have an"absence of topsoil" as referred to in 310 CMR 10.58(5), but in fact appears to have an excess of topsoil. Since it is fill material with a great deal of debris, including glass, concrete, brick, iron and other materials, it would still appear to be a degraded site. A degraded site by definition includes abandoned dumping grounds and/or impervious surfaces. This site was used for dumping of fill, and would have very low permeability. I. Precast concrete curbs will be incorporated to replace bituminous curbing that was shown on the initial submission. This is in response to one of the member's concerns about bituminous curbs being easily damaged by snow plows: 2. A snow storage area further,away from the resource areas and more toward the self-storage property will'be designated on the plans. Signs will also be placed around:the perimeter of the new parking'lot to identify areas where snow should not be stored. 3. Enclosed are five conceptual schemes that were considered in developing the present site plans. As you can see, moving the parking area as close as possible to the Swampscott Road property line does not necessarily pull the project away from't6 resource areas. The proposed layout presented in the Notice of Intent Was chosen because it limits the impact on the surrounding embankment and; in turn, on the resource areas. 4. There was some discussion at the public hearing about a new driveway from Swampscott Road into the new parking lotto decrease the circulation area and the size of the new parking lot. A new driveway serving this parking lot would be directly opposite First Street. This would create additional conflicting movements that would impact the safety at this intersection. -A new driveway would be within 100 feet of the existing NSSS LP driveway, and would result, along with"the transfer station driveway, in three' driveways within approximately 300 feet, The three driveway openingsalong with the First Street intersectionwould impact the flow and safety of traffic along Swampscott Road. A major goal of-this project is to improve safety by decreasing the parking demand on Swampscott Road by providing additional parking on site. We would.like to reiterate that this project falls within the defintion of redevelopment under the Riverfron't Protection Acta The Regulations,under 10.58(5) notes that: . Redevelopment Within Previously Developed RiverfpW Areas: Restoration:and Mitigation. Notwithstanding the provisions of 310 CMR 10.58(4) and(d) the issuing authority may allow work to redevelop a previoasly redeveloped riverfrontarea provided the proposed work improves the existing conditions. Redevelopment means replacement, rehabilitation or expansion of existing structures, improvement of existing roads, or reuse of degraded or previously developed areas. A previously developed riverfront area contains areas degraded prior to August 7 1996 bv.impervious surfaces from existing structures or pavement, absence of topsoil junkyards, or abandoned dumpint,arounds. This site clearly meets the criteria as an area degraded by the,absence of topsoil, or use as an abandoned dumping ground. The regulations then state a series of requirements under 10.58(5)(a)-(h)that must be adhered to for development of the site. On this property, where the site is completely within the RiverfrontProtection Area and has been completely degraded-in'the past, the major requirement would be to improve the conditions. Given the.debris on the site and the lack of stormwater management controls,-the implementation of even limited Best Management Practices for runoff would be a significant improvement to water quality. The applicant is also willing to clean out debris in the resource area within the property. In,regard to the Wetland Protection Act,this project not only limits impacts oii.the adjacent resource areas but also serves as an improvement to a.previously degraded site. It has no impact on.abutters and,.in fact, improves the parking and safety along.SvJampscott Roadby decrea'sing the need for'parking along the 'roadway. Finally, this project provides additional on site parking to support successful businesses that provide services to the community and tax revenue to the City. We have received verbal comments on February 6, 2001 from Don Cefalo, Conservation Commission Agent,as relayed from members of the commission. The following summarizes our understanding of the comments and our responses. 1. Comment: Since the approach has been changed from a redevelopment within the riverfront area to development by right of less than 5,000 square feet, the Notice of Intent should be revised and resubmitted: Response: Seven copies of the revised Notice of Intent are enclosed. 