This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a. The work is a maintenance dredging project as provided for in the Act; or b. The time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance. If this Order is intended to be valid for more than three years, the extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. c. If the work is for a Test Project, this Order of Conditions shall be valid for no more than one year. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. An Order of Conditions for a Test Project may be extended for one additional year only upon written application by the applicant, subject to the provisions of 310 CMR 10.05(11)(f). 6. If this Order constitutes an Amended Order of Conditions, this Amended Order of Conditions does not extend the issuance date of the original Final Order of Conditions and the Order will expire on unless extended in writing by the Department. 7. Any fill used in connection with this project shall be clean fill. General Conditions Under Massachusetts Wetlands Protection Act 8. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal has been taken, until all proceedings before the Department have been completed. 9. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done. The recording information shall be submitted to the Conservation Commission on the form at the end of this Order,which form must be stamped by the Registry of Deeds, prior to the commencement of work. 10. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" [or, "MassDEP"] "File Number 64-634 " 11. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A)to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition#13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this Order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 16. General Conditions Under Massachusetts Wetlands Protection Act (cont.) 17. Prior to the start of work, and If the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. 19. The work associated with this Order(the 'Project') (1) ❑ is subject to the Massachusetts Stormwater Standards (2) ® is NOT subject to the Massachusetts Stormwater Standards If the work is subject to the Stormwater Standards,then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs)shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. For any construction period BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the BMP has been properly cleaned or prepared for post construction operation, including removal of all construction period sediment trapped in inlet and outlet control structures; ii. as-built final construction BMP plans are included, signed and stamped by a Registered Professional Engineer, certifying the site is fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per the requirements of Stormwater Standard 10; vpaform5.d=- rev.6/16/2015 _ Page 7 of 12 Massachusetts Department of Environmental Protection Provided by MassDEP: Bureau of Resource Protection -Wetlands 64-634 WPA Form 5 - Order of Conditions MassDEP File# Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 eDEP Transaction# Salem Citylrown C. General Conditions Under Massachusetts Wetlands Protection Act (cont.) iv. all post-construction stormwater BMPs are installed in accordance with the plans (including all planting plans)approved by the issuing authority, and have been inspected to ensure that they are not damaged and that they are in proper working condition; v. any vegetation associated with post-construction BMPs is suitably established to withstand erosion. c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party(defined in General Condition 18(e))shall execute and submit to the issuing authority an Operation and Maintenance Compliance Statement("O&M Statement)for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: L)the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.)the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f)through 18(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. A plan and easement deed that grants the responsible party access to perform the required operation and maintenance must be submitted along with the legally binding agreement. f) The responsible party shall operate and maintain all stormwater BMPs in accordance with the design plans, the O&M Plan, and the requirements of the Massachusetts Stormwater Handbook. wpform5.E - my.6/16/2015 Page 8 of 12 Massachusetts Department of Environmental Protection Provided by MassDEP: \ Bureau of Resource Protection - Wetlands 64-634 WPA Form 5 — Order of Conditions MassDEP File# Massachusetts Wetlands Protection Act M.G.L. c. 131, §40 eDEP Transaction# Salem City/town C. Maintain an operation and maintenance log for the last three(3)consecutive calendar years of inspections, repairs, maintenance and/or replacement of the stormwater management system or any part thereof, and disposal (for disposal the log shall indicate the type of material and the