I have examined a letter from the City Assessor ' s Office , documentation from the Salem Fire Department , various census records and numerous affidavits from abutters of the property. Based on my review of the documentation, it is my opinion that this dwelling was a lawful three-family residence prior to the adoption of the City ' s Zoning Ordinance in 1965 . It is my opinion that this dwelling should be afforded the protection of Section VIII ( E) of the aforementioned ordinance relative to non-conforming uses and this dwelling ' s current use as a three-family unit is permissible . Sirs; I respectfully request that my 3 family be legalized as a 3 fabily dwelling, as it has been used as a 3 family since at least the 1950's and possibly earlier. I just purchased the house in April 20, 1990, from Joan Leone, wbo inherited it from her uncle Bill Gans, who passed away last year. I have put in a lot of cosmetic work on the 2nd and 3rd floors: paint, wall- paper, sanding floors and laying rugs, and I'm in the process of putting in flowers and a centerpiece with birdbath on the lawn, as well as scraping and painting the outside house, gagage, and shed. I've ,just had Anchor Oil Co. modernize the furnace and do some plumbing on the heating system. I live on the 2nd, floor and I intend to keep the property in shape & beautiful. I'm in the process of having 200 amp Elec. service (to replace fuses), and the elec- tricians that I talk to tell me it would be more cost efficient to legalize it as a 3 family 1st., because to do it later would mean they would have to charge for another job to break seals, and run more wires. I would really like my tennants to have their own electric meters, and legalize it as a 3 family for future value to V family. They tell me that the other abbutors (?) are all fairly new to the area. The Cretiens and the Dupois trill me that 11 Linden has been a 3 family as long as they can repember. As the weather gets warmer, I wanted to address the Dumpster issue that you and I've talked about in the past. Are you still serving on the condo association board? If not could you either pass this along to the appropriate party or let me know the contact person. My main Dumpster complaints are as follows: 1. Location 2. Not covered at all times as required by ordinance thus.... Pools of standing water collect and mix with trash etc. Flies and mice are a problem Trash blows into my yard For easy reference, I've attached the Salem city ordinance relative to Dumpsters and highlighted key items related to my complaints. I would appreciate the association's attention to the issues raised here and finally fixing the problem. Thanks.