2. Comment: The area was measured and calculated as more than 5,000 square feet of development. Response: The stub at the north end of the parking lot has been removed to bring the total work within the'riverfront area to 4,800 square feet. 3. Comment: Under 10.58(4)(c), "There must be no practicable and substantially equivalent economic alternative to the proposed project with less adverse effects on the interests identified in MG.L. c. 131 SS 40. Response: The self-storage property is fully developed and except for the subject parcel is surrounded by wetlands. Other parcels along Swampscott Road would not serve the purpose of providing nearby customer parking for the tenant. Comment: Under 10.58(4)(d)l.a., a 100foo1 wide area of undisturbed vegetation should be provided Response: The 100-foot buffer covers most of the site and would make it undevelopable. However, 10.58(4)(d)4., as quoted by Steve Eriksen of Norse Environmental at the previous meeting, allows the construction of a grandfathered lot if the performance standards are met to the maximum extent feasible. The project will cause no significant adverse impact. The area beyond the parking lot will not be disturbed except for the addition of trees for wildlife habitat. Stormwater management requirements have been met by the addition of stormwater pre- treatment system. The project does not impair the capacity of the riverfront area to provide important wildlife habitat functions, in fact, the addition of trees to the site will improve the habitat function. Erosion and sedimentation controls and other measures (the stormwater pre- treatment system) have been incorporated to attenuate nonpoint source pollution and minimize any impairment of groundwater and surface water quality. 5. Comment: What is the mean annual high water line? Response: We have assumed that the mean annual high water line corresponds to the wetland delineation which approximates elevation 88 around the perimeter of the site. 6. Comment:An alternative parking lot layout was suggested. Response: The present design is the most efficient and provides a larger buffer between the parking and the top of the embankment than other previous alternatives. The proposed project consists of ' the construction of an 11,000 square foot parking lot expansion with 21 additional oarkino spaces. Work will include erosion control, grading, drainage, bituminous concrete pavement and curbing, lighting, landscaping, retaining wall construction, and pavement markings. ' SITE DESCRIPTION The project site is 14,808 square feet (s.f.), bounded by the Forest River to the west, the South River to the north, Swampscott Road to the east, and an existing commercial building, self storage building and parking to the south. The project site is comprised of a lightly wooded area and some ground cover brush. The site has little or no topsoil, and along the slopes are visible deposits of paving material, metal scraps, ' concrete and other debris. The existing topography of the site slopes approximately 3% from Swampscott Road to the top of ' the existing rip rap slope. There is an approximate 2:1 slope from the top of the existing rip rap slope down to the resource area. The project site has elevations ranging from 87.0 at the resource area to 101.0 near Swampscott Road. ' The underlying soil found on the site is a Hydrologic Soils Group B/C, CrC— Chatfield-Hollis-Rock Outcrop as defined by the Soil Survey of Essex County, Massachusetts, Southern Part. ' The project site is at the intersection of two rivers, the Forest River and the South River. The boundaries of the resource areas have been delineated by Norse Environmental Services and were subsequently located on a land survey provided by Allen & Major Associates, Inc. The ' attached wetland report addresses the resource areas in detail. Approximately 92% of the proposed project area is within 100' of the riverfront buffer area with the remaining 8% in the 100'- 200' riverfront buffer area. ' NOTICE OF INTENT NSSS LP Parking, Swampscott Road tSalem, Massachusetts I'I tSURFACE DRAINAGE The existing storm water runoff infiltrates into the soil and flows overland into the existing resource ' area adjacent to the project site. The proposed storm water drainage system is designed to address the needs of the project, ' minimize drainage impacts on and off the site, and conform to the requirements set forth by the Wetlands Protection Act and the City of Salem. The proposed drainage system consists of one new catch basin connecting into the existing closed drainage system on the adjacent lot that contains the commercial and self storage building. EROSION AND SILTATION CONTROL ' Temporary erosion and sedimentation controls will be incorporated into the construction phase of the project, which will include haybale and/or silt fence barriers, inlet sediment traps, diversion ' channels, slope stabilization, and stabilized construction entrances. During the course of construction and until such time as any vegetation is properly set, the necessary erosion and sedimentation controls will be staked along the limits of construction. All ' excavated materials unsuitable for reuse will be disposed of properly by licensed trucking firms. Rows