disposal location); 2. Make the maintenance log available to MassDEP and the Conservation Commission ("Commission") upon request; and 3. Allow members and agents of the MassDEP and the Commission to enter and inspect the site to evaluate and ensure that the responsible party is in compliance with the requirements for each BMP established in the O&M Plan approved by the issuing authority. h) All sediment or other contaminants removed from stormwater BMPs shall be disposed of in accordance with all applicable federal, state, and local laws and regulations. i) Illicit discharges to the stormwater management system as defined in 310 CMR 10.04 are prohibited. j) The stormwater management system approved in the Order of Conditions shall not be changed without the prior written approval of the issuing authority. k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site Design Credit(as defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1, Low Impact Development Site Design Credits)shall not be altered without the prior written approval of the issuing authority. 1) Access for maintenance, repair, and/or replacement of BMPs shall not be withheld. Any fencing constructed around stormwater BMPs shall include access gates and shall be at least six inches above grade to allow for wildlife passage. For Test Projects subject to 310 CMR 10.05(l 1), the applicant shall also implement the monitoring plan and the restoration plan submitted with the Notice of Intent. All discharge from de-watering activities shall be filtered through straw bale sediment traps, silt filter bags or other means approved by the Commission or its Administrator. 27. Within thirty(30)days of completion of construction on any given portion of the project,all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover,using sufficient top soil to assure long-term stabilization of disturbed areas. 28. If soils are to be disturbed for longer than two(2)months,a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. A copy of this Order of Conditions and the plan(s)approved in this Order shall be available on site at all times when work is in progress. 30. All waste products,grubbed stumps, slash;construction materials, etc. shall be deposited at least 100 feet from wetland resource areas and 200 feet from river. 32. Immediately following drainage structure installation all inlets shall be protected by silt fence,strawbale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. 35. There shall be no pumping of water from wetland resource areas. 36. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines,cylinders or any other components shall be fixed immediately. 37. During construction,all drainage structures shall be inspected regularly and cleaned as necessary. 38. The applicant is herby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions by the Conservation Commission including,but not limited to,civil administrative penalties under M.G.L Chapter 21 A, section 16. Glenn Yale asked where the edge of the new fill will be located and Mr. Gerber stated he does not intend to place any fill at all. Erosion controls are to be inspected by the City prior to excavation work. Erosion controls are to be monitored and maintained in good condition throughout construction. 2 Demo existing 9 Y o shed. All demolition debris is to immediate) into a dumpster or dump trailer and removed from the site for proper disposal. 3) Remove section of existing guardrail. Reset guardrail immediately or provide temporary jersey barriers until guardrail can be replaced. 4) Clear all vegetation from the work area. Vegetation is to be chipped onsite and immediately placed in a dump truck for removal from the site. Wood chips are not to be stockpiled onsite. 5) Remove section of existing bituminous curb and rough-in excavator access area from the southwest corner of the lot. Remove stumps and haul from site. Excavate a staging pad in the central portion of the work area at the approximate bottom of building footing elevation. 6) Excavate for the proposed retaining wall. Remove any unsuitable materials from the site. Most of the work will be done with a large track-mounted excavator from the staging pad. A ramp will be constructed from the southerly end of the wall to provide access for a mini-excavator or skid-steer loader to move materials. Establish bottom of retaining wall footing grade, step footing as required, and work back towards the access point. 