Dear Ms. Horne and Members of the Commission:
In connection with my request that the Order of
Conditions for Saunders Street be extended for an additional three
years, I would submit the following.
We are still attempting to gather together the
information you requested. Thus far the information cannot be
located in the Conservation Commission files. Since the project
received a Special Permit under Site Plan Review, it may be that
the Planning Department files contain the information requested.
I 've also spoken to the engineers that did the original
filing of the Notice of Intent, Hancock Survey of Danvers. They
are looking through their back files. Unfortunately, the engineer
that was on the project has left the company and is now located in
Utah. We will continue our efforts. However, the following
information might be of assistance.
The original developer never started the project that had
been approved, and filed for bankruptcy protection. On behalf of
the owners of the property we have been able to keep alive the
Variances granted. The most recent Variance was granted this past

month, which is good for a maximum of one year and six months. In
the interim, the owners are going to market the property as an
elderly housing site or assisted living for senior citizens site,
and have been in touch with the local Housing Authority. There
are, therefore, no current plans to commence construction.
My suggestion would be to grant the suggested extension
and to provide as a condition that prior to any activity on the
site that the requested information regarding drainage calculations
etc. be submitted to the Commission for the review. If the
information is discovered, it will be promptly be submitted to you.
It appears to me that this solution would protect the
Commission and would not compromise the position of the owners of
the property. Hopefully, the Commission will see its way clear to
grant the request of the owners, subject to the above condition.
You will therefore have the comfort of knowing that no action will
take place without your being notified.

A number of issues were raised by the Commission which they
would like to address prior to the issuance of an extension permit.
, Specifically, the Commission would like information regarding the

1. Runoff calculations;
2. Where the water discharges to;
3 . The sizing of the discharge area;
4 . The water retention basin;
5. How the area is sloped; and
6. A copy of the 21E study done on this site.
In addition, the Commission is requesting that a
representative attend the next meeting to address these issues so
that they may act on the Extension Permit request.

On June 23 , 1988 , an Order of Conditions was issued
relative to the property at 24 Saunders Street, Salem. On August
1, 1991, an Extension Permit was issued, which Extension Permit
will expire on June 23 , 1994 .
The project involves the use of the property for multi-
family residential purposes. The owners of the property have in
good faith proceeded to prepare the site, and have spent a
considerable amount of money in demolishing the building, doing a
21E study and preparing the area for utilities.
However, the market for multi-family construction
disappeared with the downturn in the economy, and that situation
has continued. It is the hope of the Petitioner to work with the
local Housing Authority and/or private developers to construct
housing for the elderly or assisted living for the elderly.
Although there have been several inquiries in the past, the
Petitioner hopes that during the next year it will finally be able
to proceed with development of the site.
We would, therefore, respectfully request that this Board
grant an extension of an additional three years from June 23 , 1994,
so that within that time frame the work required under the Order
of Conditions can be implemented.

The Salem Conservation Commission has reviewed the above-referenced Notice of
Intent and plans and has held a public hearing on the project. Based on the information available to the
Commission at this time, the Commission has determined that
the area on which the proposed work is to be done is significant to the following interests in accordance with

General Conditions
1. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory meas-
ures,shall be deemed rause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges:it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal,state or local statutes,ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act:or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed• until all proceedings before the Department have been completed.
S. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land,the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land. the
Final Order shall also be noted on the land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shall be submitted to the
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,
File Number 64-169
10. Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings
and hearings before the Department.
11 . Upon completion of the work described herein, the applicant shall forthwith request in writing that a
Certificate of Compliance be issued stating that the work has been satisfactorily completed.