of hay bales and silt fence will be placed at the limit of work abutting all resource areas. ' Periodic inspection and replacement as necessary will maintain the integrity of the hay bales and silt fence. The hay bales and silt fence will remain in place until the parking lot has been constructed, the pavement resurfacing has been completed, and all side slopes have been ' loamed and seeded and vegetation has been established. The proposed catch basin has been designed with four foot sumps with hoods to minimize the impacts on water quality by promoting the settlement of sediments and pollutants before outletting to the existing closed drainage system. ' BORDERING VEGETATED WETLANDS A Wetland Report prepared by Norse Environmental Services, Inc. is included in this filing which ' describes the existing conditions in relation to the Wetland Protection Act. Any work within 100 feet of resource areas or 200 feet of riverfront will be subject to review and approval by the Conservation Commission under the provisions of the Wetlands Protection Act and the City Wetland Bylaw. The project has been designed to avoid wetland impacts and will not require the ' filling of any wetland resource areas other than within the buffer. The design provides a 10 foot no disturb buffer for the proposed redevelopment. NOTICE OF INTENT NSSS LP Parking, Swampscott Road Salem, Massachusetts STORMWATER MANAGEMENT The Stormwater Management Policy has been followed to the maximum extent possible for a redevelopment project. There is an increase in impervious area on the proposed project site and due to land area constraints, not all BMP's stated in the Stormwater Management Policy can be met on site. BMP's incorporated into the design include deep sump catch basins with hoods and ' oil absorbent pillows, and an Operations and Management Plan which addresses pavement sweeping and inspection and cleaning of the catch basin. The proposed stormwater management system will connect into the existing closed drainage system on the adjacent lot with the commercial and self storage building. See the Hydrograph Summary Report for pre and post ' development runoff conditions. DEP's Stormwater Management Policy was developed to improve water quality by implementing ' performance standards for storm water management. The intent is to implement the stormwater management standards through the review of Notice of Intent flings by the issuing authority (Conservation Commission or DEP). The Stormwater Management Standards apply to industrial, commercial, institutional, residential subdivisions, and roadway projects, including site preparation, construction, redevelopment and on-going operation. (Stormwater Management Policy Issued November 18, 1996) Stormwater runoff volumes to be treated for water quality: Total Site—0.5 Inches x 0.34 Acres = 0.014 Acre-Ft. ' Total Suspended Solids(TSS) The following network of stormwater management BMP's are relative to all drainage areas and the respective proposed drainage systems to be constructed. ' Parking Lot Sweeping: 10% Deep Sump Catch Basins: 25% Parking Lot Sweeping: 1.00 x 10% = 0.100 1.00 -0.100 0.900 Deep Sump Catch Basins: 0.90 x 25% = 0.225 0.90-0.225 0.675 t The total suspended solids remaining after treatment is 67.5%. Therefore, 32.5% of the total suspended solids will be removed. It is assumed that the remaining 47.5% of the total suspended solids will be removed once connected to the existing closed drainage system. ' The Stormwater Management Policy identifies nine Stormwater Management Standards as follows: ' Standard #1- No new storm water conveyances (e.g., outfalls) may discharge untreated stormwater directly to or cause erosion in wetlands or waters of the Commonwealth. ' There are no new discharge areas proposed for the project. Standard #2- Stormwater management systems must be designed so that post-development peak discharge rates do not exceed pre-development peak discharge rates. ' NOTICE OF INTENT NSSS LP Parking, Swampscott Road ' Salem, Massachusetts tPost-development peak discharge rates to the resource area will be less than pre-development peak discharge rates for all storm events. The peak discharge from the site will increase by only 0.70 cfs for the 100 year storm but will be directed to an existing close drainage system where it will have minimal impact. See attached drainage calculations. Standard#3- Loss of annual recharge to groundwater should be minimized through the use of infiltration measures to the maximum extent practicable. The annual recharge from the post- development site should approximate the annual recharge from the pre-development or existing site conditions, based on soil types. ' There is no infiltration proposed for the project. Based upon Soil Hydrologic Group C and Volume to Recharge of 0.10 inches, 90 Cubic Feet of water should be recharged in post-development. No ' recharge is proposed, however, loss of groundwater recharge from the proposed parking area