7) Form and pour concrete retaining wall footing and walls. Allow concrete to achieve full design strength before backfilling. The subject Sophia Road parcel (Map 4 Lot 25) was divided in t 2016 into two lots (reference ESRD Land Court Plan#11802-64). The southerly lot is developed with a single-family residence and the northerly lot is the vacant, . developable property. This application pertains only to the development of the tvacant property (Lot 747 on the referenced plan). The subject property is approximately 0.67-acres in size. The property is bounded to the west by Sophia Road, to the north by an unimproved portion of the Appleby Road right-of-way, to the west by three single-family residential properties along Ravenna Avenue, and to the south by the developed 3 Sophia Road lot. Figure 1 - ' United States Geological Survey (USGS) Locus Map depicts the general location of the project site. ' This Notice of Intent is for the construction'of a single-family residence with associated deck, driveway, retaining walls, utilities, and landscaping. The activities are located with the 100-foot Buffer Zone to Bordering Vegetated Wetland. Such ' areas are subject to protection under the Massachusetts Wetland Protection Act (MA WPA) and the City of Salem Wetland Protection and Conservation Ordinance. ' The wetland resource area is further described in Section 2.0. A detailed description of the proposed work is provided in Section 3.0. Mitigation measures associated with the project are described in Section 4.0. The reader is referred to ' Attachment B for a Site Plan showing the existing conditions and the proposed work. 2.0 WETLAND RESOURCE AREAS ' Griffin Engineering Group, LLC reviewed information regarding the subject Sophia Road property to determine if the area of proposed work is located within resource areas regulated under the Massachusetts Wetlands Protection Act (MA WPA) and the City of Salem Wetlands Protection and Conservation Ordinance. The review included an on-site inspection, topographic field survey, and a review of pertinent published information regarding the project area. This resource ' area is regulated under the MA WPA and the local Ordinance. The proposed work is located within the jurisdictional 100-foot Buffer Zone to the protected resource area requiring.a Notice of Intent to be filed under the MA WPA and local Ordinance. ' 2.1 Bordering Vegetated Wetlands ' According to the Fish &Wildlife Services inventory maps, a seasonally flooded/saturated forested wetland system is located on the northeast section of the subject property. The wetland on the property is the distal end of a 30+-acre ' wetland system tributary to and bordering on Strongwater Brook. On the subject property, the Bordering Vegetated Wetland (BVW) was delineated by t wetland scientist William Manuell of Wetlands and Land Management, Inc of Danvers, MA. The BVW boundary is well defined by topography, hydrophytic vegetation and hydric (wetland) soils. The wetland flags were mapped by ' instrument survey and are shown on the accompanying Site Plan in Attachment B. No work is proposed within the BVW however, work is proposed to occur within the ' 100-foot Buffer Zone to the BVW. Appropriate mitigation measures are proposed to protect the resource area during construction and until the disturbed areas have been restabilized. ' 2.2 Buffer Zone The Buffer Zone is the area extending 100-feet horizontally from the delineated BVW ' boundary. Buffer Zones are considered significant because they perform vital functions in protecting the resource areas and interests of the MA WPA and local Ordinance. The portion of the proposed work will occur within this area. ' Appropriate mitigation measures are proposed to protect the resource areas during construction and until the Buffer Zone has been stabilized. ' 2.3 Additional Information o The USGS Topographic Quad does not indicate any streams (intermittent or perennial) within 200-feet of the subject property. Therefore, the subject ' project is not subject to the Riverfront Area Regulations. o The FEMA Flood Insurance Rate Map for the City of Salem (Map Number ' 25009C0418G & 25009C0513G) indicates that the subject property and adjacent portion of the wetland resource area is not located within any flood hazard areas. ' o According to the Massachusetts Natural Heritage Atlas 2008 Edition, the project site is not within an area mapped as having Estimated Habitat of Rare ' Wildlife or Vernal Pools. A - 3 1 3.0 PROPOSED PROJECT / WETLAND RESOURCE AREA IMPACTS ' The proposed project is the construction a single-family dwelling with associated ' deck, driveway, retaining walls, utilities, and landscaping on a vacant lot along Sophia Road. As shown on the attached Site Plan (Attachment B), approximately 90% of the property contains jurisdictional Bordering Vegetated Wetland (BVW) and ' associated Buffer Zone. No work is proposed in the BVW but work within the Buffer Zone is unavoidable and necessary for the development of the lot. ' Disturbance associated with proposed work is located approximately 43 feet from the BVW. The proposed residence is located approximately 70-feet from the BVW at its closest point. The proposed two-story residence will be conventional cast-in-place ' concrete foundation and wood-framed construction. A new wooden-deck on sono-tube supports is also proposed along the