Findings This Order of Resource Area Delineation determines that the Storrnwater Plan, if applicable, and the boundaries of those resource areas noted above, have been delineated and approved by the Commission and are binding as to all decisions rendered pursuant to the Massachusetts Wetlands Protection Act (M.G.L. c.131, §40)and its regulations(310 CMR 10.00).This Order does not,.however, determine the boundaries of any resource area or Buffer Zone to any resource area r1gJ specifically noted above, regardless of whether such boundaries are contained on the plans attached to this Order or to the Abbreviated Notice of Resource Area Delineation. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and Inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. If the Abbreviated Notice of Resource Area Delineation was filed as Simplified Review for a Buffer Zone project,the applicant has certified that any work associated with the proposed project meets all eligibility requirements for Simplified Review listed in Section C of this Order. Any work that does not comply with the Simplified Review requirements will require a Notice of Intent or Request for Determination of Applicability. The applicant is responsible for promptly requesting a Certificate of Compliance following completion of any work allowed pursuant to a Simplified Review or no later than three years from the date of the Order of Resource Area Delineation unless the Order is extended. Failure to comply with the conditions of this Order is grounds for the Conservation Commission or the Department to take enforcement action. This Order must be signed by a majority of the Conservation Commission.The Order must be sent by certified mail(return receipt requested)or hand delivered to the applicant. A copy also must be mailed or hand delivered at the some time to the appropriate DEP Regional Office. E. Plan shows Series A of flags behind St. Anne School, but these flags were not observed in the field, this area should be flagged if it has not been already. Stream is located much further north than shown on plan. Stream appears to start at flag B-19 and is fed from drainage off of golf mune. Area behind Flags B17 & B18 vegetation shows hydrologic connection, flags in this area(should be checked. Stream is approximately 10 to 15 feet wide at flag B-16. Entire width and length of stream should be shown on plan. Stream appears to flow to the south. Drainage area should be calculated to determine if stream is perennial or Intermittent. I notice on the DEP website under comments of 1/12/06, the commentator(DEP?) states that the stream located on the map appears to be from drainage from the golf course. I am sure the Con Com knows that the stream emits from a very large drainage pipe on the other side of Castle Hill Park which comes from under North Shore Medical Center parking lot and from across Highland Avenue. It is a part of the.South River Flood Control Project done back in the late 1960's (1968?). The water, I believe, comes from the Colby Street/Andy's Pond area and flows under Highland Avenue, under the Greenway Road neighborhood and under the NSMC parking lot to Castle Hill Park outflow pipe. It is not Intermittent and flows very well all summer. I am sure there is substantial runoff from the golf course, but that is not the primary source. Also, as I have mentioned at a previous meeting, there is a stream that emits at the end of Story Street and runs into this land also. It too, is not intermittent as it has a steady flow all summer. If members of Con Com are unware of the former, would you let them know? Thank you. Vegetation within the wetland consists primarily of staghorn sumac and oriental bittersweet. (both upland species) • The intermittent stream,which bisects the property,has not been survey located and is not depicted on the plan. The stream is confined in its entirety by the wetland system, and the applicant is requesting that the Conservation Commission confirm the boundary of the Bordering Vegetated Wetland. • The intermittent stream is depicted as such on the most recent version of the USGS quadrangle. 310 CMR 10.58.2(a) 1(b) states 'A stream shown as intermittent or not shown on the current USGS map or more recent map provided by the Department, that has a watershed size less than one square mile, is intermittent unless (i) the stream has a watershed size of at least one-half(0.50) square mile... "The intermittent stream in question has a watershed that is less than one-half square mile in size and is therefore to be considered intermittent.