is anticipated to have minimal impact on the resource area. Standard #4- For new development, stormwater management systems must be designed to ' remove 80% of the average annual load(post-development conditions) of Total Suspended Solids (TSS). It is presumed that this standard is met when: A. Suitable nonstructural practices for source control and pollution prevention are implemented; ' B. Stormwater management best management practices (BMP's) are sized to capture the prescribed runoff volume; and C. Stormwater Management BMP's are maintained as designed. ' The following network of stormwater management BMP's are relative to all drainage areas and the respective proposed drainage systems to be constructed. Not Applicable ' NOTICE OF INTENT NSSS LP Parking, Swampscott Road Salem, Massachusetts t Standard#6- Stormwater discharges to critical areas must utilize certain stormwater management BMP's approved for critical areas. Critical areas are Outstanding Resource Waters (ORM, shellfish beds, swimming beaches, cold water fisheries and recharge areas for public water supplies. Not Applicable ' Standard 97- Redevelopment of previously developed sites must meet the Stormwater Management Standards to the maximum extent practicable. However, if it is not practicable to meet all the Standards, new (retrofitted or expanded) stormwater management systems must be tdesigned to improve existing conditions. The proposed project is a redevelopment project. Standards #1, #2, #5, #6, #8, and #9 have ' been met. Standards#3 and#4 have not been met. Standard#3 has not been met, however, the loss of groundwater recharge from the proposed parking area will be minimal. Standard #4 has not been met due to the small size of the site, however, it is assumed the TSS removal will be met once the proposed system is connected to the existing closed drainage system on the adjacent ' lot. Standard#8- Erosion and sediment controls must be implemented to prevent impacts during ' construction or land disturbance activities. Staked haybales and siltation barrier will be installed in the location shown on the site plan to ' prevent migration of sediments towards the resource area. Refer to Erosion Control Plan and Erosion Control Details submitted with the Notice of Intent. Standard#9- All stormwater management systems must have an operation and maintenance ' plan to ensure that systems function as designed. Refer to the attached Plan C-2. ' 100-YEAR FLOOD PLAIN ' The Flood Insurance Rate Map for the City of Salem, Panel Number 250102 0005B describes the project site as Zone C. Zone C is classified as an area of minimal flooding. No portion of the project site falls within the 100-year flood zone. RIVERS PROTECTION ACT ' The proposed project site abuts two rivers. The South River is located to the north, and the Forest River is located to the west of the project site. 92% of the proposed project is located ' within the 100 foot riverfront buffer with the remaining 8% located in the 100-200 foot buffer. The previous development had a zero foot (0') buffer, A&M intends to implement a 10 foot no disturb area. A retaining wall will be constructed along the north part of the parking lot, along the South NOTICE OF INTENT NSSS LP Parking, Swampscott Road Salem, Massachusetts ' River and will be the closest encroachment to the rivers during construction. The proposed project has been designed in accordance with 310 CMR 10.58 (5)(c)(d) and (f). Notwithstanding the provisions of 310 CMR 10.58(4)(c) and (d) the issuing authority may allow work to redevelop a previously developed riverfront area, provided the proposed work improves the existing conditions. Redevelopment means replacement, rehabilitation or expansion of existing structures, improvement to existing roads, or reuse of degraded or previously developed areas. A previously developed riverfront area contains areas degraded prior to August 7, 1996 by impervious surfaces from existing structures or pavement, absence of topsoil, junkyards, or abandoned dumping grounds. The site in question is clearly a filled lot, probably long before 1996, though the wetland scientist has no personal knowledge of when the filling took place. It has little or no topsoil and/or seems ' to be an abandoned dumping ground. Under these conditions, it would appear to qualify as a redevelopment. The regulations then state a series of requirements under 10.58(5)(a)-(h) that must be adhered to ' for development of the site. On this property, where the site has been completely degraded in the past, the major requirement would be to improve the conditions. OPERATION & MAINTENANCE PLAN ' A draft Operations and Maintenance Plan is summarized below and can be found on the attached C-2 Plan and will be incorporated into the constructions documents for this project. ' In accordance with the Stormwater Management Policy issued by the Department of Environmental Protection (DEP), Allen & Major Associates, Inc. (A&M) has prepared the following operation and Maintenance plan for the parking lot addition at 36 Swampscott Road in Salem, MA. ' During construction the contractor will adhere to the following activities: 1. Contact the Salem Conservation Commission at least (3) days prior to the start of ' construction. 