rear of the residence. The reader is referred to Attachment B for a Site Plan showing the proposed work. Specific ' elements of the project include: (1) Excavating and constructing a retaining wall with a safety railing/fence along ' the rear of the proposed residence (2) Excavating and pouring a conventional cast-in-place concrete building foundation; ' (3) Constructing a two-story, wood framed residence with attached garage and rear deck; (4) Installing municipal utility services (water, sewer, gas, electrical, telephone & ' cable); (5) Installing two stormwater infiltration trenches w/ StormTech infiltration chambers to recharge roof runoff and dampen peak runoff; ' (6) Installing a bituminous concrete driveway from Sophia Road; (7) Regrading, installing landscape walls, and landscaping all disturbed areas. ' During construction, erosion control measures are proposed as specified in Attachment D. Straw wattles will be placed downgradient of all proposed construction activities. All disturbed areas are to be re-vegetated or stabilized as ' soon as practicable. 3.1 Buffer Zone As illustrated on the Site Plan in Attachment B and noted above, approximately 90% of the site is located within the 100-foot Buffer Zone to the BVW. Locating the proposed work outside the 100-foot Buffer Zone is not practicable. Unnecessary ' Buffer Zone disturbance has been avoided. Mitigation of Buffer Zone disturbance will be accomplished by adopting erosion and sedimentation controls throughout construction and until vegetation has been reestablished. Also, mitigation is ' proposed in the form of two stormwater infiltration trenches located along the A - 4 1 1 perimeter of the residence. Roof runoff from the residence will be collected by gutters and conveyed to the infiltration trenches to be recharged. For these ' reasons, the proposed work and its associated mitigation measures are consistent with the performance standards of the MA WPA and the local Ordinance. ' 4.0 MITIGATION MEASURES Proposed mitigation measures are described below. Throughout the work, ' disturbed soil areas will be re-stabilized and re-vegetated as soon as possible. Erosion control specifications are detailed in Attachment D. ' Prior to work commencing on the site, there will be a preconstruction conference with the contractor. The purpose of this meeting will be to coordinate the best methods ' for erosion and sedimentation control, protection of the surrounding wetland resource areas, and other construction-related issues. The implementation of a comprehensive soil and erosion control plan will occur prior to any construction ' activities within the project area. In general, the following sequence of erosion control will occur: ' o Erosion and sedimentation control devices will be installed along the edge of the down gradient side of the project area prior to construction as depicted on the Site Plan (Attachment B). ' o Erosion and sedimentation control devices will be inspected daily during periods of active construction and bi-weekly during the remainder of the ' construction period. Sediments will be removed from the barriers as soon as they reach a depth of 6-inches. o Runoff from the site will be directed through sedimentation control barriers. o During construction, disturbed areas will be kept to a minimum and vegetative ' stabilization of these areas will occur as soon as possible. o Temporary seeding, mulching, or other suitable stabilization measures will be ' used to protect exposed critical areas should unprotected soils remain exposed for prolonged periods. ' Construction activities shall be monitored on-site by the construction supervisor to ensure that the soil erosion and sediment control features are installed properly, maintained, and to evaluate the need for additional erosion control and/or ' stabilization measures. The inspector will perform the following tasks: o Supervise the installation and maintenance of the soil erosion and sediment control features. ' A - 5 o Evaluate the need for additional soil erosion and sediment control features. o Scheduled inspections of erosion control features, including construction entrance, haybales, and dust control. ' o Supervise and monitor temporary and permanent stabilization activities. ' 5.0 CONCLUSION The proposed project is the construction a single-family dwelling with associated deck, driveway, retaining walls, utilities, and landscaping on a vacant lot along Sophia Road. The project is designed to comply with both state and local wetland ' regulations and to minimize impacts to the surrounding wetland resource areas. The proposed work meets the applicable performance standards for work to be performed within a Buffer Zone to a Bordering Vegetated Wetland. Permanent ' unavoidable impacts and temporary impacts have been minimized. Adequate mitigating measures are proposed so as not to compromise the function of the resource area during construction. The proposed project, with its mitigation ' measures, meets the performance standards and protects the interests of the Massachusetts Wetlands Protection Act and the City of Salem Wetlands Protection and Conservation Ordinance. 