2. Install the haybale and silt fence as shown on Plan C-2. ' 3. Install the haybales around existing catch basins to prevent sediment from entering the drainage system. ' 4. The contractor shall only disturb the minimum area necessary. 5. The entire project area shall be swept upon completion of construction and prior to removal of the erosion control devices. 6. The contractor shall comply with the General Erosion and Sedimentation Control Notes as shown on plans prepared by Allen & Major Associates, Inc. ' NOTICE OF INTENT NSSS LP Parking, Swampscott Road ' Salem, Massachusetts The owner or owner's representative will adhere to the following post-development activities: ' 1. Paved Areas—Paved areas shall be swept by street sweepers periodically during dry weather to remove excess sediments, reducing the amount of sediments that the drainage system will have to remove from the runoff. Salt for de-icing on the paved areas during the winter months should be limited as much as possible, as this will reduce the need for removal and treatment. ' However, difficulties may arise in the enforcement of such restrictions. Sand containing the minimum amount of calcium chloride (or approved equivalent) needed for handling may be applied as part of the routine winter maintenance activities. ' 2. Catch Basins—Catch basin grates shall be checked periodically and following heavy rainfalls to verify that the inlet openings are not clogged by debris. Debris shall be removed from the ' grates and disposed of properly. Deep sump catch basins shall be inspected and cleaned annually of all accumulated sediments. Catch basins with hoods shall be inspected quarterly to check oil build-up and outlet obstructions. The catch basins shall be cleaned once a year. This should be in the spring after the winter sanding season. Material shall be removed from ' catch basins and disposed of in accordance with all applicable regulations. 3. Pesticides, Herbicides, and Fertilizers—Pesticides and herbicides shall not be used anywhere ' on this site. In addition, only organic fertilizers are to be used on the site. 4. Maintenance Responsibilities — All post construction maintenance activities should be ' documented and kept on file and made available to the Conservation Commission upon request. The property is a disturbed or filled portion of land abutting the Salem Municipal Solid Waste Transfer Station to the 1 north, and a self storage facility to the south. it Is directly across from First Street. 1 According to the USGS Topographic maps(copy attached)there are three streams associated with this site.Stream#1 ftows from the Northwest to the Southeast and Is 1 shown on the maps with a dark line width. It is presumed to be a perennial stream under the Rivers Act. 1 Stream#2 is an Intermittent stream channel flowing generally east to west,from 1 adjacent to First Street and under Swampscott Road onto the subject property. 1 i 1 1 1 Stream#3 emanates from a ponded area west of the site and is shown as a perennial stream joining Stream#1. Resource areas consist of the intermittent stream channel as Land Under Water Bodies 310 CMR 10.58(2)(a c), the two perennial streams that are presumed to be Rivers tunder 10.58 (2)(a)(1)(a), and the associated banks for each stream as defined in 10.54(2)(a-c). The Banks coincide closely with the Bordering Vegetated Wetland areas as defined in 10.55(2)(a-c)that are beside the stream channels. It Is likely that Land Subject to Flooding as defined In 310 CMR 10.57(a) is also on site. The upland portions of the lot are confined to the area adjacent to Swampscott Street. The lot is virtually all disturbed or filled, with steep slopes dropping to the resource ' areae.Along the slopes are visible deposits of paving material, metal scrap, concrete and other debris.To the rear of the property and adjacent to the storage buildings part of the slope is rip-rapped. ' Vegetation within the wetland consists primarily of Phragmits (Phragmite austrelius), some Skunk Cabbage(Symplocarpus foetidus), and Cattail(Typha latifolla). Upland areas are dominated by Smooth Sumac(Rhus giabra), Knotweed(Polygonum ' cuspidata), and MulttFlors rose. ' The land drops steeply to the rear of the lot into a pond or deep marsh area. Part of the Bank to the marsh has been rip-rapped with large stones and cobbles. This area was stagnant on my visit and did not appear to show'rtvedne'characteristics. k appears to exceed 10,000 s.f. in area and would not seem to dry up, and may be considered a pond under the definitions In the Wetland Protection Act. j 1 The Commission may not feel that the ponded area is actually a'Pond*, and may believe that 4 has rivedne characteristics.