1 t ' A - 6 1 ATTACHMENT B ' SITE PLAN 1 1 1 1 1 1 1 1 1 1 ATTACHMENT C ' EROSION CONTROL SPECIFICATIONS 1 1 1 1 1 1 1 1 ' Section 01568 Erosion Control, Sedimentation and ' Containment of Construction Materials Part 1 -General ' 1.1 Provide all work and undertake all measures necessary to control soil erosion from the work site throughout the Construction Phase and continuing until removal of siltation ' controls are authorized by the Engineer or Local Authority. This work shall be, continuous throughout the project, regardless of the construction schedule undertaken by the Contractor. The contractor must ensure that controls perform as specified even j ' when he is not present at the work site. 1.2 Prevent soil and construction materials from the work area from reaching wetlands or ' waterways at all times. 1.3 Install and maintain erosion controls as shown on the drawings and as specified. Should additional controls or measures be necessary to control erosion, as determined by the ' Owner or Engineer, then provide and maintain same. 1.4 Controls installed and maintained must prevent movement of soil and construction ' materials from the work areas at all times. Controls must be capable of performing adequately during normal and severe storm events. 1.5 Controls are to be installed prior to disturbing earth or vegetation at the project. 1.6 Compliance with all requirements of the Order of Conditions issued by the Local Authority is the responsibility of the Contractor, with the following exceptions: Filing of the Order on the property deed. Requirements for actions at the property after the authorized removal of erosion ' controls. Part 2 - Quality Assurance 2.1 All erosion controls to be constructed of new materials approved by the Engineer and consistent with these specifications. Replace inadequate or worn controls with new ' materials. 2.2 Inspect and maintain as necessary erosion controls within 24 hours following every ' storm event. 2.3 Disturbance of soils or vegetation and construction activities of any type beyond the ' limits of work shown on the drawings are prohibited. Do not disturb adjacent vegetation. 2.4 The Contractor is solely responsible, at no additional cost to Owner, for repairs, replanting, remediation, or reconstruction or other any actions ordered by the Local ' Authority resulting from non-compliance with these requirements. Non-compliance includes, but is not limited to, failure to prevent soil and construction materials from reaching a wetlands or waterbody. I ' 01568-1 ' 2.5 The Contractor is required to keep on-site, throughout the project, 12 additional haybales and 50 feet additional silt fence. These additional erosion control materials are to be ' available for use solely at the project site and are to be installed immediately upon direction of the Engineer or the Local Authority. ' 2.6 Follow preventative erosion control practices established by the United States Soil Conservation Service. ' 2.7 Do not allow litter or construction materials to blow from the work area and enter wetlands. Immediately remove by hand any such materials entering wetlands. ' Part 3 - Submittals 3.1 Two weeks prior to disturbing soil at the project site, submit to Engineer for review and approval, catalog cuts showing the proposed materials to be used during construction. ' Part 4 - Materials 4.1 Haybales shall be made of straw or hay, tightly bound with string, and measure approximately 18" x 18"' x 3' or larger. 4.2 Silt Fence - shall be made of a woven geotextile with a metal reinforcing mesh fully integrated during the manufacturing process into the geotextile. 4.3 Stakes - Stakes for securing haybales and silt fence shall be made of oak, and shall have nominal dimensions of 2" x 2" x 4'. Metal fence posts for silt fence acceptable. Part 5 - Dewatering Discharges 5.1 Water discharged from the construction area must be completely free of petroleum products. 5.2 The maximum rate of pumping, without special approval of the Engineer, shall be 150 gallons per minute. 5.3 Dewatering waters shall pass through a silt removal chamber having an overflow rate less than 3,500 gallons per square foot per day and a depth of at least three feet, and ' then be filtered through haybales prior to being allowed to flow to a wetlands or waterbody. Effluent shall have turbidity less than 10 NTU. ' Part 6 -Additional Requirements ' 6.1 Install silt fence around all stockpiles of soil placed within 200' of a wetlands. 6.2 Controls are to be removed after vegetation in the work area has been established, and ' is determined by the Engineer or Local Authority as being effective at controlling erosion.
